This letter is to inform you that the new walUfence constructed at the southeast corner of
your property is in violation due to the height being greater than forty-eight (48) inches
within the front yazd setback. Mr. Alan White, Planning and Development Director and
myseif have spoken with Patrick Koentges regazding this matter and what is required to
be done to abate the violation, but still nothing has been done.
Please consider this as a notice and order to abate the fence height violation and remove a
minimum of six (6) inches from the top of the wall/fence so that the height does not
exceed forty-eight (48) inches in height measured from a point five (5) feet inside the
property line. The City must require that the walUfence height violation be abated within
seven (7) days of receipt of this notice.

Dear Mr. Koentzes,
It has come to our attention the fence you have constmcted along your south property line is in
violation of City zoning requirements. The fence is in violation of the following section:
26-30 (1. 1) -`ho divisional fence, wall or hedge above the height of forty-eight
(48) inches shall be permitted within a minimum required front yard, or above the height
of six (6) feet in instances not otherwise specified."
26-30 (9,b) - "All provisional fences, walls, hedges and other divisional structures shall be
measured from finish grade, five (5) feet inside the property to which it belongs.°
Your fence is currently in violation of section 26-30 (I, 1) due to the fence having an average height
above existing grade of 6-6" and a height of 8'-5" above existing grade at its highest point along the south
property line.
The fence is in violation of section 26-30 (9,b) due to the six (6) foot high fence being located within
the 30-foot front yard setback as measured from your southeast propeRy pin.
The current masonry wall (fence) is also built within a 10-foot drainage and utility easement alono
your west property line. Due Yo the type of fence that has been installed the natural surface drainage that is
intended to flow within this 10-foot easement has been restricted.
Please have these violations corrected no later than October 31, 2000 to avoid further enforcement

TERMS AND CONDITIONS
As applicant for a building permit in the City of Wheat Ridge, I do hereby agree to the terms and conditions
set forth below for the issuance of a Certificate bf Occupancy in connection with this building permit. The
issuance of a Certificate of Occupancy requires:
1. The completion and approval of final inspections and any necessary corrections of electrical,
plumbing, mechanica] and framing systems. Inspections are performed by the Building Division.
2. The completion of site drainage/grading requirements per the approved site grading plan and/or
final drainage report and plan, if such repoR and plan is applicable. For all residential projects of
three or more attached units and nonresidential projects with an approved final drainage report and
plan, a letter of certification is required from the projects civil engineer of record. Inspections are
performed by the Public Works Department.
3. The completion and acceptance by the Cityof Wheat Ridge of all required public
improvements, or a Development Covenant may be processed in lieu of construction said
improvements. The Public Works Department performs these inspections or provides the
Development Covenant.
4. The completion of all required landscaping and related site improVements. Inspections
aze performed by the Planning and Zoning Division.
5. For ali single family and duplex residential projects an Improvement Location Certificate
showing lot drainage and spot elevations prepazed by a registered professional land surveyor shall
be submitted for review prior to issuing Certificates of Occupancy.
All the above items must be completed and signed off by Planning and Zoning, Building and Public
Works before a Certificate of Occupancy is issued. Final Inspection by the Building Division does not
constitute authorization of a CeRificate of Occupancy nor permission for occupancy. Occupancy of the
structure is not permitted until the Certificate of Occupancy is issued. (Uniform Building Code,
Section 109)
The Ciry is not responsible for any real estate closings or other agreements concerning the property which
may be affected by failure to compete the above items and obtain a Certificate of Occupancy.
The City is under ~o obligation to issue a temporary Certificate of Occupancy.

test holes were drilled with a 3" diameter poNer auger at locations shown in
f'igure L camples of soil were taken at various depths using a 2" O.D. split spoon
sanpler driven by a 140 pound drop weight falling 30 inches. The nunber of drops
reouired to drive the sampler certain number of inches were noted.
:he soils were classified during the drilling operations based on cuttings deliver-
e3 irom auger and laboratory testing o£ samples. Sieve analysis, natural moisture
conten', dry density, Atterberg limits, and swell-consolidation tesLs were performed
in thA laboratory,

In test holes 1 and 4 which were drii.led close to the South side of the property,
the subsoils are mostly clayey and sho•a moderate to high sxell-potential. No free

at a w ut 16 feet, it rose to 12 feet 6 inches soon after drilling.
Test holes 2 and 3 are located in the loH area near tho North side of the property.
