This is to inform you that Case No. WA-97-21 which is a request
for interpretation of the requirement for a 1500' separation between adiacent
auto dealerships itt the Commercial-Two zone district and involves
property located at Lot 2, Vecchiarelli lnd gal Park
will be heard by the Wheat Ridge BOARD OF ADJUSTMENT in the
Council Chambers of the Municipal Complex, 7500_West 29th Avenue
at 7:00 p. m. on August 28, 1997
All owners and/or their legal counsel of the parcel under
consideration must be present at this hearing before the BOARD OF
ADJUSTMENT.

SUBJECT: Drainage at Garrison Lakes/Star Guide
DATE: August 27, 1997
For your information, the outfall pipe system for the Star Guide development at 49th
and Independence Street will soon be under construction. This pipe system will
originate within Garrison Lakes' Development and terminate in the lake on the east side
of Garrison Street within the City of Arvada. It has taken approximately six months to
negotiate the right of way easement for this outfall.
This system will relieve a longstanding drainage problem at Garrison Lakes which was
the result of the negligence of the developer of Garrison Lakes who failed to complete
the outfall which has caused local flooding on the Garrison Lakes Properly since 1984.
In 1984, the Garrison Lakes Developer illegally drained a portion of the development
into the Bayou Ditch. This new pipe system will eliminate that illegal pipe connection
and will help minimize downstream flooding on the Bayou Ditch. The flooding problem
at Garrison Lakes is not nor has never been caused by the Bayou Ditch leaving its
banks.
CONCERNS OF UPSTREAM DRAINAGE
It has been brought to my attention that the residents of Garrison Lakes have received
fliers stating that flooding may result if upstream drainage is allowed to enter the Bayou
Ditch. This Ditch has historically accepted a significant amount of rainfall as it is
topographically the low spot for the entire drainage basin. Any future development can
make a case that this historic situation exists, however, they must still obtain the
permission from the Bayou Ditch Association to discharge any storm drainage directly
into the ditch.
The outfall on the east side of Parfet Street from the Medved dealership (formerly Craig
Chevrolet) was carefully sized to release at historic rates into the open field. The
concept approved by the Bayou Ditch at that time was that in fact historically, the
drainage did enter the ditch, however water quality was an issue. Neil Jacquet from the
Rocky Mountain Water Association (Coors) and Bob Rock (then president of the Bayou
Ditch) agreed that this water would be acceptable only if it was directed into the vacant
field allowing the solids to settle out prior to its entering the ditch. This outfall has since
cut a path directly into the ditch which, in my opinion, should be blocked by berming, to
again allow the water to enter the field and settle before it enters the ditch.
I have no concerns that any future development will increase the risk of flooding of the
Bayou Ditch due simply to the fact that historic release rates must be maintained and
that any direct discharge into the Bayou Ditch, or any other ditch for that matter, must
first be approved by the ditch company prior to the approval by the City.
