In the event of foreclosure of this Deed of Trust or other transfer of title to the said property in lieu
of foreclosure; all right, title and interest of the Borrower in and to the insurance policies then in force
shall-pass-to_the purchaser or grantee. ,
4. If-.an award in condemnation be made with respect to all or any part of the. property subject
hereto; the .entire amount of such award attributable to Borrower's and Phillips' interest shall be paid
directly,to.Phillips rather than to Borrower and Phillips jointly, and the condemning authority is hereby
authorized and directed to make such payment accordingly. ,The proceeds of any such award, or any
portion thereof,-shall be applied by Phillips at its option either to reduction of the indebtedness secured
hereby or to the restoration or repair of the property:
5:-' If, notwithstanding the foregoing provisions, payment_of any proceeds on account of insurance
or condemnation is made to Borrower directly or to Borrower and Phillips (or Trustee), jointly, Borrower
shall immediately transfer and deliver such proceeds, or his entire interest therein, to Phillips. ~,
6. If Borrower should default in the performance of any of the obligations herein set forth, PhilIigs, '
in addition and without prejudice to any other remedy which it may have, may itself correct the default
and any sums so expended by Phillips shall be immediately due and payable by Borrower to Phillips,
together with interesE on such sums at the highest legal rate from and after the date of Such ex}~enditure
until repaid, and such expenditure, together with such interest, shall be secured hereby.

7. No failure of the Trustee or Phillips to exercise any option herein given to declare the maturity
of the debt hereby secured shall be taken or construed as a waiver of its right to exercise such option
or to declare. such maturity by reason of any past or present default on the part of th@ Borrower; and
the procurement of insurance or the payment of taxes or other liens, debts or charges by Phillips shall
not betaken or construed as a waiver of its right to declare the maturity of the indebtedness hereby
secured by reason, of the failure of tl~e Borrower to procure such insurance or to pay "such taxes, debts,
liens or charges; and the lien of this instrument shall remain iri full force and effect during any postpone-
ment or extension of time of payment of the indebtedness or~any part thereof secured hereby.

8. If the Borrower shall well and truly pay and discharge the indebtedness hereby secured as it shall
become-due and payable and shall do and perform all acts and agreements to be done and performed by
Borrower under the terms and provisions of this Deed. of Trust, then this conveyance shall be and become
null and void.
9. If ;the Borrower shall fail to pay, or .cause to_ be paid, as it matures, the indebtedness hereby
'secured, or any part thereof, according. to the terms thereof, or if the Borrower shall -fail to do or perform '
-any other act or thing herein required or agreed to be done or performed, or if the interest of the Trustee
'or Phillips in the premises or improvements becomes endangered by reason of the accrual or enforcement

Ridge Board of Adjustment on July 24, 1997, at 6:30 p.m., at 7500 West

I. REQIIEST
The applicant is requesting the approval of a 39' front yard setback
variance, to the 50' front yard setback requirement, to allow the
removal and reconstruction of a fuel pump canopy.
The. request is due to-the future remodel of .the existing fueling
station. The applicant is planning to remodel the existing service
station, construct four (4) new pump islands, and rebuild the existing
fuel pump canopy. Because there wasn't a variance approved for-the
construction of the existing canopy, the applicant must either comply
with the current setback requirement, or seek a variance. --
Currently, there is an existing fuel pump canopy located approximately
11' from the front property line. If the request is approved, the
applicant_is hoping to construct the new fuel pump canopy at almost the
exact same spot as the existing canopy.
According to section 26-'7(D)(3 )., of the Wheat Ridge Code of Laws, "if
any structure should for any reason be moved from its location at the.
time of adoption or amendment of this Ordinance, it shall conform to the
provisions of the district in which it is located after it is moved."
Currently, the property in question is located in the Commercial-One
zone district. According to section 26-22(F)(5)(c), "structures on lots
which abut...Kipling Street...shall be setback a minimum of fifty(50)
feet."
To date, there-have not been any recorded traffic accidents, as it
pertains to the existing location of the fuel pump canopy. Also, if the
canopy were to be located in the designated sight distance triangle (55'
on Kipling Street, and 25' on West 27th Avenue), it would not pose as a
visual hindrance as the height of_the canopy is larger than the required
84".

II. CRITERIA
Staff has the following comments regarding the criteria to evaluate an
application for_an adjustment:
1. Can the. property in question yield a reasonable return in use,

service, or income if permitted to be used only under the
conditions allowed by regulation for the District in which it is
located; and,
Yes-. If denied, the existing canopy may remain in its current location,.
and the business may continue to operate. Facade changes and minor --
structural modifications may be performed on the existing canopy, with
an administrative building permit, as long as 50% of the structure is
not removed..
2. Is the plight of the owner due to unique circumstances; and,
Yes. The property in question measures 100' X 150.'. As previously
stated; structures located on Kipling Street must retain a 50' front
yard setback (see exhibit). The proposed canopy is 40' X 48', and the
existing service station is 28' X 50'. Combined, the two structures -.----.--
require 68' of the site, from east to west. The property measures. 100'
from east to west.
3. If .the variation were granted, would it alter the essential
character of the locality; and
No. The property has had a fuel pump canopy approximately 11' from the
front property line during it's .existence.
4. Would the particular physical surrounding, shape, or topographical
condition of the specific property involved result in a particular
hardship (upon the owner) as distinguished from a mere
inconvenience if the strict letter of the regulations were carried
out; and,
Yes. The property measures only 100' from east to west (from the front
property line-along Kipling Street), and there is a 50'-front yard
setback requirement for structures fronting Kipling Street.- Because of
this, there is-only 50' an the property for which a service station and
fuel pump canopy may be located. _ -

