GS will solely determine the condition of watertightness. GS is not responsible for any costs related to the removal or abatement of any asbestos present in the existing roof system to which the GS roof system is applied. Included among the items which are not part of the Roof Membrane and hence not included within the protections provided by this warranty are the following: Underlying roof deck; insulation; vapor retarders; fasteners; metal work; drains; expansion joints; skylights; vents; flashings, plastic accessories, decorative and/or reflective coatings, surfacing, and/or any ballast, rock, or gravel used . Bituminous flashings shall not be considered part of the Roof Membrane. There are additional exclusions from coverage and limitations of coverage set forth below. - GS shall be discharged of all further obligation upon occurrence of any of the following events: (a) expiration of the term of this warranty (b) whenever the total value of all repairs famished hereunder (based on the cost to GS of all such labor and materials) equal GS'then maximum liability decreased as provided herein, (c) the occurrence of any event set forth as an exclusions herein, or (d) upon violation of any of the terms and conditions of this limited warranty, EXCLUSIONS FROM COVERAGE GS shall not be liable for correction of conditions on, or any damage to, any building, interior or exterior, or property contained therein or thereon, or for damages or injuries of any kind whatsoever; and shall not be liable for damages to roof insulation, roof decks or other bases over which the GS products are applied; or for leaks, damages or injuries due to improper application, defective workmanship, or use for purposes other than which it is 5 recommended; or attributable to any of the following (or any combination thereof): 1. Damage caused directly or indirectly by natural disasters, including, but not limited to, cyclones, tornadoes, hurricanes or other winds exceeding Force 9 on the Beaufort scale, lightning, earthquakes, flood, hail or,fire. 2. Physical damage resulting from falling objects, maintenance work, civil insurrection, war, riot or vandalism. 3. Damage resulting from settlement, deflection or other movement of the roof deck, walls, foundations or any other part of the building structure, insulation or other materials underlying the Roof Membrane. 4 Damage to, or failure of, the Roof Membrane and Base Flashings caused or contributed to by: 5 a) Infiltration or condensation of moisture in, through or around the walls, copings, building structure or underlying or surrounding materials; or b) Traffic of any nature or use of the roof surface as a storage area, walking or recreational surface or for any other similar purpose; or c) Movement or deterioration of metal work used in conjunction with the Roof Membrane; or 5 d) Solid or liquid deposits of any substance; or ^ e) Building design or construction; or 5 f) Lack of positive drainage, including, but not limited to, lack of adequate drainage to promptly and readily remove water fro the Root Membrane. 5.Failure to properly maintain the roof. 6. Changes in the building's basic usage unless approved in advance in writing by GS. 5 7. Any failure of non -GS approved roofing material of any kind or nature. 8. Workmanship or installation deficiencies of any kind, including failure to follow GS' published specifications and application recommendations. 5 NOTICE OF CLAIM To require GS to perform any obligation under this warranty, the owner named herein must, within thirty (30) days of discovery of the alleged defect to which the claim related, and at owner's expense, send written 5 notification of such defect, together with proof of purchase, certified mail, to the address provided below. This notice must include a general description of the alleged defect. GS shall have access to the roofing system, if access is not allowed, GS shall have the right to terminate the sections of this warranty that provides protection to the owner. The owner must allow reasonable investigation including, but not limited to the taking of samples that adequately demonstrate the alleged problem for testing by GS as part of the claim investigation. PROPER AND TIMELY NOTICE TO GS, ALLOWING GS TIMELY ACCESS TO THE ROOF AND REASONABLE TIME TO INVESTIGATE THE 5 SAME ARE ABSOLUTE CONDITIONS PRECEDENT TO THE RIGHT TO BRING CLAIM OR LEGAL ACTION OF ANY KIND. Upon being permitted such opportunity to investigate and inspect the roof membrane, GS will then promptly perform any obligation imposed by the terms of the warranty as a result of such investigation. NOTE: GS shall not be liable for any expenditure you may incur in replacing or repairing the Roof Membrane in question which is incurred prior to written acknowledgment from GS that it is responsible for the claim pursuant to the terms of this warranty. In the event an emergency condition exists which requires immediate 5 repair to avoid damage to the building or its contents, the owner may make essential temporary repair(s) performed by a qualified roofing individual. Owner shall contact GS for applicable transfer fee and notification documentation. ct LIMITATION OF DAMAGES AND LEGAL REMEDIES; AGREEMENT TO BINDING ARBITRATION 5 THE OBLIGATIONS CONTAINED IN THIS LIMITED WARRANTY ARE EXPRESSLY IN LIEU OF ANY OTHER OBLIGATIONS, GUARANTEES AND WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND OF ANY OTHER OBLIGATIONS OR LIABILITY ON THE PART OF GS. IN NO EVENT SHALL GS BE LIABLE FOR CONSEQUENTIAL 5 OR INCIDENTAL DAMAGES OF ANY KIND. SOME STATES DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. NO ACTION FOR BREACH OF THIS LIMITED WARRANTY SHALL BE BROUGHT LATER THAN ONE YEAR AFTER ANY POTENTIAL CAUSE OF ACTION HAS ACCRUED. 5 Nothing contained in this warranty shall be construed to be a waiver of GS' right for contribution or indemnity for any liability incurred as a result of this limited warranty. Invalidity or unenfomeability of any provisions herein shall not affect the validity or enforceability of any other provision which shall remain in full force and effect. This warranty supersedes all prior roof membrane warranties and bonds. 5 All disputed claims or other disputes that may arise between the owner, contractor, architect and/or GS arising out of or relating to or in connection with this limited warranty shall be submitted to and decided by arbitration in accordance with the Construction Industry Arbitration Association then in effect unless the parties mutually agree otherwise. This agreement to arbitrate shall be specifically enforceable under the applicable state or federal arbitration laws. The award rendered by the arbitrator shall be final and judgment may be entered upon such award in accordance with applicable law in any court having jurisdiction thereof. 5 ACCEPTANCE OF TERMS 5 ac Owner acknowledges that the effectiveness of this warranty is part of the consideration for the purchase of the roof materials. By purchasing GS products, Owner hereby accepts the terms, conditions, limitations and exclusions of this limited warranty. 5 EFFECTIVE DATE This labor and material warranty certificate applies to the Flintlastic roof membrane applied on or after January 1, 1998. REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent.
