REQUEST The applicant is requesting the approval of a 25' rear. yard setback variance, to the 30' rear yard setback requirement, to allow the existence of a 2-car detached garage.- The garage currently sets 5' from the rear property line-along Hoyt Street. This case was brought to staff''- attention following the issuance of a valid building permit. Upon notice, staff.--re-alized the garage, which is located adjacent a public r-fight-of-way, was well within-the required 3D' rear yard setback requirement. The hardship was created on behalf of the City of Wheat Ridge, for not noticing the non-conforming setback and not asking for the required survey or improvement.location certificate of the property. If a survey was submitted, staff would-have noticed the dual frontage on the lot and required the correct setbacks. According to section 26-15 (E')(b), of the Wheat Ridge Code of Laws, any structure which abuts a public right-of-way must retain a 30' setback. Therefore; since-the property is a through lot and has right-of-way frontages on both the east property line (Hoyt Court) and the west property line- (Hoyt Street), a 30' setback is required from both property lines. II. CRITERIA Staff has the following comments regarding the criteria to evaluate an application-for an adjustment: 1. Can the property in question yield a reasonable return in use, service, or income if permitted to be used only under the conditions allowed by regulation for the District in which it is located;. and, Yes. -Sf denied, the property in question may yield a reasonable. return in use, service or-income. Because most of the homes located off of Hoyt Street provide rear yard views of the adjoining home, the essential character of-the locality is that of an alley. Approval of this variance should not alter the essential character of the locality. 4. Would the particular physical surrounding, shape, or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out; and, No. The property is rectangular in shape and is located in a relatively flat area of Wheat Ridge. But; because the lot is defined as a through lot, there is a 30' setback requirement for both property lines which front public right-of-way (east .and west property lines). 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to other property within the same zoning classification; and, Yes. Anyone may apply for the same type of variance, but the outcome may not be the same. Variations are reviewed on a case by case basis. 6. Is the purpose of the variation based exclusively upon the desire to make money out of the property; and, No. The purpose of the variation is to provide for covered parking on a property that currently does not provide enclosed parking. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property; and, No. As previously stated, the hardship was created upon the issuance of Board of Adjustment Staff Report Page 4 Case No. WA-97-19 the building permit, which allowed for the construction of a detached garage 5' from the rear property-line, while the code requires 30' rear yard setback for structures located-adjacent to a public right-of-way. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and, No. Granting of this variance would not be detrimental to the public. welfare. Because there aren't any adjacent properties which access Hoyt Street, the .placement of the garage -will not. pose as a visual impairment. If approved, the owner should be prohibited to allow for any parking behind the garage, as additional parking may encroach the adjacent public right-of-way. Also, approval of this variance should not be injurious to other property or improvements in the neighborhood. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increased the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood, and No. Approval of the variance would not impair the adequate supply of light and air to adjacent property because the garage is located 5' from the rear property line (Hoyt Street) and complies with the side yard setback requirement. Also, because the garage already exists, there will not be an increase on congestion, danger of fire or endanger public: safety.- 10. If it is found in criteria 8 and 9 above, that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Although approval of this variance will only benefit the owner of the property, it should not hinder the essential. character of the locality. WHEAT RIDGE BOARD OF ADJIISTMENT MINOfiES OF MEETING: July 24, 1997 Page 10 Board Member THIESSEN wanted to know since a valid building permit was issued, is the city liable, and Mr. McCartney replied it states on the permit that the contractor is liable for any problems that may exist on the project, however he would have to contact the city attorney Board Member HOWARD stated many homes in Wheat Ridge have front and back yards that face public right-of-way, and wanted to know how many garages similar to this are built to the rear of their property, and Mr. McCartney said on this street their were two. Board Member HOWARD asked if there were any. houses that face Hoyt __ Court (west side of the street), and Mr. McCartney answered all the houses are addressed to Hoyt Court. Neighbors cannot see this garage from their front windows. Discussion followed. The applicant, Merrill Miller,-Budget Garages, was sworn in. He said the garage is finished and there are no plans to expand it. Don Gallegos, 3645 Holland Court, was sworn in. Mr. Gallegos said his backyard is kind of catty cornered with the .applicant's and stated he has no problems with this request. { Board Member ABBQTT expressed his dislike for the color, and asked if the applicant could re-paint it. Mr. Merrill said this is a vinyl siding and it could not be painted, the applicant would have to remove it which would cost about $2,000. No further questipns were asked. Motion was made by Board Member THIESSEN, that Case No. WA-97-19, an application by Budget Garages, be APPROVED for the following reasons: 1. The applicant has a valid building permit. 2.
