CITY OF WHEAT RIDGE, COLORADO
October 28, 1991
The City Council Meeting was called to order by the Mayor at 8 45 p m
Councilmembers present Elise Brougham, Kent Davis, Don Eafanti, Phil
Edwards, Tony FIasco, Larry Merkl, Ron Selstad, and Bill Shanley Also
present City Clerk, wanda Sang, City Administrator, Mike Smith, City
Attorney, John Hayes, Director of Planning, Glen Gidley, Chief of
Police, Jack Hurst, Director of Parks, Gary Wardle, Director of Public
Works, Bob Goebel, staff, and interested citizens
APPROVAL OF MINUTES of October 14, 1991
Motion by Mr Eafanti for the approval of the Minutes of October 14,
1991, seconded by Mr Merkl, carried 8-0
PROCLAMATIONS AND CEREMONIES
Presentation of Certificate of Championship recognition by the Mayor to
the 6A Tennis Team State Champs
Bill Shanley presented Mayor Wilde with a plaque for "Elected Official
of the Year" award, whiCh was given by the West Jefferson Chamber of
Commerce

Council Bill 119 - An Ordinance authorizing the issuance and
sale of City of Wheat Ridge, Colorado, Industrial Development
Revenue Refunding Bonds, Series 1991 (La Quinta Motor Inns,
Inc Project)
Council Bill 119 was introduced on second reading by Mr Shanley, title
read by the Clerk, Ordinance No 880 assigned
Motion by Mr Shanley for the approval of Ordinance 880, seconded by Mr
Eafanti, carried 8-0
Item 2
Council Bill 120 - An Ordin~nce est~blishin~ the salary tor the
elected positions of Mayor, Members of Council, City Clerk, and
City Treasurer, of the City of Wheat Ridge, during the term of
Office commencing November 11, 19Y1, and ending November 8,
1993, repealing Ordinance 808, Series of 19b9, and providing
for an automatic repeal and termination of this ordinance
Council Bill 120 was introduced by Mr Davis, title read by the Clerk,
Ordinance No 881 assigned

Motion by Mr Davis for the adoption of Ordinance 881, seconded by Mrs
Brougham
Motion by Mrs Brougham to amend the Ordinance in Section 2 C to read
"The City Clerk of the City of Wheat Ridge shall receive an annual
salary of $26,400 00, payable in monthly installments of $2,200 00",
seconded by Mr Merkl, carried 7-1 with Mr FIasco voting No

Council Bill 1~2 - An ordinance vacating a portion of Garrison
Street North of West 35th Avenue within the City of Wheat
Ridge, County of Jefferson, State of Colorado
(Case No WV-91-2)
Council Bill 12c' was introduced by Mr Edwards on first reading, title
read by Clerk Motion by Mr Edwards that Council Bill 122 be approved
on first reading, ordered published, public hearing be set for Monday,
December 9, 1991 at 7 30 p m in City Council Chambers, Municipal Bldg ,
and if approved on second reading, take effect 1 day after final
publication, seconded by Mr Shanley, carried 8-0
DECISIONS, RESOLUTIONS, AND MOTIONS
Item 4
Resolution 1269 - authorizing reimbursement from the City of
Wheat Ridge's attributable share of the Jefferson County Open
Space Fund for parks and open space development
Motion by Mr Merkl that Resolution 1269, authorizing payment from
Jefferson County Open Space, be approved, and the Mayor be authorized to
sign the intergovernmental agreement entitled "Request for Reimbursement
and Certification of Use of Funds", which is required by Jefferson
County Open Space before payment from the City of Wheat Ridge's
attributable share can be released, seconded by Mr Shanley
Motion by Mr Selstad to delete the $11,685 43 Salaries & benefits to
Animal Park Officers, because he doesn't think police salaries should
come out of Open Space, seconded by Mrs Brougham, Failed 3-5 with
Councilmembers Eafanti, Brougham, and Selstad voting yes

Resolution 1270 - appropriating additional sums of money in
excess of amounts budgeted for the City of Wheat Ridge,
Colurado, for fiscal year 1991

Motion by Mr Davis for the adoption of Resolution 127U, seconded by Mr
Shanley
Motion by Mr Selstad to amend the motion that the training be
accomplished during regular duty hours and the grant not be diluted by
paying time and one half for overtime, seconded by Mr Davis, failed 3-5
with Councilmembers Davis, Eafanti, and Selstad vating yes

Resolution 1271 - amending the City of ~heat Ridge annual
budget for the fiscal year 1991
Resolution 1271 was introduced by Mr Davis, title read by the Clerk
Motion by Mr Davis for the adoption of Resolution 1271, seconded by Mr
Shanley, carried 8-0
Item 6
Request for waiver of public improvement requirements for 11481
W 39th Ave
(Case No ~A-91-22)
City Clerk, Wanda Sang, read a letter from Nancy Snow into the record,
who asked for approval of the waiver
Mr Goebel presented the case and answered Council's questions
Robert McFerran, 11481 W 39th Place, asked that he not be required to
construct curb, gutter and sidewalk by his property
Jack Zeiler, 11461 W 39th Place, neighbor of Mr McFerran, gave reasons
why Mr Mcferran should not be required to construct curb, gutter and
sidewalk
Motion by Mr Shanley that Case WA-91-22, a request for waiver of the
requirement to construct curb, gutter and sidewalk within the public
street right-of-way adjacent to property located at 11481 W 39th Place
be granted, seconded by Mr Eafanti
Mrs Brougham moved for an amendment to add the following reasons Less
than half the properties on the street within 500 feet of the subject
property on both sides of the street do not have existing curb, gutter
and sidewalk, no curb, gutter and sidewalk may be required for
remodeling an existing building or an addition to an existing building
which adds less than 50% to existing square footage, the applicants
testified this is a fact Installation of curb, gutter ~nd sidewalk
would be impractical and cause a drainage problem, seconded by Mr
Eafanti, failed 4-4 with Council members Selstad, Eafanti, Brougham, and
FIasco voting yes

