The City of 7500 WEST 29TH AVENUE WHEAT RIDGE, COLORADO 80215 October 30, 1996 Alec Garbini CM2 Management 2316 Eudora Street Denver, Colorado 80207 Dear Alec: ~Theat Ridge This letter is in response to a proposa] to redevelop property located south of West 32nd Avenue between Teller and Saulsbury Street in the City of Wheat Ridge. Containing just over two acres.. the subject site is split zoned with R-3 zoning on the north and R-2 zoning on the south. In regard to the proposed redevelopment plan, I have the following comments: 1. There is adequate right-of--way width on Teller Street (25' from centerline). A 5' right-of--way dedication will be required for Saulsbury Street. 2. Fifteen foot corner radii right-of--way dedications will be required at both street intersections with West 32nd Avenue. 3. The installation of curb, gutter and sidewalk will be required on Teller and Saulsbury tying into existing improvements on 32nd Avenue. 4. The setback on Saulsbury must be adjusted for the 5' r-o-w dedication. 5. The new garage for the house must be setback 30 ;from Teller. 6. All parking for the apartments must occur on the R-3 zoned portion at a rate of I.5 spaces for each one bedroom unit and 2.0 spaces for each two or three bedroom unit. 7. For each eight multi-family units, one unit must handicapped adaptabie. 8. If the access on Teller Street is to be for emergency only, it should be gated. 9. Any sale of buildings and associated land will require subdivision plat approval. If five or fewer lots are involved and there are no r-o-w dedications required, this is a single step process involving only Planning Commission review. 10. If all land ownership is maintained, it is possible for Staff to review and approve an administrative planned building group plan to allow multiple buildings on a single parcel. This would be applicable only on the R-3 portion. The final document is akin to an official development plan and is recorded with Jefferson County. Please see attached section of the Wheat Ridge Code of Laws. 1 I. In regazd to density, the R-3 zoned portion of the property comprises roughly .86 acres (37,631 square feet). Based on the City's R-3 density formula (one multi- familyunit per every 2100 square feet of land area), this part of the property would support only 17 units rather than the 24 units proposed. 12. Density on the R-2 zoned portion appears adequate with the three duplexes as shown. In summary, with the redevelopment plan proposed, it appears that there is no single step process which would avoid review in a public heazing situation. One option available would be to attempt a rezoning to Planned Residential bevelopment to maintain the highest density possible. With the current administration, successful rezonings in Wheat Ridge are almost impossible without support of the neighborhood. The location of the existing apartment units maybe assumed to be within the R-3 zone. This area appears to be at least 166 feet from north to south, and 317.22 feet from east to west. This totals an area of 52,658 SF. Divided by 2100 SF per unit, this would indicate that 25 units could be located in the R-3 zone if we demolished the existing house. - Evaluating the proposed site plan by use, we can come to another calculation of allowable density. I have reviewed your submittal and have concluded that it, in general, it does not meet the format for a PRD outline development plan. However, I believe this could be fairly easily rectified. The nazrative provided must be incorporated as part of the 24" by 36" sheets on page I. There is an error in the address shown on the first line which should be corrected. The improvement survey plat could be used as a second page as it shows the physical features of the property which is required as part of the outline plan review. More specifically, the following must be included in the plan set for review: Title of the outline development plan. I would suggest you use the following format: "Title" "Outline Development Plan" "An Official Development plan in the City of Wheat Ridge" 2. Legal description of the property 3. List of the permitted uses. This needs to be very specific regarding the breakdown of the types of units and the number of units for each type. The proposed. new construction will use similar building materials to the existing house, and will feature cobble stave, stucco, brick, and lapped siding on the facade, The duplex units will be single story and will employ the same roof form and massing as the existing house.. The aparlsnent structure will be two stories, and will be sited between the existing mature trees so as to reduce its apparent size, The existing Small single family house will be renovated for use as .an on site manager's residence. The .provision of on site management is a reflection of the applicant's concern for the maintenance of the community. Windows of cars and houses have been broken in the past, in all likelihood, by these people. Increasing the number of apartment or rental units will only exacerbate this problem and there is not enough room to accommodate both the renters and their guests on site. 2) Crime- There is a well established connection between income level and the commission of burglaries, robberies and vandalism. Apartment dwellers are typically lower income compared with home owners. 