Subject: 40 square foot-minor building coverage variance to the -.-
1,000 square foot maximum building coverage for the ----
construction of a detached garage.
Case No. WA-96-22 is a request-for a 40 square foot minor
building coverage variance to the 1,000 square foot maximum
building coverage for the construction of a 1,040 square foot
detached garage, with workshop, to a property located at _4340__
Vivian Street and zoned Residential-One.
According to section 20-10 (F) of the Wheat .Ridge Code of Laws,
properties located in the Residential-One zone district are
permitted a 1,00.0 square foot detached garage. Because the
request is for a variance of less than 10%, known as a minor. ._
variance, section 26-_6(2)(a) of the Wheat Ridge_Code of Laws
states that the zoning administrator is empowered to decide upon
applications for minor variances.
Pertaining to the findings of fact,, staff _conaludes_that approval
of the minor variance will not. be a detriment to. the neighborhood
character, nor will it be harmful to the public's. health, safety
or welfare.. Although, there have been approximately three.
registered phone calls stating opposition to the proposed use of -- -_-_
this garage. The adjacent neighbors are afraid that the
applicant may be intending to use.-this garage as a machine,-shop
for auto repair. Staff informed the neighbors that a machine
shop is prohibited in the Residential-One zone district, and, if
the applicant proceeded to employ the garage for that use,
enforcement procedures would be addressed.
In accordance to the above information, staff recommends approval
of case no. WA-96-22.

NOTICE OF PIISLIC HEARING
Notice is hereby given of a public hearing to be held before the
Wheat Ridge Board of Adjustment on July 25, 1996, at 7:30 p.m.,
at 7500 West 29th Avenue, Wheat Ridge, Colorado. All interested
citizens are invited to speak at the public-hearing or submit
written comments. The following petitions shall be heard:
1. Case No. TUP-96-4: An application by Robert and Star
Malouff for the approval of a Temporary Use Permit to allow
a mobile home as a temporary structure on property zoned
Residential-One and located at approximately 2777 Kendall
Street.
Case No. WA-96-21: An application by Noel Lovett for the
approval of a 12' side yard setback variance to the 15'
required side yard setback for property zoned Residential-
One and located at 2655 Newland Street.
3. Case No, WA-96-22: An application by Republic Garages,
Inc., for approval of a 40 square foot building coverage
variance to the 1000 square foot maximum building coverage
allowance for a detached garage on property zoned
Residential-One and located at 4340 Vivian Street.
4. Case No. WA-96-23: An application by Tom and Isabel Abbott
for approval of a 400 square foot building coverage variance
to the 1000 square foot maximum building coverage allowance
for a detached garage on property zoned Residential-One and
located at 10780 W. 35th Avenue.
Case No WF-96-1: An application by Carol and Howard Noble
for approval to build an addition to a house in the 100-Year
Flood Plain in a Residential-Three zone district and for
