TITLE: AN ORDINANCE PROVIDING FOR APPROVAL OF A MASS REZONING
TO AGRICULTURAL -ONE FOR ALL PROPERTIES CURRENTLY ZONED
AGRICULTURAL -TWO IN AN AREA BOUNDED BY WEST 52ND AVENUE ON THE
NORTH, WEST 38TH AVENUE ON THE SOUTH, YOUNGFIELD STREET ON THE
WEST AND QUAIL STREET ON THE EAST, CITY OF WHEAT RIDGE, COUNTY
OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by the City of Wheat Ridge for approval
of rezoning in Wheat Ridge, Colorado, Case No. WZ -90 -3 and based upon
recommendation for approval from the Wheat Ridge Planning Commission,
and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council, Wheat
Ridge maps are hereby amended to exclude from the Agricultural -Two
District and to include in the Agricultural -One District the following
described land:
These properties are located in Township 3 South, Range 69 West,
County of Jefferson, State of Colorado and within one of the following
quarter- sections:
SE 17, SW 20, NW 20, SE 20, NE 20, SW 21 and NW 21. The affected
properties are designated on the following zoning map by cross-
hatching and would include the following addresses:
4315 Xenon St., 4318 Xenon St., 4322 Xenon St., 4330 Xenon St., 4350
Xenon St., 4380 Xenon St., 12500 W. 44th Ave., 12430 W. 44th Ave.,

Section 2. Legislative Intent The intent of this mass rezoning is to
rezone all Agricultural -Two zoned property within the City of Wheat
Ridge, regardless of ownership or location, to Agricultural -One. This
action is necessary as Agricultural -Two district regulations were
removed from the Zoning Ordinance by approval of Ordinance No. 796,
Series of 1989.
Section 3. Vested Property Rights Approval of this rezoning does
not create a vested property right. Vested property rights may only
arise and accrue pursuant to the provisions of Section 26(c) of
Appendix A of the Code of Laws of the City of Wheat Ridge.

Section 4. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the
proper legislative object sought to be attained.
Section 5. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 6. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first ready by a vote of 6 to 1
on this 8th day of July , 1991, ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for Monday,
August 26 , 1991, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.

Dear Ms. Schultz:
Please let this letter serve as an update on the mass rezoning
for A -2 properties.
In my letter dated July 23, 1991, I indicated that City Council
was reviewing a bill to amend the A -1 regulations to allow
existing greenhouses and kennels as a use by right.. The public
hearing for that zoning ordinance amendment was held on August
12, 1991.
However, at the August 12th meeting, City Council approved a
motion to table indefinitely the proposed amendment to the A -1
regulations as well as Case No. WZ -90 -3 (mass rezoning from A -2
to A -1). Instead, Staff was directed to prepare an ordinance
which would reinstitute the A -2 zoning regulations. Therefore,
there will be no public hearing for the mass rezoning on August
26, 1991, since reinstituting the A -2 regulations will nullify
the need to rezone any properties to A -1. Because of this
action, please disregard the certified public notices sent to you
regarding that meeting. I apologize for any inconvenience caused
you.
In regard to the latest request from City Council, a first
reading of the ordinance reinstituting the A -2 regulations has
been scheduled for August 26th. The public hearing for the
readoption of the A -2 regulations will be held on September 23,
1991. Should these dates change, you will be informed.

I. REQUEST
Case No. WZ -90 -3 is a City- initiated mass rezoning from A -2 to A-
1 for all properties with A -2 zoning in an area bounded by West
52nd Avenue on the north, West 38th Avenue on the south,
Youngfield Street on the west and Quail Street extended on the
east. (This is the only area in the City with A -2 zoning.) The
special use permits are required for various affected properties
within these areas.
II. CASE HISTORY
In 1986, the Land Development Regulations Task Force was
appointed by City Council to review all land use regulations and
recommend changes. During the review process, it was determined
that it wasn't necessary for the City to have two agricultural
zones (A -1 & A -2) so they were consolidated into a new A -1 zone
district as that A -2 is a remnant of Jefferson County zoning, and
incompatible with the residential character of Wheat Ridge.
Ordinance #796 was adopted in June of 1989 which, essentially,
removed the A -2 zone district from the zoning regulations. The
zoning maps were not changed, however, and staff was directed to
proceed with a mass rezoning to rezone all A -2 properties to A -1.
A provision was included in the motion that all A -2 zoned
properties "shall be subject to the rights and requirements of
the Agricultural -Two (A -2) district regulations which were in
effect at the time of adoption of this ordinance, until such
property is rezoned to Agricultural -One (A -1) or another zone
category." This rezoning action is a legislative, versus a
quasi - judicial type of action since it is City -wide and includes
all properties of a certain class. This is consistent with, and
a follow -up to the amendment to the zoning ordinance represented
by Ordinance No. 796.
On December 10, 1990, City Council reviewed Staff's suggested
procedure for the mass rezoning, since it was a departure from
typical rezoning procedure. This was further discussed at the
January 7, 1990 study session where Council approved the process,
but directed staff to also bring Special Use Permits in for

