I prepared this report with a very experienced structural engineer, Robert Parkhurst. I will refer to his. findings, but the full structural report and the floor and roof plans are attached. Bill Jacob of Danish Craftsmen, Inc. assisted us in preparing a cost estimate for the work outlined in the scope of work we developed. Danish Craftsmen is a local firm known for high quality construction work, with experience in the restoration of historic buildings. DESCRIPTION OF THE BAUGH HOUSE The Baugh House is named for its original owner/builder, James Baugh, an eazly Colorado pioneer. The house consists of a 1-1/2 story hand hewn, v-notched log cabin with an attached stone aggregate cold storage room, imbedded in a late victorian clapboard farmhouse. The log cabin portion of the house apparently dates from 1859 and the clapboard farmhouse apparently dates from about 1890. There were some alterations to the house made in the 1960's and 1970's, primarily the construction of a patio room off the east side of the stone room. The house is in its original location which is now a 3 acre site and includes outbuildings. The house suffered a fire, apparently due to azson, in 1994. James Baugh's original 160 acres was a very active fazm for at least 20 years, located on the main road between the growing town which would become Denver and the mining communities further up Clear Creek. Farm produce and products were undoubtedly in great demand during the early pioneering years in Colorado, pazticulazly before the railroads were established. While the log house and stone walled cold storage room apparently served the needs of the pioneer farmer, Baugh, by about 1890, the new owners of the property decided to build a modern, up to date house. These new owners found that they could save money by adding on to the existing log house and framed the new house around the old log cabin. At the same time, 100 years ago, the old 160 acre homestead and farm was beginning to be sold off in smaller pieces so that all that remains today is the core of the farm on 3 acres. REVIEW,AND EVALUATION OF THE EXISTING HISTORICAL DATA ABOUT T13E BAUGH HousE I reviewed the material on file at the Wheat Ridge Historical Society library concerning James Baugh and his property. The historic documentation included copies of U.S. government records relating to Baugh's grant of 160 acres for his farm in the valley on Clear Creek. The records show that James Baugh was born ~ ~ in Missouri on Feb. 6, 1832 and he arrived at Cherry Creek in what was to become Colorado Territory on June 1, 1859. The records show that Baugh was living on the land grant of 160 acres and began establishing his farm (which included the present day 3 acre site) by August 15, 1859. The log house is described in these records as " 1 1/2 stories with a wood shingle roof and a plank floor with 2 doors and 2 windows, a comfortable house to live in." According to the records, Baugh had 70 acres under cultivation in the early 1860's. The location near Clear Creek allowed him to establish ditches for irrigation and State water records show a May 15, 1860 date for the ditch. Baugh owned the property until 1889, and the next owner had the property until 1929. Building department records for much of the 19th century are non-existent for this area which later become Wheat Ridge, so it is difficult to put an exact con- struction date on the various portions of the house. However, I feel that the docu- mentary records are quite clear that the log portion of the house was built.at the earliest in 1859 or at the latest, within a year or two of that date. For future research, it is possible that_dendrochronology (tree-ring dating) could be used to show when the logs were, cut and therefore when construction began. There are no records regarding the stone store room addition, but I expect that it was built fair- ly early because a farm with 70 acres under cultivation would require cold storage for the produce before it was sold or shipped to the burgeoning mining camps or to the rapidly growing towns at the confluence of the South Platte and Cherry Creek. I expect that with additional research, an exact construction date for the clapboard farmhouse could be established, but I estimate a date of about 1890, based on doc- uments as well as the chazacteristics of the construction itself. SUMMARY OF THE EXISTING CONDITIONS AND EVALUATION OF THE ARCHPPECTURAL INTEGRITY The structural engineer and I found the house to be in surprisingly good condition for a building which has endured a fire. The fire damaged a few areas of the exterior walls but the worst damage was to the roof structure and interior walls of the upper floor. Structural repairs can be made without major demolition by "surgically" replacing badly burned individual framing members -rafters, studs, sheathing boazds, and leaving the intact framing members that are merely scorched in place. Repair of the areas of fire damage on the exterior walls is a mat- ter of simple replacement with new clapboards, decorative shingles and wood trim, milled to exactly match the existing original material. The log portion of the house is in excellent condition, since it has been pro- tected from the weather for nearly 100 years. The logs were very carefully hand hewn and squared and laid in alternating layers with v-notch corner joinery. The log structure exhibits high quality craftsmanship. When the clapboard farmhouse was constructed, the builders cut the logs of the west wall of the 1st floor to open the structure to the new staircase and additional rooms to the west. The logs extend above the first floor and are clearly visible in the walls of . the upper floor. Before the roof of the clapboard fazmhouse could be framed, it was necessary to remove the original roof structure of the log cabin. Much of the clapboard farmhouse is also in good condition. Except for the patio addition to the east, the exterior appeazance of the c.1890 farmhouse is ~ remarkably unchanged and in original condition. The 1960's /1970's era patio addition is in very poor condition. The construction of this addition was inferior quality, and apparently the flat roof has been leaking for many years. This addi- tion detracts from the design of the fine 1890's farmhouse and needs to be removed. In summary, the house, in spite of the fire, possesses enough original his- toric fabric from both the 1858 and 1890 periods of construction to retain its archi- tectural and structural integrity. Integrity, when discussing historic structures, is defined by the National Register of Historic Places as "the ability of a property to convey its significance." What that means for the Baugh House is that it is in its original location and has changed very little, even with the fire, and the repairs can be made in such a way that most of the historic fabric in the house will be retained and preserved. EVALUATION OF THE PROPERTY IN TERMS OF THE ELIGIBILI'T'Y REQUHiEMENTS FOR THE STATE AND NATIONAL REGISTER OF RISTORIC PLACES The National Register of Historic Places and Colorado's State Register of Historic Places use the same set of criteria for evaluating significance in an his- toric property, but the State Register is slightly less strict in certain aspects. The Baugh House meets three of the four criteria for significance and only one area of significance is necessary to nominate a property to the National Register. Criteria B - "properties associated with individuals whose specific contributions to history can be identified and documented." The log portion of the house was built and occupied by James Baugh most of his life, from 1859 to about 1889, and Baugh was an important settler and pioneer farmer in this part of Jefferson County. There is excellent historic documentation about James Baugh, including material in the local history books. Criteria C - "properties significant for their architectural design or construction - must embody distinctive characteristics of a type, period or method of construc- tion." First of all, the Baugh House is significant as an extremely rare house type with the early pioneer cabin being enveloped by a later but also significant farm- house. What is significant is the evolution of the house, the combination of the two houses into one. The log structure alone does not possess sufficient integrity to meet the criteria of significance, but it is vitally important as part of the historic whole. Generally these pioneer log structures were either demolished or relegated to outbuildings, barns or livestock sheds when the new house was built. It is extremely rare to find a cabin of this very early age in Colorado. Other than the Four Mile House, I know of no other structures from this period in the metropoli- tan Denver area on their original sites. Additionally, the 1890 farmhouse is a very good example of its type and style. Stylistically, it has late victorian characteris- tics with some colonial revival elements. Criteria D - "properties (generally archaeological) which may be likely to yield information important in history." An historical archaeologist should have a look at this property, because I believe that there is great potential for historic archae- ology on this site. There are simply very few sites that can be dated to that 1859 period. This property, in meeting the criteria for the National and State Registers, should be nominated for both and it is possible to obtain a small grant from the State Historic mind to pay a professional to prepare the nomination forms. , In being listed on the State Register, the owner of the property becomes eligible to apply for grant funds up to about $100,000.00 per grant or more for a project accomplished over a period of time. Wheat Ridge would be in a excellent position to apply for these funds since publically owned buildings get a very high priority for funding. SCOPE OF WORK (preliminary} Demolition: 1. modern era patio addition, and concrete patio floor 2. modern era kitchen in stone portion of house a. all kitchen cabinets and appliances b. all kitchen carpet a all kitchen sheetrock and studs d. all kitchen ceiling boards _ 3. shelving in 1st floor west bedroom/library 4. all visible portions of former hot water heating system (baseboards and piping) 5. all modern era plumbing fixtures 6. modern era wood ceiling boards and wood wall paneling in lst floor log room 7. water damaged plaster ceiling in 1st floor west parlor 8. structurally inadequate, burned lumber in roof framing system (leave lumber that is simply charred in place) Site Work: 1. regrade around the house to promote positive drainage Structural Work: 1. reinforce/replace unsound portions of the stairway, upstairs walls and roof structure and sheathing, using methods to preserve as much original his- toric fabric as possible 2. remove the wood post and composite wood beam (modern era) from the 1st floor log room and install new steel beams, hidden in the ceiling fram- ing system above the log room. Roofing: 1. remove existing layers of roofing, and re-roof with sawn cedar shingles and stain black with oil-based stain to match original shingles Interior: 1. Floors a. replace areas of damaged wood flooring with new flooring to match existing, clean and refinish 2. Walls/Ceilings a. repair lath and plaster where possible (small repairs, primarily on 1st floor) b. install new sheetrock to walls/ceilings and finish smooth to look like plaster (large areas where fire and water damaged the original lath and plaster) c. repair all wood trim in interior or replicate to match original (casings, t base boards, etc.) d. paint all plaster and sheetrock, refinish (as needed) all wood trim 3. Windows/Doors a. replicate missing window sash/frames with new sash to match original b. restore existing original window sash frames c. replicate missing doors to match original d. restore existing original doors 4. Electrical System a. repair/replace the existing