I have reviewed the submittal and have the following comments regarding the plat. All of these items must be added to the plat face or otherwise addressed. 1. A case history box with the following case numbers: WZ-96-11, WZ-86-8 r52. Zoning on and adjacent to the site R13. Address and phone number for the owners ~J4. Signature line, address and phone number for the surveyor ~~ 5. The signature line for the Parks and Recreation Commission can be removed ,.:~ 6. The signature line for the City Engineer should be changed to the Director of Planning and Development '7. Location of the existing house in dashed lines 8. Statement that the property is within a flood hazard zone B 9. Storm water detention easements with the attached language 10. The title should read: "Tabor Street Properties Subdivision A Subdivision in the City of Wheat Ridge, Colorado "Being a replat of a portion......." The following are items which aze specific to the final development plan. All of these items must be added to the document or otherwise addressed. ~. I. The 8' high fence will require a variance as the maximum fence height allowed is 6'. No outside storage of parts or supplies will be allowed in this area. If you would like to pursue the variance for the 8' high fence, please let me know so I can formally include this as part of your request. 2. The landscape plan needs to have an additional street tree added to it. Also, as A-1 zoned property abuts your land to both the north and south, 6' high solid fences with at least a 6' wide strip of landscaping aze required to act as buffering for these adjacent pazcels. The landscape plan is deficient 16 trees or shrubs. I recommend these trees or shrubs be shown on the outside of the fences to fulfill the buffering requirement and to meet the required tree and shrub count. 4 C.~ i~ I James and Corrine Slotnick Page 2 3. The fue hydrant must be relocated outside of the Tabor Street right-of--way to a location approved by the Arvada Fire Protection District. 4. Although the sign location meets the setback required, Staff would be more comfortable if it were moved rough]y 10' to the north to ensure sight distance visibility for vehicles exiting your site. ^ `~ 5. The materials used on the three building faces on the extreme northisouth and east Iv elevations (units E and F) need to be enhanced with architectural treatment to avoid an "industrial" look. This could be done with material (brick wainscoting) or by building offsets and landscaping. 6. The Department of Public Works is requesting that your property and the property to the north (when it redevelops) share a drive access onto Tabor Street. This is unfeasible unless the site plan for your property were "flipped" with the building along the south side of the property rather than the north. Finally, how are these documents to be recorded. If they are to be one document, the plat title needs to be changed to read: "Tabor Street Properties Final Development Plan and Plat An Official Development Plan and Plat in the City of Wheat Ridge". If they are to be two freestanding documents recorded separately, the title for the subdivision would read as specified in item 10 (above). Then the development plan title should read: "Tabor Street Properties Final Development Plan An Official Development Plan in the City of Wheat Ridge". Please adviseme to how you wish to proceed. Attached are referral responses received from other City departments and outside agencies. All of their concerns must be addressed. This case has been scheduled for public hearing in front of Planning Commission on October 17, 1996. I will need 15 folded copies of the revised plan sets no later than October 7, 1996. The .Public Works Department has reviewed the Planning Department referral dated August 20, 1996 for the above referenced address and has the following comments: 1. The second submittal of the final drainage study has been received, and is currently being reveiwed. ~., In lieu of the requirement to construct public improvements ,~~ along the Tabor Street frontage, a perpetual Development ~' Covenant will need to be processed prior to the issuance of ~~ the building permit. 3. A Dumping/Landfill Permit will need to be processed. Please be aware that an erosion control plan has been submitted for review and approval. 4. It is my understanding that Chuck Braden is currently in the process of reviewing the plat for this site. 5. We will need 10-feet of right-of-way dedicated to meet collector street standards designated for Tabor Street. 