Installation of roof sheathing (new or overlay) requires an approved inspection prior to installation of ANY roof coverings and is require on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. I would like a schedule from you on when the following items are going to be done so that we can figure out the move in date. 3 stove top burners don't work - need to be replaced Refrigerator freezes or thaws - needs to be fixed Racoon that is nesting under the house needs to be moved out Trash behind shed needs to be removed Wasp nests and snake nests need to be cleaned out of shed Shed needs to be cleaned out Tree in driveway needs to be trimmed Ceiling needs to be painted - I can't do it because it needs to be sprayed Carpet needs padding and replacing Bathtub is seated incorrectly and needs to be corrected - water does not drain because water runs away from drain 2) I asked for a five (5) year lease. 1998 through 2003 with first (1 S') option to purchase. 3) Rental increases not to exceed 2% per year. (ie. 1500 x 2% = 30.00) 4) As soon as we have definite dates on these issues and a date when they will be out of there we can assign a date to the lease. 5) Joe would be losing 45.00 per month on rent so I would agree to pay 45.00 to you toward other utilities the 201" of each month. Of course we will have PSC put in our name and pay that in full. 4300 Unit 1) The leaks in my house were reported to Joe when I was first in contact with him. I'm sure the water bill is high because of all the watering it takes during the hot summer to keep the grass green. Remember - the lawn was like straw when I first moved in. It took a lot to get it green again. Also - Peggy does laundry every day. The plumber has my bathroom all torn up - he said he wiil finish it a week from Monday. Is that correct? 2) The exterminator needs to come over and put decon and traps under the house again. I don't want the same mouse problem that we had last year. Also - the spiders are coming in now that it is getting cold so he needs to spray for spiders. 3) The furnace should be checked for winter use and the fius for the fire places need to be checked so that we can use them this year. My parents can't commit to this until we get these things done. We need to get in there right after the work is done to clean so the sooner we have all of these things scheduled the quicker we can apply a date to a lease. You wanted to know which property of Mike's I was talking about. I believe he said it is the access road to just on the other side of the trees and bushes in the front yard. He will be taking care of trimming that big tree in the front yard that sits on that road. A gentleman came over and looked at that large tree in the driveway. Water bill: a) You get back the ditch rights for the house, provide the right kind of pump and I'll pay the water biil for our usage. Or b) You pay the water bill May through September. As an agent for "the owner" I think your representation of him is disgracefui. It also is getting him into a lot of legal hot water that I am sure he does not want to deal with. I would like to consummate this transaction but you have made that nearly impossible. By doing that you have infuriated the neighborhood and I understand that there is trouble coming from that. Joe "the owner" said that he would make this right. Is this what you consider making things right? I offered Joe a great deal and you took it and destroyed it because of greed. I don't understand that. What happens - Joe tells you how it should be and you change it? Or do you not even talk with him? This all is totally baffling to me. Here is a list of violations that have been incurred by you during this rental according to the Landlord/Tenant Law from the State Attorney General's Office: Rights of All Tenants 1) Right to a livable dwelling. 2) Right to hold the landlord liable for damage caused by the landlord's negligence. Many things need to be fixed on this property. Small fixes are not acceptable. Four of the major problems are the electricity, the windows, ihe roof and the plumbing. Electrician said that the place needs to be rewired. The house could catch fire due to old wiring that needs replacing. Windows are broken and have bullet holes in them. They could shatter and hurt someone. They also keep the house cold in the winter. The plumber said that landlord will not authorize the leak under the shower in ihe master bedroom to be fixed. He said to either live with ihe leak and know that the floor in the laundry room is always going to be wet or don't use the shower. Roof in masier bedroom leaks. Has ruined one headboard and makes room unusable. Illegal Provisions in Rental Agreements 1) Requiring a tenant to pay for all damage to the unit, even if it is not caused by tenants or their guests. 2) Stating the tenant will pay the landlord's attorney's fees under any circumstances if a dispute goes to court. Refundable Deposits 1) The tenant must be given a written receipt for each deposit. Never received. 2) The deposit must be placed in a trust account in a bank or escrow company. The tenant must be informed in writing where the deposits are being kept. Unless some other agreement has been made in writing, any interest earned by the deposit belongs to the landlord. Never received this information. 1 would also like to see a statement of that money from the bank. Landlord's Responsibilities Under the Landlord-Tenant Act, the landlord must maintain the dwelling so it does not violate state and local codes in ways which endanger tenants' health and safety. 1) Maintain structural components, such as roofs, floors and chimneys, in reasonabiy good repair. 2) Maintain the dwelling in reasonable weather tight condition. 3) Keep electrical, plumbing and heating systems in good repair, and maintain any appliances which are provided with the rental. Renting Condemned Property The landlord may not rent units which are condemned or unlawful to occupy due to existing uncorrected code violations. The landlord can be liable for three months rent or treble damages, whichever is greater, as well as costs and attorney's fees for knowingly renting the property. Retaliatory Actions If a tenant exercises rights under the law, such as complaining to a government authority or deducting for repairs, the law prohibits the landlord from taking retaliatory action. Marcie, I am sure too that the PUC would be interested in comparing payments made and shut off notices from Peggy and i for Public Service. I also believe that defamation is against the law. These are two other violations covered by separate laws. I am attaching two options for agreement on settlement of this lease. I think it would be best if we agreed on one and moved forward. I am also attaching all documentation sent to you over the last few weeks. I expect an answer by Saturday, October 17, 1998. Owner agrees to carry paper for 2 years at which time purchaser would obtain a mortgage loan to pay off lien holder. Owner agrees to 7.0% interest rate for this period of time.
