As this property is zoned Planned Industrial Development, any new structures on the property must be approved by way of an amendment to a final development plan. Keep in mind that any additional development on a property which already has buildings on rt allows the City to review the site in regard to existing deficiencies. In this case, the property is currently nonconforming relative to the City's standards for landscaping, parking and pazking lot paving. I will discuss these items further in this letter. In regazd to your submittal for development plan amendment, I have reviewed the document and have concluded that the following must be added to the plan face or be addressed otherwise. 1. The title of the document should read as follows: "Tract 6, Nicholas Gardens Planned Industrial Development" "Amendment No. 1" "An Official Development Plan in the City of Wheat Ridge" 2. Proof of ownership for the property as well as lease agreements between your client and the property owner 3. Legal description of the entire site 4. A complete site plan of the property including all structures, paced areas, curb cuts, pazking and drive aisles, and landscaping with a site data breakdown showing square footage for each of the categories listed above with percentage of total site 5. All existing and proposed signage 6. A landscape plan showing existing and proposed landscaping 7. Height and material of all existing and proposed fencing 8. All exterior lighting 9. Elevations of existing and proposed structures 10. Indication of all outdoor storage azeas 11. An explanation of the proposed amendment 12. Property owner's certification with notarization 13. Jefferson County Clerk and Recorder's Certificate Please be advised that the plan being proposed for the new monopole is nonconforming relative to the City's standazds relative to height and setbacks. The height limitation in Wheat Ridge in all industrial zone districts is 50' with the ability to grant a 10% variance for 55' of total height. The setback requirement fora 55' high structure on both the rear (east side) and the side (north side) is 30' and 25', respectively. As such, the case was published for public hearing on December 5th as having variances. You will need to prepaze in writing a justification of why the variances are needed for the December 5th packet. I will need fifteen copies of the revised plans no later than November 25, 1996. With the building permit issued for the new monopole, the City of Wheat Ridge will require the following improvements on the property at 4836 Van Gordon Street. 1. All parking azeas and drive aisles must be paved. A grading plan will have to bue reviewed and approved by the Department of Public Works prior to any work being done. 2. Landscaping must be installed on ten percent of the gross lot azea including but not limited to street trees at a rate of one tree In regard to your desire to place antennas on the exisiing tower at 7500 West 29th Avenue and roofinounted antennas at 8300 West 38th Avenue and 6340 West 38th Avenue, please consider the following. The ordinance we are proposing would allow additional atrtennas on existing, nonconforming towers. If the ordinance is approved with this provision, an administrative building permit approval would be required in addition to any contractual arrangements regarding placement on the lattice tower. City Council will be reviewing the proposed commercial mobile radio legislation at a public hearing held on November 18, 1996. Since Staff can not guarantee the final outcome of the public hearing, any additional work done on the three sites noted in the paragraph above should be done at your own risk. Wheat Ridge Code of Laws, Article 1, Chapter 26-5; Definitions, is hereby amended by the addition of new definitions as follows: Building or Structure Mounted Commercial Mobile Radio Service (CMRS) facility: A CMRS facility in which antenna are mounted to an existing structure (e.g., water tower, light pole, steeple, etc.} or building face. Commercial Mobile Radio Service (CMRS) Accessory Building or cabinet: An unmanned building or cabinet used to house equip- ment associated with a CMRS fiacility. Commercial Mobile Radio Service (CMRS} Site: An unmanned facility consisting of equipment for the reception, switching and transmission of wireless telecommunications, including, but not limited to personal communications service {PCS), enhanced specialized mobile radio (ESMR), paging, cellular telephone and similar technologies. Freestanding Commercial Mobile Radio Service (CMRS) facility: A CMRS facility that consists of a stand-alone support facility (monopole and/or lattice structure), antennae, associated equip- ment, accessory buildings and equipment cabinets. Roof Mounted Commercial Mobile Radio Service {CMRS) facility: A CMRS facility in which antenna are mounted on an existing building roof. Section 2. Wheat Ridge Code of Laws, Article 1 ,Chapter 26-30. General Regulations _ are hereby amended by the addition of the following new section: __ _ _ _. __ ~- {T) Commercial Mobile Radio Service {CMRS) facilities: {1) Prohibition-:- No CMRS facility shall be constructed