To whom it may concern: (Regarding Garrison Village)
In regards to the grading issues on the retaining walls located on the east side of
building #1 and #2, Jack Cunningham from Centex Homes and Darin (head building
inspector for the city of Wheat Ridge) discussed the drainage from the base of the
retaining wall to the east fence line. At that time Darin requested a gentle slope from the
base of the retaining wall to the east fence line with all debris from the most southern part
ofthe retaining walls to the furthest northern part ofthe retaining walls be cleared to
where there would be drainage flowing from south to north and that area to be filled with
I y," rock. After the above was complied with Darin came out and inspected the areas
and approved of compliance of his requests.
By adding a swell to the bottom of the retaining walls to the east fence line would
jeopardize the integrity of the walls and would minimize the flow of water from north to
south.

Garrison Village Drainage Issues
This morning 1 found a request for Certificate of Occupancy for 4643, 45, 47, 49 Flower Street.
I will not issue any of these C.O. 's based upon an agreement between John Benallo of Centex
Homes, Steve Nguyen and myself during a meeting held on November 30, 2004.
During our 1l/30 meeting with Mr. Benallo, it was agreed upon that 1 would issue C.O'.'s for
units that were coming in during the 151 week of December if a design from Paragon was received
and approved. The design was received and approved on 12/13/04, and I signed off on the C.O.'s
as we had agreed to do.
The second part of the November 30th agreement was that no further C.O.'s would be issued until
the pond improvement construction was under way.
Mr. Benallo assured me in December that not only would the work commence ASAP.
Well of course there were a few periods of snow that delayed the start, and then there were the
holidays.. .
Mr. Benallo sent me a fax from Scott contracting (please see attached sheet) stating that the work
would commence the week of January 2, 2005 and be completed within a couple of weeks.
When I spoke to Mr. Benallo (and also to his "underling" Amber Wood), I have continuously
held fast to our initial agreement that no C.O.'s would be issued until the work was under way. I
was re-assured time after time that everything would be completed before this became an issue.
To this date, no work has started toward the pond re-construction measures.
Whether or not Centex is having scheduling issues with Scott Contracting is immaterial from the
Public Works standpoint.
Bottom line: No further C.O. 's shall be signed by Public Works until such time as the drainage
construction is under way (per the agreement).
I phoned both Mr. Benallo and Ms. Wood this morning to reiterate that no C.O. 's will be issued.

RE: Lack of Drainage from Pond #3, Garrison Village Subdivision, Wheat Ridge.
Dear Yvonne,
This letter is in response to the latest submittal from Sylvester Mikosz, P.E. of Paragon
Engineering to resolve the lack of drainage from the recently constructed detention pond #3.
Due to the fact that the storm drainage facilities in this area were initially constructed too low in
elevation, detention pond #3 does not function as stated in the approved Final Drainage Report
and Plan. The following is a brief summary of the pond #3 and associated drainage system
Issues:
1. 1 spoke with Mr. Mikosz for the first time on July 29, 2003 with regards to drainage
facilities in this area not functioning as designed. The U-Channelleading into detention
pond #3 was holding approximately 2" of water. On July 29,2003 I suggested that the
storm sewer be removed and constructed per the original approved plan design to attain
the grade needed to drain the facilities. Mr. Mikosz stated pipe re-location was an
option that he didn't wish to explore at that time due to the cost involved.
2. Subsequent to the above conversation, the U-Channel was modified to achieve a grade
allowing for 0.5" of standing water. Typically the City does not accept a drainage item
that does not properly drain, but in an effort to assist Centex in resolving this issue in a
timely and cost effective manner, the City was willing to accept the modified U-
Channel if the standing water was to remain at no more than the 0.5" depth.
3. The trickle channel and water quality pipe for the outlet structure for pond #3 were also
initially constructed in such a fashion as to not allow the pond to fully drain. The
approved Final Drainage Report/Plan does not state the pond would hold any water for
excessive periods of time (e.g., beyond the normal water quality period), so it must be
assumed the pond was designed to fully drain. The trickle channel was constructed flat,
and the water quality pipe on the outlet structure for pond #3 was constructed 4" too far
above the flowline of the trickle channel to drain the pond. The trickle channel should
have some positive grade to allow the runoff to get to the outlet structure, and water
quality drain pipe needed to be constructed lower on the outlet structure to be effective
(down by the flowline of the trickle channel).

