Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. NOW, THEREFORE, IT IS HEREBY AGREED THAT: 1. The responsibility for providing improvements along the street frontage of the Property, as set out in the SUBDIVISION REGULATIONS of the city, is hereby acknowledged by the Owner. 2. The Owner has caused certain improvements to be constructed on the Property and associated on-site improvements. 3. The existing improvement of property frontage along 4830 Inaalls is below those standards as set forth in the SUBDIVISION REGULATIONS of the city, and the completion of those improvements as required by section Five: Improvements of the SUBDIVISION REGULATIONS will make no significant change at the present in those streets fronting the property. 4. In accordance with Section 5-45 of the Code of Laws of the City of Wheat Ridge, Colorado, subsection E, the Department of Public works D'epartment has determined that public improvements along ~ IruJ.a..ll.s. need not be .imrr.-:ldi~t:.ely. constructed and .that e:(.ecution of this Development Covenant. is appropriate. The Owner agrees to participate in engineering and construction costs for the property's frontage along 4830 Ingalls when the street is brought in accordance with city street standards, or as directed by the Director of Public Works. The Director of Public Works shall give written notice and an estimate of costs to the Owner 30 days prior to advertisement of any major improvements to 4830 Inaalls which would affect the).J Property and will submit to the Owner a detailed cost breakdown and billing after Award of the construction contract by city council. The detailed cost estimate will include the Owner's portion of the cost of curb, gutter and sidewalk and associated pavement improvements and other items listed in Paragraph 4. 6. Upon receipt of the detailed cost estimate or billing, the Owner hereby agrees to pay to the city, within 45 days, the full amount of the detailed cost estimate or billing. The Owner also agrees to pay to the city any extra costs associated with the Public Improvements to the Property due to variations in estimated contract quantities or as a result of change orders within 30 days of written request for payment by the city. The city will pay to the Owner any overcharges paid to the city by the Owner within 45 days after final acceptance of the Public Improvements. 7. Owner agrees to pay for all public improvements or billings within 45 days of written notice; Owner further agreeing that any amount resulting from his failure to pay for any improvement or billing this improvement completed shall constitute a lien upon the property above described in the actual amount of the public improvements or billing completed, less any payments made by Owner, plus interest on the amount unpaid at 10 percent (10%) per annum from the date of final acceptance or billing, plus any costs incurred by the City in collecting same, including court costs and attorney's fees. 8. In the event an Improvement District or a Special Improvement District is created by the city to improve or provide those requirements as set out in the SUBDIVISION REGULATIONS as they exist at the date of execution of this Covenant, for curb, gutter, sidewalk related street and drainage improvements, solely relating to those streets fronting on the property and neighboring tracts of land, the Owner or his assigns and successors agree not to oppose its creation, or subsequent reasonable assessment of the costs to the property. 9. In the event an Improvement District is created by the City to provide the improvements as provided by the SUBDIVISION REGULA- TIONS, the costs assessed against the property shall not be disproportionate with costs assessed to other nearby and like properties. 10. This COVENANT is executed by the Owner pursuant to the SUBDIVISION REGULATIONS of the city of Wheat Ridge. 11. The City, in its sole discretion, may require a cash or surety bond to be held in escrow by the City to secure completion or the public improvements described herein. Such cash or surety bond shall be in the sum sufficient to cover the estimated costs of the construction of the public improvements described herein, said estimate to be made at or about the time of the notice described in Paragraph 5 above. Any interest earned on any escrow funds shall be the sole property of the city. 12. The DEVELOPMENT COVENANT shall be recorded with the Clerk and Recorder of Jefferson County, Colorado, and constitute a continuing covenant running with the land, providing however, that this DEVELOPMENT AGREEMENT shall be released by the city upon the completion of the public improvements and complete and satisfactory payment by the Owner of all costs and fees associated therewith of the public improvements described herein, which release shall be . evidenced by a signed document attested to by the City Clerk and bearing the City's seal, which document shall likewise be recorded. The house is presently set on steel beams in preparation for the move, The following items comprise the inspection report: I, The exterior siding appears to be asbestos hardboard siding, There are numerous places where the siding is missing or broken, One means of repair for the siding is to cover all existing material with foam board and cover that with new siding, This procedure encapsulates the asbestos, The other repair would be to take off all the siding and replace with new siding, This can be a very expensive way to remove the material. Check with local hazardous material mitigation companies for prices and assistance, The exterior needs painting. 