in any residential district (with the exception of Planned Residential Districts pursuant to subparagraph (3) hereof). {2) Review Procedure: General: Proposed CMRS facilities in the RC-1, RC, C-1, C-2, I, A-1 and A-2 Zone Districts shall be reviewed pursuant to the following procedures: (a) Building or Structure MountedCMRSfacilitiesshall be reviewed by the Department of Planning and Development for compliance with the requirements of the Zoning Ordinance. (bl Roof Mounted CMRS facilities must_receive a conditional use permit; pursuant to the procedure at Section 26-6(A). (c) Freestanding CMRS facilities must receive a_ special use permit, pursuant to the procedure at Section 26-6(B)• (3) Review Procedure: Planned Development Districts: Roof mounted and freestanding CMRS facilities proposed for construction in any Planned Development District {includ- ingPlanned Residential Districts); unless specifically listed- or shown as such in the Final Development Plan, require amendment of the Final Development Plan. Building or structure mounted CMRS facilities proposed for construc- tion in any Planned Development District (including Planned Residential Districts), may be permitted by the . Department of Planning and Development pursuant to Section 26-25, provided the proposed facility is consistent with the character of the District. (4) Multiple Providers: No more than one {1)roof-mounted or freestanding CMRS facility may be constructed or maintained upon a property in single ownership, provided,- however, that additional CMRS facilities may be approved at the same location by conditional or special use review, consistent with subsection (T)(2), provided all other requirements of subsection (T} and the Zoning Ordinance are met. (b) The maximum protrusion of such facilities from the building or structure face to which they are attached shall be two 121 feet. (c) Building or structure mounted whip antennas shall extend no more than 10' above the highest point of the building or structure to which they are attached. (6) Roof Mounted CMRS facilities shall be_ screened or camouflaged as appropriate from view from adjacent property lines. Such facilities are additionally subject to the following requirements: (a) Such facilities shall be architecturally compatible with and colored to match the building or structure to which they are attached. (b) Roof mounted CMRS whip antennas shall extend no more than 10 feet above the parapet of any flat roof or ridge of a sloped roof to which they are attached. (c) Roof mounted CMRS panel antennas shall extend no more than 7 feet above the parapet of a flat roof or ridge of a sloped roof to which they are mounted. {d) Roof mounted CMRS accessory structures shall extend no more than 7 feet above any parapet of a flat roof upon which they may be placed, and shall not be permitted on a sloped roof. {7) Freestanding CMRS facilities shall be visually screened from adjacent residential development and public rights- of-way as follows: (a) All accessory buildings and equipment cabinets shall be totally screened from view from adjacent property lines. GEOV53027U 68365.2 -3- - ~ ~' (b) Screening, landscaping and/or exterior building finishes and colors shall be compatible with the existing character of .the site and adjacent properties and shall be determined as part of the special use permit review process. {8) Pursuant to Charter Section 5.10.1, and notwithstanding any other provision of this Code to the contrary, no CMRS facility shall exceed the height limit applicable to the underlying zone district in which such facility is located. (9) The construction and use of a CMRS facility shall not cause interference to other adjacent CMRS facilities. The City of Wheat Ridge shall be held harmless if interference occurs. {10) CMRS facilities which are abandoned by disconnection of power service, equipment removal or loss of lease for greater than six months shall be removed by the CMRS facility owner. Should the owner fail to remove the facilities, the City may do so at its option, and the costs thereof shall be a charge against the owner. (1 1) Notwithstanding any provision of this Section T to the contrary, any freestanding CMRS facilities legally existing upon the effective date of these regulations: November 18, 1996, shall be considered legal noncon- -- forming uses. Additional antennas may be permitted to be collocated upon such facilities, provided such facility is certified by a registered, professional engineer that it was originally desigried and constructed, without need of structural modifications, including increased height, to handle the additional load. Any such addition to noncon- forming freestanding facilities will be allowed only upon special use review and approval pursuant to Section 26-6(BI. This provision does not apply to roof or building mounted CMRS facilities. