Both the front and back of this permit are required to be posted on the job site at all
times. If the complete permit is not present, inspections WILL NOT be performed.
Work shall comply with 2012 IRC & 2017 NEC. Per IRC Sec. R314, smoke detectors are required
to be installed in every sleeping room, in hallways outside of sleeping rooms, and on every
level of the structure.
I, by my signature, do hereby attest that the work to be performed shall comply with all accompanying approved plans and specifications,
applicable building codes, and all applicable municipal codes, policies and procedures, and that I am the legal owner or have been authorized
by the legal owner of the property and am authorized to obtain this permit and perform the work described and approved in conjunction with

I. This permit was issued based on the information provided in the permit application and accompanying plans and specifications and is
subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the original ppermit fee.
3. If this permit expires, a new permit may be required to e obtained. Issuance of a new permit shall be subject to the standard

rements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Building Official and is not guaranteed.

SPAS AND HOT TUBS
AG102.1 General. For the purposes of these requirements, the
[erms used shall be defined as follows and as se[ forth in Chap-
[er 2.
ABOVE-GROUNDlON-GROUND POOL. See "Swim-
ming pool."
Br1RRIER A fence, wall, building wall or combina[ion [here-
of which completely surrounds the swimming pool and ob-
structs access to the swimming pool.
HOT TUB. See "Swimming pool."
IN-GROUND POOL. See "Swimming pool."
RESIDENTIAL. That which is si[uated on the premises of a
detached one- or [wo-family dwelling or a one-family town-
hoase no[ more than [hree srories in height.
SPA, NONPORTABLE. See "Swimming pool."
SPA, PORTABLE. A nonpermanen[ structure intended for
recrea[ional bathing, in which all con[rols, water-heating and
water-circula[ing equipmen[ are an integral part of [he product.
SWIMMING POOL. Any structure intended for swimming
or recreational bathing [ha[ wntains water over 24 inches (610
mm) deep. This includes in-ground, aboveground and on-
ground swimming pools, ho[ tubs and spas.
SWIMMING POOL, INDOOR. A swimming pool which is
totally contained within a structure and surrounded on all four
sides by walls of said structure.
SWIMMING POOI., OUTDOOR. Any swimming pool
which is no[ an indoor pool.
SECTION AG103
SWIMMING POOLS
AG103.1 In-ground pools. In-ground pools shall be designed
and constructed in conformance with ANSI/NSPI-5 as listed in
Section AG107.
AG104.1 Permanently installed spas and hot tubs. Perma-
nen[ly installed spas and hot tubs shall be designed and
constructed in conformance with ANSI/NSPI-3 as listed in
Section AG107.
AG104.2 Por[able spas and hot tubs. Portable spas and hot
tubs shall be designed and cons[ruc[ed in conformance wi[h
ANSI/NSPI-6 as lis[ed in Sec[ion AG107.
SECTION AG105
BARRIER REQUIREMENTS
AG105.1 Application. The provisions of this chap[er shall
con[rol the design of barriers for residential swimming pools,
spas and hot tubs. These design controls are in[ended to provide
protection agains[ poten[ial drownings and nearvdrownings by
res[ric[ing access ro swimming pools, spas and hot tubs.
AG105.2 Outdoor swimming pool. An ou[door swimming
pool, including an in-ground, aboveground or on-ground pool,
hot [ub or spa shall be provided with a barrier which shall com-
ply with the following:
1. The top of the barrier shall be at least 48 inches (1219
mm) above grade measured on the side of [he barzier
which faces away from [he swimming pool. The maxi-
mum vertical clearance between grade and the bottom of
the barrier shall be 2 inches (51 mm) measured on [he
side of the barrier which faces away from the swimming
pool. Where the top of the pool s[ruc[ure is above grade,
such as an aboveground pool, the barrier may be at
ground level, such as [he pool struc[ure, or mounted on
top of the pool structure. Where [he barrier is mounted on
top of the pool structure, [he maximum vertical clearance
be[ween the [op of the pool structure and [he bottom of
the barrier shall be 4 inches (102 mm).
2. Openings in the barrier shall not allow passage of a
4-inch-diameter (102 mm) sphere.
3. Solid barriers which do not have openings, such as a ma-
sonry or srone wall, shall not contain indentations or pro-
tmsions except for normal wnstmction tolerances and
tooled masonry joints.
4. Where [he barrier is composed of horizontal and vertical
members and [he distance between the [ops of the hori-
zon-tal members is less than 45 inches (1143 mm), [he
horizon-tal members shall be located on the swimming

