Brougham, Don Eafanti, Phil ~dwards, Tony FIasco, Larry Merkl, Ron Selstad, and Bill Shanley Kent Davis was absent, but left votes with the City Clerk Also present City Clerk, Wanda Sang, City Administrator, Mike Smith, City Attorney, John Hayes, City Treasurer, Jim Malone, Director of Planning, Glen Gidley, Chief of Police, Jack Hurst, Director of Parks, Gary Wardle, Director of Public Works, Bob Goebel, staff, and interested citizens APPROVAL OF MINUTES of September g, 1991 Motion by Mr Eafanti for the approval of the Minutes of September 9, 1991, seconded by ~r Merkl, carried 6-0 with Mr Edwards abstaining because he had not attended that meeting CITIZENS' RIGHTS TO SPEAK Ed Cervino, 3095 Depew Street, complained that the Code against junk on properties was not being enforced in his area David Goracke, Wheat Ridge Police Department, addressed Council once again on pay issue and read crime statistics into the record Michael bliss, Fraternal Order of Police, asked for pay increase for police, citing safety concerns Ken bohling, Trustee for Wheat Ridge Fraternal Order of Police, Lodge #24, read a citizen's letter into the record, praising the police departu;ent Chris Fedak, 605 Boyd Street, Golden, employee of the City of Wheat Ridge asked for raises for all the employees of the City John Thamann, lives outside of Winter Park, was involved in an accident at 48th & Garrison, feels that intersection needs a revision before somebody is seriously injured or killed He showed video to Council and asked for their help to revise this intersection Arie Verrips, commented on the 1992 budget, was concerned about salary dispute; feels City of Wheat Ridge can afford to pay what is right, even if it means increasing taxes, facts are necessary for Council to make a decision, citizens rely on administration to bring correct figures to council, cOffimended the Council for insisting on good information before making decisions CITY COUNCIL MINUILS Septewber 23, 1991 Page -2- Louise Turner, 1125b h 38th Avenue, spoke regarding the solar system in Ci ty hall Donald A Coates, 9835 h 35th Avenue, stated it was up to the citizens of Wheat Hidge to pay a fair wage, he has always gotten a very professiunal response from the Police and would like to maintain this Pay discussion followed LOCAL LIQUOR LICENSING AUTHORITY MATTERS Itew 1 Application by Port 44, Inc , 4400 Ward Road, Wheat Ridge, to modify premises John Thorpe, 4333 Ulysess hay, Golden, applicant, was present and sworn in by the t--layor Motion by Mr Merkl to approve the modification of premises for Port 44, Inc , dba Port 44, 4400 Ward Road, Wheat Ridge, and authorize the Mayor and City Clerk to sign the application, seconded by Mr Selstad, carried 8-0 Item 2 Application by the Denver Lodge of the Order Sons of Italy in America, 5925 h 32nd Avenue, for a Special Events Permit for October 18, ISJ91, to serve a100hol during the City of Wheat Ridge's Boards and Commissions dinner James DeRose, of Sons of Italy, was present and sworn in by the Mayor He asked for approval of the Special Events Permit and answered Council's questions Motion by Mr Shanley to approve the Special Events Permit for the Denver Lodge of the Order sons of Italy in America at the location of 59c5 W 32nd Avenue, Wheat Ridge, to dispense malt, vinous, and spirituous liquor on October 18, 1991 from 6 00 p m to 2 00 a m during the City of Wheat Ridge's boards and Commissions Appreciation Dinner I further wove to authorize the Mayor to sign the Approval for the Special Events Permit, seconded by Mr Merkl Motion by Mr Selstad to change the 2 00 a m to 12 00 midnight, seconded by Mrs Brougham, carried 4-3 with Councilmembers Shanley, Merkl, and Edwards voting No Vote on original motion as amended carried 7-0 IterrJ 3 Application by Sts Peter and Paul Church, 3920 Pierce Street, for a Special Events Permit for October 19, 1991 Motion by Mr Merkl to approve the Special Events Permit for Sts Peter and Paul Church, at the location of 3900-3920 Pierce Street, Wheat Ridge, to dispense malt, vinous, and spirituous liquor on October 19, 19SJl between the hours of 5 OOp m and 11 00 P m in the gym I further wove to authorize the Mayor to sign the approval for the Special Events permit, seconded by Mr Shanley, carried d-O CIT) COUNCIL ~INUT~S September 23, 1991 Page -3- Item 4 Application by Paramount Lanes, 2625 Kipling Street, for Transfer of Gwnership (Continued from Aug 26, 1991) Chris farnham, 3785 Garland Street, was present to answer 4uestions He was sworn in by the Mayor City Attorney, John Hayes, asked Mr Farnham if he wanted to make any statements to Council as to his statements on his application indicating three criminal contacts that happened during his adult life time It was his opportunity to speak to his moral character Mr Farnham stated he planned to put money and ef'fort into the Bowling Center and to run it as the same nice establishment it has been for the last 30 years Mr FIasco stated that Mr Farnham had not addressed Mr Hayes' question Mr Farnham chose not to make any further statements Motion by Mr Edwards to ap~rove the Transfer of Ownership from J&B Bowling Enterprises, dba "Paramount Lanes", 2625 Kipling Street, to Pyramidion Inc for the following reasons 1 All applications and fees required by statute have been filed and paid, 2 The applicant will be entitled to