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the genera! police power of the City of Wheat Ridge, that it is prdmulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Emergency Ordinance No. 1049 Repealed. REQUEST The applicant requests approval of an amendment to a Planned Industrial Development final development plan on property located at 4836 Van Gordon. The purpose of the application is to allow the placement of commercial mobile radio panel antennas on an existing lattice tower. II. FINAL DEVELOPMENT PLAN City Council recently passed legislation relating to the erection of commercial mobile radio service (CMRS) facilities. Attached under Exhibit `A' is a copy of the new regulations. According to the new ordinance, roof-mounted and freestanding CMRS facilities are allowed in planned development districts only if specifically listed under the allowed uses of the regulating planned development. CMRS facilities not specifically listed require an amendment to the underlying final development plan. Further, additional antennas may be placed on existing nonconforming towers, following the procedure specified in the ordinance for the zone district in which the existing tower is located. In this instance, because of the PID zoning, an amendment to the final development is required to allow collocation. The development plan on the property is known as Tract 6, Nicholas Gardens Planned Industrial Development. The property has on it a steel manufacturing plant (Colorado Steel), a small house used as conunercial office space and an existing CMRS lattice tower located on the very southeastern corner of the property. Please refer to Exhibit `B' which is a reduction of the existing development plan. The existing tower which was built in the late 1980's is not shown on the existing plan. The existing lattice tower is 200' in height and is accessed by a drive ruruting from Van Gordon Street along the south side of the house. There is an existing equipment shelter structure and a 6' high fence surrounding the tower and equipment housing. The proposed panel antennas will be hung below the existing antennas at a level which is 150' above grade. An additional equipment cabinet would be installed along with the new antennas. There would be no other changes to the property. The applicant has indicated that this is a desirable site for the antennas because of the height of the existing tower. Any towers built under the new ordinance would be limited to a maximum height of 50'. The panel antennas attached at 150' above grade on the existing lattice tower would cover the same area as four CMRS towers SO' in height. Staff would note that the plan set included in the packet does not meet the requirements for an amendment to a final development plan. The provisions of Section 26-25(B)(3) of the Wheat Ridge Code of Laws would have to be met prior to review by City Council. ~~ J Planning Division Staff Report Page 3 Case No. WZ-96-12/Western PCS III. SURROUNDING ZONING AND LAND USE Adjacent zoning and land use in the azea is generally industrial in nature with PID zoning on the east and west and I zoning on the north and south. Corresponding land uses include vacant , land to the north, an office building in the process of being built to the east, a light manufacturing operation to the west and an office/warehouse/distribution facility to the south. Staff concludes that proposed plan amendment would not be incompatible with land use and zoning in the area. IV. AGENCY REFERRALS All responding agencies can provide service to the property. V. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that pursuant to new legislation adopted by City Council, an amendment to the underlying PID final development plan is required to allow collocation of CMRS panel antennas on the existing lattice tower at 4836 Van Gordon Street. Staff further concludes that the attachment to the existing tower would alleviate the necessity of several CMRS towers of a lesser height and that the proposal is compatible with adjacent land use and zoning. For these reasons, a recommendation of Approval is given for Case No. WZ-96-12 with the condition that the provisions of Section 26-2~(B)(3) of the Wheat Ridge Code of Laws be met before review by City Council. VI. RECOMMENDED MOTIONS Option A: "I move that Case NO. WZ-96-12, a request for an amendment to a Planned Industrial Development final development plan for property located at 4836 Van Gordon Street, be APPROVED for the following reasons: 1. PUBLIC FORUM (This is the time for anyone to speak on any subject not appearing under Item 7 of the Public Hearing section of the agenda) No one was present to speak. 7.