4. The standing water in pond #3 has created an ideal breeding ground for West Nile
mosquitoes during the spring and summer months. I have been in contact with Mr.
Mikosz on several occasions with regards to the West Nile issue and the proposed re-
design of the water quality outlet pipes.
5. On October 10, 2004 I received an acceptable proposal from Mr. Mikosz, P.E. to
resolve the water quality outlet pipe problem, along with an amendment to the original
approved Final Drainage Report speci fying the outlet structure changes for all pond
outlet structures in the Garrison Village Subdivision.
6. Currently pond #3 has about 3" of standing water in it. In fact, the City received a
proposal from Dave Lang, P.E. of Cent ex Homes back in August to substitute 3" rock
for the originally approved sod for the pond bottom because of the standing water issue
(grass dies when submerged for long periods of time). On September 28,2004 this
proposal was discussed with Meredith Reckert, Senior Planner (regarding how this
would affect the approved landscaping), and the proposal was accepted.
7. I spoke to Mr. Mikosz towards the end of October regarding the stipulations I placed
upon the 4793-4799 Flower Street Building Permit acceptance (please see attached
copy of the stipulations). I spoke to Mr. Mikosz again in early November to remind him
that the standing water in pond #3 needs to be addressed, and that no Certificates of
Occupancy will be issued until this drainage problem is resolved.
8. The latest submittal proposes constructing a I '8" wide, 0.5' deep concrete channel
across the adjacent property to the east. The proposed channel is to be built across the
frontage of a neighboring property (to resolve an issue that needs to be addressed
within the Garrison Village Subdivision), and at a grade of 0.29%. Concrete pans
should be no less than 0.50% to ensure constructability and functionality. Therefore,
this proposal is unacceptable to the City of Wheat Ridge.
Conclusion:
There has not been an acceptable solution to fully resolve the drainage issues for pond #3 and its
associated drainage facilities. Therefore, the City shall refer back to the original approved Final
Drainage ReportlPlan and Civil Construction Plans and require that all of the drainage facilities
be constructed and function as stated in these documents. In addition, this drainage issue shall be
resolved prior to the issuance of any additional Certificates of Occupancy.

Dear Amber:
Please let this letter serve as a follow-up to our discussion yesterday regarding signage in the
Garrison Village Planned Residential Development project within the City of Wheat Ridge.
You had requested directional signage for certain addresses in the project. The sign proposed
would be a maximum of one square feet in size and would contain addresses of two of the
buildings. The sign would be placed at the entrance drive where these units gain access off of
Flower Street. According to my master address map, the affected buildings are 4723-29 and
4683-89 Flower Street. Staff has no problem with the directional signage as long as only one
sign is used and the total sign height does not exceed two feet. A permit will not be required for
erection of this directional sign.
Another issue was the signs adjacent to retention ponds warning that these areas are subject to
flooding. You have requested that two signs adjacent to the southern pond on the western side of
Flower Street be reoriented towards the pond. Staff has no problem with this either. No permit
will be required for reorientation of these signs.

SUBJECT: Garrison Village D & U Easement Vacation
Dear Meredith,
1 have reviewed the documents submitted by Centex regarding the vacation of approximately 300' of the
10' drainage and utility easement located along the easterly side of the Garrison Village Subdivision.
The vacation of the 300' portion of the easement may be approvable by the City, but not per the Legal
Description and Exhibit included. Due to the fact that the Engineer-of-Record, Mr. S. Sylvester Mikosz,
P.E., has clearly stated that the wall construction will be in compliance with the original approved Final
Drainage Report ONLY if the conditions he specifies are met. One of the conditions he states is that a
swale be constructed along the face of the walls (between the walls and the fence line), with a positive
grade towards the 1-70 Frontage Road.
Because the Engineer added the swale construction as a condition of his Certification, the (drainage)
easement must remain in force for the 3' strip between the wall face and the fence line.
Therefore, I recommend the vacation of only the westerly seven (7) feet of the current 10' easement.
Even if the utility companies have all agreed to allow for the vacation of the easement, it may be easier to
simply vacate the westerly 7' of the easement rather than attempting to vacate the entire utility portion of
the easement, and only the westerly 7' of the drainage portion. This makes not only the creation of the
vacation document a bit more difficult to write, but ultimately much harder for one to understand in the
future.
At such time as all of the utility companies have agreed to vacate the westerly 7' of the current easement,
and a revised Legal Description! Exhibit are created, in my opinion the vacation will be approvable by the
City of Wheat Ridge.

