Also attending were Executive Director Ann Pitinga, and LaVonne Youngblood. 3. MoTION by Commissioner ADSIT, seconded by Commissioner MATTHEWS, to excuse the absense of Commissioner Burkepile. Carried 8-0. (motion made before Commissioner.Burkepile.'s arrival at 7:25 p.m.) 4. MOTION by Commissioner MATTHEWS, seconded by Commissioner Dv,.irnLLY, to approve the Minutes of February 4, 1997. Carried 6-0, with Commissioner Roach and Longo abstaining. 5. Public Forum. No one appeared to speak. 7. A. 1. Review of Good Times site plan. The site plan was presented to the Planning Commission on April 3, and is now being presented to EDARC for review and determination of compliance with the Wheat Ridge Urban Renewal Plan. It was the consensus of EDARC Commissioners that it was in conformance with the completion and fulfillment of the goals, and objectives of the Wheat Ridge Town Center Urban Renewal Plan, as amended; and that it increased the sales tax generating facilities and beneficial utilization of land. MoTION by Commissioner Dv.+.~n,,LY, seconded by Commissioner NlATTHEWS, to recommend approval of the Good Times site plan as presented. Motion carried 8-0. ~. B. 1. I have the following recommendations: LANDSCAPE: 1. No tree planted on the east side of the building, next to building No tree planted directly south of above tree These trees have the potential of limiting natural observation of the building and grounds as they mature. This can cause potential for criminal activity to occur or the perception of criminal activity occurring. 2. All other trees on the site to be trimmed of branches up 6'-8' from the ground to allow for natural visual observation from surrounding areas to the parking lots and building. 3. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 4. Plants/landscape immediately next to the building should be low=growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. 5. Existing shrubs on north property line should be kept trimmed to a maximum height of 36". 6. No bushes planted in island east of the handicapped parking. This has the potential of "closing" in the parking space, creating a tunnel effect for users. The bushes also create a potential hiding place, raising the risk of criminal activity to occur in and around any vehicles/persons in the immediate area. These bushes also may make access in/out of a vehicle mare difficult if not kept well trimmed. TRASH ENCLOSURES: 1. Fencing/wall and gate should be constructed of a material that will allow observation through the structure to lower the risk of criminal activity occurring in and around the enclosure. 2. Trash enclosure should be well-lite to prevent criminal activity or the potential of occurring in and around the structure. 3. I have reviewed the plan and have concluded that the following muss be added or changed on the plan face: 1. The title should read: "Lot I, Currier Subdivision" "Final Development Plan Amendment #1" "An Official Development in the City of Wheat Ridge" 2 The correct zoning on the property is PCD and should be referenced as such. 3. A case history box with the following case numbers: WZ-97-6, WZ-90-9, WZ- 80-2, MS-80-2 4. The landscape plan needs to be revised to show all existing plant materials. A total of four street trees are required between the front wall of the structure and the front property line. Staff will also require at least one tree in the patio area and trees and shrubs in the parking lot islands behind the building. 5. The building height must be changed from 17' to 21'. This is consistent with the definition of building height in the zoning code. 6. The signature blocks for Public Service Company, Mountain States, the Director Public Works and the Director of Parks and Recreation can be removed since this is not a platting document 7. The note regarding lighting needs to be expanded to include the following language: "in accordance with Section 26-30(S) of the Wheat Ridge Code of Laws." 8. The site data needs to be revised to show square foot coverage and percent of total site for the following categories: building coverage, outside seating coverage, landscaped coverage (do not include landscaping in the right-of--way), is uLr,, a~ o =:.c=:. • and parking, drives and other hard surfaces 9. The parking requirements should be revised to be shown as required parking for inside seating as 24 plus one handicapped space = 25 plus four additional spaces for outside seating equaling a total requirement of 29 spaces 10. On page 2, more information is needed regarding the freestanding sign including elevations, maximum squaze footage and maximum height 11. On page 3, Staff will not support the lighted facade treatment on the north and south sides 12. On page 3, more information is needed regarding architectural materials and colors. These items should be consistent with those used on adjacent buildings (Safeway Marketplace, Makatura office building to the east and the First Bank building to the north) and with the Town Center Design Guidelines. 