6. The common boundary between 4549 and 4601 Tabor Street is in alignment with West 46th Avenue. It will be safer for traffic. at this proposed intersection if a shared access can be constructed between the two properties referenced. The property in question, just under one acre in size, was rezoned from Agricultural-One to planned Commercial Development pursuant to Case No. WZ-86-8. An outline Development Plan was approved allowing a variety of land uses including office, service, retail sales and light manufacturing and assembly. General design guidelines were established with a breakdown of approximately 28% building coverage, 16% landscaped coverage and 56% of the lot covered by parking, drive aisles and other hard surfaces. Attached please find a reduced copy of the approved outline plan. II. FINAL DEVELOPMENT PLAN The proposed final development plan shows a 13, 500 square foot building which is slightly over that approved in the outline stage (32% versus 28% coverage). Landscaped areas constitute 23% and areas covered by hard surfaces constitute 45%. The owner and primary user is an electrical contractor who will occupy roughly 3600 square feet at the rear. Five additional spaces of 1980 square feet each would be leased to separate Yenants. A small, fenced area to the west of the structure would be used for the storage of company vehicles. The building is being shown as a one-story prefabricated building 18' in height. For the purposes of establishing setbacks, City Council recently passed a revision to the Zoning code which specifies that for commercial buildings, each 12' in height constitutes a story. Since the proposed structure is 18' in height, it is technically atwo-story building requiring a 10' setback on the north where only a 5' setback is shown. Staff has pointed this out to the applicant's architect who will try to revise the interior space to accommodate the increased setback. All other minimum requirements regarding setbacks, parking standards and landscaping have been met or exceeded. The building being proposed is a metal structure with split concrete walls. When Staff did the first review on the proposal, we requested that the eastern elevation and the north and south walls of the eastern most spaces be architecturally enhanced with a combination of upgraded material, such as brick wainscoting, landscaping and building offsets. The applicant has chosen to do only the increased landscaping. Staff recommends further treatments be provided to avoid an "industrial" look. All requirements for a Planned Commercial Development Plan have been met. Staff concludes that the proposed final development plan is consistent with the underlying outline plan. III. SUBDIVISION PLAT Part of the final development plan approval process is the submission of a final plat which has been provided. Tabor Street is classified as a collector which requires a 30' wide section from center line to property line. The applicant will be dedicating 10' of street right-of-way by this plat. This same requirement was required of, and has been met, by similar developments to the north and south along this west side of Tabor Street. All requirements of the Subdivision Regulations have been met. PBanning Division Staff Report Case No. WZ-96-11/Slotnick IV. AGENCY REFERRALS All responding agencies can serve the property. Valley Water District will require a water tap and service line installation. Page 3 Arvada Fire District has worked with the applicant to establish hydrant location. Water service line and fire hydran4 must be installed prior to any above-ground construction. Public Works has reviewed a final drainage report and is waiting for the next submission. Funds escrowed with the Oily will be required in lieu of the construction of improvements on Tabor Street. V. STAFF CONCLUSION AND RECOMMENDATION Staff concludes that the proposed development plan is consistent with the underlying outline development plan. Staff further concludes that all requirements for a final developmen8 plan have been met. For these reasons, a recommendation of approval is given with the following conditions: 1. The setback on the north be increased to 10 feet; 2. The eastern elevation and north and south elevations of the two eastern end units be upgraded by the use of brick and building offsets to avoid an "industrial" look, In regard to the platting portion of the request, Staff concludes that aside from minor corrections, all requirements of the Subdivision Regulations have been met. For this reason, a recommendation of approval is given for 4he subdivision plat with the following condition: The applicant work with Staff to resolve minor conections. Vl. The use ofsemi-tractor trailers as a normal course of business is not allowed, however, Incidental deliveries is not prohibited. In regard to the Fruitdale Valley Master plan, Staff quotes the following statements: C.1.Intent: "It is not the purpose of the Guidelines (Master Plan and Development Guidelines for the Fruitdale Valley Neighborhood) to inhibit development but to promote quality growth which preserves property values and upgrades the community". C. 2. ILa.