Re: Water drainage from adjacent property, 44 Morningside Drive.
This letter is in reference to water drainage onto your property Born the house
to the south of your residence at 44 Mumingside Drive.
I visited the property on Wednesday, July 27, and observed the following conditions:
5
1. Water was flowing in a steady stream through the wall and under the wall on
your south property line and onto your yard and driveway.
A drain pit has been constructed in the rear yard by a previous owner to catch the
water run-off from several roof drains and downspouts. It was obvious that it was
not working property. Surface flow could also be contributing to this over -flow
onto the 46 Momingside property.
2. It was apparent that the water drainage has been going on for some time
as there were noticeable stains and water paths visible.
3. Water has seeped beneath your site wall, the planter box, sidewalk, and
into the garage. The water has caused rot damage to the south garage wall
siding and the sill plate appeared to be rotten.
4. 1 observed both settlement and heaving of walkways. The water appears to
seep under and on top of the walkways, driveway, walls, walks and garage.
5. 1 took numerous photos to document these conditions and have attached
6 of them to this letter.
1. This condition would be difficult to solve from your side of the property line.
It needs to be corrected at the source, which I believe is the gutters,
downspouts, and drainage pit in your neighbor's yard.
2. The drain pit could, be re -built, considerably deeper, to allow the water to
into the earth at a lower elevation. This could be more than 8 feet, possib
as much as 12 feet to achieve a depth lower than your improvements. I
3. Extend a physical, underground drain from the bottom of the existing drain
pit out to Morningside Drive. This would be located completely within the
neighbor's property.
4. Construct an underground drain on your property along the retaining wall,
all the way to Momingside Drive. As the termination point would be lower
than the existing curb flow line, a pop-up drain would be required.
This drain line would be more than 100 feet in length, as it needs to start almost
as far as your property comer to the East. Ideally, this drain line should be
below the frost depth of 36 inches,
5. Gutters and dowiispouts could be re -configured to direct the water
somewhere other than into the existing drain pit. This would be in addition
to the underground drain line mentioned in Item 4.
6. Another possible solution would be for the adjacent property owner to
install a sump pump below frost depth in the pit and pump the water
up and out along their concrete driveway to Morningside Drive.
I have attached the current Jefferson County Statute regarding Stone Water Drainage.
Article 3.3.1 Post Development Flow Conditions refers to your
particular situation. It appears that a civil law relative to drainage is being violated here.
In summary, I suggest this condition be remedied as soon as possible, as the damage
will certainly increase with time. My feeling is that over the past few years the
water has continued. to find an easy channel onto and under your property and
it appears to be getting worse.
I hope these comments help you achieve a positive solution.

Case Number: 13-117630AM
Case Name: Temporary Regulation Amendment
Applicant: Jefferson County
Location: County -Wide
Purpose: To amend the Zoning Resolution and the
Stormwater Drainage Design and
Technical Criteria Regulations in
Jefferson County
WHEREAS, due to the recent flooding in Colorado, the Planning and Zoning
Division finds that modifications to the Zoning Resolution and the
Stormwater Drainage Design and Technical Criteria are necessary to ensure
the reconstruction efforts can be completed in an efficient and timely
manner and necessary improvements are made to prevent the destruction to
public roads and private property such as occurred with the most recent
storm events.
- MO.
I i: ill MWO
WHEREAS, the Board of County Commissioners finds that the temporary
regulation amendments are in the best interest of the health, safety, and
general welfare of the residents of Jefferson County, and will enable the
County to safely and efficiently begin the reconstruction process to the flood
impacted areas.
The provisions for adequate drainage are necessary to preserve and promote the general health, welfare and economic wellbeing of the County, Drainage is a
regional feature that afiects all governmental jurisdictions and ail parcels of property. This characteristic of drainage makes it necessary to forniulate a program
that balances both public and private involvement. Overall coordination and master planning must be provided by the governmental units most directly in-
volved, but drainage must be integrated at a regional level.
When planning drainage facilities, certain underlying principles provide direction for the effort, These principles are made operational through this set ofpol-
icy statements. The application of the policy in turn is facilitated by technical criteria and data.
3.2 Basic Principles
3.2.1 Multi -Purpose Resource
The county encourages the use ofstorturvater run(J'as a nnifti-purpose resource and to require space allocation fear appropriate drain agefi7cilides in the
planning of neav developments.