3) Noise- More people in a small area equates with more noise, especially during holidays such as July 4th, Cinco de Mayo, Juneteenth, etc. In the past, people at the existing apartments have launched bottle rockets which land in the surrounding single family neighborhood. 4) "Walk through" traffic- One of the reasons many of us bought in this area is the lack of larger apartment complexes which encourage walking through the neighborhood with pets which evacuate on people's lawns, and younger people who can be intimidating to elderly people, who make up the largest part of this neighborhood. 5) The past record of failure to manage the current apartments well. There are bridges across the ditch, trash thrown in the ditch and blowing around the neighborhood. Why would this be arty different in the future if the owners have failed to do something about it in the past? 6) Incompatibility with the rest of the neighborhood: The entire area around these apartments is single family homes, with only a very few duplexes and rentals. This proposal would substantially change the character of this neighborhood. 7) Property value loss: Historically, when apartment complexes like the one proposed move in, quieter and more considerate neighbors move out, leading to a change for the worse in the long run. Note that the owner himself lives in Golden. 8) Tree loss- It's hard to imagine not having to sacrifice at least some of the trees in the area to accommodate such a cramped project. 9) Unauthorized businesses- Already, the occupants of the "family house" have attempted to start a cleaning business in the area. Other renters would likely try similar things. Garage sales would increase, bringing further traffic congestion to the area. I have the following recommendations: LANDSCAPE: 1. All trees to be trimmed of branches up 6'-8' from the ground to allow for natural visual observation from surrounding areas to the parking lots and building. 2. All shrubs and bushes mature height to not exceed 36". This height reduces th.e risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 3. Plants/landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. TRASH ENCLOSURES: 1. Fencing/wall and gate should be constructed of a material that will allow observation through the structure to lower the risk of criminal activity occurring in and around the enclosure. 2. .The trees/bushes that are indicated on the site plan around the trash enclosure should be eliminated to reduce the risk and fear of crime. BUILDINGS: 1. The building finish should be with an anti-graffiti paint or sealant. 2. It is unknown from the plans were the buildings have entrances and windows. Provided that there are entrances and windows that would allow far consistent observation of the parking areas by normal users and traffic, the parking layout appears to be adequate. If there are places around the buildings that do not allow for observation, the parking areas should be reconfigured to reduce the risk of criminal activity to persons and property. FENCING/GATE: 1. Any solid privacy fencing/walls should be avoided as they provide cover and concealment, • WZ-96-1/Saulsbury Page 2 December 27, 1998 raising risk and fear of crime. Fencing should be constructed of material or in a manner that allow s for observation through. Material or a design such as wrought iron provides visibility and discourages/prevents climbing over. 2. Fencing and privacy walls should be sealed or finished with an anti-graffiti paint/sealant to aid in the ease of clean up. 3. The site plans do no indicate the type of gate or method of operation for the gate. This information will be necessary so as to allow emergency access to the property. SITE: I. During construction, the property should be clearly posted with "No Trespassing" signs. This may help deter trespasses, and allow the Police Department to cite offenders with the crime along with any others offenses that may be committed by trespassers. LIGHTING: 1. Exterior lighting on the drive accesses and in parking lots should be a minimum of 1.5 candle minimum maintained. This will provide for brightly lit areas that discourages criminal activity due to the illusion/perception of observation and recognition. 2.. Interior halls of the apartment building should be lit with minimum of three foot candle minimum maintained. Brightly lit accesses and passage ways, discourage criminal activity due to the illusion/perception of observation and recognition, thus giving a higher sense of security for the normal users. OTHER: 1. It is suggested that the entire property be addressed with one street number with individual units designated in a manner such as "A", "B", etc. This will allow for ease in locating the buildings by emergency personnel. From these plans, I have no further recommendations at this time. Revisions in the plans, may alter my recommendations. While my recommendations do not guarantee acrime-free environment, it has been experienced that application of the concept of Crime Prevention Through Environmental Design (OPTED) will reduce the opportunity for crime to occur and will enhance the quality of life. Windows of cars and houses have been broken in the past, in all likelihood, by these people. Increasing the number of apartment or rental units will only exacerbate this problem and there is not enough room to accommodate both the renters and their guests on site. 2) Crime- There is a well established connection between income level and the commission of burglaries, robberies and vandalism. Apartment dwellers are typically lower income compared with home owners. 