Re: Case No. WA-97-26
Case No. WA-97-26 is a request fora 2' front yard setback variance, to the 30' front yard
setback requirement. Approval of the request would allow for a kitchen addition to the
front of the existing structure.. As per Section 26.D.2.a.,the request was administratively
processed without the need of a public hearing. No written or verbal complaints were
recorded.
FINDINGS OF FACT
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by the regulations for the district
in which it is located?
Yes. If denied, the property may continue to be used as asingle-family residential. The
applicant is requesting the variance to enlarge a small kitchen.

Is the plight of the owner due to unique circumstances?
No. The plight of the owner is not due to unique circumstances. The plight of the owner
is due to personal space.
If the variation were granted, would it alter the essential character of the locality?
No. There are other structures within the neighborhood that have non-conforming
setbacks.
Are there any particular physical surroundings, shape or topographical conditions of the
property involved that would result in a particular hardship?
No. The property is a typical rectangular shaped lot, located in a relatively sloped area of
Wheat Ridge. Therefore, neither shape nor topography results in a particular hardship.
5. Are the conditions upon which the petition for a variation is based be applicable,
generally, to the other property within the same zoning classification?
Yes. However, variations are reviewed on a case by case basis and the outcomes may not
be the same.
6. Is the purpose of the variation based exclusively upon a desire to make more money out
of the property?
No. The purpose of the variation is not based upon a desire to make money out of the
property. The applicant is seeking the variance to add more space to their existing kitchen.
7. Has the alleged difficulty or hardship been created by any person presently having an
interest in the property?
Yes. The hardship was created by the applicant, who has interest in the property.
g, Will the granting of the variation be detrimental to the public welfare or injurious to
other property or improvements in the neighborhood in which the property is located?
No. The granting of this variance will not be detrimental to the public's welfare or
injurious to other property or improvements in the neighborhood as this is a minor
addition to the main structure that will still be solely contained on private property.
g, Will the proposed variation impair the adequate supply of light and air to adjacent
property or substantially increase the congestion in the public streets or increase the
danger of fire or endanger the public safety and substantially diminish or impair property
values within the neighborhood?
No. Granting of this request would not impair the adequate supply of light and air,
substantially increase the congestion in the public streets, nor increase the danger of fire as
the proposed addition will comply with the required side and rear yard setbacks, allowing
for adequate separation between structures.
10. If it is found in criteria 8. and 9. above that granting of the variation would not be
detrimental or injurious to other property or improvements in the neighborhood, and it is
also found that public health and safety, public facilities and surrounding property values
would not be diminished or impaired, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished from an
individual benefit on the part of the applicant, or would granting of the variance result in
a reasonable accommodation of a person with disabilities?
Although granting of this variance will be solely for individual benefit, the proposed
addition will be designed to match the existing structure, thereby contributing to the
neighborhood, not detracting.

CONCLUSIONS
Staff finds that:
1. The variance does not exceed 10% of the minimum or maximum standard; and.
2. The "Findings of Fact" as set forth in subsection 26.D.2.c. support the request; and
3. All adjacent property owners have been notified of the request at least 10 days prior to the
rendering of this decision and only one property owner has registered concerns during the
10 day period; and
4. The request will not be a detriment to the neighborhood nor result in an endangerment to
the public's welfare
staff concludes that all conditions and requirements of this request have been met in regards to
Section 26.D.2. Minor Variance or Waivers, therefore, a recommendation of APPROVAL is given __
for Case No. WA-97-26.