- PUBLIC HEARING 1. Case No. WZ-96-12: An application by Western PCS, III for approval of an amendment to a Planned Industrial Development final development plan on property located at 4836 Van Gordon. Ms. Reckert presented Staff s report on Case No. WZ-96-12. She stated that the applicant was Western PCS, III, 2323 Delgany Street, Denver, Colorado, 80216. She presented slides to describe the surrounding area. Ms Reckert entered into the record the zoning ordinance, case file, packet materials, and exhibits. Jurisdiction was established. The Commission has jurisdiction to hear this case. Ms. Reckert gave an overview of this request. She stated the City Council had passed an Ordinance in late November, 1996, dealing with this type of facility. Generally, the Ordinance allowed these type facilities and addressed the different procedures for approval. This property is known as the Colorado Steel property requiring an amendment to the final development plan. The applicant is requesting the approval of installation of receivers on the existing tower on this property. She stated further that the existing tower is 200 feet in height which is considerably higher than the current Ordinance allows. The proposed equipment would be added to the tower at 150 feet above grade. Ms. Reckert stated that Staff is recommending approval with the condition that all the requirements for a PID final development plan be met prior to City Council Review. There were no questions posed from the Commission to Staff at this time. Chairperson WILLIAMS swore in Georgia Lichte, 2323 Delgany Street, Denver, Colorado, 80216. Ms. Lichte provided additional materials to the Commission including photo simulations. She advised the Commission that Western Wireless' purpose was to provide wireless communications service to the western states including the City of Wheat Ridge. This corporation is the first FCC auction winner to provide service to 57 rural service areas within fifteen (IS) western states and sixteen (16) metropolitan service areas. The total subscriber base is 240,000. Ms. Lichte elaborated on a few of the positive items the company has taken part in. She supported the Staff Report stating that four (4) additional towers would have to be constructed to provide the same coverage as the existing tower would allow. These items were addressed by Staff. Chairperson WILLIAMS swore in the Senior ItF Engineer, Chris Arington, 2323 Delgany, Denver, 80216. He stated that he was the Senior Engineer who designs radio frequencies. He confirmed that this vvas an ideal site for location of the receivers to provide the most coverage without having to build additional towers. Conmiissioner LANGDON inquired as to what the equipment would accomplish. Mr. Arington gave an overview in layman terms to explain the purpose of the equipment which would be installed. Chairperson WILLIAMS swore in Pat Berrit, Project Coordinator, 2323 Delgany, Denver, Colorado, 80216. Mr. Berrit advised that information had to be sent to the structural engineers of the company who constructed the tower. After review, these engineers sent a letter to Western and A&T to review. Mr. Berrit stated that AT&T would not entertain consent before reviewing the information. There were no questions asked of Mr. Berrit. Brief general discussion took place including questions regarding the red and white colors being changed, a beacon vs paint, and liability of Wheat Ridge (the City has none). Commissioner THOMPSON motioned and Commissioner ECKHART seconded, that Case No. WZ-96-12, a request for an amendment to a Planned Industrial Development final development plan for property located at 4836 Van Gordon Street be APPROVED for the following reasons: 1. A plan amendment is required to allow the collation of CMRS panel antennas on an existing tower in the PID zone. 2. The plan amendment will alleviate the necessity of additional shorter towers. Not having the additional shorter tower will increase the visual aesthetic environment in the Wheat Ridge area. 3. The plan amendment is compatible with adjacent zoning and land use. With the following conditions: The provisions of Section 26-25(B)(3) be met before review by City Council. An amendment was made by Commissioner CERVENY to include the purpose of additional receivers being placed on the existing tower vs the construction of new towers. (Item 2 was expanded to include the addition). No other discussion took place. Motion carried 7-0. Planning Commission Meeting Minutes December 19, 1996 Page 4 _ 2. Case No. PBG-96-1; An application by the City of Wheat Ridge for approval of a rezoning of property located at 11200 West 45th Avenue from Public Buildings and Facilities (PBF) to Agricultural-One (A-i) and for approval of a Special Use Permit to allow governmental buildings with outside storage and repair facilities. Ms. Reckert presented an overview of this request. The approximate area is 2.5 acres which is owned by the City of Wheat Ridge and is surrounded by low density residential development with one commercial property abutting this property to the south. Ms. Reckert entered into the record the Comprehensive Plan, the zoning Ordinance, case file and packet materials, and exhibits. Jurisdiction was established. Ms. Reckert stated that only one slide of the area could be located prior to the meeting and apologized to the Commission. Ms. Reckert stated that the main concern expressed by the neighbors in attendance at the residential meeting was that of the fencing. Ms. Reckert continued with review of the Staff Report and further stated that City Council has directed Planning to initiate rezoning of these types of properties. Gerieral questions were posed to Staff including maximum height offences, zoning, condition of the current site, possibility of a phase in program to improve appearance, consideration of a combined site location to house several departments