brougham, Kent Davis, Don Eafanti, Phil Edwards, Vance Edwards, Tony Flasco, Hon Selstad, and Eill Shanley Also present City Clerk, henda Sang, City Attorney, John Hayes, City Tre8surer', Jim halune, Lirector of Plc,nning, Glen Gidley, Chief of Police, Jack Hurst, Directur of Parks, Gar'y wardle, Director of Public works, Bob Goebel, staff, and interested citizens APPROVAL OF MINUTES of December 23, 1992 Motion by kr Eafanti for the approval at the kinutes 1992, seconded by Mrs brougham, carried 7-0 with Mr abstaining (He had not been present at the December of DeceoJber Selstari 23 meeting) 23, CITIZENS' RIGHTS TO SPEAK Jerry Roach, 7805 h 41st Avenue, thanke~ Carul and Duane Luebke for their $400 00 donation to the Christmas lighting contest sponsored by Wheat Ridge Tuday and Tomorruw and mentioned the Luebke's and their son's spectacular lighting displays that draw people from near and far Louise Turner, 11256 W 3bth Avenue, spoke regarding the committee formed by the City to explore the possibility of a tax increase She feels this will not be too popular and asked th8t another cummittee be formed that would study alternatives to a tax increase LOCAL LIQUOR LICENSING AUTHORITY MATTERS I ten, 1 Application for a new Class G - Hotel & Restaurant Liquor License with extended hours for Venture III, Ltd , dba "Luke's", 4~90 Kipling Street, Units I & II, Wheat Ridge, Colorado Motion by Mr Shanley to approve the application for a new Class G _ Hotel & Restaurant Liquur License with extended huurs fur Venture III, Ltd , riba "LUke's", 4990 Kipling Street, Units I & II, Wheat Ririge, Colurado, for the following reasons 1 All applications anj fees required by statute have been filed and paid, 2 Notice of hearing and posting of the prewises have been accompJished according to statutory requirements, 3 The applicant will be entitled to occupancy of the premises by virtue of a signed lease dated Oct 9, 1991, 4 The applicants have been cleared by the PoJice consideratiun are for granting this license, as evidenced by petitions bearing 80 signatures in favor of issuance, 5 signatures in o~position, and 18 signatures evidencing no opinion and that the issuance of this license is consistent with the needs of the neighborhood under consideration, seconded by Phil Edw~rds Applicant Michael Lucas, 1~OOO W ~2nd Avenue, wheat Ridge, was sworn in by the Mayor and answered Council's questiuns Motion carried ~-O Item 2 A~plication for a transter of ownershi~ for "Paramount Lanes", 2625 Kipling Street, Wheat Ridge Motion by Mr Shanley to ap~rove the Transf'er of Ownership frum J & B bowling Enterprises, Inc to Paramount Lanes, Inc , dba "Paramount Lanes", 2625 Kipling Street, wheat Ridge, for the following reasons 1 All applications and feES required by statute have been f'iled and paid, 2 The applicants will be entitled to occupancy of the ~remises by virtue of a signed lease dated December 12, 1991, 3 The applicants have been cleared by ORDINANCES ON SECOND READING Item 3 Council Bill 1~6 - An Orainance amending Chapter ~2 Taxation of the Code of Laws of the City of wheat Ridge, Color8do, by adding a new Division 6 to Article II of Cha~ter 22 of the City's Code uf Laws authorizing the City Council to designate certain "business Development Zones," providinb for the abatement of certain categories of fees, taxes, and other development-related charges for new development or redevelopment within said business development zones, which businesses are expected to generate incremental revenue to the City equal to or exceeding the amount of any abatement Council Bill 126 was introduced un secund reading by Mr Shanley, title read by the Clerk, Ordinance ~o 888 assigned Motion by Mr Shanley for the approval of Ordinance 888, seconded by Mr Davis, carried 7-1 with Mrs Brougham voting No ~ITY COUNCIL MINUTES January 13, 1992 Page -3- ORDINANCES ON FIRST READING Item 4 Council Bill 1 - An Ordin8nce amending the provisions of Section 26 Article I of the Code of Laws of the City of hheat Ridge, hereafter referred to as the Zoning Code of the City of ~heat Ridge, and providing for the adoption of regulations pertaining to the expiration of variance approvals Council Sill 1 was introduced by