13. On page I, there does not appear to be enough room for a wheelchair to manuever from the handicapped parking space to the front door. Please be advised that the front setback for the addition is in violation of the standards pursuant to the the Wheat Ridge Code of Laws. The setback required for buildings fronting Wadsworth Blvd. is 50'. When the original development plan for Rally's was approved in 1990, a 10' front setback variance was granted to allow a 40' front setback. The justification for the variance approval was hardship created because of the 20' right-of--way dedication for Wadsworth. This case can be processed with a front setback variance request but it will not be supported by Planning staff. The chance of the variance being approved by City Council is not good. Please advise me as'to how you wish to proceed. Attached are referral responses received from other City departments and outside agencies. Of particulaz concern is the response received from the Jefferson County Department of Health and Environment. The City of Wheat Ridge will not issue a building permit for expansion until the Health Department's requirements are satisfied. There may be other issues unforeseen at this time which will need w be addressed in the future. Based on the seriousness of the problems with the project, I will not be scheduling this case for Planning Commission public hearing for April 3 as originally discussed. All shrubs and bushes mature height to not exceed 36". This height reduces the risk of persons hiding. It also allows for natural visual observation onto the property both for the parking lot and building. 4. Plants/landscape immediately next to the building should be low-growing ground cover, not to exceed 18" mature height to allow for maximum natural visual observation and eliminate concealment for potential offenders. 5. Existing shrubs on north property line should be kept trimmed to a maximum height of 36". 6. No bushes planted in island east of the handicapped parking. This has the potential of "closing" in the parking space, creating a tunnel effect for users. Planning Division Staff Report Page 2 Case No. WZ-97-6/Good Times I. REQUEST The applicant requests approval of an amendment to a Planned Commercial Development final development plan for property located at 4020 Wadsworth Boulevard. This case was continued from the April 3, 1997, meeting . The property in question was rezoned as part of the Currier property outline development plan approval in 1980. A minor plat was approved in 1981 which created new parcels and the connector drive which runs along the rear of this property. A development plan, originally for Rally's Restaurant was approved in 1991. II. PROPOSED PLAN The original PCD approval allowed for a single story, fast food restaurant with double drive-through windows and no inside seating, but a concrete patio area for outside seating. Site coverage data included 2.45% in building coverage (636 square feet of total building area), 12.56 % landscaped coverage and 84.99% in hard surfaces including the outdoor seating area. As part of the 1990 approval, a 10' front setback variance was granted reducing the required setback along Wadsworth from 50' to 40'. Part of the justification for the variance was the requirements fora 20° strip of land dedicated asright-of--way for Wadsworth Blvd. Although the dedication was required, the street was never built out to the full section. This r-o-w is currently landscaped but is available when additional improvements to Wadsworth are required. Please refer to Exhibit `A' which is a reduction of the approved plan. The proposed addition will be built in line with the front wall of the existing building maintaining the 40° setback. The proposed plan amendment would be fora 1096 square foot addition to allow inside seating bringing gross building area up to 1,757 squaze feet. The building addition would displace some of the existing outside patio dining area with a few covered tables remaining. Required parking is at a rate of 1 space for every 75 squaze feet of gross building azea or 24 spaces. Staff has required pazking for the outside seating area as well plus one handicapped space totaling 29 spaces. Some of the numbers in the site data table on Sheet S 1 are inconsistent and need to be corrected before City Council review. Building coverage of the site would be 7% with 17% in patio coverage , 12% in landscaped coverage and 64% in hazd surfaces. The building will be 21' in height. , In regard to the landscape plan, the new trees (two honey locusts) in front of the building should be moved out of the right-of--way, if possible. Staff would like to see the parking lot island north and opposite of the dumpster enclosure landscaped with at least one tree and four shrubs and the decorative lighting along the north and south sides of the building eliminated . Staff is also concerned that there is inadequate room for a person in a wheelchair to maneuver from the handicapped space to the front door. ~ i Planning Division Staff Report Case No. WZ-97-6/Good Times Page 3 An additional item of concern is the size of the existing freestanding sign. When the original development plan was approved, the existing freestanding sign was also approved. This existing sign is 23 feet tall with a sign face equaling l Ol squaze feet per face. The applicant is proposing no changes to this sign. The current sign size standazds for a building this size would be 40 square feet per side. Staff recommends the freestanding sign be reduced in size to be consistent with the current sign code. The property is located within the Town Center master plan area and, therefore, must be reviewed for compliance with the established design guidelines, included under Exhibit `B'. Architectural materials to be used include tan stucco similaz in color to the McDonald's to the south. The