5. Would the conditions upon which the petition for a variation is
based be applicable, generally, to other property within the same
zoning classification; and,
Yes.. Anyone may apply for the same type of variance, but the outcome
may not be the same. bariations are reviewed on a case by case basis.
6. Is the purpose of the variation based exclusively upon the desire
to make money out of the property; and,
No. The purpose of ..the variance is to allow for the reconstruction of an
existing canopy. Because the canopy was originally constructed without _
a variance, the applicant must be granted the variance to complete the
remodel of the site.
7. Has the alleged difficulty or hardship been created by any person
presently having an interest in the property; and,
Yes. The applicant, who has interest in the. property, has created his
own difficulty or hardship. Yet, as described above the existing size
of the property also creates a physical hardship.
8. Would the granting of the variations be detrimental to the public
welfare or injurious to other property or improvements in the
neighborhood in which the property is located; and,
No. The existing fuel pump canopy is currently located with a 39' non-
conforming front yard setback, and allows for adequate visual pathways,
since it is located on the corner. And, anytime a site is remodeled or
visually- enhanced, the surrounding neighborhood benefits from the
updated aesthetics. Therefore, approval of the request should not be
detrimental to the public welfare or injurious to other property or
improvements in the neighborhood.

9. Would the proposed variation impair the adequate supply of light
and air to adjacent property or substantially increased the
congestion in the public streets or increase the danger o£ fire or
endanger the public safety or substantially diminish or impair
property values within the neighborhood, and
No. The request is to legalize an existing non-conforming front yard
setback and there will not be_-a change in use. Therefore, the proposed
variation should not impair the adequate supply of_ light-.and air -to_
adjacent properties or_substantially increase the congestion- in the
public streets__ __
10. If it is found in criteria 8-and 9 above, that granting of the variation
would not be detrimental or injurious to other property or improvements
in the neighborhood,' and it is also found that public health and ~_.._-
safety, public facilities and surrounding property values would not be
diminished or impaired, then, would the granting of the variance result
in a benefit or contribution to the neighborhood or the community,
as distinguished from an individual benefit on the part of the applicant,
or would granting of the variance result in a reasonable accommodation
of a person with disabilities?
Approval-of this_ request is solely for the benefit of the applicant who
is seeking to enlarge the existing canopy. But, anytime there is
remodeling to enhance the- aesthetics of a .property, it is the
neighborhood who benefits.

Sean McCartney presented the staff report. All pertinent _
documents were entered into record, which Vice Chairman MAURO
accepted.
Board Member THIESSEN asked if this setback variance would carry-
over to another owner, and Mr. McCartney replied yes, the variance
( remains with the site. The board can stipulate however, that this
setback is for a canopy only. Questions were raised and discussed
about the lot line.
Board Member ECHELMEYER asked if there were any plans to widen
Kipling, and Mr. McCartney answered none that he is aware of.,
However, if Kipling would be widened there would still be 16' of
which right-of-way can extend without even touching the property.
William Shay, Bradley Petroleum, was sworn in. Mr. Shay said they
want to modernize and make the site more user friendly, and more
aesthetically friendly to the neighborhood and city. The proposed.
canopy will be about 16' to the lower fascia.
Board Member HOWARD questioned how long Bradley has owned this
property, and Mr. Shay referred this to the president of Bradley,
in the audience, who said there has been some association for 40
years. Mr. Shay informed the board that Merchants Oil has been
consumed by Bradley Oil.
Board Member ABBOTT asked if the city allowed the banners draped
underneath the permanent sign, and Mr. McCartney said they would
be allowed „ however;-there has not been_a permit issued for that.
Banners and remodeling the current sign were discussed.

No further questions were asked.
Motion was made by Board Member ABBOTT, that Case No. WA-97-17, an
application by Bradley Petroleum, be APPROVED for the following
reasons: _
1. No traffic accidents-have been recorded'to date pertaining to
the fuel pump canopy.
2. The canopy would not be a visual hindrance if it were located
in the sight triangle.
3. The re-construction_of service stations in Wheat Ridge have
consistently required canopy setback variances.
4. If denied, the existing canopy may remain in its current
location and the business may continue to operate.. Facade
changes and minor structural modifications may be performed
on the existing canopy with a building permit as long as_50%
of the structure is. not removed.
S. With the current front and rear setbacks there are only 35'
for which the structure and canopy can be located.
WITH THE FOLLOWING CONDITIONS:
1. This variance is for a service station canopy only.
2. The existing signage shall be brought into compliance with
the ordinance.
Mr. McCartney explained the existing sign as it relates to the
Sign Code. Discussion followed with Board Member ABBOTT
withdrawing Condition #2.. Motion was seconded by Board Member
JIINKER. Motion carried-7-0. Resolution attached. _
