If approved, ,there are. no structural improvements planned for the existing residence, so the structure will remain the same. Staff was originally addressed with this matter from the applicant's real estate ,agent. Upon listing of the home, the real estate. agent called..to see if there were any restrictions on ,this property_that he_ should know about. We informed him that the property was sub standard in both lot width and lot area.~.0~ NS's aS ~ aw~~ H^ aM Q~Z ~~" Currently, this is an operational two-family dwelling with one 'unit on top and one unit in the basement. The basement apartment is accessed by a separate door in the rear of the property, and the property provides for adequate parking for both units. It should also be noted that the property is located in a predominantly medium density residential neighborhoody,raJGk- ?~M~/+'e~ Q/ly~- ~~~ N`^"'~'~'~• Pursuant to.el2ction 26-15 (F) of the Wheat Ridge Code of Laws, a duplex or two-.family structure is permitted in the Residential-Two. zone district providing that the property is a minimum 12,500 square feet in lot area and at least 100' in lot width. If the request is denied, the residence 'must .discontinue the use.. as _a __, two-family dwelling and retain a single family status. To date there have been no complaints or letters of opposition. II. CRITERIA Staff-has.-the following comments regarding the criteria to evaluate an application for a variance:- 1. Can the property in question yield a reasonable return in use, service, or income if permitted to be used only under the conditions allowed by regulation for the District in which it is located; and, No. If denied, the property must relinquish the right to rent the basement as a separate unit and retain a single family status. Is the plight of the owner due to unique circumstances; and, No. There ,are several properties in-the City of Wheat Ridge which are substandard for the zone district they are located. 3. If the variation were granted, would it alter the essential character of the locality; and No. There are several two-family dwelling units within the immediate neighborhood, creating a medium density zone district. Also, because the. applicant is not-proposing to alter- the physical features of the structure, the house will continue to blend into the existing community. 4. Would the particular physical surrounding, shape, or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out; and, 6j13{ Yes. Because the property is located in the Residential-Two zone district, the Code of Laws establishes the .allowance of two-.family dwellings in this specific zone district, as long as the property complies with the lot area and. lot width requirements. 5. The hardship has been created by the applicant who has sole interest in the property. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located; and, No .. The granting of this variance will not be detrimental to the public welfare or injurious to o-ther property or improvements as this variance is specifically for the lot size and. shape. There has not been any plans submitted for future expansion or redevelopment of the existing structure, __ 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood, and No. As previously stated, the variance is for the physical shape and area of the property, there aren't any plans to expand the existing structure. Therefore, approval of this request should not impair the adequate supply of light and air to adjacent properties nor increase the danger_of fire.. Also, because this site has been .used as a two-family _ dwelling for a number of years, there should not be a substantial increase in congestion on the public streets. 10.