Mr Davis on first reading, title read by Clerk Notion by Mr Lavis that Council Bill 1 be approved on first reading, ordered published, public hearing be set for Monday, February 10, 1992 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication, seconded by Mr Selstad After discussion Council agreed to strike the words "with due cause" Motion carried 8-0 Item 5 Council Bill 2 - An Ordinance vacating a portion of West 38th Lrive in the Ridge Subrlivision within the City of Wheat Ridge, County of Jefferson, State of Colorado Council Bill 2 was introduced by Mr Eafanti on first reading, title read by Clerk Motion by Mr Eafanti that Council Bill 2 be approved on first reading, ordered published, public hearing be set for Monday, February 10, 1992 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 1 day after final publication, seconded by Mr Davis Mrs broughalli asked for a friendly amendment that an address be included This was accepted by mution-maker and second Motion carried 8-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 6 Resolution 1279 - amending the City of Wheat Ridge Annual Budget for the fiscal year of 1992 (Joint Venture Grant from SBA in the amount of $13,625) Resolution 1279 was intruduced by Mrs Brougham, title read by the Clerk Motion by Mrs Vance Edwards, Broughau for the adoption of Resolution 1279, seconded by carried 8-0 CITY COUNCIL MINUTES January 13,1992 Page -4- Item 7 Maintenance Contract fur Dictaphune Recorder for 1992 Notion by Recording amount of Acct l~o Phil Edwards that the Mainlenance Contract for the Dictaphone System fur 1992 be awarded tu Dictaphone Corporation in the their quote of $2,bb2 00 and that all costs be charged to 01-204-776, seconded by ~r Eafanti, carried 8-0 Item 8 ~aintenance Contract for Telephune System for 1992 Motion by Vance Edwards that the Maintenance Cuntract for the Telephone System for 1992 be awarded to Jem Communications in the amount of their bid of $7,932 00 and that all costs be charged to Acct No 01-b10-759, seconded by Mr Eafanti Motion by Mr Flasco that this Item be tabled and be sent out to bid and comparative custs with the old system be prepared, Reconded by Pllil Edwards, carried 7-1 with Mr Shanley voting No Itew 9 Trash Removal Services Contract for 1992 ~otion by Phil Edwards that the contract for the Trash Removal Services for 1992, (RFB #92-01) be awarded to Arvada Rubbish Removal for their bid of $4,080 00 per year for annual service and $892 00 estimated for seasonal service, with all costs to be charged tu the various approved budget accounts for utilities by the affected departments, seconded by Mr Eafanti, carried 8-0 IteITJ 10 Undergrounding utilities on 38th Avenue between Wadsworth and Kipling Bub Goebel presented 3 different options rebarding the undergrounding Judy DiCroce, 42b5 Everett Street, chairperson of the Planning Cowmission, was sworn in by the Mayor She urged City Council include underbrounding of utilities in the initi8l phase of h Avenue reconstruction and reco~mended Option 3 to 38th George Langdon, 3570 Miller Street, was sworn in by the Mayur He represents hheat Ridge Alliance for Frogress and has been asked to thank Council and staff for the modernization of ~ 38th Avenue between Sheridan and Wadsworth ThiR improvement including the undergrounding of utilities has the endorsement of all progressive citizens of Wheat Ridge They respectfully request Council's continued support of similar modern improvements, including undergrounding uf all utility lines Bob Eckhardt, 7400 W 44th Avenue, was sworn in by the Mayur, spoke in favor uf Option 3 Carl Cerveny, 3425 Moore Street, representing Jeffco Realtors, was sworn in by the Mayor and read a Resolution into the record, which supports Optiun 3 CITY COUNCIL MINUTeS January 13, 1992 Page -5- Arie Verrips, 15 Hillside Drive, was sworn in by the Mayor and spoke in favor of Option 3 Juhn Tracy, 2890 harlan Street, #104, chairperson of ~heat Ridge Issues Council of the hest Chamber, was sworn in by the Mayur and read letter into the record, which favors Option 3 Lee Hill, Public Service Company, 805 12th Street, Golden, was present to answer yuestions Rae Jean Behm, 3835 Quail Ct , member of 38th Avenue