pool side of the fence. Spacing between vertical mem-
bers shall no[ exceed 1.75 inches (44 mm) in width.
Where there are dewra[ive cu[outs wi[hin vertical mem-
bers, spacing wi[hin [he wtouts shall not exceed 1.75
inches (44 mm) in width.
5. Where [he barrier is wmposed of horizontal and ver[ical
members and the distance behveen the [ops of [he hori-
zon-[al members is 45 inches (1143 mm) or more, spac-
ing be[ween vertical members shall not exceed 4 inches
(102 mm). Where there are decorative wrou[s within
ver-tical members, spacing within the cutouts shali not
exceed 1.75 inches (44 mm) in width.
6. Masimum mesh size for chain link fences shall be a
225-inch (57 mm) square unless the fence is provided
with sla[s fastened at [he top or the bot[om which reduce
the openings to no[ more than 1.75 inches (44 mm).
7. Where the barrier is composed of diagonal members,
such as a la[tice fence, [he maximum opening formed by
[he diagonal members shal] not be more than 1.75 inches
(44 mm).
8. Access gates shall comply with the requirements of Sec-
tion AG105:2, Items 1 through 7, and shall be equipped
to accommodate a locking device. Pedestrian access
gates shall open ou[ward away from the pool and shall be
self-closing and have a self-latching device. Gates other
[han pedes[rian access gates shall have a self-latching de-
vice. Where the release mechanism of the self-latching
device is located less [han 54 inches (1372 mm) from the
bot[om of [he ga[e, the release mechanism and openings
shall comply wi[h [he following:
8.1. The release mechanism shall be located on the
pool side of the gate a[ ]eas[ 3 inches (76 mm)
below the top of the gate, and
82. The gate and barrier shall have no opening
greater than 0.5 inch (12.7 mm) wi[hin 18 inch-
es (457 mm) of the release mechanism.
9. Where a wall of a dwelling serves as par[ of the barrier
one of the following conditions shall be met:
91. The pool shall be equipped with a powered safe-
ty cover in compliance with ASTM F1346; or
92. All doois with direct access [o the pool throagh
that wall shall be equipped wi[h an alarm which
pro-duces an audible waming when the door
and its screen, if present, are opened. T'he alarm
shall sound continuously for a minimum of 30
sewnds immediately after the door is opened
and be capable of being heard throughout the
house during normal house-hold activities. The
alarm shall au[omatically reset under all condi-
tions. The alarm system shall be equipped with
a manual means, such as touchpad or switch, [o
[emporarily deactivate the alarm for a single
opening. Such deactivation shall last for not
more than 15 seconds. The deactivation
switch(es) shall be located at least 54 inches
(1372 mm) above the threshold of the door; or
9.3. Other means of pro[ection, such as self-dosing
doors with self-latching devices, which are ap-
proved by the governing body, shall be accep[-
able so long as the degree of protection afforded
is no[ less than [he pro[ection afforded by Item
91 or 92 described above.
10. Where an aboveground pool s[ructure is used as a barrier
or where the barrier is mounted on top of [he pool stmc-
[ure, and the means of access is a ladder or steps, [hen:
10.1. The ladder or steps shall be capable of being se-
cured, locked or removed to prevent access, or
10.2. The ladder or steps shall be surrounded by a bar-
rier which meets the requiremen[s of Section
AG105.2, Items 1 through 9. When the ladder
or steps are sewred, locked or removed, any
opening created shall not allow the passage of a
4-inch-diameter (102 mm) sphere.
AG105.3 Indoor swimming pooL All walls surrounding an
indoor swimming pool shall comply with Section AG105.2,
Item 9.
AG105.4 Prohibited locations. Baniers shall be located so as
to prohibit permanent struc[ures, equipment or similar objects
from being used to climb the barriers.
AG105.5 Barrier exceptions. Spas or hot tubs wi[h a safety
cover which complies with ASTM F 1346, as lis[ed in Section
AG107, shall be exempt from the provisions of this appendix.
SECTION AG106
ENTRAPMENT PROTECTION FOR SWIMMING
POOL AND SPA SUCTION OUTLETS
AG1061 General. Suction outle[s shall be designed to pro-
duce circulation throughout [he pool or spa. Single ou[let sys-
tems, such as automa[ic vacuum cleaner systems, or other such
multiple suc[ion ou[le[s whether isolated by valves or o[her-
wise shall be protec[ed against user entrapment.
AG106.2 Suction fittings. All Pool and Spa suction outlets
shall be provided with a cover that conforms with ANSI/ASME
A112.19.8M, or a 12" x 12" drain grate or larger, or an ap-
proved channel drain system.
Exception: Surface skimmers
AG106.3 Atmospheric vacuum relief system required. All
pool and spa single or multiple outlet circulation systems shall
be equipped with atmospheric vacuum relief should grate cov-
ers located [herein become missing or broken. Such vacuum re-
lief systems shall include at least one approved or engineered
method of the type specified herein, as follows:
1. Safety vawum release sys[em conforming to ASME
A112.19.17, or
2. An approved gravity drainage sys[em
AG106.4 Dual drain separation. Single or multiple pump cir-
wla[ion sys[ems shall be provided with a minimum of two (2)
suction outlets of [he approved type. A minimum horizon[al or
vertical distance of three (3) feet shall separa[e such ou[lets.
These suction outlets shall be piped so tha[ wa[er is drawn
through them simultaneously through a vacuum relief-pro-
tected line to the pump or pumps.

