Pursuant to the Code, the height limitation for the billboard sign is 32 feet; accordingly, a variance of 3 feet will not exceed 10% of the height restriction and therefore may be considered a minor variance. I-70 Frontage Road North REQUEST: Height vaziance of 3'-2" to the 32' maximum billboazd height requirement in the B-2 Billboard Overlay Zone District. APPLICANT: C & E Communications 4926 SW Corbett #2205 Portland, Oregon 97201 / -J'` Christopher S. Melcher, (Attorney in Fact) Brownstein, Hyatt, and Strickland, P.C. 22nd Floor 410-17 Street Denver, CO 80202 WHEREAS, Wheat Ridge Code of Laws Section 26-6 (D) set forth specific procedures and requirements for applications for VARIANCES including specific procedures relating to "Minor Variances", and WHEREAS, Applicant, C& E Communications has made an application for a minor variance asking fora 35'-2" maximum height allowance for a billboard where 32' is the maximum billboard height requirement. THERFORE,I, Sean McCartney, Case Manager, make the following Findings of Facts and Determination: 1. The application fora 3'-2" height variance does not exceed 10%, therefore may be considered a minor variance. 2. Letter Notice to adjacent property owners and site posting notice occurred as required by law. No protests were received regarding the variance request. 4.
