Board of Adjustment Staff Report Case No. WA-97-32 ~ Weiss I REQUEST Page 2 The applicant is requesting approval of a 15' side yard setback variance to the 30' side yard setback requirement for a property located on a corner. If approved, the 24' X 24' bedroom addition will be located I5' from the side property line along_Twilight Drive. Pursuant to section 26-10 (F)(a), of the Wheat Ridge Code of Laws, ~~any side yard which abuts a public street shall-have a minimum setback of 30' for all structures". .Said property has Twilight Drive along the designated side property line on the south. The applicant intends the proposed addition to allow for the enlargement of an existing master bedroom. Staff-asked the applicant why he could not construct the addition .within the designated rear yard of the property. The applicant replied that.-placing the addition within the side yard would be ideal because the existing master-bedroom is already located on_that side of the house. .Staff was informed that they did_not want to add a second floor because they did not want to'obstruct the view of the other residents.. _ ' Since then, staff has received. numerous phone calls of opposition .for. this request. The sentiment of the opposition was-that approval of this request would alter the essential character of the .locality and would also obstruct the view of_the residents to the east. II. CRITERIA - .. Staff has the following comments regarding the criteria to evaluate an application fora variance:. 1. Can the property in question yield a reasonable return in use, service, or income if permitted to be used only under the conditions allowed by regulation for the District in which it is located? Yes. According to the enclosed site plan, the applicant has plenty of development options for placement of the room addition in the rear of the property. Even though the property is slightly sloped towards the rear property line (west), there are other structures within the immediate neighborhood which have successfully developed with. the same circumstances. Therefore,- if the request is denied, the applicant may continue to use the property as a single-family residence, and propose an alternative location for~the bedroom addition that will comply with the regulations established in the code of laws. Board of Adjustment staff Report- Page 3 Case No. WA-97-32 \ Weiss 2. Is the plight of the owner due to unique circumstances? No. Because the. property contains more .than the minimum lot area requirement (17,424 square feet), and the property is primarily square in shape, there aren't any unique circumstances attributed to this case, 3. If the variation were granted, would it alter- the essential character of the locality? Yes. Throughout the neighborhood where this-property_is located, there aren't any other corner properties which have structures located within the required side yard setback.. Also,__according to the residents of __ this neighborhood,- approval of this variance would alter a view that is characteristic of this neighborhood. 4. Would the particular physical surrounding, shape, or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? No. The structure is currently located on a square lot that contains 17,424 square-feet within it's parameters. Although the property has a slight slope toward the .rear property line (west), there is development potential within the rear of the property. Therefore, neither the shape,- topography .or the physical surrounding would result in a particular hardship. 5. Would the conditions upon which based be applicable, generally, zoning classification? the petition for a variation is to other property within the same Yes. Anyone may apply for the same type of variance, within the same zone district, but the outcome may not be the same. Requests are reviewed on a case by case basis. 6. Is the purpose of the variation based exclusively upon the desire to make money out of the property? Has the alleged difficulty or hardship been created by any person presently having an interest in the property? Yes. The hardship has been created by the applicant who has sole interest in the property. _ _ 8. Would the granting of the variations_be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? _ No. Approval of the request-should not_be detrimental to the public's health, safety and welfare because the applicant is proposing to locate the structure outside o_~ the__required 25'.X 25' sight-distance-triangle. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood? _ No. Because the proposed structure will be located-near_a._public right- of-way and 'not near any other development, approval of the request should not impair the adequate supply of light and air to adjacent properties nor increase the danger of fire.. .Also, because the_use of the residence will. remain. single family, approval of the request sh__ould not increase the congestion in the public streets. Approval of this.. location could also alter-.the views which contribute toward the property values. 10. If it is found in criteria 8 and 9 above, that granting of the variation would not be detrimental or injurious to other property or improvements in the neighborhood, and it is also found that public health and safety, public facilities and surrounding property values would not be diminished or impaired, then, would the granting of the variance result in a benefit or .contribution to the neighborhood or the community, as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? No. Approval of this request is neither a benefit-for the.. community nor for the reasonable accommodation of a handicapped person. This_r_equest_ is based solely upon individual benefit. STAFF'S CONCLUSION Page 5 Staff concludes that the above_criteria does not support the request for a variance.- As the site plan shows, there is adequate room on the .sit e, for an addition to be located_in the rear,pf the ,property.. Although the_ property has a slight slope to the rear property line (west), there are other homes within the immediate neighborhood that have accommodated living area upon the sloped property. Also, staff has concluded £hat, approval _of this request will, alter th_e essential character of .the. locality. . IV RECOMMENDED MOTIONS OPTION A: "I move that case no. WA-97-32, a request for a 15' side yard setback variance to the 30' side yard setback variance, for property located at 31 Hillside Drive, be APPROVED for-the following reasons: 1. 2 - 3." OPTION B: "I move that case no ._ WA-97-31,a request for a 15' side yard setback variance to the 30' side yard setback_variance,_for property located_at 31 Hillside Drive, be DENIED-for the following reasons: 1. The evaluation criteria does not support approval 2. The applicant has other development alternatives portion of the property. 3. Approval of the request will alter the essential locality. 4. The subject property has adequate area for expansion within the existing R-1 setbacks. Without having to obtain any variances, the applicants can expand toward the rear of the lot, or they can add a second story. Two story structures may be prohibited in the subdivision's protective covenants, but these covenants are dated and are no longer being enforced. If the variance were granted, the proposed building addition would stick out at least fifteen feet farther toward the street than the other homes on Twilight Drive. This surely would alter - the essential character of the locality and may be injurious to other property in the neighborhood. And such a nonconforming protrusion is likely to diminish property values in the area. There are approximately fifty other corner lots in Paramount Heights. This week I looked at each of them and found no apparent variances to the thirty-foot setback requirements. The city's records show no previous approvals of any street-setback variances for corner lots in the residential parts of Paramount Heights. One of the desirable features of Paramount Heights is the ample space around and between the homes. Let's do out best keep it that way.