Storaiwater runoff is a resource that is a subsystem of urbanization. This subsystem should he multi-purpose to satisfy the demands placed on water within
urban development, The stonriwater resource has the potential for a beneficial use if it is compatible with adjacent land uses and Colorado Water Law, Exam-
ples of beneficial use include, groundwater infiltration and use in landscape features.
The planning of drainage facilities must be included in the development process. The provision for adequate drainage becomes a competing use for space
along with other land uses. Ifadcquate provision is net made in a land use plan for the drainage requirements, storm water runoff will conflict with other land
uses and will result in water damages and will impair or even disrupt the functioning of other urban systems.
Drainage facilities can fulfil other purposes aside man just drainage. Facilities that are net typically designed for drainage, such as recreational areas and
parking lots, can ficquently be designed to provide water quantity and quality beriefits.
Elimination or reduction in the size of detention and/or retention facilities is preferred where acceptable groundwater infiltration methods are used,
3.2.2 Water Rights
The county requires durl analysis of impacts on water rights he included in the planning and design od drainage Jacififies,
,1propose
When the drainage sub -system interferes with existing water rights, the value and use of the water rights, are allected. Drainagaways and storage facilities
frequently interrelate with water rights, which must be addressed when planning new facilities to preserve their integrity,
3,2.3 Major Dramageway
7he county &fines a major drainagerviiu, as ariv drainageflou, path with a tributary area of]30 acres or more,
3.3 Regional and Local Planning
3.3,1 Post Development Flow Conditions
The county encourages infiltration andfir post developmentflow conditions to be in a manner and quanfire (fiou, rate) as to not do more harm than the pre-
development./low within the drainage basial, unless the ownsldeveloper can obtain approval ondlbr easements from the affected property olfner(s,).
Colorado follows the modified civil law rate that the owner of upstream property possesses a natural easement on land downstream for drainage of surface
water flowing in its natural course. Natural drainage conditions can be altered by the owner of the upstream land provided the water is not sent down in a man-
ner or quantity to do more harm to the downstream land than trinnerly. During the development proms, if water is allowed to flow into the development in its
historic manner and quantity and is discharged in the historic manner and quantity, the alterations are generally acceptable. When the development alters the
natural drainage into the development in a manner or quantity that results in more harm to the downstream land, it may violate the modified civil law rule.
likewise, if the development does not return the drainage to the natural drainage conditions or does so in a manner or quantity that results in more harm, it
may violate the modified civil law rule. Etevelopment proposals that violate the modified civil law rule will not be approved unless the owner/developerob-
tains approvals and/or casements firom the affiected property owner(s),
a.,3.4 andtolal r1dolling
the county requires that new developments conipty with adopted regional drainage master plans.
As set forth in Section :3.2.1, drainage planning is required for all new developments. In recognition that drainage boundaries are non -jurisdictional, the County
participates in the preparation of regional basin -wide master plans. These plans define major drainage facilities, including those that are required public im-
provements for new developments.
3.33 Drainage Problem Areas
The caunry requires offsite analrsis and drainagefacififiesfor developmem in a drainage problem area A drainage problem area is an area where there is no
downstream ou#411 to a street, roadvide ditch, open channel or storm sewer that meets the relevant requirements in these Criteria. The offsite antaiysis will
address downstremn conditions at every point along the projectsue boundaries where ,steers afar ninoff will exit the property.
The counit, allows storinivater retention in drainage problem areas only if there is no other viable option, in the opinion of planning crud Terming, available to
resolve the drainage impact from the development, Storinivater relentionfacififies must be designed to meet these criteria (storago).
'there are areas within the County where significant drainage problems exist. Any new development in those areas may compound the existing drainage prob-

response is d'uected to items 4 through 10. The following paragraph numbers correspond to the
pazagraph numbers in your review notice:
4. The conflict in the column cap called out in the drawing has been corrected in our revised
~ drawing revised 12/21/01. This is now an ECC 5 1/4-8 connector.
. 5. Detail D/S-2 should specify (2) 1'/<"xl 17/8° Microlam beam as shown on the plan.
6. A 3" diameter standard pipe column is a 3'/2" outside diameter column. This will match the
proposed hangers.
7. We aze submitting structural calculations for this project.
. 8. The eacisting roof rafters aze 2x12's at 16 inches on center in the area of the addition. See
detail B/S-3 for the connection of new to old roof framing.
9. The 2x wedge in details B/S-3 and GS-3 will be built into the glulam beam as one beam when
the beam is ordered and manufactured.
• 10. The connector type at GS-3 will be a H2.5 tie at each side of the sloping glulam beam.
