Where terms aze not defined, they shall have their ordinazy accepted meanings within the context with which they are used. Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall be conshued as providing ordinazy accepted meanings. Words used in the singular mascuGne gender include the feminine and the feminine the masculine. BUILDING CODE is the International Code Council, as adopted by this jurisdiction. DANGEROUS BUILDING is any building or strucNre deemed to be dangerous under the provisions of Section 302 of this code. HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building Officials, as adopted by this jurisdiction. INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property Mainienance Code promulgated by the International Code Council, as adopted by [his jurisdiction. SECTION 302 - DANGEROUS BUILDING For the purpose of this code, any building or sVucture which has any or all of the conditions or deFects hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects exist to the extent that the Gfe, health, property or safety of the public or its occupants are endangered. 1. Whenever any door, aisle, passageway, stairway or other means of exit is not of safficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic. 2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in case of fire or panic. 3. Whenevar the stress in any materials, member or por[ion [hereof, due [o all dead and life loads, is more than one and one half times the working sVess or sVesses allowed in the Building Code for new buildings of similaz structure, purpose or location. 4. Whenever any poRion thereof has been damaged by fire, ear(hquake, wind, flood or by any other cause, to such an exten[ that the structural svength or stability thereof is materially less than it was before such catastrophe and is less than the minimum requirements of the Building Code for new buildings oF similar structure, purpose or loca[ion. 5. Whenever any poRion or member or appur[enance [hereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property. 6. Whenever any ponion of a building, or any member, appur[enance or ornamentauon on the exterioc thereof is not of sufficient suength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the building Code for new buildings of similar structure, purpose or location without exceeding the working s[ressed permiited in the Building Code for such buildings. 7. Whenever any portion thereof has wracked, warped, buckled or settled ro such an extent that walls or other suucWrat portions have materially less resistance to winds or ear[hquakes than is required in the case of similar new construction. 8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deteriocation or decay; (ii)faulty conswction; (iii) the removal, movement or instability of any portion of the ground necessazy for the purpose of supporting such buildings; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completety collapse. 9. Whenever, for eny reason, the building or structure, or any portion thereof, is manifestly unsafe for purpose of which it is being used. 10. Whenever the exterior walls or other vertical sVUCtural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle on third of [he base. ll. Whenever [he building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterioration of its non-supporting members, enclosing or outside walls or coverings. 12. Whenever the building ot structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to chi]dren; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts. 13. Whenever any building or structure has been constructed, exists or is maintained in violation oF any specific requirement or prohibition applicable to such building or structure provided by the building regutations of this jurisdiction, as specitied in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of buildings. 14. Whenever any building or structure which, whether or not erected in accordance wi[h a all applicable laws and ordinances, has in any non-supporting part, member or portion less [han 50 percen[, or in any suppor[ing pazt, member or portion less [he 66 perceat or the (i) streng[h, (ii) fire-resisting qualities or chazacteristics, or (iii) weather-resisiing quali[ies or characreristics required by law in the case of a newly constructed building of like azea, height and occupancy in the same loca[ion. 15. Whenever a building or structure, used or intended to be used for dwelling pwposes, buause of inadequate maintenance, dilapidation, decay, damage, faulty consvuction or anangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be unsanitary, unfit foc human habitation or in such a condition that is likely to cause sickness or disease. 16. Whenever any building or sVucture, because of obsolescence, dilapida[ed condition, de[erioration, damage, inadequate exists, lack of sufficient fire-resistive construction, faulty elecvic wiring, gas connections or heating appazatus, or other cause, is determined by the fire marshal to be a fire hazard. 17. Whenever any building or structure is in such a condition as to constimte a public nuisance known to the common law or in equity jurisprudence. 18. Whenever any poRion or a building or structure remains on a si[e after the demolition or destruction of the building or structure or whenever any building or structure is abandoned for a period in excess of six months so as to constimte such building or portion thereof an atvactive nuisance or hazazd [o the public. The 1997 Uniform Housing Codes states SECTION 1001- DEFINITIONS 1001.1 General. Any building or por[ion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit, guest room oc suite or rooms, or the premises on which the same is located, in which there exists any of the condi[ions referenced in this section to an extent tha[ endangers the life, limb, health, property, safety or welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard buildings. 1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they aze when they are in sanitary. Inadequate sanitation shall indude, but not be limited to, the following: 1. Lack of or improper water close[, lavatory, bathtub or shower in a dwelling uni[ or lodging house. 2. Lack of or improper water closets, lavatories, and bathtubs or showets per number or guests in a hotel. 3. Lack of or improper kitchen sink in a dwelling unit. 4. Lack of hot or cold running water ro plumbing Gxtures in a hotel 5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house. 6. Lack of adequate heating facilities. 7. Lack of or improper operation or required ventila[ing equipmen[, 8. Lack of minimum amounts of natural light and ventilation require by this code. 9. Room and space dimensions less than required by this code. 10. Lack oF required elecvical lighting. 11. Dampness of habitable rooms. 12. Infestation of insects, vermin or rodents as determined by the health officer. 13. Generat dilapida[ion or impropet maintenance. 14. Lack of connection to required sewage disposal system. 15. Lack of adequate garbage and rubbish srorage and removal faciiities as determined by the health officer. 