occupancy of the premises by virtue of a signed lease dated June 29, 1991, 3 The applicants have been cleared by the Police Department, seconded by Mr Shanley, failed 3-5 with Councilmembers Shanley, Davis, and Edwards voting yes Mr Merkl voted No, because he doesn't feel the applicant has given specific findings as to moral character hr FIasco voted no for the same reasons PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 5 Council Bill 115 - An Ordinance repealing and reenacting Sections 2-62 and Section 19-21 through 19-29 of the Code of Laws of the City of Wheat fiidge Council Bill 115 was introduced on second reading by Mr Shanley, title read by the Clerk, Ordinance No 877 assigned Motion by Mr by Eafanti Jeanie Rossillon, 4226 Owens spoke on behalf of the Civil of the proposed changes Motion carried 8-0 Shanley for the approval of Ordinance No 877, seconded Street, was sworn in by the Mayor She Service Commission and asked for approval CITY COUNCIL MINUTES September 23, 1991 Page -4- Item 6 Council Bill lIb - An Ordinan~e amending the provisions of Section 26 Article I of the Code of Laws of the City of hheat ridge, hereafter referred to as the Zoning Code of the City of Wheat Ridge, and providing for the adoption of regulations pertaining to the Agricultural-Two Zone District (Case No ZOA-91-3) Council Bill lIb was introduced on second reading by Mr FIasco, title read by the Clerk, Ordinance No 878 assigned City Clerk, kanda Sang, read a letter from Wheat Ridge United Neighborhoods into the record, whi~h urged Council to pass this Ordinance Claudia Callas, 8701 W 38th Avenue, was sworn in by the Mayor spoke for the Wheat Ridge Livestock Association and urged that Ordinance be approved She this Motion by Mr FIasco that Ordinance No 878, which provides for adoption of regulations pertaining to the Agricultural-Two zone district, be approved, seconded by Mrs Brougham the Motion by Mrs Brougham on page 5 to delete the word "detached" before Garage or Carport, seconded by Mr Selstad, failed 2-5 with Councilmembers Brougham and Eafanti voting yes Motion by Mrs Brougham to change Section F to keep it as it was before in the Zoning laws, 100 feet front yard setback for building housing livestock, seconded by Mr Merkl, carried 5-2 with Council members FIasco and Edwards voting No Vote on original Motion as amended c~rried 6-1 with Mr Merkl voting No DECISIONS, RESOLUTIONS, AND MOTIONS Item 7 Discussion of Greenbelt Trail Kipling Crossing Gary Wardle gave the staff report and answered Council's questions Tom Dodd, 9960 W 34th Drive, spoke in favor of Mr Wardle's proposal Motion by Mrs Brougham that the City secure professional appraisals, surveys, title policies and acquire an easement on the west side of land located at 3SJ75 Kipling, 407~ Kipling and the SW corner of 41st and Kipling, I further move that the City work with the property owner on the west of West 41st Avenue by providing a fence to give him more privacy on the west, seconded by Mr Edwards Mr FIasco will vote against this motion because he can't see putting it back on West 41st He will make a motion to do this project along the green and yellow line CITY COUNCIL MINUTES September 23, 1991 Page -5- Mr Selstad moved to amend the motion to appraise the land for an easement or to purchase it, this was accepted as a friendly amendment Motion carried 6-1 with Mr FIasco voting No Item b Bid Aw~rd for Pedestrian/Bike Path, 41st & Kipling (HFB #91-35) Motion by Mr Shanley that the Pedestrian/Bike Path, 41st and Kipling Project (RFB #91-35) be awarded to Paramount Construction, Inc in the amount of their ~id of $82,094 05, that a maximum amount of 2% of the bid amount, $1,642 00, be allocated for payment of any early completion of the project, that a 10% contingency in the amount of $8,209 UO be established, that the Director of Parks and Recreation be authorized to issue change orders up to the total contract amount and contingency amount of $90,303 05 and that all costs associated with this Project be charged to Acct No 32-601-862, that the funds be encumbered for the length of the Project which expressly allows the expenditure of funds in 199c for the Project in accordance with Ordinance #787, 1989 Series, that $24,712 00 e transferred from Acct No 32-607-795 to Acct No 32-601-862, seconded by Mr Merkl, carried 8-0 BOARDS AND COMMISSIONS MATTERS Item 9 Presentation by Carl Cerveny of Planning Commission nesolution Carl Cerveny read Planning Commission Resolution into the record, which asks that when the City of Wheat hidge undertakes any major street reconstruction project in the future, the project should include installation of utilities underground, even if it means postponing the project or seeking other means of financing ELECTED OFFICIALS' MATTERS Item 10 Decision regarding November meetings Motion by Mr Shanley to cancel the November 4, ISJ91 Study Session and to hold the first regular meeting on November 25, 1991 and order this aovertised in the newspaper, seconded by Mr Merkl, carried 7-0 Larry Merkl asked for updates on various City projects updates Mr Goebel gave Elise Brougham asked for clarification about holding only 1 meeting in November Mr Hayes explained that Council could cancel meetings under Council Rules She asked Mr Goebel about the Planning Commission Resolution, how much would undergrounding cost?
