This letter is in response to your request to build a garage into a portion of the
eight foot wide utility easement that is platted along the northwesterly line of Lot
13 of the Stoneridge Subdivision in Wheat Ridge.
Based on a review of your construction plans and survey, it appears that the
proposed garage would extend approximately three to four feet into the
easement. Public Service Company has no gas or electric facilities in the
easement, and the company has no objection to the proposed encroachment.

The applicant is requesting approval of a 6' side yard setback variance,.
to the 10' side yard setback requirement, to allow-the construction of
an attached, single-car addition. _If approved, the garage will be 4'
from the side property line {west). _
Currently, there is an existing 2-car attached garage on the west side
of the property. The applicant, who owns 2 personal vehicles used for
travel, is also a car enthusiast, who restores old vehicles. Approval
of the. variance will allow for a11__vehicles to be enclosed within _,
attached garage space.
According to the Stone Ridge Planned Development, all structures must
retain an total of 15' between side yard setbacks (5' on the narrow side
yard setback, and 10' on the other side yard setback). Permission for
application of this case was warranted .by the previous Planning Director
Glen Gidley. There is jurisdiction to hear this case.
At publishing time, there has not been any written or verbal objections
regarding this request:
II. CRITERIA
Staff-has the following comments regarding the criteria to evaluate. an
application-far an adjustment:.
1. Can the property in question .yield a reasonable return in use,
service, or income if permitted to be used only under the
conditions allowed by regulation for the District in which it is
located; and,
Yes. The property currently provides a 2-car attached garage. Because
of this, the property allows for adequate enclosed parking.
2. Is the plight of the owner due to unique circumstances; and,
No. Because the variance is to provide for parking convenience, there
aren't any unique circumStaxices attributed to this request.

3. If the variation were granted, would it alter the essential
character of the locality; and
No. Approval of this variance may enhance the essential character of .
the locality as it will allow for all of the applicants vehicles to be
enclosed. Enclosed garage space provides aesthetic relief-from exterior
storage.
4. Would the particular physical surrounding, shape, or topographical
condition of the specific property involved result in a particular
hardship (upon the owner) as distinguished from a mere
inconvenience if the strict letter of the regulations were carried
out; and,
Yes. bue to the angled con£igusa_tion of the-property, it is difficult
to provide for. adequate room for future additions, along the west side
of the property .(see exhibit). Also, the west side of the property is
the only side where development may occur.
5. Would the conditions upon which the petition for a variation is
based be applicable, generally, to other property within the same
zoning classification; and,
Yes. Anyone may apply for the- same type of variance, but the outcome
may not be the same. Variations are reviewed on a case by case basis.
6. Is the purpose of the variation based exclusively upon the desire
to make money out of the property; and,
No. The purpose of the variation is based exclusively upon the desire
to allow for additional enclosed parking.
7. Has the alleged difficulty or hardship been created by any person
presently having an interest in the property; and,
Yes. The applicant., who has interest in the property, has created his
own difficulty or hardship. Yet, as described above, the existing shape
of the__property also creates a physical hardship.

8. Would the granting of the variations be detrimental to the public
welfare or injurious to other property or improvements in the
neighborhood in which the property is located; and,
No. Granting of the variance will not be detrimental to. the public.
welfare as there currently is an existing 2-car garage. Also, approval
of this request will not:._be.:injurious to other property or improvements
in the neighborhood in which the property is located. In fact, approval
of the variance may enhance-the nearby properties as it will provide. for
additional enclosed parking and storage.
9. Would the proposed variation impair the adequate supply of light
and air to adjacent property or substantially increased the
congestion in the public streets or increase the danger of fire or
endanger the public safety or substantially diminish or impair
property values within the neighborhood, and
No. Approval of this variance will not impair the adequate supply-of_
light and air to the adjacent property as there will still be adequate
separation between the proposed .addition and the existing structure to
the west. Also, it will not increase traffic congestion nor increase
the danger of fire.
10. If it is found in criteria 8 and 9 above, that granting of the variation
would not be detrimental or injurious to other property or improvements
in the neighborhood, and it is also found that public health and
safety, public facilities and surrounding property values would not be
diminished or impaired, then, would the granting of the variance result
in-a benefit or contribution to the neighborhood or t_he community,
as distinguished from an individual benefit on the part of the applicant,
or would granting of the variance result in a reasonable accommodation
of a person with disabilities?
Although the request for the side yard setback variance is strictly for
individual benefit, approval of this, request will allow for aesthetic
relief from exterior parking and storage of automotive materials.

a 6' side yard setback variance to the 1D' side yard setback
requirement to allow an attached garage. The property is zoned
Planned Residential Development and located at 11421 W. 45th Place.
Sean McCartney presented the staff report. All pertinent documents
were entered into record, which Vice Chairman MAURO accepted.
Board Member ECHELMEYER inquired about the shed on the property, and
Mr. McCartney answered it will be removed.
Board Member ABBOTT wanted to know if there is a drainage Swale to
the left of the trees, and Mr. McCartney replied it is not shown on
the development plan. This easement is referred to as a utility
easement and not a drainage easement. Since the area is not in a
WHEAT RIDGE BOARD OF ADJIISTMENT

high topographical area, Mr. McCartney would not see the need for
that type of Swale, since the property is not in the flood plain.
Mr. McCartney said the garage will not necessarily be for travel
vehicles but more for the applicant's antique 1940 Roadster.
The applicant, Shannon Hasch, 11421 W. 45th Place,. was sworn in. He
is proud of his property and since he is remodeling the garage-will _
be a nice addition.
Board Member ABBOTT questioned this being a hardship, and Mr. Hasch
said he does have the two automobiles, plus he needs. a place for
storage of his woodworking tools and saws. $e has no room to work
now and does have a limited budget.
No further. questions were asked.
Motion was made by Board Member THIESSEN, that Case No. WA-97-16, an
application by Shannon Hasch, be APPROVED for the following reasons:
1. The request will not be detrimental to the public welfare, or
injurious to other property or improvements to 'the
neighborhood.
( 2. The request will not impair the adequate supply of light and --
air to adjacent properties or substahtially ihcrease
congestion in the streets.
3. It will benefit the neighborhood by providing aesthetic relief
from exterior parking and storage of automotive materials.
4. There were no protests registered against this request...
Board Member ABBOTT offered friendly amendments:
5. The applicant will remove the existing shed.
6. There is significantly more than average separation from the
garage to the neighboring structures. -
Motion was seconded by Board Member ECHELMEYER. Motion carried