herchants Group, asked that utiTities be undergrounded from ~adsworth to Kipling to keep the continuity as from Sheridan to Wadsworth Motion by ~r Selstad to proceed with Option III (use $200,000 annual 1% money to payoff $1 6 million bond used to underground utilities from Wadsworth to Kipling in 1992), seconded by Vance Edwards, carried ~-3 with Phil Edwards, Kent Gavis, and Tony Flasco voting no Phil Edwards is voting no because he doesn't believe in spending over 1 Million Dollars on interest, you get no undergrounding for it, only interest, it is a real waste of money, it will not cost any more to put this in later and save the interest money Kent Davis is voting no because this will delay 38th Avenue Item 11 hotion by Mr Shanley to allow the Jefferson County Elections Department to use our premises as polling place and to authorize the Mayor to sign a written agreement for this use, seconded by Vance Edwards, carried 8-0 Item 12 Motion to authorize payment for contributions and membership dues Motion by Mr FIasco to vote on each contribution separately, seconded by Mr Eafanti, carried 6-2 with Mr Selstad and Mr Shanley voting no Dick Hanscom, 879c Pierce Way, was sworn in by the Mayor, he spoke on behalf of the 3bth Avenue Merchants Association and answered questions Gary Nees, 2150 h 29th Avenue, representing Boys and Girls Club, was sworn in by the hayor and answered questions Dan Wilde, 3596 Ingalls Street, was sworn in by the Mayor He commended Council for the diverse allocation of monies on this list tonight He is representing the Wheat Ridge Carnation Festival, and spoke in favor of the duck race to benefit the boys and girls club He feels that the foot traffic going to and from the duck race will greatly Vance Edwards to approve $3,000 for American ked Cross, seconded by l'ir Lavis, carTied 8-0 Motion by Vance Edwards to approve $1,000 for JeffcQ Self-Sufficiency ~ciJ, seconded by f'irs Brougham, carried 7- 1 with l'tr Flasco voting no l'totion by Vance Edwards to approve $b,800 tor Arvada Center for Arts & Humanities, seconded by l'trs brougham Mr Davis said he will be voting against this motion, and if it fails, he will move to approve the full $10,000 l'tr FIasco agreed with Mr Davis, motion failed 4-4 with Mr Davis, Mr FIasco, Mr Eafanti, and Mr Shanley voting no Motion by Mr Davis and seconded by Mr FIasco that the entire $10,000 be awarded to the Arvada Center for Arts & humanities, motion failed by a vote of 4-4 with Mrs Brougham, Mr Vance Edwards, Mr Eafanti, and l'tr Selstad voting no Motion by \ance Edwards that $8,00U be awarded to the Arvada Center for Arts & Humanities, seconded by ~r Selstad, carried 5-3 with Mr Eafanti, Mr FIasco, and Mr Shanley voting no Motion by Vance Edwards to a~prove $2,500 for Jefferson Symphony Orchestra, seconded by Phil Edwards, c~rried 8-0 Motion by Vance Edwards to appruve $800 for the Wheat Ridge Art League, seconded by Mrs Brougham, carried 8-0 Motion by Tony FIasco to approve $1,000 for RAQC, secunded by Vance Edwards, carried 8-0 Motion by Vance Edwards to a~prove $12,500 for the hheat Ridge Seniors' Resource Center, seconded by Mrs Broubham, carried 7-1 with Mr Davis voting no Motion by l'trs Brougham to delete the request for a contribution to the Jefferson Economic Council, as they are funded by the County and that the County is a tax-supported entity and therefore all County residents are paying for this Mrs Brougham also stated that if the Jefferson Economic Council is benefiting businesses, funding should come from private resources, seconded by Mr Flasco Phil Edwards stated that the Jefferson Economic Council is one of the few groups that reaches out ~cross the nation to bring business into this community, and that he will vote against this motion Mr Flasco agreed with Mrs Brougham Motion failed 2-6, with Mrs Brougham and Mr Flasco voting yes f'lotion $1,500, and l'ir by l'tr Shanley that the Jefferson Economic seconded by l'tr Phil Edwards, carried 6-2 Flasco voting no Council receive with Mrs Brougham Motion by Mr Shanley that Jefferson Sr High School and ~heat Ridge Sr High School each receive $300, seconded by Mr FIasco, carried 8-0 l'totion by Mr Eafanti to approve $3,750 fur the