Item 7
Purchase of traffic signal equipment
Motion by kr Merkl that the zone monitor IV software, (10) ASC ~UOU
controllers, (1) traffic logging system and (10) traffic logging system
interconnect cables be purchased from Western Signal, Inc at a total
cost of $25,900 That US West be authorized to install 16 phone lines
at a total cost of $825 56 That the following equipment be purchased
frolTi the source at their bid price (2) VGA monitors and video c&rds at
$43U 00 per uni t, (1) SJO t'IEG hard dr i ve at $3~5 00 per uni t, (1) 2400
baud internal modem at $85 00 ~er unit That the following equipment be
purchased from Computer City (3) 2400 baud Hayes Smartmodems at
$33900 per unit, (13) 1200 baud flayes SruartmodeoJs at $28SJ 00 per unit,
(16) 3 foot cables at $3 93 per unit That costs associated with these
purchases be charged to Capital Fund Account 30-304-843, Traffic Signal

Item 8
Bid award for 1992 traffic signal maintenance program,
T-TSA-92
Motion by Mr Shanley that the 1992 Traffic Signal Maintenance Program,
T-TSM-92, be awarded to WL Contractors, Inc in the amount of their unit
price bid ($9,019 00) and that all costs associated with this project be
charged to account 01-302-704, seconded by Mr Davis, carried 8-0
Item 9
Professional Land Survey Services for 1992
Item USJ has been withdrawn to receive bids
Item 10 Discussion of Jonathan's Gate Lift Station
Bob Goebel gave background on this problem and asked that City Council
contribute money to hel~ alleviate the problem
kotion by Mr Merkl that we authorize Mr Hayes to contact the Wheat
Ridge Sanitation, th&t we enter into an intergovernmental agreement,
that we participate up to $15,000 00 and if a satisfactory agreement
cannot be worked out with Wheat Ridge ~anitation, that then a contract
be worked out with the Jonathan Gate Homeowners Association for a cost
of up to $15,000 to solve the odor problem developed by the sewage in
that area, se~onded by kr Selstad, carried 8-0
Item 11 Contract award for Non-Destructive Pavement Testing Services

I further move that the Director of Public Works be authorized to
approve additional work up to the total project cost of $4,349 53 and
that all costs associated with this contract be charged to Capital
Projects Fund account number 30-303-875 That the funds be encumbered
for the length of the Project which expressly allows the expenditure of
funds in 1992 for this Project in accordance with Ordinance #787, 1ge9
Series seconded by Mrs Brougham, carried 8-0
Item 12 Contract award for 1992 janitorial services for various
locations
Motion by Mr Davis that the contract for the 1992 Janitorial Services
be awarded to Homework Contract Services in the amount of their base
monthly bid of $2,675 00 per month with all costs to be char~ed to the
various contractual service 704 accounts, seconded by Mr Merkl, carried
8-0
Item 13 Motion re Election Judges' list and pay
Motion by Mr Merkl to approve the amended judges list as presented
tonight for the November 5, 1991 election
I further move that the judges be paid $70 00 for each regular judge and
$75 00 for each supply judge, seconded by Mr Shanley, carried 8-0
CITY ADMINISTRATOR'S MATTERS
Mike Smith distributed memo on pay proposals He asked when hiring
freeze would be effective Consensus was 8-0 for January 1, 1992
Nr Smith then asked for an Executive Session under Section 5 7(b)(2)
Mr Shanley so moved, seconded by Mr Edwards, carried 8-0
CITY ATTORNEY'S MATTERS
John Hayes gave updates on intergovernmental agreement with Lakeside for
44th & Harlan, Wheat Ridge Sanitation lawsuit
On November 25 amendments to our sales tax ordinance will be discussed,
that were suggested by CML
He wished Mr Merkl good luck
ELECTED OFFICIALS' MATTERS
Larry Merkl thanked citizens of District I for their support in the last
16 years, he further thanked Lonnie Scoma, Jim Reynolds and the staff
of the City of Wheat Ridge
Kent Davis wished Larry luck
Don Eafanti asked if 3bth would be done soon Answer was that due to
the weather there might be a delay of a few weeks

Ron Selstad asked about weeds on W 38th that were causing obstruction
on sidewalk
Phil Edwards thanked Larry Merkl for all his help in the last two years
Motion by Mr Selstad to hold a City Council meeting on November 18,
1991 for the purpose of swearing in the Elected Officials and to
hold a Regular Meeting on November 25, 1991, seconded by Mrs Brougham,
carried 8-0
