Midroof & Final Roof inspections for ROOFS 6/12 PITCH & OVER: 3rd party inspection will be
required for both the midroof and final inspections. The 3rd party inspection report AND
THE ORIGINAL PERMIT CARD needs to be dropped off to the Permit Desk at the City of Wheat
Ridge. The report MUST BE SIGNED by the Homeowner.
REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec.
R806. The installation of ridge venting requires the installation or existence of soffit
venting. For calculation purposes, one hat or turtle vent equal to one-half of one square
foot of opening.
Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75% of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75% of the mid -roof may be complete. Asphalt shingles are required to be
fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is
required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name) roof
covering" is required to be on site at the time of final inspection.

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the originalpermit fee.

requirements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of

5. The permit holder shall notify the Building and Inspection Services Division in accordance with established policy of all required

an approval of, any violation of the provisions of the building codes or any other ordinance, law, rule or regulation.

NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a DANGEROUS BUILDING within the meaning of Section
302 of the Uniform Code For The Abatement Of Dangerous Buildings and the Uniform
Housing Code and the 1997 Uniform Building Code all of 1997 edition, as adopted by
the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation to the following
Code Sections 302.10,13,15 and 17 in the 1997 edition ofthe Abatement of Dangerous
Buildings. The building is also in violation to the following Code Sections 1001.2.1,
Sections 1001.2. 3, Sections 1001.2., Sections 1001.2.11, Sections 1001.2.13, Section
1001.8; Section 1001.11 in the 1997 Uniform Housing Code.
1. Section 302.9 states, " Whenever for any reason, the building or structure, or any
portion thereof, is manifestly unsafe for the purpose for which it is being used."
2. Section 302.13 states, " Whenever any building or structure has been constructed,
exists or is maintained in violation of any specific requirement or prohibition
applicable to such building or structure provided by the building regulations of
this jurisdiction, as specified in the Building Code or Housing code, or of any law
or ordinance of this state or jurisdiction relating to the condition, location or
structure of buildings."
3. Section 302.15 states, "Whenever a building or structure, used or intended to be
used for dwelling purposes, because of inadequate maintenance, dilapidation,
decay, damage, faulty construction or arrangement, inadequate light, air or
sanitation facilities, or otherwise, is determined by the health official to be
unsanitary, unfit for human habitation or in such a condition that is likely to
cause sickness or disease."
4. Section 302.17 states, " Whenever any building or structure is in such a condition
as to constitute a public nuisance known to the common law or inequity
jurisprudence. "
5. Section 1001.2.5 states, " Lack of hot and cold running water to plumbing
fixtures in a dwelling unit orlodging house."
6. Section 1001.2.13 states," General dilapidation or improper maintenance."
7. Section 1001.2.1 states, "Lack of or improper water closet, lavatory, bathroom
or shower in a dwelling unit."
8. Section 1001.2.3 states, "Lack of or improper kitchen sink in a dwelling unit."
9. Section 1001.11 states, "Hazardous or insanitary premises. The accumulation of
weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat
harborages, stagnant water, combustible materials, and similar materials or
conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of this code."
10. Section 1001.8 states, "Faulty weather protection. Buildings or portions thereof
shall be considered substandard when they have faulty weather protection, which
shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing of exterior walls, roof
foundations or floors, including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings,
including lack of paint, or weather due to lack of paint or other approved
protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings."
ORDER
The City of Wheat Ridge Building Official has determined the building referenced above
to be a DANGEROUS BUILDING and to constitute a health hazard if occupied, as
more fully stated above. Pursuant to Code Sections 401 and 404, immediate vacation of
the building is therefore required in order to protect the life, health and safety of the
public.
The property owner and all current occupants are hereby ORDERED TO CEASE
AND DESIST occupancy and use of the above described building within receipt of
this Notice and Order. The Building Official shall cause the property to be posted
with the attached Notice to prevent occupancy and shall take action to remove all
occupants from the building.
REMEDIAL ACTION
No occupancy shall be permitted until and if all violations are abated pursuant to the
remedial action as set forth below:
1. The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct the mentioned deficiencies.
2. Jefferson County Health Officer must determine the residence is habitable after the
building is brought up to code before Occupancy will be granted.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Board of
Appeals pursuant to section 205 of the Code, provided that the appeal is made in writing
as provided in the Code and filed with the Building Official within ten (10) days from the
date of service of this Notice and Order. Failure to appeal will constitute a waiver of all
rights to an administrative hearing and determination of this matter. FILING OF AN
APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND
ORDER.

