Case No. WA-96-28 is a request fora 3 foot front yard setback variance to the 30 foot front yard setback requirement and a 1.5 foot side yard setback variance to the 15 foot side yard setback requirement to allow for a bedroom addition to a property in the Residential-One zone district and located at 41 Hillside Drive. According to section 26-10 (F) of the Wheat Ridge Code of Laws, structures built in the Residential-One zone district must maintain a 30 foot front yard setback, as well as a 15 foot side yard setback. Because the request is for a variance of less than 10%, known as a minor variance, section 26-6 (2)(a) of the Wheat Ridge Code of Laws states that the zoning administrator is empowered to decide upon application for minor variances, Pertaining to the findings of fact, staff concludes that approval of this minor variance will not be detrimental to the neighborhood character, nor will it be harmful to the public's health, safety and welfare. The case has met the 70 day required notice and has met all other legal requirements. In accordance to the above information, staff recommends approval of case no.