in another area, fuel tank safety, and future residential site development. Staff addressed each concern. Chairperson WILLIAMS swore in Kent Young, l 1280 West 46th Avenue, Wheat Ridge. Mr. Young stated his concerns regarding living close to this facility was that the when the "red barn" (sand and salt storage dome) was built and blocked out the view. He stated that the function of the facility was fine overall but that the materials delivery trucks during the evening and night were cause of a loud banging noise when emptied. He prefers not to see another red bazn type building and felt that the operation and addition would be fine. No questions were posed to Mr. Young. General questions were posed to Staff including the responsible parties for the building of the storage dome. Director Goebel of Public Works stated that the facility was constructed during the tenure of the previous Director. Mr. Young said that there was no wazning or advisement of the residents at that time. Director Goebel advised the Commission that during the neighborhood meeting the noise issue was presented and since then a directive was issued to discontinue the banging/throttling of hydraulics to alleviate the noise. Other questions involved landscaping, planting around power lines, Council concerns, other possible neighborhood concerns, and other general construction questions of the new building. Discussion also took place regarding the possibility of relocation of the entire facility to another area and suggestion that other departments such as Parks and Recreation could also be included in the use of the new facility. Various locations were suggested. Director Gidley suggested that Planning Commission Meeting Minutes December 19, 1996 Page 5 _ the Commission recommend to City Council to up-grade the appearance of the facility to improve the neighborhood or move it to another azea perhaps as a phase-in plan. It was also suggested that a time frame be established to accomplish the either the construction of the new building or investigation into a new location. The Planning Commission believe a wiser future planning and use of public funds would be to seek out another appropriate location and move this facility thus the current residential location would be enhanced, the City would still be serviced, and the new facility could incorporate other department employees as well. Commissioner CERVENY motioned, seconded by Commissioner JOHNSON, that the request for approval of a rezoning from Planned Buildings and Facilities to Agricultural-One for property located at 11200 West 45th Avenue be APPROVED for the following reasons: 1: It will bring the use of the property and zoning into conformance. 2. City Council directed Staff to initiate rezoning on all nonconforming City-owned properties, and 3. Staff recommends approval. No further discussion was held. Motion carried 7-0. Commissioner CERVENY motioned, Commissioner JOHNSON seconded, that the request for Special Use to allow governmental facilities with outside storage and repair for property located at 11200 West 45th Avenue be DENIED for the following reasons: 1. There may be a better alternative of seeking another location for this facility. 2. Other City departments may be able to share the new facility. 3. The present location is not compatible. 4. There is no opportunity to expand the current facility due to it being located in a residential azea. 5. It would be economically feasible for the City to combine operations, specifically Public Works and Parks Departments, into one site. Motion to deny 7-0. Discussion was held regarding making a motion to refer to City Council an alternative plan for this alternative site plan. Commissioner THOMPSON motioned, Commissioner JOHNSON seconded, that a professional engineering firm be contracted that specializes in public facilities, locations, and design, to evaluate locations and possible site design with the initial evaluation process being completed within three months after this matter goes before City Council. Planning Commission Meeting Minutes December 19, 1996 Page 6 Motioscanied 7-0. Summary of the motion regarding the Planning Commission concerns include: 1. The property should be zoned agricultural. 2.- The location of this facility is incompatible with the neighborhood. 3. The facility should be relocated. 4. A study should be completed in a timely fashion so that this project is completed prior to next winter. 5. Consolidation be considered for Public Work/Parks and Recreation Departments in the same facility. 6. Both department operations are considered industrial/commercial in use and they are both adjacent to residential neighborhoods. 7. If the construction does occur at the current location that the City provide a higher level of aesthetic improvements. 9. OLD BUSINESS Director Gidley advised the Commission of three items which have gone before City Council; the 29th Avenue Mass Rezoning -approved (they did exempt the property as designed by the Planning Commission on Ames Street); the Schneider proposal of a combination rezoning/subdivision and variance -denied, Mr. Schneider is currently redesigning his subdivision and will be before City Council 1/13/97; emergency ordinances were adopted - 90-day moratoriums leave been placed on R-2, 2A, 3, and 3A and two (2) family/mufti-family building permits both of which maybe extended. 