2, The soffit material is pulling away from the overhang at various places, Also the gutter is pulled away from the facia board and replacement with new material will be needed, 3, The floor construction is 2"x8" pine joists on 16" centers with cross bracing along the entire length of mid span on both sides of center. The overlap of floor joists for the entire run will need a bearing wall or a beam designed to carry the load when placed on site, The subfloor is I "x8" pine set diagonal to the floor joists, The subfloor is then covered with tongue and groove oak flooring, but unable to know condition throughout. It is not possible to examine the flooring due to carpet and vinyl covering, I 4. The interior walls and ceilings have cracks and require patching, The largest cracks are in the kitchen, The paint is peeling throughout. The area of what would be the basement steps was not supported properly during the move and it is this movement which I believe to be the miUor cause, The plaster ceiling sags and needs repair, This house was constructed prior to 1978 and could contain lead in the paint, plaster and supply piping system. Buyer must be aware of the hazards caused by the presence ofleall. Testing for these materials is highly recommended, 5. Furnace flue will need I" clearance for the circumference of the flue. There is combustible materials against the flue now. The heating duct is totally gone, along with the return duct. The furnace has been disconnected and can be found in the living along with the water heater. The furnace is an old Singer model and should be replaced, 6, The electrical meter box needs replacing, along with the mast. The wiring in the wall is all two-wire, but a few outlets have three prong receptacles. A few more outlets will be required throughout the house ( no more then 12' apart) and GFCl's are required in bath, kitchen, and exterior. GFCI receptacles can also be used in the two wire circuits in place of rewiring the entire house, 7. The plumbing system consists of 1/2" copper and galvanized piping for the supply lines and the waste lines are cast. Galvanized strapping has been used to hold copper piping and this should be replaced along with the galvanized plumbing, The waste lines under the water closet are broken and the water closet itself will require replacement. The flooring under the water closet and the perimeter of the tub should be checked for soundness, due to the water damage of the subfloor in this area, The water heater is in the living room and appears to be only 4 to 5 years old. 8, The attic area was in good condition, The ventilation was adequate, the insulation was 8" to 10" (approximately R-30) rockwool insulation and the framing was 2"x6" pine with collar ties every four feet. The ceiling joists over the kitchen area are in need of repair, The walls appeared to be insulated, but further examination by opening the wall cavity is recommended, 9. Home Services Consulting, Inc. , , 3 ~ t(Q)f1f DEVELOPMENT COVENANT THIS DEVELOPMENT COVENANT, as authorized by the SUBDIVISION REGULATIONS of the city of Wheat Ridge, is entered into this ath- day of se~tember, 1997 between the City of Wheat Ridge, a Municipal corporation, hereinafter referred to as City, and James L. & Kathleen S. Beaver, hereinafter referred to as Owner, and concerns property located at ~ Inaalls st., Wheat Ridge, Colorado. WITNESSETH: WHEREAS, Owner is the titled Owner of a tract of land in the city of Wheat Ridge, County of Jefferson, State of Colorado, more fully described as Berkely Heights Second Filing, City of Wheat Ridge, county of Jefferson, State of Colorado, which property is hereinafter referred to as the "property"; and WHEREAS, Owner is in the process of constructing a new residence and associated improvements and is desirous of obtaining a building permit; and WHEREAS, curb, gutter, sidewalk and street improvements bordering the Property and neighboring tracts of land are incomplete and/or below those standards as set forth in the SUBDIVISION REGULATIONS of the city; and WHEREAS, 'to be uniform and consistent with the existing neighboring improvements, the completion or non-completion of those improvements as required by SECTION FIVE: IMPROVEMENTS of the SUBDIVISION REGULATIONS will make no significant change at the present in those streets fronting the Property. and the neighboring tracts of land; and WHEREAS, in order to conform to those requirements as set out in the SUBDIVISION REGULATIONS of the city, this Agreement is hereby determined to be proper. NOW, THEREFORE, IT IS HEREBY AGREED THAT: 1. The responsibility for providing improvements along the street frontage of the Property, as set out in the SUBDIVISION REGULATIONS of the City, is hereby acknowledged by the Owner. 2. The Owner has caused certain improvements to be constructed on the Property and associated on-site improvements. 