Merchant's Group, seconded by Mr Shanley, carried 7-1 with Mr Flasco voting no CITY COUNCIL MINUIES January 13,1992 Page -7- Motion by Phil ~dwards to approve $1,000 for the Wheat Ridge Historical Society, seconded by Mr Shanley Mr Flasco stated that he will be vuting against this motion because their problems with the Post Office are their problems, they entered into an agreement with the City and they should abide by it Also, this is the unly group that did not send a letter requesting a contribution, but rather was brought to Council by Vance Edwards Motion failed 4-4, with Councilwembers Phil Edwards, Ron Selstad, Kent Davis, and Bill Shanley voting yes Motion by Vance ~dwards to award $1,~OU to the ~heat Ridbe Historical Society, seconded by Mrs Brougham Mr Davis stated that he will vote no on this motion if any money goes to the Post Office Vance Edw8rds stated that they can make a provision that it would assist in any general operating funds for thew to offset costs of the other projects that they do for the City Motion carried 5-3 with Mr Davis, Mr Flasco, and Mr Eafanti voting no Motion by Mr Shanley that payment uf $38,850 be authorized from Account 01-610-780 to the above agencies in the amounts designated, seconded by Mr FIasco, carried 8-0 Motion by Mr Flasco that annual legislative Acct 01-102-716 be paid as follows Colorado Municipal League National League of Cities DRCOG (2 installments of $3,150) The West Chamber membership dues budgeted in and that payment be authorized f'rom agencies in the amounts designated, 8-0 $14,953 $ 1,209 $ 6,300 $ b15 $23,077 Acct 01-10.:::-716 seconded by Phil 79 00 00 00 79 to the above Edwards, carried Motion by Mrs Bruugham that payment be authorized from Acct No 01-122-704 in the amount of $6,580 to DRCOG, and the terms contained in the DkCOG Elevator and Escalatur Safety Inspection letter agreement dated November 13, 1991, be accepted, seconded by Vance Edwards, carried 8-0 Motion by Vance Edwards that payment be authorized from Acct 01-610-721 in the amount of $8,965 37 to the Jefferson Animal seconded by Elise Brougham, carried 8-0 No Shelter, Motion by Mr FIasco that payment be authorized from Acct No 01-124-704 in the amount of $2,504 90 to Jefferson County Hazardous Substance Authority, seconded by Mrs Bruugham, carried 8-0 Item 13 Motion to erase Council tapes after three years City Clerk, wanda ~ang, explained the cust savings to the City of Wheat Ridge if the audio tapes could be re-used Mr Eafanti stated that he had been approached by the Historical Society and they had expressed interest in keeping and preserving the tapes CITY COUNCIL MINUTES January 13,1992 Page -8- Wanda Sang informed Council that these tape~ could only be played on a Lanier ta~e recurder Notion by Mr Eafanti to keep the last three years of Council Tapes in the City Clerk's Office and to donate the older ta~es tu the Wheat Ridge Historical Society and that this be an on-guing process, seconded by Mrs Brougham, carried 5-3 with Councilmembers Flasco, Phil ~dwards, and uavis vuting no CITY ADMINISTRATOR'S MATTERS ~ayor Winger ex~lained that the annual goal setting session would be postponed until we have a new City Administrator CITY ATTORNEY'S MATTERS John Hayes requested that Council approve holding an executive session under Section 5 7(b)(1) and 5 7(b)(3) of the Charter at the conclusion of the meeting So moved by Mr Shanley, seconded by Mr Davis, carried 8-0 ELECTED OFFICIALS MATTERS Motion by Mr Davis to adjourn, seconded by Mr FIasco, failed 2-6 with Mr FIasco and Mr uavis voting yes Mayor Winger asked to lurm a new committee, called the Senior Housing Committee, to find out what kind of situation we have for senior housing Consensus was 6-2 to form this committee Don Eafanti com~lained about the dirty and ripped flag flying outside City Hall Run Selstad moved that we initially contact all the ~roperty owners on 38th Avenue between Wadsworth and Sheridan, asking their assistance in clearing their sidwalks and if that doesn't work we look at something with teeth in it, seconded by Mr Shanley, carried 8-0 Motion by Mr Shanley to adjourn, seconded by V Edwards, carried 7-1 with P Edwards voting no Meeting adjourned at 11 15 p m
