Brougham, Kent Davis, Don Eafanti, Phil Edwards, Tony FIasco, Larry Merkl, Ron Selstad, and Bill Shanley Also present City Clerk, ~anda Sang, City Administrator, Mike Smith, City Attorney, John Hayes, APPROVAL OF MINUTES of September 23, 1991 Motion by Mr Eafanti for the approval of the Minutes of September 23, 1991, seconded by Mr Merkl, carried 8-0 CITIZENS' RIGHTS TO SPEAK City Clerk, Wanda Sang, read a letter into the record from Moe Keller, which asked for fair and equitable pay for the Police Department All the police department employees listed below, made it clear that they were present to speak on their own behalf and had not been asked by their command staff or anybony else to attend this meeting Jack Chism, Police Lieutenant for the City of Wheat Ridge, has been employed by the City for 18 years, asked the citizens of Wheat Ridge through the City Council for a pay raise Bill Santee, Police Sergeant for the City, employed by the City for 18 years, asked for pay raise Jim Darlinger, Police Lieutenant, employed by the City for 21 1/2 years, asked for pay raise Desmond Sarnella, Senior Police Officer, employed by the City for 17 1/2 years, asked for pay raise Len pay raise for the police department Rosalind Lobus, resident and Chair of the Personnel Commission, asked for a pay raise for the Police Department Paul McSheehy, property owner and businessman in the City, expressed his displeasure over the lack of pay raises for the Police Department Margaret Griffin, Records Clerk, employed by the City for nearly 9 years, asked for a pay raise Trent Cooper, Patrol Ufficer, employed by the City for 3 years, asked for a pay raise Jeanie Rossillon, Chairman of the Civil Service Commission, asked fOf a pay raise for the Police Department Councilmember Shanley explained to the employees and the public that the City's budget had been discussed for 4 nights last week and would be discussed again tomorrow night and that the pay issue was a top priority and was not being ignored LOCAL LIQUOR LICENSING AUTHORITY MATTERS Item 1 Transfer of Ownership from Osco Drug to Pay Less Drug, 4260 \-Jadsworth Blvd Motion by Mr Merkl to approve the Transfer of Ownership from American Drug Stores, Inc to Pay Less Drug Stores Northwest, Inc , dba "Pay Less Drug Store #5350", 4260 Wadsworth Blvd, \-Jheat Ridge, Colorado, for the following reasons 1 All applications and fees required by statute have been filed and paid, 2 The applicants will be entitled to occupancy of the premises by viftue of a signed sublease dated September 12, 1991 and an assignment of lease dated June 13, 1991 3 The applicants' clearance will be taken care of by the State Liquor Division, the CBI and FBI, seconded by Mr Selstad, carried 8-0 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 2 Council Bill 117 - An Ordinance adding section 13-7 to the Code of Laws of the City of Wheat Ridge by waking it unlawful to drive through private property or driveways Council Bill 117 was introduced on second reading by Mr Davis, title read by the Clerk, Ordinance No 879 assigned CITY COUNCIL MINUTES October 14, 1991 Page -5- Motion by Mr Davis for the adoption of Council Bill 117 (Ordinance 879), seconded by Mr FIasco, carried 8-0 Item 3 ORDINANCES ON FIRST READING Council Bill 118 - An Ordinance providing for the approval of rezoning from Residential-One to Residential-One-A on land located at 11675 and 11645 West 32nd Avenue, City of wheat Ridge, County of Jefferson, State of Colorado (Case No WZ-91-6) (Ida Lewis Estate) Council Bill 118 was introduced by Mr Edwards on first reading, title read by Clerk Motion by Mr Edwards that Council Bill 118 be approved on first reading, ordered published, public hearing be set for Monday, December 9, 1991 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication, seconded by Mr Eafanti, carried 8-0 I tern 4 Council Bill 119 - An Ordinance authorizing the issuance and sale of City of wheat Ridge, Colorado, Industrial Development Revenue Refunding Bonds, Series 1991 (La Quinta Motor Inns, Inc Project) Council Bill 119 was introduced by Mr S~anley on first reading, title read by Clerk Motion by Mr Shanley that Council Bill 119 be approved on first reading, ordered published, public hearing be set for Monday, October 28, 1991 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication, seconded by Mr Eafanti Mr Hayes advised Council that on pa5e 4, Section 2, the word "underwriter" should be stricken and replaced with "placement agent" and instead of "Bond Purchase Agreement" it should read "Marketing Agreement" Mr Shanley moved to accept these changes, seconded by Mr Merkl, carried 8-0 Motion as amended carried 8-0 Item 5 Council Bill 120 - An Ordinance establishing the salary for the elected positions of Mayor, Members of Council, City Clerk, and City Treasurer, of the City of wheat Ridge, during the term of Office commencing November 11, 1991, and ending November 8, 1993, repealing Ordinance 808, Series of ISJ69, and providing for an automatic repeal and termination of this ordinance Council Bill 120 was introduced by Mr Davis on first reading, title read by Clerk Motion by Mr Davis that Council Bill 120 be approved on first reading, ordered published, public hearing be set for Monday, October 28, 1991 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect November 11, 1991, seconded by Mr Edwards CITY COUNCIL MINUTES October 14, 1991 Page -6- Motion by Mr FIasco to a~end Council Bill 120 to change in the title the year "1969" to "1989" and in Section 2 C strike the words "shall be a full time position" and in D strike the words "shall be a part time position", seconded by Mr Selstad, carried 8-0 Motion as amenderl carried 8-0 Mrs Brougham insisterl that the record reflect that the city clerk and city treasurer