SECTION 301 - GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code, Where terms are
not defined, they shall have their ordinary accepted meanings within the context with which they are used,
Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Wards used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdiction,
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 ofthis code,
HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building
Officials, as adopted by this jurisdiction,
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction,
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of the public or its occupants are endangered,
1. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or
size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in
case of fire or panic.
3, Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is
more than one and one half times the working stress or stresses allowed in the Building Code for
new buildings of similar structure, purpose or location.
4, Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent that the structural strength or stability thereof is materially less than it was
before such catastrophe and is less than the minimum requirements of the Building Code for new
buildings of similar structure, purpose or location,
5, Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property,
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of that specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
stressed permitted In the Building Code for such buildings,
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent
that walls or other structural portions have materially less resistance to winds or
earthquakes than is required in the case of similar new construction.
8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of
any portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to
partially or completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly
unsafe for purpose of which it is being used.
10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the middle on
third of the base,
11. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12, Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has
become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a
harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for
the purpose of committing unlawful or immoral acts,
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to such building or structure
provided by the building regulations of this jurisdiction, as specified in the Bnilding Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14, Whenever any building or structure which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii)
fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics
required by law in the case of a newly constructed building of like area, height and occupancy in
the same location.
15, Whenever a building or structure, used or intended to be used for dwelling purposes, because of
inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement,
inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be
unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or
disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufficient fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or other cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance known
to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site after the demolition or
destruction of the building or structure or whenever any building or structure is abandoned
for a period in excess of six months so as to constitute such building or portion thereof an
attractive nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001 - DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the
conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard
buildings,
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary, Inadequate sanitation shall include, but not be limited to, the following:
I, Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house,
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a
hotel.
3, Lack of or improper kitchen sink in a dwelling unit.
4, Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold rnnning water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
8, Lack of minimum amounts of natural light and ventilation require by this code,
9, Room and space dimensions less than required by this code,
10. Lack of required electrical lighting.
11. Dampness of habitable rooms,
12, Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15, Lack of adequate garbage and rubbish storage and removal facilities as determined by the health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain structural hazards, Structural hazards shall include, but not be limited to, the following:
1. Deteriorated or Inadequate foundations,
2, Defective or deteriorated flooring or floor supports,
3, Flooring or floor supports of insufficient size to carry imposed loads with safety,
4, Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective
material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety,
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag,
split or buckle due to defective material or deterioration.
7, Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of
insufficient size to carry imposed lads with safety,
8. Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration.
9, Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety,
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code
are deemed substandard buildings,
1001.5 Hazardous Electrical Wiring. Electrical wIrIng that was installed in violation of code
requirements in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at
the time of installation or plumbing not installed in accordance with generally accepted construction
practices in areas where no codes were in effect or that has not been maintained in good condition or that is
not being used in a safe manner shall be considered substandard,
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered substandard,
1001.8 Faulty Weather Protections, Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard, Any building or portion thereof, device, apparatus, equipment, combustible
waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to
cause a fire or explosion or provide a ready fnel to augment the spread and intensity of fire or
explosion arising from any cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are
specifically allowed or approved by this code and the Bnilding Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and
similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits, Except for those buildings or portions thereof that have been provided with
adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in relations to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent to the time of construction shall be
considered substandard,
Notwithstanding compliance with code requirements in effect at the time of their construction,
buildings or portions thereof shall be considered substandard when the building official finds that an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
when other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fire-resistive construction or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and
fITe-extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in occupancy.
1001.14 Improper Occupancy, All buildings or portions thereof occupied for living, sleeping, cooking or
dining purposes that were not designed or intended to be used for such occupancies shall be considered
substandard,
The following is a list of items that shall be fixed to meet code:
1. Inside of the house was not inspected and other code violations
may need to be addressed per our inspection ofthe property,
2, Dangerous Electrical needs to be brought up to code,
3, All hazardous wiring needs to be repair by licensed Electrician.
4, Electrical Service is not at required height.
5, Lack of steps on back door.
ORDER
I. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building since the date of September, 16
2004, The owners are ordered to pull a building permit to fix the deficient items.
The previous building permit has been voided, Permits are only good for a period
of 180 days, If such items are not fixed by June 14, 2005, the Building
Department will start the Abatement process under Section 801 as stated in the
Uniform Code for the Abatement of Dangerous Buildings. Pursuant to Code
tenants shall not be permitted to occupy this unit until all issues are brought up to
code and are inspected by the City of Wheat Ridge Building Department. This is
therefore required in order to protect life, health and safety of the public,
II. If the structure has not been bronght to code or demolished by July 11,2005.
Section 801 in the Uniform Code for the Abatement of Dangerous Buildings
states, " 801.1 Procedure. When any work of repair or demolition is to be
done pursnant Section 701.3, Item 3, of this code, the building official shall
issue an order thereof to the director of public works and the work shall be
accomplished by personnel of this jurisdiction or by private contract under
the direction of said director. Plans and specifications therefore may be
prepared by said director, or the director may employ such architectural and
engineering assistance on a contract basis as deemed reasonably necessary. If
any part of the work is to be accomplished by private contract, standard
public works contractual procedures shall be followed." Section 801.2 states,
"801.2 Costs. The cost of such work shall be paid from the repair and
demolition fund, and may be made a special assessment against the property
involved, or may be made a personal obligation of the property owner,
whichever the legislative body of this jurisdiction shall determine is
appropriate. "
The property owner and all occupants are hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described building. The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove all future occupants from the building until the building is brought up to
code.
REMEDIAL ACTION
1. The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct any deficiencies,
III. Both Units shall be brought up to 2003 IRC and 2002 NEC,
APPEAL OF THIS NOTICE AND ORDER
Note there is no appeal to this Notice and Order since this is the second Notice and
Order that has been sent out.
It is a misdemeanor to occupy this building, or to remove or deface this notice.