(1)Land use: "Incompatible and undesirable uses should be excluded. This includes activities such as industrial or commercial uses which involve handling and transporting of dangerous material, outside storage or storage of bulk materials. We made specific recommendations to the applicant prior to and at the Planning Commission meeting so as to bring the proposed final plan into full conformance with these prior approved plans. The applicant has responded to these recommendations positively, by making the suggested revisions. The only area of concern which may not have been adequately addressed is the issue of "high quality design" as the azchitecture of the building uses metal and concrete block construction, Although Fieinie's Market to the south used metal, they also used some brick. The new Trailer Source building is all metal. ~ City Council desires to establish an architectural character for this pazcel, that character will be used for the two adjoining properties to the north and south. ~r Parking requirements for individual tenants shall be calculated on a case-by-case basis. The property in question, just under one acre in size, was rezoned from Agricultural-One to planned Commercial Development pursuant to Case No. WZ-86-8. An outline Development Plan was approved allowing a variety of land uses including office, service, retail sales and light manufacturing and assembly. General design guidelines were established with a breakdown of approximately 28% building coverage, 16% landscaped coverage and 56% of the lot covered by parking, drive aisles and other hard surfaces. Attached please find a reduced copy of the approved outline plan. II. FINAL DEVELOPMENT PLAN The proposed final development plan shows a 13, 500 square foot building in the same location as approved in the Outline Plan. Landscaped areas constitute 23% and areas covered by hard surfaces constitute 45%. The owner and primary user is an electrical contractor who will occupy roughly 3600 square feet at the rear. Five additional spaces of 1980 square feet each would be leased to separate tenants. A small, fenced area to the west of the structure would be used for the storage of company vehicles. All other minimum requirements regarding setbacks, parking standards and landscaping have been met or exceeded. The building being proposed is a metal structure with split faced masonry walls. Staff and Planning Commission requested that the eastern elevation and the north and south walls of the eastern most spaces be architecturally enhanced with a combination of upgraded material, such as brick wainscoting, landscaping and building offsets. The applicant has modified the plan by extending architectural treatment on the north side and adding shrubbery along the north side yard. All requirements for a Planned Commercial Development Plan have been met. Staff concludes that the proposed final development plan is consistent with the underlying outline plan. III. SUBDIVISION PLAT Part of the final development plan approval process. is the submission of a final plat., which has been provided. Tabor Street is classified as a collector which requires a 30' wide section from center line to property line. The applicant will be dedicating 10' of street right-of--way by this plat. This same requirement was required of, and has been met, by similar developments to the north and south along this west side of Tabor Street. All requirements of the Subdivision Regulations have been met. IV. PLANNING COMMISSION ACTION Planning Commission reviewed this request at a public hearing held on October 17, 1996. In regard to the five foot setback variance, a recommendation of approval was given however, after further review of the zoning code, Staff has concluded that a variance is not needed in accordance with Section 26-22(F)(a) where it states that side yard setback shall be "five (5) feet per story minimum, except a zero setback may be permitted where structures are constructed of a masonry or nonflammable material in accordance with the Uniform Building Code". Staff concludes that this section applies and the variance is not needed. Staff would further note that the existing Planning Division Staff Report Case No. WZ-96-1 i/Slotnick building to the north is at least thirty feet from the common property line. Page 3 In regard to the final development plan and plat, a recommendation of approval was given for the following reasons: The property is within the City of Wheat Ridge and all posting and notification has been requirements have been met. 2. The proposal is consistent with an already approved Planned Commercial Development outline development plan. 3. All requirements for a final development plan have been met. With the following conditions: 1. The eastern elevation and the north and south elevation of the two eastern end units will be up-graded by the use of architectural block or building off-sets. 2. Some plan be worked out that either texture, paint and landscaping be used to break up the plain look of the north wall to avoid an industrial look and be more pleasing to the adjacent properties. The exact material and plan will be left up to Staffs approval. 3. That a complete drainage report be submitted prior to public hearing before City Council. 4. Staff make certain that the entrance is adequate for the occasional semi-truck that is mentioned in the approved outline development plan. 5. That the large evergreen trees in front of the building be retained. Regarding the conditions of approval, Staff has the following comments: 1. The applicant has addressed Items #1 and #2 by breaking up the metal fascia on the south side, by extending the architectural band along the east and north sides and be installing shrubbery along the north side of the building. 