did not ask for a raise and will not receive a raise for 2 years I tern 6 Council Bill 121 - An Ordinance amending various provisions of Article III Code of Ethics, of ChajJter 7, Elections, of the Code of Laws of the City of Wheat Ridge to incorporate changes adopted by the Colorado General Assembly during its 1991 legislative session Council Bill 121 was introduced by Mr Eafanti on first reading, title read by Clerk Motion by Mr Eafanti that Council Bill lc'1 be approved on first reading, ordered publisherl, public hearing be set for Monday, December 9, 1991 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication, seconded by Mr Selstad, carried 8-0 I tenJ 7 DECISIONS, RESOLUTIONS, AND MOTIONS Resolution 1266 - requesting congressional support to re-authorize Surface Transportation Act Resolution 1266 was introduced by Mr Flasco, title read by the Clerk Motion by Mr FIasco for the adoption of Resolution 1266, seconded by Mr Merkl, carried 8-0 I tenJ 8 Resolution 1267 - authorizing Jefferson County Open Space to accept the owner's appraisal on, and to contract for the acquisition of, the property located at 4220 Kipling Street, Wheat Ridge, Colorado, and further authorizing acquisition of said property for an amount not to exceed $70,104 00, and authorizing Jefferson County Open Space to take any and all actions necessary to complete the legal requirements to purchase said property Resolution 1267 was introduced by Mr Merkl, title read by the Clerk Motion by Mr Merkl for the adoption of Resolution 1267 and order it published, seconded by Mr Selstad, carried 8-0 CITY COUNCIL MINUTES Item 9 October 14, 1991 Page -7- Resolution 1268 - authorizing the Mayor to execute a Warranty Deed conveying Title to a portion of property located within Stites Park within the City of Wheat Ridge to Jefferson County, Colorado, and aC0epting a Commissioners' Deed from the Board of County Commissioners of the County of Jefferson for the same property, and further accepting reimbursement from the County of Jefferson in the amount of $7,500 00 from the City's attributable share of the Jefferson County Open Space Fund to cover the costs of said transaction Resolution 1268 was introduced by Mr Merkl, title read by the Clerk Motion by Mr Merkl for the adoption of Resolution 126~ and order it published, seconded by Mr FJasco, carried 8-0 I tern 10 tJlotion re Pedestrian/Bike Path, 41st & Kipling Motion by Mr proceed with appraisal of carried i)-O Item 11 Selstad that we take no action on the suggestion and the previous motion regarding the acquisition, the the easements and the contract, seconded by Mr Eafanti, Motion re Appraisal Services for the Pedestrian/Bike Path at 41st & Kipling (HFP #91-005) Motion by Mrs Brougha~ that the contract for appraisal services for the Pedestrian/Bike Path at 41st and KijJling (RFP #SJI-005) be awarded to Kagy Appraisal Service in the amount of their bid of $4,500 00 and that all costs be charged to account number 01-601-750 professional services That $4,500 00 be transferred from Unallocated Fund Balance account number 01-607 -795 to account number 01-601-750 That the funds be encumbered for the length of the Project which expressly allows the expenditure of funds in 1992 for this Contract in accordance with Ordinance #787, 1989 Series, seconded by Mr Selstad, carried 8-0 Item 12 Hotion re Renewal of Boiler and Machinery Insurance Motion by Mr Edwards that the City renew boiler and machinery coverage through Hartford Steam Boiler Insurance Co for $4,817 00 and to pay the City's broker, Sedgwick James, Inc for this coverage to be charged to Account # 01-610-781, seconded by Mr Eafanti, carried 8-0 Item 13 Motion re Additional Funding for Weed Cutting Program Motion by Mr Selstad that $2,000 00 be transferred from 607-795, Unallocated Reserves to account number 123-71b, Enforcement, seconded by Mr Merkl, carried 7-1, with Mr no account number Ordinance Davis voting CITY COUNCIL MINUTES October 14, 1991 Page -8- CITY ATTORNEY'S MATTERS John Hayes distributed a packet of information regarding liquor violations at Club Peaches and asked that Council make a motion to set a hearing date to show cause on the alleged violations cited in the packet Motion by Mr Merkl to set a show cause hearing for Club Peaches on October 28, 1991 at 6 00 pm, seconded by ~r Eafanti, carried 8-0 Consensus was 8-0 that Mr Hayes attend the budget Session on Tuesday evening ELECTED OFFICIALS' MATTERS Mr Shanley asked for consensus that the Council ask the Chief of Police to meet with us on the last Thursday of every month for a maximum of 2 hours, to just update the Council as to his perception as to what is going on in the department, what he is doing positively with the department, not so much with pay as with general attitudes, progress, education, law enforcement in the City and talk to us about his management with that department How is the department set up, how does it work? Make Council aware Mrs Brougham asked that this be changed to have dialogue with all departments and the date be set for the third Monday every month Mr Shanley agreed with this, but specified that the first two meetings be with the police Mr Shanley asked that this start after the election Consensus was 8-0 Larry Merkl asked why the wall at Valente's wasn't moved replied that we were receiving bid proposals to remove the soon as a proposal was acceptable, the wall would be moved Hr Smith wall and as Tony FIasco recognized Tom Abott and Glen Gidley for their work with DRCOG Don Eafanti reported on another wall at 38th & Newland in front of the bowling alley that obscures the view Meeting adjourned at 10 25 P m lerk APPROVED BY q;yy COUNCIL ON OCTOBER 28, 1991 BY A VOTE OF / / I /l ~~4_//0.1:. ,,, ~ Kent Davis, Council President 8 TO 0