electrical system including historir/period fixtures 5. Heating System a. replace the existing heating system with a new, unobtrusive forced air system 6. Plumbing System a. repair plumbing as necessary to make the 1st floor bathroom opera- ble, replace the existing bathroom fixtures with historidperiod fix- tures b. replace the 2nd floor bathroom fixtures with historidperiod fixtures (it is not necessary for this bathroom to be operable) Exterior 1. Cladding a. replace fire damaged wood sheathing boazds, clapboards, trim, mold- ings, and decorative shingles as needed with new material to match existing original b. scrape, sand and repaint the entire exterior RECOMD~NDATIONS: Based on my reseazch and my evaluations I most strongly recommend that the Baugh House be preserved and restored on its original site. I believe that it is an extremely significant property, both architecturally and historically and per- haps azchaeologically. But again I emphasize that it is significant as it evolved, a combination of two building periods, not as a log cabin alone. It is also significant that the building remains in its original location, the surviving acreage of the orig- inal 160 acre homestead - it should not ever be moved. I believe the funds required to acquire and restore the structure would be appropriate and well spent. Additionally, there are tremendous opportunities for grant money through the State Historic Fund (income from the gambling towns, not tax dollars) to help pay the costs of restoration. IVANHOE, SUITE 208 DENVER, CO 80222-5-750 (303) 584-9481 FAX (303) 584-9482 January 9, 1997 Merrill Wilson 32351 Horseshoe Dr. Evergreen, Co 80439 Dear Merrill, Structural Investigative Report Baugh Property 11361 West 44th Ave. Wheat Ridge, Colorado I performed on site structural investigations of the above referenced property on January 7th and 8th, 1997. In particular, the two story structure located in the southwest corner of the property, is the focus of this report (see figure 1, site plan). Observations were performed without destructive means which will limit the scope of this report to items which were openly visible at this time. Some of the foundations were observable as was most of the roof framing. Referring to figure 2, first floor plan, 950 of the logs in the "log parlor" were visible. Walls noted as 2 x 4 stud construction-were covered at this time thus not observed. First and second floor joists also were hidden from view for the most part. Based on these limitations the following findings and recommendations are presented: General F~amina Systems The structure consists of a main log portion shown as crosshatched walls in figure 2. This log portion consists of hand hewn logs typical of mid to late 1800 's construction. Surrounding the log parlor on the west and south sides is a two story wood framed Victorian style addition. Construction techniques noted date to the late 1800's era. This addition also appears to have created a second floor over the "Log Parlor". Also at the time of this addition, wood framed floors on the first floor were added throughout the Victorian and "Log Parlor" portion of the structure. At the southeast corner of the "Log Parlor" a stone aggregate structure was added. This is noted in figure 2 as the "Stone Kitchen". A wood framed roof supported by stone aggregate walls 1 foot thick are the primary structural systems in this area. The walls appears'to be constructed of 1" to 2" diameter river rock set in lime and sand mortar beds. 1/4 A hard coat has been applied to both inside and out thus. preserving the relatively soft mortar material. This stone construction is hard to-elate as it appears to have been constructed in a unique manor with very basic materials. East of the Log Parlor an addition titled "East Bay" was constructed with wood framing. Techniques incorporated were from a later date than the Victorian addition. East of the Stone Kitchen and Log Parlor is located a "1960's era Patio Addition". Referred to as a patio addition due to the fact is was constructed on an old patio and garage slab. This area is wood framed with conventional framing members typical of the 1960's. Foundations were observable only under the Victorian addition, Stone Kitchen and 60's Patio. The Victorian foundation consists of large aggregate-concrete type. Cement material is heavy in lime content. These foundations are shallow with none seen deeper than about 1 foot. The Stone Kitchen is founded on a concrete footing. This was-noted to extend beyond the outside face of the wall indicating a well distributed soil bearing condition. The 1960's additions were constructed on existing concrete slabs. These slabs appear to be similar to modern day Portland cement type. As stated previously, the foundation of the Log Parlor was not visible at this time. Present Condition of Foundations and.Framino Svstems General condition of the structure is good with the exception of fire damaged areas. This fire occurred in May, 1994. Damage to the structure occurred mainly to the roof framing of the second level and some minor damage to walls as noted. The Log Parlor area is in exceptional condition at this time.- Referring to figure 2 it is noted.-three sides of .this room have been protected from external elements for many year. Note that prevailing winds occur from the west and northwest direction. With the addition of the Victorian portion occurring early in the life of the log structure, these logs have been well protected. Chinking is in good condition with some minor areas in need of attention. Lower logs near the soil appear in solid condition with very little signs of moisture. Note the front porch on the south side is adjacent to the logs. Due to the roof over this porch, good weather protection-has been provided in this area. This is the most susceptible area and yet no signs of deterioration were 2/4 lofa)nisanotedsin1figures3casdtheoEasto(Log)sBedroom1Closet and bath. This floor is constructed with 2 1/4" x 8" wood joist spanning about 16 feet. Due to this excessive span, a shore beam was added with a column in the center of the Log Parlor. •With the addition of this shore beam, the floor is relatively newtahistoriccconsideratpiona mighttwarrantrthe is removal of the columns. This could be achieved with the use of hidden steel beams. The roof over this area has experienced heavy fire damage. Replacement and/or sister framing would be necessary east of the dormers. The two dormer, see figure 4, can remain as is. Restructuring of this portion of the roof would requixe a new ridge beam. The log walls of the Log Parlor extend 3 feet above the second floor. -Due to the lack of collar ties in this area lateral thrust of the rafters has kicked the wall logs to the outside about 1". By using a ridge beam this problem could be rectified. The Victorian addition is in good condition with some exceptions. .Due to the presence of a fairly good foundation under the exterior walls, the structure appears in good alignment. First floor framing of 2" x 8" wood joists seems to be in good condition. These can be observed in the furnace pit (see. figure 2}. The joists appear to bear directly on the soil probably on wood sill plates. Some deterioration of the joist near the pit area was noted, however as a whole the floor joists seem in good condition. Floor joists cut to form the pit opening should be shimmed to bear on the pit walls.- This will limit any further movement noted on the north wall of the stair.- The stairs have been fire damaged and should be replaced as required. The soil under the joists appears to be very dry which would inhibit wood rot. Second floor construction of the Victorian addition 'is 2 x 8 joist at 16". Excessive deflection of the joist over the west parlor was noted. This is due to the_16' span of these joists. Roof framing is bearing on some of these joists as well. Due to fire damage to the roof in this area, restructuring will be necessary. With the use of a new ridge beam, Ioads can be minimized on the floor joists in this area. The roof ever the north bedroom can be restructured in a similar fashion. The Stone Kitchen appears in good condition at this time. Heavy vine growth on the exterior walls should be eliminated. Due to the strength of 1 foot thick stone walls, this area needs- little attention. The 60's additions are in good condition at this time. Some water damage has occurred to the roof to the patio addition. New roofing will be necessary in this area. 3/4 t~ - Conclusions General structural conditions of the building varies from excellent to poor.- The original log building has been well protected most of its_life by the Victorian addition on the windward side. Several other additions over the years have almost completely encapsulated the logs. A recent fire has heavily damaged the roof over the second floor. This portion of the building will need to be rebuilt in some areas by the use of sister rafters and new ridge beams. Most of the ornate dormers and all the second floor walls can be salvaged. Renovation of the roof can be accomplished with little loss of the original configuration with almost all details remaining as is. Foundations under condition. Some minor areas. Due to the age of the building, moisture can deteriorate structural elements rapidly. Immediate shoring of the second floor roof should be done. I have reviewed the plan and have the following comments: I. The standard street section for Robb Street is 25' from the centerline to the property line. If the r-o-w is currently substandard in width, a dedication will be required to meet the half width standard. 2. The standard street section for West 44th Avenue is from the centerline to the property line. If the r-o-w is currently substandard in width, a dedication will be required to meet the half width standard. 3. A fifteen foot corner right-of--way dedication will be required at the intersection of the two streets. 4. Zoning on the property is currently A-I. A rezoning to a new zone designation will be required to receive the proper approval. Staff would recommend a Planned Residential Development zone as chances of success may be better than a straight zone classification. The rezoning process in the City of Wheat Ridge can take from four to six months. 5. Required setbacks from both West 44th Avenue and Robb Street is 30' from the new property lines (after right-of--way dedication). 6. A minimum of 25 percent landscaped coverage will be required. 7. Parking will be required at a rate of 1.5 spaces per each one bedroom unit and Z spaces per each two or three bedroom units. 8. The northern curb cut on Robb Street should be located 25' from the adjacent property fine. 9. A six-foot wide landscaped buffer with a 6' high solid fence will be required along the north property line. 10- The current development proposal of nine units per acre fits within the City's definition of medium density housing. This property is designated as medium density residential C~ ri E~..: , ~-P. pF~,t:. • in the Fruitdale Valley Master Plan which is used as a guide for rezoning. I would encourage you to work with the neighborhood, particularly the adjacent property owners, regarding design issues. In Wheat Ridge, neighborhood support can seriously affect the outcome of rezoning proposals. 11. The proposed development plan does not show the log house as remaining on site. At their October 28 meeting, City Council passed a temporary moratorium on demolitions of buildings built before 1875. Please refer to the attached emergency ordinance. This new legislation will affect the subject property. Keep in mind this is a highly sensitive matter which should be handled carefully. I would encourage you to work with Gary Wardle, the City' Director of Pazks and Recreation, regazding this issue. There may be other issues which I haven't addressed. I have the following recommendations: LANDSCAPE: (If developer is responsible for landscape design.) 1. All trees to be trimmed of branches up 6'-8' from the ground to allow for natural visual observation from surrounding areas to the parking lots and building. 2. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 3. Plants/landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. TRASH ENCLOSURE: Fencing/wall and gate should be constructed of a material that will allow observation through the structure to lower the risk of criminal activity occurring in and around the enclosure. PERIMETER FENCING: The fencing should be finished with an anti-graffiti paint or sealant toaid in the ease and promptness of clean-up of any type of graffiti or tagging vandalism. SITE: During construction, the property should be clearly posted with "No Trespassing" signs. This is deter trespasses, and allow the Police Department to cite offenders with the crime along with any others offenses that may be committed by trespassers. LIGHTING: Exterior lighting should be a minimum of .4 foo candle maintained. From these plans, I have no further recommendations at this time. Revisions in the plans, may alter my recommendations. While my recommendations do not guarantee acrime-free environment, it has been experienced that application of the concept of Crime Prevention Through Environmental Design (OPTED) will reduce the opportunity for crime to occur and will enhance the quality of life. J ~' • • P Planning Commission Staff Report December 27, 1996 Page 2 . _ REQUEST The applicant requests approval of a rezoning from Agricultural-One to Planned Residential Development and for approval of an outline development plan on property containing 2.7 acres . located at the northeast corner of West 44th Avenue and Robb Street. II. OUTLINE DEVELOPMENT PLAN The applicant is requesting only rezoning and outline development plan approval at this time. The outline plan is intended as serving as a general guide for development. Allowable densities, maximum building height, minimum perimeter setbacks and the general character of the project aze established at this time. Final development plan and plat approval aze required prior to any building permits being issued for the property. The submitted outline plan shows a development plan with a maximum density oftwenty-six (26) units broken down into eleven (11) townhome type units along West 44th Avenue on the southern one-third of the lot and fourteen (14) duplex units and one (1) single family unit on the northern two-thirds of the property. The development will be accessed by two curb cuts on Robb Street. There will be no access to West 44th Avenue. Maximum building height will be thirty- two (32) feet. Minimum perimeter setbacks will be thirty (30) feet along both 44th Avenue and Robb Street, twenty (20) feet on the rear (east side) and ten (10) feet on the north side. There will be a minimum of 25% landscaped coverage. Aside from dome minor typographical errors, Staff concludes that the requirements for a Planned Residential Development final development plan have been met. The City of Wheat Ridge is considering buying all or a portion of the property for parkland purposes. The their December 18, 1996, meeting, City Council authorized a study by an architect who specializes in historic preservation to determine the potential of refurbishing the historic buildings on the property. III. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a rezoning request. That the change of zone is in conformance, or fvill bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive Land Use plan and other related policies or plans for the area. Planning Commission Staff Report December 27, 1996 Page 3 _ The property is designated as Medium Density Residential in the Fruitdale Valley Master Plan. In the Comprehensive Plan, medium density residential is defined as containing seven to thirteen residential units per acre. The development proposal of 26 units on 2.7 acres (without street dedications) results in a density of 9.6 units per acre, thus allowing confortnance with the City's comprehensive plan. The proposal is consistent with the goals and objectives of the Fruitdale Master Plan for land use transitions. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. Adjacent zoning and land use surrounding the property include an equipment rental business with Restricted- Commercial zoning to the west, low density development with R-1 zoning on the east, and A-1 zoned property to the north which is used agriculturally and as low density residential. Abutting the property to the south across W. 44th Avenue is City-owned parkland with A-1 zoning and a duplex development with Planned Residential Development zoning which was approved in 1994. The proposed medium density, duplex and townhome development would not be inconsistent with adjacent property zoning and development. It would also provide a land use transition with multi-family along 44th Avenue, and duplexes farther north transitioning into the single family neighborhood farther north on Robb Street. 3. That there will be social, recreational, physical and/or economic benefits to the community der-ived by the change of zone. The property has historically been a "problem" property from a Code Enforcement perspective, therefore, development of it could result in a social benefit. Increased tax base and actual construction revenues would provide an economic benefit to the City. Development of all or a portion of the land into parkland would provide a recreational benefit. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that tltc applicant will upgrade and provide such where they do not exist or are under capacity. All outside agencies can provide service to the property with the cost of which would be paid for by the developer. 5. That the proposed rezoning will not adversely affect public health, safety or Fvelfare by creating excessive traffic congestion, create drainage problems, or seriously reduce light and air to adjacent properties. Traffic generated by the development would increase the number of vehicle trips on Robb Street by roughly 260 trips per day. Drainage on the property would have to follow historic flows. As ~. Planning Commission Staff Report December 27, 1996 Page 4 no structure would exceed thirty-two (32) feet in height, there will be a minimal reduction of the amount of light and air to adjacent properties. 6• That the property cannot reasonably be developed under the existing zoning conditions. The current A-1 zone district regulations allow a range of uses from single family residential to general farming. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. There is Planned Residential Development zoning in the near vicinity, therefore, spot zoning is not a concern. S• That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. It is impossible for Staff to ascertain whether the change in zone will fill a void in services, products or facilities. Staff has concluded that the rezoning would be consistent with the designation within the Fruitdale Valley Master plan and the goals and objectives of the plan by providing a land use transition from the multi-family development along W. 44th Avenue, to duplexes and then to low density residential-use farther to the north. Since the proposal is not inconsistent with adjacent land used and zoning, Staff concludes that the criteria support approval of this request. IV. Valley Water District will require a water mainline extension at the developer's expense. City Works Department has reviewed a preliminary drainage report and preliminary plat and is asking for revisions. Access to West 44th Avenue will not be allowed. City Forestry Division is requesting that the healthy, mature trees on the property, including a 56" caliper cottonwood and a 14"caliper blue spruce, be saved. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff has concluded that the proposed rezoning with 26 dwelling units and a resultant density of 9.6 units per acre is consistent with the medium density residential designation in the Fruitdale Valley Master Plan. Staff further conclude that the proposal provides a land use transition and is not incompatible with adjacent zoning and land use. Since the evaluation criteria Support approval and aside from minor typographical errors, all the requirements for an outline development plan have been met, a recommendation of Approval is given for Case No. WZ-96- 16. VII. RECOMMENDED MOTIONS Option A: "I move that Case No. WZ-96-16, a request for approval of a rezoning from Agricultural-One to Planned Residential Development and for approval of an outline development plan for property located at 11361 West 44th Avenue, be APPROVED for the following reasons: 1. PUBLIC HEARING Case No SUP 46 ~• An application for approval to allow the addition of commercial mobile radio panel antenna on an existing lattice tower on Residential-Two zoned property located at 7500 West 29th Avenue (City Hall property). Ms. Reckert presented Staff's.report on Case No. SUP-96-I5. She stated that the applicant was SBA of Denver, hic., for Sprint Spectrum, 6310 S. Fiddler's Green Circle, Englewood, 80111 and that the owner of the property is the City of Wheat Ridge. This property is zoned Residential-Two and is used for the Wheat Ridge City Hall facility. The property is within the City of Wheat Ridge and all proper posting and notification requirements have been met, therefore, the Commission does have jurisdiction to hear this case. This is a request for a Special Use Permit to allow additional Commercial Mobile Radio antenna to be installed on the City Hall lattice tower. Ms. Reckert advised that recently City Council passed new legislation relating to these types of facilities and .generally the regulation slates that towers such as this aze allowed in commercial zones and are not allowed in residential zones, however, since there is an existing tower located at City Hall, this would be a legal nonconforming use. She advised that there was a neighborhood meeting held December 3, 1996, for input from residents of the neighborhood. However, she stated that the applicants and herself were the only ones. present. Chairperson WILLIAMS swore in Ann Prouty, 6312 S. Fidder's Green Circle, Englewood, who represents Sprint in their application to place nine (9) Personal Communication Services antenna on the existing tower. Using this tower she stated would eliminate the need to request to build other towers in the City and will provide extensive service area. It will also not interfere with current radio/cellulaz traffic. She further stated that City Council had approved the lease for this facility in July, 1996. The tower has been analyzed and can hold the additional antenna without any problems. She provided overheads to elaborate on the appearance of the tower before and after acid requested that the Commission approve this request. Chairperson WILLIAMS swore in Gary Pultz, 7667 E. Warren Drive, Denver, the engineer for Sprint. He stated he was in attendance to answer any questions of the Commission. He stated that Arvada, Lakewood, and Jefferson County Police Department Planning Commission Meeting Minutes January 2, 1997 Page 3 had been contacted and they have all responded that they have no problem with the lease of this facility. Chairperson WILLIAMS swore in Andrew Orcowski, 7667 E. Warren Drive, Denver. He stated that as an engineer for the company, he was in attendance to clarify any questions. He wanted to address the capacity question. He stated that their proposed request has been designed to include expansion for the next five (5) yeazs including additional channel banks. Therefore, he stated that additional towers for this company would not be needed in the City. Questions raised by the Commission included the concern regarding police department needs and use; numerous tower use requests; ability to withdraw the special use to allow the antenna to be used for emergency/safety