2. A final drainage report has been reviewed and approved by the Department of Public Works. 3. Staff has reviewed the turning radius with template and have concluded that the turning radii are adequate for semis. 4. The large existing trees in the front of the property have been included on the landscape plan. V. AGENCY REFERRALS All responding agencies can serve the property. Valley Water District will require a water tap and service line installation. Arvada Fire District has worked with the applicant to establish hydrant location. Water service line and fire hydrant must be installed prior to any above-ground construction. Funds escrowed with the City will be required in lieu of the construction of improvements on Tabor Street. VI. STAFF CONCLUSION AND RECOJIAMENDATION Staff concludes that the proposed development plan is consistent with the underlying outline development plan. Staff further concludes that all requirements for a final development plan have been met. For these reasons, a recommendation of approval is given. !n regard to the platting portion of the request, Staff concludes that all requirements of the Subdivision Regulations have been met. Commissioner THOMPSON asked Mr. Gidley to address the building being larger-than that proposed by the Fruitdale Master. Plan. Mr. Gidley answered that the building was not larger than proposed by the Fruitdale Master Plan, but it was larger than__the Outline Development Plan provided for. He explained- Commissioner THOMPSON asked if semi-trucks would be servicing the businesses, and if so were the turning radii adequate and also what is the City planning to do with Tabor Street? Mr. Gidley stated that there was not adequate room to pull a semi-truck onto the site,-.turn around and pull out- He thought that smaller trucks would be servicing the businesses- He added that the applicant might be able to answer that question better. Regarding Tabor Street, which is a collector street, the only Planning Commission Minutes Page 3 October 17, 1996 -- standard the City has for a collector street, is that the right- of-way be 60 feet in width.. He elaborated. Commissioner THOMPSON asked if Mr_ Gidley thought Tabor Street would be widened in the future. The civil engineering on the project had been completed, which required bringing in fill dirt to raise the elevation. He explained how the site drains and informed those present it would be impossible to move the building five feet. He elaborated. Mr_ Bray showed a color rendering of the proposed building and emphasized that it would not be constructed solely out of "block~~. He .added that .according to the landscape plan, the landscape would_provide a natural barrier to the_east wall. Mr. Gidley stated that parapet walls could be designed to alter the roof line in order to add interest, as well. Commissioner RASPLICKA asked Mr edge" block was being used. Commissioner CERVENY-asked Mr_ Bray if there was a problem with staff's recommendation that the eastern elevation and north and south elevations of the two eastern end units .be upgraded by the use of brick or building offsets in order to avoid_an "industrial" look. Mr. Brav spoke about the .importance of constructing a development which is aesthetically pleasing, especially the front of the. _ _ development. Mr.'Gidley stated that if the .developer was also willing to upgrade the front(south) of the building, that would be great. Commissioner CERVENY asked if there could be any leniency regarding the setbacks, since the ruling had changed after he applied. Mr. Gidley answered the City Attorney had interpreted our ordinances so that if you want to allow a five-foot setback, that would require a variance- It would be a_separate issue and M Planning Commission Minutes October 17, 1990 Page 5 require a greater-than-majority vote of Planning Commission and City Council would be required. Commissioner CERVENY asked if that would require a separate motion. Mr. Gidley stated, yes, it would. He added that the setback issue should be split from the original request. Chairperson LANGDON asked if_would be .possible to take the five- foot shortage from the landscaping. Mr. Brav stated that .suggestion would not work because the large trees being retained were in .that .area, plus major drainage for the site was being channelled through there. He explained. He suggested English ivy could grow on the north side. A ten-foot setback would allow more options such as upright junipers, etc: Commissioner THOMPSON stated that she thought it was time Wheat Ridge encouraged quality developments that would attract good tenants. - - Mr. Gidley mentioned several recent developments where staff worked with the builder to provide architectural relief. He elaborated. Commissioner GRIFFITH suggested the possibility of a painted mural. She asked if there would be a fence?_ Mr. Brav answered there would be a fence along the south side. Commissioner GRIFFITH asked if there would be a fence constructed along the north side? Mr. Brav answered that the only fencing on the north would be to secure some vehicle storage, which he pointed out. Commissioner GRIFFITH reiterated that some type of painted design would dress it up. Mr. Brav answered some type of graphic-could be done; or perhaps accent striping.