3. The existing improvement of property frontage along 4830 Ingalls is below those standards as set forth in the SUBDIVISION REGULATIONS of the City, and the completion of those improvements as required by Section Five: Improvements of the SUBDIVISION REGULATIONS will make no significant change at the present in those streets fronting the property. 4. In accordance with Section 5-45 of the Code of Laws of the city of Wheat Ridge, Colorado, subsection E, the Department of Public works Department, has determined that public improvements along ~ Ingalls need not be immediately constructed and that execution of this Development Covenant is appropriate. The Owner agrees to participate in engineering and construction costs for the property's frontage along 4830 Ingalls when the street is brought in accordance with City street standards, or as directed by the Director of Public Works. The engineering and construction costs will be limited to those reasonable and necessary to construct ~ Inaalls to current local street standards, inclUding earthwork, one half street width paving, curb, gutter and walk, and miscellaneous and incidental items. 4 DEVELOPMENT COVENANT Page 2 5. The Director of Public Works shall give written notice and an estimate of costs to the Owner 30 days prior to advertisement of any major improvements to 4830 Inaalls which would affect the property and will submit to the Owner a detailed cost breakdown and billing after Award of the construction contract by City Council. The detailed cost estimate will include the Owner's portion of the cost of curb, gutter and sidewalk and associated pavement improvements and other items listed in Paragraph 4. 6. Upon receipt of the detailed cost estimate or billing, the Owner hereby agrees to pay to the City, within 45 days, the full amount of the detailed cost estimate or billing. The Owner also agrees to pay to the City any extra costs associated with the Public Improvements to the Property due to variations in estimated contract quantities or as a result of change orders within 30 days of written request for payment by the City. The City will pay to the Owner any overcharges paid to the city by the Owner within 45 days after final acceptance of the Public Improvements. 7. owner agrees to pay for all public improvements or billings within 45 days of written notice; Owner further agreeing that any amount reSUlting from his failure to pay for any improvement or billing this improvement completed shall constitute a lien upon the property above described in the actual amount of the public improvements or billing completed, less any payments made by Owner, plus interest on the amount unpaid at 10 percent (10%) per annum from the date of final acceptance or billing, plus any costs incurred by the City in collecting same, including court costs and attorney's fees. 8. In the ,event an Improvement District ,or a Special Improvement District is created by the City to ~mprove or provide those requirements as set out in the SUBDIVISION REGULATIONS as they exist at the date of execution of this covenant, for curb, gutter, sidewalk related street and drainage improvements, solely relating to those streets fronting on the property and neighboring tracts of land, the Owner or his assigns and successors agree not to oppose its 'creation, or subsequent reasonable assessment of the costs to the property. 9. In the event an Improvement District is created by the City to provide the improvements as provided by the SUBDIVISION REGULA- TIONS, the costs assessed against the property shall not be disproportionate with costs assessed to other nearby and like properties. 10. This COVENANT is executed by the Owner pursuant to the SUBDIVISION REGULATIONS of the city of Wheat Ridge. 11. The City, in its sole discretion, may require a cash or surety bond to be held in escrow by the City to secure completion or the public improvements described herein. Such cash or surety bond shall be in the sum sufficient to cover the estimated costs of the construction of the public improvements described herein, said estimate to be made at or about the time of the notice described in Paragraph 5 above. Any interest earned on any escrow funds shall be the sole property of the City. 12. The DEVELOPMENT COVENANT shall be recorded with the Clerk and Recorder of Jefferson County, Colorado, and constitute a continuing covenant running with the land, providing however, that this DEVELOPMENT AGREEMENT shall be released by the City upon the completion of the public improvements and complete and satisfactory payment by the Owner of all costs and fees associated therewith of the public improvements described herein, which release shall be evidenced by a signed document attested to by the City Clerk and bearing the city's seal, Which document shall likewise be recorded. -, DEVELOPMENT COVENANT Page 3 SPECIAL PROVISIONS AND AGREEMENT The Parties hereto agree that this DEVELOPMENT COVENANT, by its terms, shall be binding upon the City and the Owner and upon the assigns and successors thereof; and shall constitute covenants running with the property for a period of ten (10) years from the date of execution by the Owner.