Attached are elevations showing the fence proposed between the patio on the 38 and 3A units at
Garrison Village. fl.J5 shown on the details the fence w~1 be localed between the units to separate
the patio space. The fence will be constructed of white vinyl 10 match the picket fence material.
The interior fence will be 6 feet in height and be finished on bolh sides; there will be no unfinished
looking side of the fence. The fence will be entirely on the porch with the end post located on the
concrete porch slab. Let me know if you have any questions or if you need additional information.

Dear Meredith,
This letter is to confirm our conversation earlier today regarding the masonry on the fourplex units
at Garrison Village. The masonry shown on the construction drawings differs from the elevations
shown on the Final Development Plan because as we worked through the final design of the
buildings we realized there were natural break points and construction issues that defined the
placement of the masonry on the buildings. Thus building plans include the following
modifications: 1. The masonry was removed from all optional fireplaces because they are
cantilevered and will not support masonry. 2. Masonry was removed form the areas located
within the fenced porch areas since it would be totally screened from site. 3. Masonry was
stopped at natural break points on the facades of the buildings such as the fireplace and/or
window edges. Per our conversation the plans as submitted to the building department dated Jan
31,2003 meet the Planning Departments expectations for masonry on the buiidings and are
approved for building permit.

General Information
CLEANING
Dirt etc. may be removed by using a strong solution of granu-
lated soap or detergent and water with a bris"e brush. Do not
use a wire brush as it will causa damage' to Ihe surface. Rinse
Immediately wilh 'resh water. For help with serious cleaning
problems, contact your local dealer. Do not attempt to clean
using acid or acid containing produc's, 00 not clean with
high pressure power washer.
SALT AND DE.ICING CHEMICALS
Because all concrete and masonry is vulnerable to damage by
sait, Cultured Stone~ products are not warranted against dam.
age incurred from salt or o1her chemicals used fo remove snow
or ice. Do not use de-icing chemicals on areas immediately
adjacent to a Cultured Slonee application.
SCUFFING
Scuffing occurs on all natural stone. Occasionally some scult-
ing will OCcur on the surfece of Cultured Slone"prodlJcts. This

Instellation. Some scuff marks can be removed by cleaning as
described ebove.
EFFLORESCENCE
Efflorescence is a water-soluble saftthal is deposited on the
surface of stucco, concrete, brick and other masonry products
by the evaporation of water 'hat has penetrated the wall. On
rare occasions eltlorescence will occur on Cultured Stone"
products. To remove efflorescence, allow the slone 10 dry
thoroughly, then scrub vigorously with a stiff bristle brush and
clean water. Rinse thoroughly - do not use a wire brush. For
mor.. difficult. elflorescence problems, scrub thoroughly wilh a
solulion of 1 part white household vinegar to 5 parts water.
Rinse thoroughly. For unusually difficult cleaning problems
contact your local Cultured Stone" dealer.
SWIMMING POOLS
Cultured Slonee products should not be used below waler level
as in swimming pool liners. Chlorine and other cI,emicals may
discolor the Cultured Stone" products and olher masonry materials.

CAPPING OFF THE EXPOSED TOP OF EXTERIOR WAllS
To achieve a finished architecturat look on horizontal or Sloping
lOp areas 0' exterior walls, piers. retaining walls, or other sur.
faces, Ihe use of Cultured Stonee Capstones or a poured-in.
piace concrete cap must be used to provide ede!luate run-off
protection '0 the wall areas. Caps should extend approximately
l' to 2" beyond the finished slone surface. Cultured Stone"
corner pieces or flal pieces must not be used to cap walls.
RETAINING WAllS
All retaining walls must be water-proofed at the fill side. Wall
construction should incorporale proper use 01 granular back
fill and provisions lor good drainage. A continuous longiludinal
drain along the back of the wall set In drain rock is recom-
mended.
CllIMNEY CAP
All chimney chases musl be capped with a one-piece cap
that extends 1" . 2" beyond the finished stone surface to pre-
vent waler from entering the wall syslem. Chimney or chase
construction should incorporate proper flashing.

Dear Meredith,
This letter is to confirm our conversation earlier today regarding the masonry on the fourplex units
at Garrison Village. The masonry shown on the construction drawings differs from the elevations
shown on the Final Development Plan because as we worked through the final design of the
buildings we realized there were natural break points and construction issues that defined the
placement of the masonry on the buildings. Thus building plans include the following
modifications: 1. The masonry was removed from all optional fireplaces because they are
cantilevered and will not support masonry. 2. Masonry was removed form the areas located
within the fenced porch areas since it would ba totally screened from site. 3. Masonry was
stopped at natural break points on the facades of the buildings such as the fireplace and/or
window edges. Per our conversation the plans as submitted to the building department dated Jan
31, 2003 meetlhe Planning Departments expectations for masonry on lI1e buildings and are
approved for building permit.