Please be advised that at its meeting of September 22, 2005, the Boazd of Adjustment APPROVED
the request for an 8 foot reaz yazd setback vaziance from the 15 foot reaz yazd setback requirement for a
swimming pool on property zoned Residential One and located at 3201 Nelson Street for the following
reasons:
1. The request will have a minimal effect on the essential character of the locality.
2. There aze very limited options for placement of a swimming pool of the size proposed
without the need for a variance or vaziances. The property is a corner lot and thus subject
to more stringent setback requirements. Without the benefit of the variance, the pool could
only be eight feet wide.
3. The intent of the classification of swimming pools as structures subject to setback
requirements is more applicable to above-ground pools. The applicant is proposing an in-
ground pool.
4. The pool can be located no closer to the house due to structural piers on the house itself.
5. A letter of approval for the vaziance was received from a representative of the Applewood
Reserve Subdivision.
With the foilowing condition:
I. The pool shall be in-ground and not be an above-ground pool.
2. This vaziance acknowledges the one-foot drainage easement encroachment and final
approval is subject to review by City of Wheat Ridge Department of Public Works.

could only be eight feet wide.
3. The intent of the classification of swimuiing pools as structures subject to setback
requirements is more applicable to above-ground pools. The applicant is proposing an in-
ground pool.
4. The pool can be located no closer to the house due to structural piers on the house itself.

1. The variance does not alter the essential character of the
neighborhood as there is currently angled parking adjacent to the
street.
2. It would not be detrimental to the public welfare and, as designed, the
landscaping that the applicant has included can be perceived as a
possible benefit to the neighborhood by increasing some of the
landscaping as seen from the public view.
Board Member ABBOTT offered the following friendly amendment:
Reason No. 3: It is not in the best interest of the city or its citizens that this
commercially zoned property remain a vacant, paved and otherwise
unimproved parcel.
The amendment was accepted by Board Members HOVLAND and PAGE.
Board Member HOVLAND requested an amendment to add two conditions
to his motion as follows:
1. Landscaping will be required as shown on the review with planters
and trees as approved by the city.
2. Parking spaces in front that lack adequate depth must be addressed
and approved by the city.
Board Member PAGE agreed to the amendment to add the two conditions.
Board Member ABBOTT offered another friendly amendment as follows:
Condition No. 3: Landscaping of the 171 square foot triangle at the corner of
44th and Vance, as proposed in the applicant's letter, be required.
The amendment was accepted by Board Members HOVLAND and PAGE.

This case was presented by Jeff Hirt. He entered all pertinent documents into the
record which were accepted by Chair BLAIR. He advised the Boazd there was

jurisdiction to hear the case and reviewed the staff report and digital presentation.
Staff recommended approval of the request for reasons outlined in the staff report.
In response to a question from Board Member HOWARD, Meredith Reckert
explained that the easement referred to in the staff report is an 8-foot utility and
drainage easement. The pool would encroach into the easement by one foot.
Approval from appropriate parties would be required for this encroachment to
occur.

Mr. Pusateri, the applicant, was sworn in by Chair BLAIR. He is requesting an 8-
foot reaz yazd setback to build a 16-foot by 36-foot swimming pool.
In reply to a question from Board Member PAGE, Mr. Pusateri stated that there is
a sump pump that would pump any water away from the perimeter of the
property.

Mr. Lynch, the applicanYs contractor, was sworn in by Chair BLAIR. In
response to a question from Boazd Member ABBOTT, Mr. Lynch stated that any

that, from a structural standpoint, the pool could be built no closer than four feet
from the house.
Chair BLAIR asked if there were others present who wished to address this case.
There was no response.
Upon a motion by Board Member ABBOTT and second by Board Member
HOWARD, the following resolution was stated:

the removal of most of the existmg OSB flooring within the basement to allow for
additional excavation of the crawlspace and the installation of supplemental stiffener details
wosxhi8ao,, Dc for the primary steel framing. In addition, WJE specified supplemental puddle welds at
each location where the existing light gage channels frame over the steel beams and we
required a"glued and screwed" connection between the replacement OSB and the light
gage channels.
Based upon our periodic site observations, we believe that Palace Construction Co., Inc. has
successfully completed the repairs in general conformance with ou and

