I have completed the second review of the above referenced civil engineering documents received via e-
mail on December 14, 2012, for development of the property located at 4565 Kipling Street. This letter is
to inform you that these documents have been reviewed and are hereby approved for construction by the
Department of Public Works.
Please have the engineer forward three (3) signed and sealed hardeopies of the Final Drainage
Report and Construction Plans to me for inclusion in the Building Permit plan sets. Upon receipt of
these document-, Public Works will sign-off on the Building permit so it may be issued.
In addition, please be aware of the following items regarding the construction of the project:
1. Public Improvement Restoration/Debris Tracking
It will be the responsibility of the of the contractor for the project to repair any damage to the existing
public improvements along Kipling Street as a result of related construction traffic in the area. Also,
the contractor will be responsible for maintaining Kipling Street on a regular basis such that they
remain free of construction debris and tracking from construction traffic accessing the site.

NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation to the following
Code Sections 302.3, 302.4, 302.5, 302.6, 302.7, 302.8, 302.9, 302.10, 302.13, 302.17 in
the 1997 edition of the Uniform Code for the Abatement of Dangerous Buildings.
1. 302.3 states, "Whenever the stress in any materials, member or portion thereof,
due to all dead and live loads, is more than and one half times the working stress or
stresses allowed in the Building Code for new buildings of similar structure, purpose
or location".
2. 302.4 states, "Whenever any portion thereof has been damaged by fire,
earthquake, wind, flood or by any other cause, to such an extent that the structural
strength or stability thereof is materially less than it was before such catastrophe and
is less than the minimum requirements of the Building Code for new buildings of
similar structure, purpose or location."
3. 302.5 states, "Whenever any portion or member or appurtenance thereof is likely
to fail, or to become detached or dislodged, or to collapse and thereby injure
persons or damage property."
4. 302.6 states, "Whenever any portion of a building, or any member, appurtenance
or ornamentation on the exterior thereof is not of sufficient strength or stability, or
is not so anchored, attached or fastened in place so as to be capable of resisting a
wind pressure of one half of that specified in the Building Code for new buildings
of similar structure, purpose or location without exceeding the working stresses
permitted in the Building Code for such buildings."
5. 302.7 states, "Whenever any portion thereof has wracked, warped, bucked or
settled to such an extent that walls or other structural portions have materially less
resistance to winds or earthquakes than is required in the case of similar new
construction."
6. 302.8 states, "Whenever the building or structure, or any portion thereof because
of (i) dilapidation, deterioration or decay; (ii) faulty construction; (iii) the
removal, movement or instability of any portion of the ground necessary for the
purpose of supporting such building; (iv) the deterioration, decay or inadequacy
of its foundation; or (v) any other cause, is likely to partially or completely
collapse.
7. 302.9 states, "Whenever, for any reason, the building or structure, or any portion
thereof, is manifestly unsafe for the purpose foe which it is being used."
8. 302.10 states, "Whenever the exterior walls or other vertical structure members
list, lean or buckle to such an extent that a plumb line passing through the center
of gravity does not fall inside the middle one third of the base."
9. 302.13 states, "Whenever any building or structure has been constructed or is
maintained in violation of any specific requirements or prohibition applicable to
such building or structure provided by the building regulations of this jurisdiction,
as specified in the Building Code or Housing Code, or of any law or ordinance of
this state or jurisdiction relating to the condition, location or structure of
buildings. "
10. 302. 17 states, "Whenever any building or structure is in such a condition as to
constitute a public nuisance known to the common law or in equity
jurisprudence."
ORDER
The City of Wheat Ridge Building Official has determined the building referenced above
to be a Dangerous Building and to constitute a health hazard if occupied, as more fully
stated above. Pursuant to Code occupancy shall not be permitted until all issues are
brought up to code and are inspected by the City of Wheat Ridge Building Department.
This is therefore required in order to protect life, health and safety of the public.
The property owner and all future occupants are hereby ORDERED TO CEASE
AND DESIST occupancy and use of the above described building. The Building
Official shall cause the property to be posted with the attached Notice to prevent
occupancy after present tenants move out and shall take action to remove all future
occupants from the building.
REMEDIAL ACTION
No occupancy shall be permitted until all violations are abated pursuant to the remedial
action as set forth below:
I. The property owner shall pull a building permit and bring the structure up to code
by March 1, 2005 or shall have the build Demolished by March 1, 2005. If the
structure has not been brought to code or demolished by March 1, 2005. Section
80 I in the Uniform Code for the Abatement of Dangerous Buildings states, "
801.1 Procedure. When any work of repair or demolition is to be done pursuant
Section 701.3, Item 3, of this code, the building official shall issue an order
thereof to the director of public works and the work shall be accomplished by
personnel of this jurisdiction or by private contract under the direction of said
director. Plans and specifications therefore may be prepared by said director, or
the director may employ such architectural and engineering assistance on a
contract basis as deemed reasonably necessary. If any part of the work is to be
accomplished by private contract, standard public works contractual procedures
shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall
be paid from the repair and demolition fund, and may be made a special
assessment against the property involved, or may be made a personal obligation
of the property owner, whichever the legislative body ofthis jurisdiction shall
determine is appropriate."
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Board of
Appeals pursuant to section 112 of the International Building Code, provided that the
appeal is made in writing as provided in the Code and filed with the Building Official
within ten (10) days from the date of service of this Notice and Order. Failure to appeal
will constitute a waiver of all rights to an administrative hearing and determination of this
matter. FILING OF AN APPEAL SHALL NOT STAY THE EFFECTIVENESS OF
THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.