1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they aze or contain sVuctural hazards. Svuctural hazards shall include, but not be limited to, the following: l. Deteriora[ed or inadequa[e foundations. 2. Defective or deteriorated flooring or floor supports. 3. Flooring or floor supports of insufficient size to carry imposed loads with saFety. 4. Members of walls, partitions or other vertical supports that split, lean, Gst or buckle do to defec[ive material or deteriorations. 5. Members of walls, paztitions or other vertical supports that aze of insufficient size to carry imposed loads wi[h safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizon[al members that sag, split or buckle due to defective material or deterioration. 7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size ro carry imposed lads with safety. 8. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration. 9. Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with saFety. 1001.4 Nuisance. Buildings or portions thereof in which [here exists any nuisance as defined in this code aze deemed substandazd buildings. 1001.5 Hazardous Electricai Wiring. ElecVical wiring that was ins[alled in violadon of code requirements in effect at the time of installation or elecVical wiring not installed in accordance with generally accepted cons[ruction practices in areas where no codes were in effect or that has no[ been maintained in good condition or [hat is not being used in a safe manner shall be considered substandard. 1001.6 Hazardous P►umbing. Plumbing that was installed in violation of code requirements in effect at the time of instaltation or plumbing not installed in accordance with generally accepted construction practices in azeas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.7 Hazardous Mechanical. Mechanicat equipment that was installed in violaGon of code requiremenfs in effect at the time of installation or mechanical equipment not installed in accordance with generally accepted construction practices in areas where no codes were in effec[ or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard when they have faulty wea[her pmtections, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plas[er. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather pro[ection for exterior wall coverings, including ]ack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, spli[ or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazacd. Any building or portion thereof, device, apparatus, equipment, combustible waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause shall be considered substarrdazd. 1001.10 Faulty Materiais of Construction. The use of materials of consuucfion, except those that are specifically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditions, shall cause a building ro be subs[andard. 1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat hazborages, stagnant water, combuspble materials, and similaz materials or conditions on a premises constitu[es fire, heal[h or safety hazards tha[ shall be abated in accordance with the procedures spuified in Chapter 11 of this code. I001.I2 Inadequate Exits. Except for those buildings or portions thereof that have been provided with adequate exit facili[ies conforming ro the provisions of this code, buildings or portions [hereof whose exit facilities were installed in vio7ation of code requirements in effect at the time of their consvuction or whose exit facilities have not been increased in number or width in relations ro any increase in occupant load due to alterations, additions or change in use or occupancy subsequent to the time of construction shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of [heir consVuction, buildings or portions thereof shall be considered substandazd when the building official finds that an unsafe condition exists through an improper location of exi[s, a lack of an adequate number or width of exits, or when other conditions exist that are dangerous to human life. 1001.13 Inadequate Fire-Protection or Fire-Fighting Eguipment. Buildings or portions there of shall be considered substandard when they aze not provided with the fire-resisGve construction or fire- extinguishing systems or equipment required by this code, except [hose buildings or poRions thereof that conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and fire-extinguishing systems or equipment has been adequatety maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy. 1001.14 Improper Occupancy. All buildings or por[ions thereof occupied for living, sleeping, cooking or dining pwposes that were not designed or intended to be used for such cecupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. Water heater was not installed properly and no pernut was pulled with the City of Wheat Ridge Building Department. 2. A Building Pernut shall be pulled for this hot water heater and shall be installed per code and manufactures installation criteria. ORDER 1. The City of Wheat Ridge Building Official has deterntined the building referenced above to be a Dangerous Building. The owners are ordered to pull a building permit to fix the deficient items. If such items aze not fixed by October 9, 2005, the Building Department will post the building as a Dangerous Building. Pursuant to Code future tenants shall not be pernutted to occupy this units until all issues are brought up to code and aze inspected by the City of Wheat Ridge Building Department, This is therefore required in order to protect life, health and safety of the public. II. If the structure has not been brought to code or demolished by October 9, 2005. Section 801 in the Uniform Code for the Abatement of Dangerous Buildings states, " 801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, of this code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the director may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichevet the legislative body of this jurisdiction shall deternune is appropriate." The property owner and all occupants are hereby ORDERED TO CEASE AND DESIST occupancy and use of the above described building. The Building Ofticial shall cause the property to be posted with the attached Notice and shall take action to remove all future occupants from the building until the building is brought up to code. REMEDIAL ACTION 1. The property owner must apply for and obtain a City of Wheat Ridge building pernut to correct any deficiencies. III. All deficiencies shall be fixed but are not limited to the items on this list. APPEAL OF THIS NOTICE AND ORDER Any person having record title or other legal interest in the above described premises may appeal this Notice and Order or any action of the Building Official to the Building Code Advisory Board ar known as the Board of Appeals pursuant to section 112 of the Code, provided that the appeal is made in writing as provided in the Code and filed with the Building Official within ten (10) days from the date of service of this Notice and Order. Failure to appeat will constitute a waiver of all rights to an administrative hearing and deternunation of this matter. FILING OF AN APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND ORDER.