As we have reviewed Colorado State Law Article 5 Buildings Constructed by Public or Private
Funds Section 9-5-110(2) states: The government unit responsible for enforcement of this article
may exempt any building or facility from any provision of this article upon a finding that
compliance with such provision would subject an undue hardship on the taxpayers of the
governmental unit liable for the cost of such compliance in relation to the benefits to the persons
with disabilities that are derived from such compliance.
Centex Homes is formally requesting an exemption to the Colorado State Law due to a hardship.
As we reviewed the Sate law, the Federal Fair Housing Act and the ANSI Code, we found several
conflicts and inconsistencies that create a hardship for Centex Homes as the code is interpreted
by the City of Wheat Ridge. As we discussed at our meeting on October we are willing to provide
access to a number of units within our project.
The state law requires that one in seven homes be adaptable either to Type A or Type B of the
ANSI Code. We discussed at our meeting that we would meet the Type B requirements in nine
homes. This would be two full buildings plus one additional home. As we reviewed the code we
interpreted it to mean the first floor of the required number of units would be accessible and
adaptable. We designed one of our homes to be accessible/adaptable on the main floor of tile
home, as we discussed the requirements further with the City staff the City of Wheat Ridge
interpretation became that both floors would need to be made fully accessible.
We have been aware of the accessibility issues throughout the entitlement process and felt we
were going above and beyond the required standards by providing a main floor accessible home.
As we reach the end of our project, we have spent a substantial amount of money on the project
without the knowing that we needed nine fully accessible homes or 14% of our homes fully
accessible. We have designed our buildings with two story homes to provide homes for young
married couples or single parent families. We believe we have designed these homes for the
demand in the area. To modify the architecture of the buildings for a fully accessible home would
require a full redesign of the buildings and was not within the scope of our project.
As we began this project we reviewed the Federal Fair Housing Act and found that buildings that
have four homes or less that are two story without an elevator are not required to provide
accessible units.
The State Code section 9-5-111 Exemptions for certain privately funded projects states" This
article does not apply to privately funded projects for the construction of separate houses
designed as single-family residences. Our project is defined as an attached single famiiy
residential project. Thus our first interpretation of the state law was also that we did not need to
provide accessible units.
As we discussed the State Law with the State staff we have also received conflicting information.
The first time we talked to the State staff we were told we did not have to provide accessible
units. As the project progressed we were told we would have to provide accessibility/adaptability
on the first floor, and now as we have just received final plat approval we are told we need to
have a fully adaptable unit.
As Carmen and i researched the issue we both contacted several city's to inquire about the
enforcement of the state law. We both found several cities are not enforcing it and others like
Thornton are enforcing it along with the federal law. In Douglas County we found a project that
built a ranch attached home which provided full accessibility. As the builder went through the
project they were unable to sell the homes. Thus at the completion of the project they went back
to Douglas County and requested acceptance of a remodeling plan for these homes. They are
currently remodeling these homes in an effort to sell them. Several local jurisdictions, the State
regulating agency and the Home Builders Association have been working on revisions to the
state law which will make it less ambiguous. The proposed law would require that a project with
two story homes provide 2% of the homes with a full visitable ground floor.
To reach a resolution on this accesslbiiity issue we are proposing that we provide 8 homes with
full accessibility on the main floor. The homes would have a fully accessible half bath and an
accessible path from the exterior of the home throughout the main floor.
Centex Homes has been building in the Denver region for more than 20 years and have always
provided accessible housing when it is requested. In the last ten years Centex Homes has built
about 3400 homes and provided less than 5 request a year for modifications to homes to make
them accessible. The most common request has been to instali a ramp into the home. We have
always provided a design service for people who request accessible homes. We would like to
extend that offer to this project also and would provide accessibility to the main floor with the
entrance and bathroom having full accessibility. We can provide an accessible design option for
the kitchen and the second floor to any homebuyer who would request that type of construction.
The conversion of the kitchen would include a different cabinet and counter that would meet the
ANSI regulations, the second floor would include a lift on the stairway and one bathroom upstairs
wtlere two bathrooms currentiy exist.
An estimated 7.4 million people in the United States use assisted technology devices for mobility
impairments. That is about 2.5% of the national population. We at Centex homes are willing to
provide eight main floor Visitable homes or viSitable homes or a total of 12.5% of our homes on
site.