approval for the kennels and greenhouses so that they would not
result in a nonconforming status. Hence, the accompanying SUP
cases.
III. REZONING ACTION
The breakdown of uses in the new regulations was done somewhat
differently than in the old regulations. The old regulations had
categories for uses broken down into only permitted and special
uses.
The new regulations have been expanded to have four categories:
permitted uses, accessory uses, conditional uses and special
uses. Exhibit 'A' is a breakdown and comparison of the old A -1,
old A -2 and new A -1 zone districts. The code in parenthesis to
the left of the use designates which category the use became in
the new A -1 zone.
These categories are:
(P) permitted use
(A) accessory use
(C) conditional use
(S) special use
(N) new use
(D) deleted use
The mass rezoning will affect almost fifty separate parcels with
36 different ownerships. Most of the property is used for either
single- family residences or greenbelt /open space. Therefore, the
rezoning should have no affect on these uses of the land.
MASS REZONING PARCEL INVENTORY
There are five commercial businesses within the existing A -2 zone
district that will require Special Use Permits to operate
legally. At the direction of City Council, staff is processing
simultaneous special use permits for these five properties so
that they will not become nonconforming. Those cases are:

2. Case No. SUP -91 -2: A Special Use Permit to operate a
cattery /kennel at 12410 West 44th Avenue.
3. Case No. SUP -91 -3: A Special Use Permit to operate a kennel
at 11440 West 44th Avenue.
4. Case No. SUP -91 -4: A Special Use Permit to operate a
greenhouse at 4280 Vivian Street.
5. Case No. SUP -91 -5: A Special Use Permit to operate a
greenhouse at 12200 West 44th Avenue.
All regular posting, publication and notification requirements
have been done allowing Planning Commission to take action on
these requests in addition to the mass rezoning.
At the neighborhood meeting, a property owner claimed to have
pigs, which is a use deleted from the A -1 regulations, and
therefore, must be ceased within 15 years of adoption of the new
maps if the rezoning is approved. The keeping of pigs is not a
use allowed by special use permit either.
IV. NEIGHBORHOOD MEETING
A neighborhood meeting was held on May 29, 1991, at 7:00 p.m. in
the council chambers at City Hall. Those attending the meeting
were as follows: Meredith Reckert, Glen Gidley, Dorothy
Thompson, Louise Turner, Karen Heine, Jeff McLaury, Jerry Bauer,
Roy Storms, Richard Beckfield, Howard Ferguson and Ray
Strohmeyer.
The following questions or comments were raised by those
attending:
1. Are Special Use Permit's granted with the mass rezoning
revokable? Do they run with the land?
Staff answer: Special Use Permits run with the land, not
the ownership.
2. There wasn't enough (or any) input from property owners
during the LDR process.
Staff answer:
A. First, there were three representatives of
this geographic area which sat on the LDR Task Force, one
was a City Councilmember. As representatives, it was assumed
that they were in contact with their neighborhood on these
matters.

B. There were nine public meetings where the changes to the
A -1 and A -2 zone district regulations were discussed. Three
of those meetings were held as public hearings, with proper
legal notice, including publication of an ordinance on lst
reading and publication of the ordinance on 2nd reading. The
magnitude of the LDR project with all of the revisions being
considered and the wide - ranging affects on all geographic and
use segments of the community did not allow for individual
contact with every property owner potentially affected.
3. How can property owners protest the existing rezoning?
Staff answer: Property owners can come to the public
hearings at Planning Commission and City Council or submit
written protests.
4. What happens if the A -1 rezoning isn't approved?
Staff answer- the property will remain A -2 and subject
to the old A -2 district regulations until rezoned to some
other zone class.
V. CORRESPONDENCE
Included under Exhibit 'B' are copies of all correspondence,
written or verbal, received by the City concerning this request.
VI. CONCLUSIONS
Staff concludes that the A -2 zone district regulations have been
deleted from the zoning ordinance and that in order to achieve
conformity between the Zoning Regulations and the City's zoning
maps, a mass rezoning from A -2 to A -1 is required.
Staff further concludes that City Council directed us to proceed
with the mass rezoning and Special Use Permitts as indicated.
Since no existing land uses will be affected by the change, a
recommendation of Approval is given for the following case
numbers:
