All pertinent documents were entered into record, which Vice Chairman MAURO accepted. Board Member ECHELMEYER was concerned with the different addresses listed for this case, and Mr. McCartney said all exhibits relate to west of 6300 W. 49th Drive. Discussion followed. Mr. McCartney said they are staying within the B-2 district, however the billboard will be relocated. Intent of the ordinance was discussed. Board Member ECHELMEYER said with the discrepancies in the address and the sign being moved closer to Clear Creek and actually into the flood plain itself, will that change the information submitted for a tower of this size. Mr. McCartney said he specifically gave the flood plain administrator the exact site plan which clearly shows the property entirely in the flood plain. The administrator based his decision upon this exact site plan and his condition was that he receive updated engineering plans showing that this structure can withstand anything within that flood plain. Mr. McCartney explained where the power station was located.- Board Member HOWARD wanted to know if this is the same company that is moving a billboard from 48th & Marshall, and Mr. McCartney replied no. Martin Kelly, representing Mile High Outdoor, 9745 E. Hampden, was sworn in. He said they are not enlarging their inventory, but asking only for permission to change location and height of the billboard. The billboard now is in a location where there is a lot of visual clutter and also nearby residential. They feel the new location is t WHEAT RIDGE BOARD OF ADJUSTMENT ~ MINUTES OF MEETING: July 24, 1997 Page 12 the best because it is strictly industrial,. kind of a wasteland. It is also a more serviceable and useful _location,.for a billboard because it will be seen by. many more people. Mr. Kelly feels this is one variance because if the location i:s approved, the height has to be approved also or it will be about 85% below the freeway. The billboard on Ward will be .dismantled and removed. He said they are trying to put this request in the most positive light as possible because there is a great deal of difference_in appropriateness between the two locations. There has been no protests .received regarding their request. Board Member ECHELMEYER wanted to know what will be the distance from this billboard_to 49th Avenue, .and Mr. Kelly replied 48-50 feet, however they do comply.. Discussion followed.. The faces of the billboard will be perpendicular to the access of I-76. Mr. Kelly said he has worked closely with staff to find a location even though they had a narrow envelope to work with. Board Member ABBOTT. would like to see something more visual than the exhibits submitted. He .feels the graphics .presented make it impossible to determine accurately if there is a visual hardship and a need for-the height variance. Mr. Kelly said it would be no ( problem for the case. to be continued to the next available meeting and they will supply whatever exhibits wanted. Motion was made by Board Member ABBOTT, that Case No. WA-97-11, be continued to the next available meeting. Motion was seconded by Board Member WALKER. ~MOtion carried 7-0. _ 5. CLOSE THE PUBLIC HEARING 6. OLD BUSINESS A. Discussion followed regarding starting the_meetings at 6:30 p.m. Board Member THIESSEN motioned to forward a resolution -- on to City Council for approval. REQUEST Page 2 The applicant is requesting the approval of an 18' billboard height variance to the 32' maximum billboard height requirement, to allow for the relocation of a billbnard. If approved,.-the applicant will be relo-eating an existing 32' high billboard from Ward Road, and placing it on the property located-at approximately 6400 w. 49th Drive.- The billboard will be 50' ih height. The applicant has submitted exhibits which show the change in grade elevation of the nearby Interstate 76 and said property.- The applicant believes the new location and height request, will allow for optimum visibility. The applicant has received confirmation of approval from the Colorado Department of Transportation (CDOT) and has ensured there will be the required 600' of separation between any adjacent, like- oriented billboards. According to section 26-412 (1) of .the Wheat Ridge Code of Laws, the maximum number of billboards permitted in the B-2 district is 16. Because there are currently 18 billboards located in-the B-2 district, the applicant must request permission to relocate their existing billboard. Once a non-conforming structure is removed, it-must comply with the current regulations. Concurrently, according to section 26-412 Z4) of the Wheat Ridge Code of Laws, the maximum height for a billboard in the B-2 district is 32' (measured from finished grade, to the top of the structure). The applicant is requesting the 18! billboard height variance to allow for the proposed billboard to be more visible to the adjacent Interstate 76. There is a 26' grade difference between Interstate 76 and said property. Also, according to section 26-208 (C) (5) , a class I special exemption permit, for structures of nonhuman occupancy, must be submitted to and approved by the Flood Plain Administrator, prior to any development possibilities. The Flood Plain Administrator has reviewed the request and .has submitted his approval within this packet (see attached letter). II. CRITERIA Staff has the following comments regarding the criteria to evaluate an application for an adjustments 1. Can the property in question yield a reasonable return in use, Board of Adjustment Staff Report Case No. WA-97-11 Page 3 service, or income if permitted to be used only under the conditions allowed by regulation for the District in which it is located; and, Yes. Because the property is currently vacant, the development options are not inhibited. However, the property is located entirely within .the 100 year flood plain and any 'future development- of the site would- -.- require approval of a Class II special flood exemption from the Board of Adjustment. 