roof has an architectural feature which is similaz in pitch to those used in the Safeway Mazketplace building and the recently completed Makatura office building directly to the eas4 across the Connector Drive. All requirements for a Planned Cormercial Development final development plan have been met. III. AGENCY REFERRALS All responding agencies are currently serving the property. Wheat Ridge Fire Protection District has no problems. Wheat Ridge Sanitation District can serve. Jefferson County Health Department is working with the applicant to resolve interior design issues. Public Works Department will require a revision to the current drainage plan. Colorado Department of Highways will not require additional improvements to Wadsworth Blvd. at this time. EDARC reviewed this request of their March 25, 1997 meeting. Their minutes area attached under Exhibit `C'. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS: Staff concludes that an amendment to the existing Planned Commercial Development final development plan is required to allow expansion of the building for inside seating. Staff further concludes that all requirements for a PCD final development plan have been met and that the plan is in conformance with the Town Center master plan design guidelines. For these reasons, a recommendation of approval is given for Case No. WZ-97-6 with the following-conditions; 1. The two new trees in front of the building be moved out of the right-of--way, 2. DESIGN GUIDELINES 1. The First Bank building at Wadsworth Boulevard and, West 44th . Avenue and the Vectra Bank building on West 38th Avenue have established certain common design elements and features that should be incorporated into future development or redevelopment throughout the balance of the Wheat Ridge Town Center. It is not intended that new/redeveloped buildings try to clone or recreate these buildings, but rather to ~ utilize some of the design elements so that it functions and appears to be a unified Town Center. Those common elements and features that are to be used as unifying design features include the following: a. Use of brick of a similar size and color for facing or accent. b. Use of non-reflective glass with bronze metal frames and 'casings. c. Use of horizontal bands of complementary the or brick as architectural accent. cl. Use of round pillars, where pillars are used, as design feature. e. Use of landscape materials near building entrances and against large blank walls. 2. The use of metal, smooth-faced block or concrete as primary architectural features on exposed walls of buildings shall be kept to a minimum. No more than 20$ of the exposed walls of buildings should incorporate such materials. 3. Generally, the color of buildings, including walls and roof should be earth tones with complementary accents. 4. Building components such as windows, doors, eaves, parapets, and canopies should be visually attractive in proportion, scale and relationship as related to other parts of the same building or adjacent buildings. 5. Mechanical equipment, trash storage areas, outside storage areas, loading docks and other similar elements which tend to be unsightly, shall be appropriately screened or enclosed so. as not to be visible from adjacent properties or public streets. 6. Landscaping shall be designed to achieve the .following objectives: wheat Ridge ~ Center Design Guidelin~ 2 a. Provide an attractive transition and buffer around the street perimeter: b. Provide both separation and buffering adjacent to residential areas. c. Provide visual corridors. to delineate major entrances and major interior drives. d. Provide visual breaks within large expanses of parking lots and to reduce storm water runoff and heat buildup. 7. Exterior lighting within parking lots and along major interior drives should be uniform throughout the Town Center. Area light standards of the type and color as used within the Town Center Park should be used. Light should not be directed towards or allowed to bleed onto adjacent residential properties. 8. Major access points and associated drives, as well as major interior drives should be designed to achieve the following: a. Physical separation and delineation from'park3ng stalls and sidewalks next to buildings by use or curbs and landscaping. b. Protection for pedestrians at major store entrances by use of pavement markings, texture and or optional pavement materials, and through use of appropriate signage. Speed bumps are discouraged. c. Width of lanes should safely accommodate the primary purpose and function of the particular drive, relative to the""location within the Town Center. d. Reckert stated that she had an additional exhibit she received from Economic Development __evitalization Committee for the Commission to review. These were distributed and then Ms. Reckert presented information regazding this case. She entered into the record slides, overheads, staff report and exhibits. She further stated that the sign at this location does not meet today's standazd and that Staff is recommending compliance. The sign vaziance was granted when the original planned development was approved in 1990 to allow this location a chance to compete with surrounding businesses. Discussion occurred regarding pazking requirements, landscaping and its location, irrigation, lighting, size of the building, signage, wheelchair access, proposed architectural design/materials, and setbacks. Chairperson WILLIAMS