The applicant is proposing to place the 24' X 46' two-car detached garage on the .side of the house where he currently parks, on a gravel parking area. The .garage will have a separation of 5' from the existing structure. (required by U.F.C.), and 3'-6" from the south property lin_e_. The existing structure is 32'-7" from the south property line. According to section 26-15(F), of the Wheat Ridge Code of Laws, detached garages or carports built within the Residential-Two zone district must retain a 5'_side yard setback from the property line. II. CRITERIA Staff-has. the following comments regarding the criteria to evaluate an application for an adjustment: 1. Can the property in question yield a reasonable return is use, service, or income if permitted to be used only under the conditions allowed by regulation for the District in which it is located; and, Yes. If the variance is denied, the property may retain it's single- family use. Also, there is currently a one-car attached garage=qn the site. 2. Is the plight of the owner due to unique circumstances; and, No. The plight of the owner is not ,due to a unique circumstance. 3. If the variation were granted, would it alter the essential character of the locality; and Yes. Because most of the structures in the neighborhood meet the required setbacks. However, because most of the structures in_the locality have covered parking, approval of this structure may conform to Board of Adjustment Staff Report Page 3 Case No. WA-97-13 the essential character .of .the.locality.- 4. Would the particular physical surrounding, shape, or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out; and, No. The physical shape of the property is rectangular and is relatively wide (93') for a single-family property in the Residential-Two zone district. Also, the property is located in a relatively flat area of Wheat Ridge, therefore topography does not cause hindrance. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to other property within the same zoning classification; and, Yes. Anyone may apply for the same type of variance, but the outcome may not be the same. Variations are reviewed on a case by case basis. 6. Is the purpose of the variation based exclusively upon the desire to make money out of the property; and, No. The purpose of the variance is to allow for additional parking space on-a, property that currently provides a one-car attached garage. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property; and, Yes. The applicant, who-has interest in the property, has created his own difficulty or hardship. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and, No. If approved, the proposed garage addition will be located in an area that would not pose as hazardous or injurious to other property. The Uniform_Eire Code requires .that there is a minimum of 10' .between Board of Adjustment Staff Report Page 4 Case No. WA-97-13 structures. that are not built with non-flammable material. There will be adequate separation-between the proposed addition and the existing adjacent house to the south. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increased the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood, and No. The proposed addition will not impair the adequate supply of light and air to-the adjacent property, as there will be adequate separation between the proposed garage and the existing structure to the south. Also, there will be increase in fire danger or increased congestion on the public streets. 10. If it is found in criteria 8 and 9 above, that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of .the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Because the .proposed detached garage is purely for individual benefit, it will not pose as a direct benefit to the neighborhood or the community. Yet, covered parking is always a benefit to surrounding neighborhoods, as it provides for aesthetic relief-from outside storage and parking. C. = Case No WA- 7-i : An application by Oliver Bochantin for approval of a 1'6" sideyard setback variance to the 5' sideyard setback requirement to allow-for a detached garage. The property is zoned Residential-'Itvo and located at 4655 -- Saulsbury Street. Sean McCartney presented the staff report. All pertinent documents were entered into record, which Chairman HOVLAND accepted. Board Member ECHELMEYER-questioned if-it would-be a brick garage, and Mr. McCartney replied there are no requirements on that, however a brick structure would be considered non- flammable, so they would not have to have the 5' separation unless there would be-a window. The applicant, Oliver Bochantin, 4655 Saulsbury Street, was sworn in. He said if the City requires the garage to be brick then he will comply. He corrected-the staff report saying it is actually 20' 6" between the property line and the neighbor's building. Board Member THIESSEN stated this is an exceptionally large- garage-and wondered if the applicant will be doing commercial work, and Mr. Bochantin replied no, and other than storage and work shop, the main reason is for storage_ of their three family cars-and two antique cars. A 24' is a standard garage and he would like to stay with that. He wanted to move the garage further toward the back, but it would interfere with his backyard. There will be a concrete driveway to the garage. Board Member ECHELMEYER was concerned if the garage is frame and brick would the 5' be sufficient for fire protection, and Mr. McCartney replied yes, that is all that is required by code. WHEAT RIDGE BOARD OF ADJIISTMENT page 5 MINIITE5 OF NESTING: June 26, 1997 Property lines were discussed. Mr. Bochantin noted the sheds in the backyard are portable and can be removed. Board Member WALKER was concerned with the four vehicles being a lot of flammable material-in one structure and would be hard to fight afire, and the applicant replied even though there is_the space for them, he does not believe there will be four vehicles in the garage at one time, as he still wants some open area for a work shop. Board Member HOWARD thinks the garage sticking out 9' from. the dwelling will be very noticeable. The peak of the roof will be 2-3' lower than the house, and Mr. Bochantin added he thinks it will look good with his house and not be an eyesore. Mr. McCartney-told the board even though this might not be aesthetically pleasing, the 30' front setback is all that is required by-code. Mr. Bochantin added there is really no standard in the neighborhood, they are anywhere between 30-50' Setbacks. The three .storage sheds in the backyard will remain. Board Member THIESSEN raised questions about the 5' setback being reduced if there were different materials used, and Mr. McCartney stated again, if there is a window in the structure they need access out of that window in case of fire. The Uniform Fire Code regulation is 5' regardless of materials used. Mr. Bochantin asked if the window would be sealed off would they still need the 5',a_nd Mr. McCartney replied-that is out of his jurisdiction, so if it is pertinent, they would have to continue the case and get an answer from a building official. Mr. Jim Tucker, 4705 Kendall Street, neighbor to the north, was sworn in. He stated the road jogs and their house sets further out, so he has no objections to this request. No further questions were asked.. It was noted there were no inquiries regarding this case.. Motion was made by Board Member MAURO, that Case No. WA-97- 13, an application by Oliver Bochantin, be APPROVED for the following reasons: WHEAT RIDGE BOARD OF ADJIISTMENT MINUTHS OF MEETING: June 26, 1997 Page 6 1. The-garage is located in an area that will not pose as hazardous or injurious to other properties. 2. The garage does meet the--Uniform Fire Code regulations bf a minimum of 10' between the structures. 3. The proposed addition will-not impair the supply of light and air to the adjacent property. 4. There will be no increase in fire danger or increase in congestion on the public streets. Motion was seconded by Board Member JUNKER. Motion carried 6-1, with Board Member HOWARD voting no. Resolution -- attached- - C. Case No. WA-97-14: An application by LeRoy Burry for the approval of a 21' sideyard setback variance to the 30' sideyard setback requirement to allow a carport. The property is Zoned Residential-Two and located at 3424 Kendall Street. Sean McCartney presented-the staff report. All pertinent documents were entered into record,_which--Chairman HOVLAND accepted. Board Member ECHELMEYER wondered if the variance would be the same if the applicant would turn the carport into a garage at a later date, and Mr. McCartney answered that would not affect anything because the setbacks are .the same. Sight triangles were discussed. The applicant, Leroy Burry, in. He stated he wants the fighting snow. 3424 Kendall Street, was sworn carport because he is tired of Board Member THIESSEN wondered since this is-a large property, if the applicant had considered placing the carport on the east side, and Mr. Surry said he had considered that, however the proposed location would make it easier accessed..- Mr. Burry discussed the length of_his vehicles, parking, and the distance from the street. If curb, gutter, and sidewalks would ever be put in, Mr. McCartney said they would be in about 8' from the edge of-- asphalt.
