NOTICE AND ORDER
To
PROPERTY OWNER AND ALL CURRENT OCCUPANTS
Pursuant to the 1997 Edition and the Uniform Code for the Abatement of Dangerous
Buildings, the 1997 Uniform Housing Code and the 2003 International Property
Maintenance Code, the following property is in violation. According to County Records
you are the property owner of the described property in violation.

Property Description: 2405 Barths, Coulehan Grange, Wheat Ridge Area, Lot 2, Section
24, Township 3, Range 69 or commonly known as: 4462 Jay Street (Apartment 4464).

NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the following
Code Sections 302.13 in the 1997 edition ofthe Uniform Code for the Abatement of
Dangerous Buildings.
1. 302.13 states, "Whenever any building or structure has been constructed or is
maintained in violation of any specific requirements or prohibition applicable to
such building or structure provided by the building regulations of this jurisdiction,
as specified in the Building Code or Housing Code, or of any law or ordinance of
this state or jurisdiction relating to the condition, location or structure of
buildings."
The 1997 Uniform Housing Codes states;
a) Section 1001.6 state, "Hazardous Plumbing. Plumbing that was installed
in violation of code requirements in effect at the time of installation or
plumbing not installed in accordance with generally accepted construction
practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not free of cross-connections or
siphon age between fixtures shall be considered substandard."
b) Section 1 001.8 states, "Faulty Weather Protection. Buildings or portions
thereof shall be considered substandard when they have faulty weather
protection, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective water proofing of exterior walls, roof,
foundations or floors, including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings,
including lack of paint, or weathering due to lack of paint or other
approved protective covering."
4. Broken, rotten, split or buckled exterior wall coverings or roof
coverings. "
The following is a list of items that shall be fixed to meet code.
1. Bedroom windows do not meet egress requirements ofthe
Uniform Building Code or the International Building Code as
required in Section R31 O.
2. Dish washer does not work properly and plumbing was not
installed according to code.
3. Fix faulty drainage so water does not enter into building from
outside.
4. Need additional crawlspace ventilation with a vapor barrier on
the ground in the crawlspace.
5. Floor joist are rotting out where they have come in contact with
the concrete foundation. These floor joist should be looked at
to prevent further decay that would make this structure a
Dangerous Building.
ORDER
The City of Wheat Ridge Building Official has determined the building referenced above
to be a Dangerous Building and to constitute a health hazard if not fixed. The owners are
ordered to pull a building permit to fix the deficient items. If such items are not fixed by
March 10, 2005, the Building Department will post 4462 Jay Street, Wheat Ridge
Colorado as a Dangerous Building. All existing tenants may stay in the building as long
as a permit is pulled to fix all issues. When a tenant moves out of the rental unit, the unit
shall not be leased out until all items are brought to code. Pursuant to Code future
tenants shall not occupy the apartments in this complex until all issues are brought up to
code and are inspected by the City of Wheat Ridge Building Department. Therefore this
is required in order to protect life, health and safety ofthe public.
The property owner and all future occupants are hereby ORDERED TO CEASE
AND DESIST occupancy and use of the above described building. The Building
Official shall cause the property to be posted with the attached Notice after March
10,2005 and shall take action to remove all future occupants from the building.
REMEDIAL ACTION
I. The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct the following deficiencies.
I. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Board of
Appeals pursuant to section 205 of the Code, provided that the appeal is made in writing
as provided in the Code and filed with the Building Official within ten (10) days from the
date of service of this Notice and Order. Failure to appeal will constitute a waiver of all
rights to an administrative hearing and determination of this matter. FILING OF AN
APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND
ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.