- He had some confusion about what the concern was about the looks of the building. Mr_ Gidley explained that staff had been given flexibility to work with developers in the past to provide some measure of visual architectural relief on the sides of the building exposed to public eye. He elaborated. Mr. Brav spoke of the importance of a unified design and not getting too many materials on the building. Mr. Sutton stated that three different types of ma-terial were being considered for the east wall, He elaborated. Mr. Sutton stated that the. carrying the color bands around to the north side would be an easy task for his company. He explained further the planned exterior materials- on the proposed building. Kim Stewart, 11700 West 46th Avenue was sworn in. Ms. Stewart stated she wanted to .raise some questions regarding this proposed development. Among her concerns were semi-truck traffic, opposition to the widening of Tabor Street and,the need for a signal light at 44th and Tabor Street- She had heard that drainage from the proposed site would be directed across Tabor Street into the property backing up to her property- She had concerns about that plan being carried through. Ms. Stewart-was concerned about the type of tenants going into the development. She wanted to'know if the neighborhood would be protected. She supported. retaining the trees on site and any architectural enhancement. There were no questions for MS_ Stewart at that time. Commissioner THOMPSON asked Mr. Gidley if he could address the drainage concerns. Mr. Gidley suggested the applicant address drainage concerns. Mr. Brat/ pointed out on the site plan projected overhead how the drainage plan would work. He stated that. the_establishment would not be retail, but mostly wholesale Discussion followed. Jerry Brown 4430 Tabor Street was sworn in. He stated he had some questions regarding drainage and semi-truck traffic. Mr. Gidley stated that the issue of semi-truck traffic was addressed when the outline development plan was reviewed. H thought deliveries would mainly be made with a step-van type of vehicle, however, from time-to-time smaller semi bob-tail type trucks could be_making deliveries. He thought if the turn-around could accommodate a 55-foot long truck, it could also accommodate a semi-truck. _ Commissioner ECKHARDT pointed out that a PCD had.been approved, and therefore .semis will be Servicing the tenants. He thought it a moot point- Mr. Brat/ explained how they had arrived at the current drainage plan. Chairperson LANGDON asked if a motion should be made regarding a variance for the five-foot setback_ Commissioner CERVENY asked if a motion for variance should be made first? Mr. Gidley suggested that Commission deal with the variance issue first,-then follow with a separate motion dealing with the balance_of site plan. He explained. Commissioner CERVENY moved that a five-foot variance be approved for the following reason: 1.~ Between the time of.application and public hearing, an ordinance was passed increasing the setback requirement. Commissioner JOHNSON seconded the motion. Commissioner THOMPSON asked Mr. Gidley if Commission-would be setting a precedent for other possible developments on Tabor. Street. Commissioner CERVENY offered to amend his motion to read that this would not establish a precedent because engineering work had been completed on this site prior to the requirement for setback had been established by the City. Mr. Gidley stated that the term "unique and unusual hardship imposed by a change in regulations in the development review process"-would be more appropriate in this case. This would identify this case as_being different from any other application at a later date. Commissioner CERVENY agreed to that amendment to his motion. Chairperson LANGDON suggested that the five feet of remaining setback could be planted in a xeriscape-type design to avoid it becoming an eyesore later on. Mr. Gidley pointed out that the back area of this.development could be the front area for someone else. Since there is not a fence proposed, that area could be incorporated into landscaping of the development to the north. The developer could work with staff to determine the size and type of shrub(s) used. Discussion followed. Commissioner ECKHARDT stated that there. had been considerable concern regarding traffic, drainage, type of tenant{s), however, those were concerns when the original PCD was approved. The plan is in accordance with the Comprehensive Plan and-the Fruitdale Valley Master Plan. Street improvements will someday be necessary to Tabor Street. Traffic on Tabor Street will not likely decrease. Motion carried 8-0. Commissioner THOMPSON asked if there was a sign on 46th and Tabor Street prohibiting large truck_tr_affic. Could anything be done. to make it more difficult for trucks to travel that area? Mr. Gidley stated a "neck down" design could be considered for several intersections.