2. Is the plight of the owner due to unique circumstances; and, No. The plight of the owner, in this instance, is the difference in grade between Interstate 76 and said. property. The property-does offer plenty of street frontage to allow for future access on the site. 3. If the variation were granted, would it alter the essential character of the locality; and No. The. property is located in the Light. .Industrial section of Wheat Ridge, and adjacent to Interstate 76: Because of the proximity to the freeways, there are several existing billboards located in this area. Therefore, additional billboard space -will not alter the essential character of the locality. 4. Would the particular physical surrounding, shape, or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out; and, Yes. As it pertains to advertisement, the-.-grade difference between Interstate 76 and said property creates a marketing hindrance. Yet, because the property is relatively flat, and provides adequate access, there is a high development potential. Board of Adjustment staff Report Case No. WA-97-11 Page 4 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to other property within the same zoning classification; and, Yes. Anyone may apply for the same type of variance, but the outcome may not be the same. Variations are reviewed on a case by case. basis. 6. Is the purpose of the variation based exclusively upon the desire to make money out of the property; and, Yes. The applicant is requesting the 18' billboard height variance to allow for:additional visibility from the nearby Interstate 76 for there -.. _. advertisement. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property; and, Yes. The applicant; who is leasing the property from the owner, has_ created.the_hardship. A 32' billboard may be constructed on .this site, but.-the visibility from Interstate 76 will be hindered by the differing grade. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and, No. Granting of this. request will not be detrimental to the publics welfare as the billboard in non-habitable and located away from any nearby structures. Also, approval of the variance will not_be injurious to other property or improvements in the area. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increased the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood, and No.- Approval of the variance will not impair the adequate supply of light and air to adjacent property nor substantially increase congestion Board of Adjustment Staff Report Page 5 Case No. WA-97-i1 in the public streets.. Also, there will not be an increase in fire danger nor will approval of the request diminish the property values within the neighborhood- - _. 10. If it is found in criteria 8 and 9 above, that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? We believe that a billboard with exposure to I-76 in a primarily industrial district would be more appropriate and more useful than the existing billboard on an arterial street in a mixed retail-residential setting. Sean McCartney presented the staff report. All pertinent documents were entered into record, which Chairman HOVLAND accepted. After some questioning, Mr. McCartney explained there are currently 18 billboards in the B-2 District, and the applicant is just relocating an existing billboard within the same district. The code states once a non-conforming structure is changed, it has to comply with today's standards. Therefore, the applicant needs a variance for relocation and a variance to the height because it is a non-conforming structure. The maximum height for a billboard is 55', and even though it has not been surveyed, Mr.~McCartney believes this billboard is under that. The applicant, Martin Ke11y, 1702 E. Highland, Phoenix, AZ, was sworn in. There.is a 26' difference in elevation from ground level of the billboard to the freeway. On the freeway, in the nearest lane, the bottom half of :the billboard is not visible to the driver,,, and the problem gets worse in the far lane. Board Member HOWARD asked_if the applicant could apply for an administrative height variance of 10~ after this, and Mr. McCartney replied yes, however it would still have to_be approved by staff. Mr. Kelly assured the board they would not be asking for_more height. Board Member HOWARD asked the size of the billboard they own on ward Road, and Mr. Kelly replied 10' by 30'. Due to freeway speeds, the billboard in question will be considerably larger (14' x 48'), and Mr. McCartney added that size is permissible by code. No further questions were asked. Board Member ABBOTT stated this motion would be in two parts. Motion was made by Board Member ABBOTT, that Case No. WA-97- 11-A, an application by Mile High Outdoor to relocate an existing billboard, be APPROVED for the following reasons: 1. The property is zoned Residential-Two and located at 8350 W. 41st Avenue. Sean McCartney presented the staff report. All. pertinent documents were entered into record, which Chairman HOVLAND. accepted. Mr. McCartney said this request includes 2 fence variances; one for the rear yard and one for the side yard. The dilapidated fence in the rear belongs to the neighbor, and since the applicant's backyard is lower, an 8' fence would bring it level with the dilapidated fence. The side yard variance represents the civil matter regarding privacy. Board Member MAURO asked if there is an existing 6' fence on the west side of the house, and Mr. McCartney answered yes. The applicant, Gayle Maschari-Mohr, 8350 W. 44th Avenue, was 'sworn in. Ms. Mohr explained the current fencing on her property. She would like an 8' in the rear to hide the unsightly plywood that the neighbor has put up and also to hide the deteriorating cement retaining wall. She showed on _ the overhead where the 'pillars and wrought iron will be placed for the fence in the frontyard. They want to put the 8' wooden fence from the front edge of the house to the back because from her kitchen she can see directly into her neighbor's daughter's bedroom. The distance between the two windows is only 8;4 feet,-and they would like to block the view and create more privacy.