1. Meeting was convened by Richard Ondrusek.
2. Members present -'Kenneth Adams, Rich Ondrusek, Charles Petty, Charles Hiitz
and Sam Martin. Also present was Mr, Fred Morin of 49015 Harlan St.
3. Mr. Morin requested a variance to allow him to maintain a ceiling height of
7:_'-4" in lieu of the required minimum of 71-6" under the Uniform Building Code.
Mr. Morin was issued a building permit to allow him to move and set a factory
built addition to the residence at 41905 Varian St. Wheat Ridge, Colorado. 'this
unit is manufactured by Champion homes in Berthoud, Colorado. Theyare constructed
and inspected under the auspices of ]SOD and the Colorado Department of !lousing.
Each approved unit is labeled, following inspection, as conforming to the Code.
After the unit was set, utilities connected and ready for final inspection,it was
noted the ceilingheight was 71-011. The UBC requires a minimum height of 716" in
residential construction.The Chief Building Inspector informed Mr. Florin this
condition must be Corrected, Because of the cost involved Air. Morin requested the
appeal to the Board.
Evidence was submitted that the requirements for a-minimum ceiling height are
necessary'. to maintain a minimun cubic feet. of space in conjunction with the're-
quircd minimum square Feet of floor ,pace. Since the square feet of the unit in
in question for exceeds the minimum requirements of the Code, the intent of the
Code for cubic feet of space is met. This will not impose >a health hazard for the ;
occupants'.
Mr. Ondrusek requested the Chief Building Inspector to obtain Justification from
Champion }tomes for saying the unit met the Codes.
Mr. Petty wondered if, in the interest of energy conservation, the Code could be
changed to allow 7t-C1" high ceilings?
Mr, Martin moved that the Board grant a variance to Mr. Morin, because the intent
of the Code is met and the unit does conform to all other Codes. The variance is
for this one unit- at 005 Harlan St., Wheat Ridge,.. CO. Motion seconded by Mr. Hiltz.
Motion passed 5-0,
4. Ire Ondrusek moved that the City adopt the 1573 Edition of the uniform Fire Code
and the 19713 Edititaaof the ICSO Plumbing Code with an amendment that approved plastic
pipe he used only in residential oreu;sanczcs, above ground no more than two storits
high. Seconded by ltr. Martin. Motion passed 5-0;`