swore in the applicant Boyd Hoback of 8620 Wolff Court #330, Westminster. Mr. Hoback presented a brief history of the store location. Additionally, he stated this would be the thirtieth store in Colorado however, would be the company's new prototype to include indoor seating. There will be a more up scaled look and will be compatible to the surrounding area. He requested that the Commission allow the size of the sign to remain the same and stated that other issues of concern would be conformed to. REQUEST The applicant requests approval of an amendment to a Planned Commercial Development final development plan for property located at 4020 Wadsworth Boulevard. The property in question was rezoned as part of the Currier property outline development plan approval in 1980. A minor plat was approved in 1981 which created new parcels and the connector drive which runs along the reaz of this property. A development plan, originally for Rally's Restaurant was approved in 1991. II. PROPOSED PLAN The original PCD approval allowed for a single story, fast food restaurant with double drive-through windows and no inside seating, but a concrete patio area for outside seating. Site coverage data included 2.45% in building coverage (536 squaze feet of total building azea), 12.56 % landscaped coverage and 84.99% in hard surfaces including the outdoor seating area. As part of the 1990 approval, a 10' front setback variance was granted reducing the required setback along Wadsworth from 50' to 40'. Part of the justification for the variance was the requirements fora 20' strip of land dedicated asright-of--way for Wadsworth Blvd. Although the dedication was required, the street was never built out to the full section. This r-o-w is currently landscaped but is available when additional improvements to Wadsworth are required. Please refer to Exhibit `A' which is a reduction of the approved plan. The proposed addition will be built in line with the front wall of the existing building maintaining the 40' setback. The proposed plan amendment would be fora 1096 square foot addition to allow inside seating bringing gross building azea up to 1,757 squaze feet. The building addition would displace some of the existing outside patio dining area with a few covered tables remaining. Required parking is at a rate of 1 space for every 75 square feet of gross building area or 24 spaces. Staff has required pazking for the outside seating area as well plus one handicapped space totaling 29 spaces. Some of the numbers iri the site data table on Sheet S 1 are inconsistent and need to be corrected. Building coverage of the site would be 7% with 17% in patio coverage , 12% in landscaped coverage and 64% in hard surfaces. The building will be 21' in height. In regard to the landscape plan, the new trees (two honey locusts) in front of the building should be moved out of the right-of--way back into the Good Times.property frontage. Staff would like to see the parking lot island north and opposite of the dumpster enclosure landscaped with at least one tree and four. Staff is also concerned that there is inadequate room for a person in a wheelchair to maneuver from the handicapped space to the front door. When the original development plan was approved, the existing freestanding sign was also approved. This existing sign is 23 feet tall with a sign face equaling 101 square feet per face. The current sign size standards fora building this size would be 40 square feet per side. The applicant is proposing no changes to this sign and has indicated that reducing the sign would be a hardship for competition reasons.Planning Commission approved the plan allowing this sign to remain. Planning Staff Report Page 3 May 17, 1997 The property is located within the Town Center master plan area and, therefore, must be reviewed for compliance with the established design guidelines, included under Exhibit `B'. Architectural materials to be used include tan stucco similar in color to the McDonald's to the south. The roof has an architectural feature which is similar in pitch to those used in the Safeway Marketplace building and the recently completed Makatura office building directly to the east across the Connector Drive. All requirements for a Planned Commercial Development final development plan have been met. III. AGENCY REFERRALS All responding agencies aze currently serving the property. Wheat Ridge Fire Protection District has no problems. Wheat Ridge Sanitation District can serve. Jefferson County Health Department is working with the applicant to resolve interior design issues. Public Works Department will require a revision to the current drainage plan. Colorad2Department of Highways will not require additional improvements to Wadsworth Blvd. at this time. EDARC reviewed this request at their Mazch 25, 1997 meeting. Their minutes area attached under Exhibit `C'. IV. PLANNING COMMISSION ACTION Planning Commission reviewed this request at a Public Hearing held on May 1, 1997. A recommendation of Approval was made for the following reasons: 1. The property is in the City of Wheat Ridge and all posting requirements and notifications have been made. 2. The amendment to the PCD final development plan is required to allow the building expansion. 3. The proposal is consistent with the Town Center Master Plan Design Guidelines. With the following conditions: 1. The two new trees in front of the building be moved out of the right-of--way. 2.
