REQUEST Page 2 The applicant is requesting the approval of a 10' side yard setback variance to the 15' side yard setback requirement_to allow the construction_of a single family residence on an existing vacant parcel .__ If approved, the structure. will be located 5' from the south property line. The property in question is part of a 3 lot Planned Residential,. Development that was recently replatted. --As shown on the -- attached plat, the property, shown as lot one, is located in the northern portion of the development adjacent to a designated wetland and drainage area. The property also slopes from south to north, as it approaches the designated wetland. Because of the existing topographical feature, and the fact that there is a designated drainage easement that diagonally cuts across the north portion of the property (see attached exhibit), the applicant believes the odd shaped building envelope has created a hardship. Section 26-25(B)(1)(e) of the Wheat Ridge. Code of Laws states that perimeter setbacks for structures located in a Planned Residential_Development should comply with the standard development requirements established in the specific residential zone districts, unless otherwise-established in the development plan. According to the Schaefer Planned Residential Development, Residential-One development standards must apply-to lot 1. There is a 15' side yard setback requirement for all structures built in_the Residential-.One zone district, therefore, this standard... applies to lot 1 of the Schaefer Planned Development. The development restrictions for lots 2 and 3 is Residential-One A. II. EVALUATION CRITERIA Staff has the following comments regarding the. criteria used to evaluate a variance- request. 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located. Yes.- If denied, the applicant may construct a single-family. residential unit upon the property, within the permitted building envelope. There is a maximum of 40% coverage__permitted on the _ site, thereby allowing up to 5,576 square feet of buildable ... space. 2. Is the plight of the owner due to unique circumstances. Ridge City Council recently approved this development plan, permitting the lot configurations knowing-that all structures would be able to be placed on the property without a need for any variances to the development regulations. Although a drainage easement encumbers a portion of the lot, the property is oversized and will still allow adequate space to build. Therefore, there are no unique circumstances attributed to the, property. 3. If the variance were granted, would it alter the essential character of the locality. No. The property in question, although located in an area of Wheat Ridge which provides larger than average lot sizes, will Yie located adjacent to properties which. permit 5' side yard setbacks for structures (i.e. lot 2 and 3 of the Schaefer Planned Residential Development). 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship upon the owner, as distinguished from a mere inconvenience, if the strict letter of the regulations were carried out. Although the applicant, believes the drainage easement and slope of the property may create a hardship, there is plenty of room on the property to allow for 5;576 square feet of buildable space. Therefore; if the strict letter of the regulations were carried out, the physical shape of the property creates a mere inconvenience for the applicant as distinguished from a particular hardship. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification. Applications are reviewed on a case by case basis, therefore, the outcome may not be the same for each request. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property. No. The purpose of the request is to provide for more building area. If denied, the applicant will have to develop a building plan that will conform to the setback requirements and the drainage easement. Page 4 Board of Adjustment Staff Report Case No. WA-97-27 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property. Yes. The applicant, who has sole interest in the property, purchased the property knowing that there was a drainage easement on the north portion of the property. g, Would the granting of the variation be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. No. The granting of this request would not be~detrimental to the public welfare or other improvements in that there will be a minimum of 10' separation between the proposed structure, and any future development to the south. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. If approved, the proposed structure will retain a 5' side yard setback from the south property line. Therefore, when development on the properties is completed, there should be a minimum separation of 10' between structures on lots 1 and 2. 10. If it is found in criteria 8 and 9 above that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also, found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Request for this variance is purely for the benerovalfofhthis applicant. However, it should be noted that app variance will not create a negative impact on the surrounding neighborhood.
