FINDINGS OF FACT 8r ADMINISTRATIVE DETERMINATION
CASE: WA-96-38
LOCATION:4420 Jay Street
REQUEST: 3' front yard setback variance, to the 30' front yard setback requirement, and a 1'
rear yard setback variance, to the 10' rear yard setback requirement.
APPLICANT: Karl Koch

WHEREAS, Wheat Ridge Code of Laws Section 26-6 (D) set forth specific procedures and
requirements for applications for VARIANCES including specific procedures relating to "Minor
Variances", and
WHEREAS, Applicant, Karl Koch has made an application for a minor variance asking fora 3'
front yard setback and a 1° rear yard setback variance where 30' and 10' are required,
respectively.
I, Sean McCartney, Case Manager, make the following Findings of Facts and Determination:
The application for the 3' front yard setback and 1' rear yard setback variance does not
exceed 10, therefore may be considered a minor variance.
2. Letter Notice to adjacent property owners and site posting notice occurred as required by
law.
3. Approximately 13 verbal protests were received expressing opposition to the variance
case.
4. The preliminary design for the proposed structures equates to a maximum coverage of
42%. Approval of the 10% variance places the proposal 2% above the allowable
coverage.
5. Staff concludes that, although the minor variance would not dramatically effect the
overall development of the site, nor detriment the public's health, safety and welfare, the
magnitude of the registered verbal opposition warrants DENIAL of case no. WA-96 38.