10. NEW BUSINESS Director Gidley advised that a Wadsworth Corridor Meeting will take place on January 28, 1997 at 7:00 p.m. in the Council Chambers and a Planned Neighborhood Meeting will occur on January 30, 1997, at 6:00 p.m. at38th and Kipling. Director Gidley asked the Commission if they would like to see the letter before it is mailed to the property owners. It will be made available for their review. il. DISCUSSION AND DECISION ITEMS Commissioner ECKHARDT told of some observations he made regarding the revamping of courtyard areas during his recent trip to South America. Commissioner LANGDON shared conversation he had with a citizen who was concerned about the wastewater odor problem. REQUEST. _ _ __ The applicant requests approval of an amendment to a Planned Industrial Development final development plan on property located at 4836 Van Gordon. The purpose of the application is to allow the placement of commercial mobile radio panel antennas on an existing lattice tower. II. FINAL DEVELOPMENT PLAN City Council recently passed legislation relating to the erection of commercial mobile radio service (CMRS) facilities. Attached under Exhibit `A' is a copy of the new regulations. According to the new ordinance, roof- mounted and freestanding CMRS facilities are allowed in planned development districts only if specifically listed under the allowed uses of the regulating planned development. CMRS facilities not specifically listed require an amendment to the underlying final development plan. Further, additional antennas may be placed on existing nonconforming towers, following the procedure specified in the ordinance for the zone district in which the existing tower is located. In this instance, because of the PID zoning, an amendment to the final development is required to allow collocation. The development plan on the property is known as Tract 6, Nicholas Gardens Planned Industrial Development. The property has on it a steel manufacturing plant (Colorado Steel), a small house used as commercial office space and an existing CMRS lattice tower located on the very southeastern corner of the property. Please refer to Exhibit `B' which is a reduction of the existing development plan. The existing tower which was built in the late 1980's is not shown on the existing plan. The existing lattice tower is 200' in height and is accessed by a drive running from Van Gordon Street along the south side of the house. There is an existing equipment shelter structure and a 6' high fence surrounding the tower and equipment housing. The proposed panel antennas will be hung below the existing antennas at a level which is 150' above grade. An additional equipment cabinet would be installed along with the new antennas. There would be no other changes to the property. The applicant has indicated that this is a desirable site for the antennas because of the height of the existing tower. Any towers built under the new ordinance would be limited to a maximum height of 50'. The panel antennas attached at 150' above grade on the existing lattice tower would cover the same area as four CMRS towers 50' in height. Staff would note that the plan set included in the packet does not meet all of the requirements for an amendment to a final development plan. The provisions of Section 26-25(B)(3) of the Wheat Ridge Code of Laws would have to be met prior to plan recordation with Jefferson County. III. SURROUNDING ZONING AND LAND USE Adjacent zoning and land use in the area is generally industrial in nature with PID zoning on the east and west and I zoning on the north and south. Corresponding land uses include vacant land to the north, an office building in the process of being built to the east, a light manufacturing operation to the Planning Division Staff Report Case No. WZ-96-12/Western PCS Page 4 west and an office/warehouse/distribution facility to the south. Staff concludes that proposed plan amendment would not be incompatible with land use and zoning in the area. IV. AGENCY REFERRALS All responding agencies can provide service to the property. V. PLANNING COMMISSION ACTION The Planning Commission reviewed this requests at a Public Hearing held on December 16, 1996. A recommendation of approval was given for the following reasons: 1. A plan amendment is required to allow the collation of CMRS panel antennas on an existing tower in the PID zone. 2. The plan amendment will alleviate the necessity of additional shorter towers. Not having the additional shorter tower will increase the visual aesthetic environment in the Wheat Ridge area. 3. The plan amendment is compatible with adjacent zoning and land use. With the following condition: The provisions of Section 26-25(B)(3) be met before review by City Council. VI. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that pursuant to new legislation adopted by City Council, an amendment to the underlying PID final development plan is required to allow collocation of CMRS panel antennas on the existing lattice tower at 4836 Van Gordon Street. Staff further concludes that the attachment to the existing tower would alleviate the necessity of several CMRS towers of a lesser height and that the proposal is compatible with adjacent land use and zoning. For these reasons, a recommendation of Approval is given for Case No. WZ-96-12 with the condition that all the provisions of Section 26-25(B)(3) of the Wheat Ridge Code of Laws be met before recordation with Jefferson County. VII. RECOMMENDED MOTIONS Option A: "I move that Case NO. Case No WZ-96-12: An application by Western PCS, III for approval of an amendment to a Planned Industrial Development final development plan on property located at 9836 Van Gordon. Ms. Reckert presented Staff s report on Case No. WZ-96-12. She stated that the applicant was Western PCS, III, 2323 Delgany Street, Denver, Colorado, 80216. She presented slides to describe the surrounding azea. Ms Reckert entered into the record the zoning ordinance, case tile, packet materials, and exhibits. Jurisdiction was established. The Commission has jurisdiction to hear this case. Ms. Reckert gave an overview of this request. She stated the City Council had passed an Ordinance in late November, 1996, dealing with this type of facility. Generally, the Ordinance allowed these type facilities and addressed the different procedures for approval. This property is known as the Colorado Steel property requiring an amendment to the final development plan. The applicant is requesting the approval of installation of receivers on the existing tower on this property. Slie stated further that the existing tower is 200 feet in height which is considerably higher than the current Ordinance allows. The proposed equipment would be added to the tower at 150 feet above grade. Ms. Reckert stated that Staff is recommending approval with the condition that all the requirements for a PID final development plan be met prior to City Council Review. There were no questions posed from the Commission to Staff at this time. Chairperson WILLIAMS swore in Georgia Lichte, 2323 Delgany Street, Denver, Colorado, 80216. Iv1s. Lichte provided additional materials to the Commission including photo simulations. She advised the Commission that Western Wireless' purpose was to provide wireless communications service to the western states including the City of Wheat Ridge. This corporation is the first FCC auction winner to provide service to 57 rural service areas within fifteen (1~) western states and sixteen (16) metropolitan service areas. The total subscriber base is 240,000. Ms. Lichte elaborated on a few of the positive items the company has taken part in. She supported the Staff Report stating that four (9) additional towers would have to be constructed to provide the same coverage as the existing tower would allow. She stated that the comp<~tny's intent was to make the installation as inconspicuous as possible. Brief general discussion was held including confirmation that the existing tower belonged to AT8cT, how many receivers could/would be placed on the tower, area covered, other tower Planning Commission Meeting Minutes December 19, 1996 Page 3 alternatives, if other companies could request the same thing, reconstruction if tower was destroyed, and painting requirements. These items were addressed by Staff. Chairperson WILLIAMS swore in the Senior RF Engineer, Chris Arington, 2323 Delgany, Denver, 80216. He stated that he was the Senior Engineer who designs radio frequencies. He crnifirmed that this was an ideal site for location of the receivers to provide the most coverage without having to build additional towers. Commissioner LANGDON inquired as to what the equipment would accomplish. Mr. Arington gave an overview in layman terms to explain the purpose of the equipment which would be installed. Chairperson WILLIAMS swore in Pat Berrit, Project Coordinator, 23? i Delgany, Denver, Colorado, 80216. Mr. Berrit advised that information had to be sent to the structural engineers of the company who constructed the tower. After review, these engineers sent a letter to Western and A&T to review. Mr. Berrit stated that AT&T would not entertain consent before reviewing the information. There were no questions asked of Mr. Berrit. Brief general discussion took place including questions regarding the red and white colors being changed, a beacon vs paint, and liability of Wheat Ridge (the City has none). ` Commissioner THOMPSON motioned and Commissioner ECKHART seconded, that Case No. 4VZ-96-12, a request for an amendment to a Planned Industrial Development final development plan for property located at 4336 Van Gordon Street be APPROVED for the following reasais: 1. A plan amendment is required to allow the collation of CMRS panel antennas on an existing tower in the PID zone. 2. The plan amendment will alleviate the necessity of additional shorter towers. Not having the additional shorter tower will increase the visual aesthetic environment in the Wheat Ridge area. 3. The plan amendment is compatible with adjacent zoning and land use.