purposes; how many antenna can the tower feasibly handle; would this and other Companies request additional antenna; how wide the coverage. A request was made by the Commission that the surrounding entities be checked to see if they have a need or potential need to use this antenna for emergency purposes and to assure the capabilities for City Hall use in the future as well as structural integrity. Commissioner CERVENY motioned and Commissioner LANGDON seconded, "that Case No. SUP-96-5, a request for approval of a Special Use Permit to allow the addition of CMRS panel antenna onto an existing lattice tower'on Residential-Two zoned property located at 750Q West 29th Avenue, be APPROVED for the following reasons: 1. ... A Special Use Permit is required to allow the collocation of CMRS panel antennas on an existing, nonconforming tower, 2. The collocation will alleviate the necessity of additional shorter towers, 3. The evaluation criteria support approval of this request, 4. Agencies have indicated no adverse considerations with regard to this addition, 5. Property owners and notification requirements have been met. With the following conditions: 1. The City recheck before City Council meeting to assure that the Wheat Ridge Police Department feels that this will not interfere with any future needs of the City. 2. Ms. Reckert presented an overview of the staff report regazding this request. The applicant and owner is Toin Sloan for Wycoff Construction Company, 6428 Newcomb Street, Arvada, 80004. The approximate azea of the site is 2.7 acres and is zoned agricultural. She entered into the record the comprehensive plait, zoning ordinance, case file with packet materials and exhibits. The property is within the City of Wheat Ridge and all notification and posting requirements have been met, therefore, the Commission does have jurisdiction to hear this case. Ms. Reckert clazified that the plan development approval is a three step process. The outline development plan which is the first stage is a concept plan to establish parameters as far as the design guidelines for the property is addressed and is fairly general. The second two steps aze the final development plan and the platting process. In this case the applicant is asking for outline plan approval only. Ms. Reckert noted that prior to any building permits being issued, the applicant would have to go through another development review process for the final development plan and plat before the Planning Commission and City Council. Ms. Reckert further stated that City Council is considering the possible purchase of this property for park land purposes. At their December 18, 1996, meeting they authorized a study of this property by a architect who specializes in historic preservation to determine the significance of the property and establish a monetary cost estimate for refurbishing some of the existing structures on the property. At City Council's meeting of January 13, 1997, they will be presented the information from the azchitect who is working with the Director of Pazks and Recreation. Ms. Reckert continued the staff report with regard to rezoning. She stated that a neighborhood meeting was held on December 19, 1996, which had a very good turn out. Many concerns were expressed at the meeting which were addressed. Vazious agencies responded with special needs required by their agencies. Chairperson WILLIAMS swore in Tom Sloan, 6428 Newcomb, Arvada. Mr. Sloan stated he was providing attractive and affordable housing for citizens. Mr. Sloan provided an overview of his vision of this site. He stated that City Council appeared ready to spend a considerable amount of money to restore and purchase this property. He stated he hired an azchitect to evaluate this situation as well. Mr. Sloan has been advised that the property does not qualify for state or national historical designation. Mr. Sloan stated he has been trying to give a historical building to the City which in tum could move it to another location to save and restore it. Planning Commission Meeting Minutes January 2, 1997 Page 5 Chairperson WILLIAMS swore in Michael Casey, 1768 Platt Street, Denver. Mr. Casey is the azchitect for the Wycoff Company. Mr. Casey clarified that the property is a little over three (3) acres which includes the property dedication requirement. He further elaborated on the proposed development which overall equals 9.6 units/acre. Chairperson WILLIAMS swore in Tom Shockley, 11605 W. 46th Avenue, Wheat Ridge. Mr. Shockley stated that he is against the rezoning, density, and that he felt the proposal is not compatible with surrounding area. Chairperson WILLIAMS swore in Kim Stuart, 11700 West 46 Avenue, Wheat Ridge. Ms. Stuart stated she was against the rezoning but would support single family dwellings and not duplex or townhouse type homes. Explanation regarding the City Council's moratorium on building permits and rezoning approvals were provided to the audience. Chairperson WILLIAMS swore in Diane Mattox, 4515 Robb Street, Wheat Ridge.. Ms. Maddox stated that she would prefer if zoning remained agricultural. She further stated that she also would prefer single family units with space if the area could not become a park. Chairperson WILLIAMS swore in George Jorgerson, 4515 Robb Street, Wheat Ridge. Mr. Jorgersal stated he felt the same what other residents did. He does not want multi- family residential. Single family housing is preferred. Chairperson WILLIAMS swore in Paul Anderson, 4610 Queen Court, Wheat Ridge. Mr. Anderson is opposed to rezoning because it would have a negative impact on local wildlife, (Prospect Park holds a variety of wildlife that the subdivision would disrupt), several other project are in process therefore, how much growth is needed, traffic is overburdened in the area and the new subdivision will make it worse, water and sewer . systems are already taxed, there is an obligation to future generations to show what the origins of Wheat Ridge were and