Subsequently, on 8/30/99, we met with the two City of Wheat Ridge officials responsible for drainage and code enforcement, Greg Knudson (Development Review Engineer) and Darin Morgan (Codes Administrator and Chief Building Official). We were advised that as the "uphill" property owner, our responsibility is to insure that water follows the "natural patb of drainage", i.e. downhill to the swale between tbe uphill and downhill properties, with the goal of getting the water to the sidewalk and ulrimately the street, and that the responsibility of the "downhill" property owner is to carry the water through. Both Greg and Darin confirmed we were meeting the City of Wheat Ridge standards and fulfilling our responsibility as "uphill owners". We discussed with Greg and Darin your suggestion for a chase drain. Both city officials denied ever "strongly recommending" a chase drain and Greg stated, that from an engineering standpoint, there was no basis for a chase drain. Since purchasing our property in July 1998, we have implemented a costly and time intensive plan to insure that the City of Wheat Ridge drainage standards are met. These have included: 1. Hiring a professional landscape designer to develop a xeriscape plan for land that adjoins your property. 2. Removing grass with high watering needs that adjoins your property. 3. Grading our property to insure that water will follow the "natural path of drainage". 4. Planting xeriscape plants that require minimal watering. 5. Evaluation and readjustment of the sprinkling system to minimize over watering. 6. Rerouting the effluent From the sump pump that was previously emptying into the swale. 7. Installing a French drain to expeditiously remove water from the swale. Please note that your driveway slopes towards and drains water into the swale. The French drain is draining, per the City of Wheat Ridge standards, water from both properties and moving the water along the natural path to the sidewalk. During previous conversations with you in the Spring of 1999, we had agreed to angle the French drain upward onto our property when your driveway was removed and subsequently replaced. Our understanding of this neighborly verbal agreement was that a licensed contractor would regrade both properties during the replacement process. This was not done. Instead, without the courtesy of calling and seeking permission, you started digging on our property after your driveway was replaced. Rock, mulch, and dirt were dumped onto our grass and after a short time of working you left without notifying us of when and if the job would be completed and began working on another project on your property. This required us to clean up our grass, repair the disassembled French drain, and complete the rerouting process to accomodate your wishes. Darin Morgan noted that this idea of rerouting the French drain away from our property line was ill advised and recommended we reinstall the final ten foot section of French drain between the two properties so that the French drain is "daylight" at the end of our property and draining "directly onto the sidewalk." Currently, water that drains from our grass in the front yard drains downward onto the sidewalk and progresses down the sidewalk (per the City of Wheat Ridge standards). Because the sidewalk on your property tilts inward toward your driveway, water continues its downward progression along the sidewalk and lower edge of your driveway. The water subsequently drains into the street gutter from your sidewalk on the north edge of your driveway. Please note that your downspout empties and drains water in this same location after a rainstorm and after you water your lawn. After a comprehensive review of this situation, we will be restoring the French drain so that it empties water directly onto the sidewalk, per the requirements of the City of Wheat Ridge standards for the "uphill" owner. As the "downhill" owner, you may wish to consider the following options to fulfill your responsibility of carrying the water through: 1. Installing a drain under your brickwork. 2. Redesigning your sidewalk so that it slopes toward the street gutter and away from your property.