3) Noise- More people in a small area equates with more noise, especially during holidays such as July 4th, Cinco de Mayo, Juneteenth, etc. In the past, people at the existing apartments have launched bottle rockets which land in the surrounding single family neighborhood. 4) "Walk through" tratFic- One of the reasons many of us bought in this area is the lack of larger apartment complexes which encourage walking through the neighborhood with pets which evacuate on people's lawns, and younger people who can be intimidating to elderly people, who makeup the largest part of this neighborhood. 5) The past record of failure to manage the current apartments well. There are bridges across the ditch, trash thrown in the ditch and blowing around the neighborhood. Why would this be any different in the future if the owners have failed to do something about it in the past? 6) Incompatibility with the rest of the neighborhood: The entire area around these apartments is single family homes, with only a very few duplexes and rentals. This proposal would substantialiy change the character of this neighborhood. 7) Property value loss: Historically, when apartment complexes like the one proposed move in, quieter and more considerate neighbors move out, leading to a change for the worse in the long run. Note that the owner himself lives in Golden. 8) Tree loss- It's hard to imagine not having to sacrifice at least some of the trees in the area to accommodate such a cramped project. 9) Unauthorized businesses- Already, the occuparns of the "family house" have attempted to start a cleaning business in the area. Other renters would likely try similar things. Garage sales would increase, bringing further traffic congestion to the area. A meeting with the planning commission was scheduled. In late January 1997, the Wheat Ridge city council adopted a moratorium on the processing of PRD developments and processing of this application was stopped. Such moratorium expired on September 30, 1997. During the intervening time, the Wheat Ridge city council adopted a series of ordinances which takes density away from R-3 properties, including PRD developments in the city, and amended the PRD ordinance. In order that we may make appropriate plans for this property, we need to know the policy of the city as to processing the application on file. While we believe the application met the density and other requirements at the time of application, the city council changed the density and PRD regulations during the moratorium. Therefore, we need to know: 1. which PRD regulations apply to the application; 2. which density regulations apply; and 3. will the city process the present application. Section 26-25(IV)IBI(1}(K){31 of the Wheat Ridge Code of Laws, Planned Residential Development District (PRD) is amended to read: Land used for commercial uses shall be calculated separately and may not be included in the land area used to calculate the maximum of i::i,=.~-o:.~~ SIXTEEN (161 RESIDENTIAL units per acre To ensure this, where commercial uses are a part of a Planned Residential Development, the area used for commercial purposes shall be clearly delineated on the plan, including areas used .for parking, ingress, egress, landscaping, etc. If the commercial uses are part of a generally residential building, or for other reasons cannot be clearly separated from the residential areas,' the land attributable to the commercial use shall be considered to be the building square footage occupied by commercial uses, the required parking, and a proportionate share of the common areas, such as ingress-egress, landscaping, roadways, etc. Commercial ventures solely for the use of the residents, such as food service, laundry facilities, etc., shall be considered an amenity rather than a commercial use, and the land and buildings occupied by such uses are not required to be subtracted from the total acreage before computing the maximum ofd'-~-r' SIXTEEN (16f RE5IDENTIAL units per acre. This exemption shall not apply to: (1) new construction where no replacement of a preexisting structure takes place or (2) reconstruction of structures- which were not legally in existence (as distinguished frbm legal nonconforming structures). Section 5. Safetv Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated, under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety- and for the protection of public convenience and welfare. -The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 6, Severability: Conflicting Ordinances Repealed.