should allow the Historical Society to share this property with all citizens. Chairperson WILLIAMS swore in Claudia Callas, 8701 West 38th Avenue, Wheat Ridge. Ms. Callas stated she did not support the zoning change. She was carcerned about the historical value of the, property and the wildlife. She stated as a member of the historical society that they have been pursuing this land and dedication of its historical value for over two yeazs. Chairperson WILLIAMS swore in Alice Datma, 4645 Robb Street, Wheat Ridge. Ms. Plamiing Commission Meeting Minutes January 2, 1997 Page 6 Datma stated she was not opposed to the rezoning. She also owns 4655, 4665, 4675 as well. She stated she is appalled with the messes that must be cleaned up when people do not keep their promises as it relates to the sod house, the new post office, the barn housing old farm equipment at the Wheat Ridge Historical Pazk. She would prefer to develop the azea to clean it up and hopefully the property values would increase. Chairperson WILLIAMS swore in Terry Moore, 6428 Newcombe Street, Arvada. Ms. Moore is the realtor for the applicant. She elaborated on the product being proposed and stated that this would be the fifth project that she and Mr. Sloan have worked upon together. General discussion was held and the concerns expressed by the Commission included saving vazious large trees located on the property, number of units being proposed, curb cuts, parking, fire response, street width, traffic, landscaping, open space, density, transients and income housing vs family residential, townhouses/duplexes vs single family, affordable dwellings, zoning changes, overall development of this parcel, and historical value. Ms. Reckert advised the Commission that they did not have to approve or recommend this proposal. They could approve it, deny it, approve it with conditions, or continue for more information. All requirements for planned residential development outline have been met, 2. It is desirable for the City of Wheat Ridge to have affordable housing. The builder/developer shall provide a clause in the purchase contract that identifies that the purchaser intends to use the dwelling unit as primary residence, not a rental, 2. There will be a minimum of 35% landscaping, 3. That all mature trees as practical, are to be preserved, ' 4. There will be no more than 9.6 units per acre. Commissioner CERVENY wished to enter into the record the observation that six (6) residents were in opposition to the development with one in support. Also that the developer consider modifying his plan to see if affordable housing is still practical by providing increased landscaping along 44th Avenue and allowing these units to be either doubles that aze sold as individual units per site or single family detached homes. Commissioner THOMPSON stated for the record that she would be voting against the motion. She felt the design of the buildings aze very nice, however, being a representative of this area and finding that so many residents aze opposed to this proposal, she would rather wait and see this postponed and give the Commission an opportunity to see what the City of Wheat Ridge is going to do with the Baugh Property and also it would give the Commission an opportunity to discuss with the developer what will be built. Motion carried 5-3 with Commissioners THOMPSON, GRIFFITH, and ECKHART voting no. 9. OLD BUSINESS There was no old business to discuss. 10. NEW BUSINESS A. CASE NO. ZOA-96-15: Ordinance re Parking Regulations: Ms. Reckert presented an overview of the parking regulation including changes to encompass Americans with Disabilities Act Accessibility Guidelines, multifamily and office/warehouse parking. She stated that there has been some concern regarding the parking ratios particularly as it pertains to multifamily units. Commissioner THOMPSON commented that off street parking is still a problem inmost areas of Wheat Ridge. She requested that the regulation be flexible and even though it is being increased at this point, she believed that the number of units should be reduced to increase parking. Plamiing Commission Meeting Minutes January 2, 1997 Page 8 Ms. Reckert stated that pazking changes would have to be presented at a public hearing. Commissioner THOMPSON asked that in regazd to multifainily parking that a provision be made for allowing additional parking exceeding the 5-10% increase if no on-street parking is adjacent to the development. Acceptance was reached by consensus with Commissioner RASPLICKA voting no. B. CASE NO ZOA-97 1• Industrial District Regulations Ms. Reckert reviewed the Industrial District Regulations to the Commission. She stated that City Council was concerned as they thought the regulation was too loose. There was thought given to rezoning all Industrial azeas to PID which would be a difficult endeavor. Director Gidley is recommending that Commercial-Two district uses be reviewed and perhaps stiffened to require some allowed uses as special uses. Acceptance was reached by consensus with Commissioner RASPLICKA voting no. C. NEW SLIDE PROJECTOR Commissioner THOMPSON requested that a new slide projector be purchased so that all information can be reviewed. Ms. Reckert stated that the sound and A/V systems need to be revamped or replaced. Commissioner THOMPSON asked if this could be included in the budget. Commissioner THOMPSON motioned, Commissioner LANGSTON seconded that Staff investigate all alternatives to providing an updated AV system and new slide projector. Motion carried 8-0. 11. DISCUSSION AND DECISION ITEMS Ms. Reckert stated that there is some concern regarding the new procedure of holding one Public Hearing and one Study Session per month. For the month of February's Public 'Hearing there are already three cases. It will be a testing period to see if this plan is feasible. It was suggested that if there are obviously too many cases that part or all of the Study Session be dedicated to becoming a Public Hearing.