for the repairs being done to the above referenced address.
1. A building permit will be required for the floor repairs.
2. Verify that there is 12 inches clearance between the sub-floor and earth in the crawl
space. UBC, Section 23063
3. Provide 12 inches clearance under beams so a person can maneuver under floor or
provide 18x24 access opening at all canceled under floor spaces. UBC, Section
23063.
4. All welds to be done as part ofthe repair will need to be approved by an engineer and
inspected by a certified welding inspector. UBC, Section 1701
Due to the structural concems with the floor and the problems that have become evident, the
City will require that a structural engineer inspect the floor structure when all corrections are
completed and submit a letter of approval to the City.

Dear Darin:
We are the owners of 3201 Nelson St. I, Rhonda, spoke with you Friday, Oct. 1, concernir.g the
repair of our structural floor. We would appreciate if you would write in letter form the
requirements for the repair of the floor, to bring it up to code. The main issues are:
1) A permit is needed for these repairs.
2) The removal of dirt to 12" access space.
3) The need for an engineered plan for the repair of the whole floor.
4) The floor needs to be opened up to do the welding and the welding needs to be done by a
certified welder. The welds need inspected by an engineer.
We also have concerns about all the revets that have broken and the welding that was used to fix
the misalignment of the beam downstairs. There are also extremely weathered boards that have
lost their strength.
The builder Native Sons, Mike Roberts, is denying that these are the code requirements. Please
call me if questions. Thank you for your time. This will be of great help to us.

On Monday, August 3, 1998, I met with Mr. Mike Robores of Native Sons Country Homes ac the
above address. Tbe pwpose of ttris meeting was co investigau rhe removal of an eusang (48
diameter inch) Siberian Elm tree. W. Roberts admitud that his company had removed the uee
and remaining stump. This tree was removed without pemriseion of the City in accordance with
tha Subdivision Plat.
Mr. Roberts has agreed to plant additional trees atong W. 32nd Ave. Inside the fence line. I have
requested that he plart three addiaonal aees aloag this line. No tree shall be capable of
growing larger than thirty-five feet tall and interfering with the utility lines. Mr. Robarts will be
planting three spruce trees.

This letter is in regard to the property located at 3201 Nelson Street currently under construction,
also known as Lot 4 of Distinctive Addresses Subdivision.
Please be advised that when the property was subdivided, a condition was made for the keeping
of existing mature trees on the property. Pursuant to Sheet 2 of the Distinctive Addresses
Subdivision plat, "Prior to the removal of any tree designated on the face of this plat, approval
must be received from the Department of Planning and Development. Removal of these mature
trees will be allowed only when in direct conflict with a building footprint with new home
construction."
There aze three existing trees documented on Lot 4 of the approved plat document - two along
the eastern property line and one along the southem property line. Please refer to the attached
plat copy. It is my understanding that at least one of these trees has been removed. Prior to the
issuance of a Certificate of Occupancy for the new home, any of these trees removed must be
replaced with an equivalent caliper. The existing and replaced trees can count toward the street
tree requirements for the Nelson and West 32nd Avenue frontages. I would suggest that you
contact Bill Cassel, City Forester, to determine what wouid be appropriate replacements.

Please let this letter serve as a follow-up to our conversation regarding the Distinctive Addresses
at Applewood Subdivision.
You have requested that I respond in writing regazding the transfer of a water tap from the
landscaping located behind the back of sidewalk along West 32nd Avenue to the house being
built on Lot 4.
My understanding of the situation is that the tap was originally used by the then existing house
(now demolished) on Lot 4. When the building was demolished you allowed the tap to be
transferred and used for the establishment of landscaping along 32nd Avenue. A permit has
recently been issued for new construction on Lot 4 and the builder has requested that the tap
used for landscaping irrigation be transfened back to this lot for the new house.
Although we are reluctant to allow the transfer to occur, the City of Wheat Ridge has no
requirement that landscaping has to be irrigated with an automatic sprinkler system. However,
the City does require that once landscaping is installed, that it be maintained. According to the
information available, it appears that the majority of this landscaped area is a part of Lot 4.
Therefore, if the landscaping is not maintained or allowed to die, the City can pursue code
enforcement action with the property owner.
The City of Wheat Ridge appreciates your consideration in involving us in this decision. If you

under the provisions of Section 26-33 of the Wheat Ridge City Code. Upon conformance
with Section 26-33 of the City Code, grading plan review fees and grading permit fees shall
be established in conformance with Sectiou 3310, Table A-33-A, and Table A-33-B
respectively of the Uniform Building Code.