Dear Meredith,
Thank you for meeting with me last week regarding the Administrative amendment to Garrison Village. As we
discussed we are requesting an amendment to the Final Development Plan to change the Front Garage Access
from Internal Private Drives from 20 feet to 17 feet and to change the side-to-side building separation from 24
feet to 17.8 feet.
Internal private drive setbacks are addressed under note L on page two of seven of the Final Deveiopment Plan.
As you iook at the plan you will see that none of the building locations change or the private drive widths or
iocations. The distance needed is 62'2" for the homes plus 20 feet on each side for driveways for a total of
102'2". The distance and in some situations ranges from 96.9 feet to 1 00.4 feet. With a 62'2" building footprint
that leaves in the worse case a 17.3-foot driveway. This situation oniy occurs on the East side of Flower Street.
Thus our request to modify the Final Development Plan L as follows:

In addition we also ran into the same problem on the separation between buildings on the west side of Flower
Street. Buiiding #14 and Building #15 need a total distance from the Flower Street setback to the easement of
148 feet, this includes two 62'2" building envelopes and a 24 foot building separation. The actual dimension is
145.1 feet, which will not allow the full two bUildings and 24 feet of separation. Thus we are asking for a
reduction in the Building Separation from 24 feet to 17.8 feet.
M. Buildine Seoaration
Side-to-Side:
17.8 feet
This would cover our worse case scenario and we would try to get as close to 24 feet a possible. If we can have
the patio area within the 20-foot drainage easement we will be able to have a greater separation between
buildings. Thus our question for clarification, Can we allow the patio area to encroach into the 20' drainage
easement? The patio will consist of a concrete slab, which is 6' by 29 feet on the 3 plan and 6'8" by 12'4" on the
2 plan. These patios will include a maximum 42" fence to enclose the patio area. I believe the drainage is piped
in this area and the grading would not be disturbed.
I have enclosed a redlined version of the Finai Development Plan, Preliminary Architectural plans, a fit analysis
done by KMD for each buiiding type, I have highlighted in the problem areas.

Dear Dave:
We are writing regarding Centex Homes's request for an Administrative Amendment to decrease
the required driveway length from 20 feet to 17 feet. We have reviewed the drainage impact of
this request on the site.
This change will have no negative impact on the approved phase III drainage report of Garrison
Village. The reduction of paved surface will actually make a minor improved to the site in that the
paved area or area of imperviousness will be reduced.

Contract to Provide Accessibility for
Garrison Village
Case NO. WZ-02-08/Centex
This Contract to provide Accessibility for Garrison Village developed by Centex Home 9250 East Costilla
Avenue #200, Greenwood Village, CO 80112 (the "Contract") this 2'" day of December 2002, by and
between Centex Homes and the City of Wheat Ridge, Jefferson County, Colorado (the" City")
A. Centex Homes has proposed the construction of sixty-four (64) homes on at Garrison Village located
on the north east corner of Garrison Road and 461h Place. Case Number WZ-02-08/Centex. ( the
"Land")
B. Title 9, Article 5 (Article 5) C.R.S. requires that buildings and facilities used by the public be
constructed in such a manner as to be easiiy accessible and adaptable for persons with disabilities,
and that one unit for every seven units (" Accessible Units") within a multi-family residential project be
constructed to comply with the most current version of the ANSI Standards.
C. Centex Homes wishes to enter into a contract guaranteeing that nine residential units shall be
constructed in such a manner as to be easily accessible and adaptable on the main floor for persons
with disabilities as further defined in Section E of this agreement.
D. Section 9-5-102, C.R.S. permits the governmental units responsible for the enforcement of Article 5 to
grant exceptions to or modify any particular standard or specification when such governmental unit
determines that it is impractical and wouid create an unusual hardship or wouid unreasonably
complicate the construction, alteration or repair in question.
E. The City of Wheat Ridge and Centex Homes hereby agree that Garrison Village will be in compliance
with Title 9 Article 5 and ANSI Standards by including the following items within the required nine
units.
1. Accessible route to and through the front door
2. Main floor kitchen with a 24" maximum finished depth for cabinets. Plans will be submitted to the
City of Wheat Ridge for the conversion of the standard sink to an accessible sink.
3. Light switches on the main floor at 48 inches and outlets at15 inches
4. Patio will be on the accessible route
5. Main floor adaptable half bath with rough in plumbing for addition of a shower or tub. Pians will be
submitted to the City of Wheat Ridge for the conversion of the bathroom from a half bath to a full
bath.
6. Living Room adaptable to bedroom.
G. This contract shall run with the Garrison Village deveiopment plan and shall be binding upon Centex
Homes, heirs, successors, and assigns.
