SUBJECT:
A revised flood study and a revised grading report for the proposed Koentges residence at
34th Avenue and Simms Street were submitted on May 24, The study and report indicates
that the proposed construction of a retaining wall and re-grading of the site will maintain the
flood flows along Lena Gulch without adversely impacting the flood elevation or flood width
on adjacent properties. The grading plan includes re-grading a portion of property north of
the subject property.
The 100 year flood elevation is approximately 5427.5 feet at the location of the proposed
home, The new structure must be protected to an elevation of 5428,5 feet The first floor
elevation of the new house is reported to be designed at 5430.5 feet above sea level.
I find that the flood study, grading plan and structure elevation are acceptable. The current
design of the house with the retaining wall and grading are satisfactory to issue a Class II
Special Flood Exception Permit The grading plan calls for re-grading an area north of the
Koentges property to Lena Gulch. A permit cannot be issued until Koentges provides
evidence of the right to enter on the adjacent property to perform the required grading.

_Map Revision Data. Certified documentation by a registered professional engineer of as-built
conditions for flood plain alterations were received and submitted to FEMA for a flood insurance
map revision,
_Fill Certificate. A conununity official certified the elevation, compaction, slope and slope'
protection for all fill placed in the flood plain consistent with NFIP regulations Part 65,5 for map
revisions,

property zoned Residential One and located at approximately 3430 Simms Street for the following reasons:
1, The variance has been approved by the director of public works who is the city's floodplain
administrator, and the project has been recommended for approval by staff.
With the following conditions:

or more above the 100-year flood level as per city ordinance,

Now; therefore, be it resolved that Board of Adjustment Case No. TUP-06-01
be, and hereby is approved.
For the following reasons:

1. There should be no impact on the amount of light and air in the
neighborhood.
2; There should be no resultant air, water or noise pollution in excess of
what is already occurring.
3. There will be no impact on utilities, parks or schools.
4. There will be no anticipated increase in automobile traffic in the area.
With the following conditions:
1. Written permission shall be obtained from Xcel Energy to allow
encroachment into their easement prior to issuance ora building
permit for the strncture. .
2. The temporary bnilding shall be allowed for one year starting from
the date of occupancy of the structure in the new location.
3. Currentlandscaping displaced by these improvements shall be
accommodated elsewhere on the site in a location that is visible by the
general public and as approved by staff.
4. No additional parking shall be allowed on Parfet Street and, as per
testimony from staff, this shall be enforced on a complaint basis.

filed by Patrick and Laura Koentges for approval of a Class II Floodplain

property zoned Residential One and located at approximately 3430 Simms

The motion passed 7-0.
Board Member ABBOTT disclosed that he is an acquaintance of the applicant and
that he has no financial interest in this case.
The case was presented by JeffHirt: 'He entered all pertinent documents into the
record and advised the Board there was jurisdiction to hear the case. He also
entered a memorandum from the city's floodplain administrator dated May 24,
2006 into the record, Staff originally recommended denial of the application for
. reasons outlined in the staff report, However, staff agrees with the floodplain
administrator's recommendation contained in the May 24th memo (received after
the staff report was prepared) that the application should be approved with one .
condition,

Tim Paranto, Director of Public Works and Floodplain Administrator, stated that
he recommended approval of the application with the condition that the applicant
provide evidence of the right to enter the adjacent property to perform the
required grading, Board members reviewed the memo at this time,
Those individuals wishing to address this case were sworn in by Chair BELL
Patrick Koentges

Mr. Koentges, the applicant, assured the Board that he would not build a structure
in an area that could incur future flood problems.

In response to a question from Board Member ABBOTT, Tim Paranto stated that
the revised grading plan would remove any fill from the floodway so the volume
would remain constant without raising the floodplain elevation, The grading plan
. requires 25-30 feet of grading north of the subject property toward Lena Gulch to
ensure the adequate flow ofwateL Mr, Paranto stated that he would withhold
approval of the application until such time as the applicant shows he has
permission to access that property, The proposed structure will not have a
basement and aU livable space will be well above the 1 00- year floodplain, The
applicant also plans to build a retaining wall in order to provide further protection,
Board Member BELL asked about runoff problems during construction. Mr,
Paranto explained that, if this application is approved, the applicant will submit a
grading plan and erosion control plan to be approved by the city before a building
permit will be issued,
There were no other individuals who wished to speak at this time, Therefore,
Chair BELL closed the public hearing portion of the meeting.
Upon a motion by Board Member ABBOTT and second by Board Member
BLAIR, the following resolution was stated:

C. Case No. W A-06-06: An application filed,by Holly Hall and Stephanie
McNamara for approval of (A) a 3.5 foot side yard setback variance from
the 15- fO,ot side yard setback requirement resulting in an 115 foot side
yard setback; (B) a 10-foot rear yard setback variance from the 15-foot
rear yard setback requirement resulting in a 5-foot rear yard setback; and
(C) a 136 square foot variance to maximum lot coverage for property
zoned Residential One (R-l) and located at 3880 Everett Street
Board Member HOVLAND disclosed that he is associated with the applicant
through membership in the same homeowners association and that he has no
financial interest in the case,
The case was presented by Travis Crane, He entered all pertinent documents into
the record and advised the Board there was jurisdiction to hear the case, He
reviewed the staff report and digital presentation, He advised that two additional
letters of objection had been received by staff These were entered into the record
and reviewed by the Board, Staff recommended approval of all three variance
requests for reasons outlined in the staff report

I. REQUEST
The property in question is located at approximately 3430 Simms Street, and encompasses two separate lots at
this time, "Lot 2" and Tract "A" ~, Lot 2 is 43,598 square feet (I acre) and Tract "A" is
28,006 (,64 acres) making the total lot area 71,604 (L64 acres), The applicant is requesting a class II floodplain
ex.:eption permit ~o allow .forco~truction of a single family home ~~.

The property is currently zoned Residential One (R-I), and sits vacant with no structures on it The R-I zone
district allows single family residential uses and accessory buildings, The majority of the property is within the
100 year floodplain, All other development standards have been met with this request
Per the Code of Laws Sec 26-808 (D)(1) the Board of Adjustment must hear this case,
II. CASE ANALYSIS
The Wheat Ridge Code of Laws states that in order for any single family home to be constructed in the 100 year
floodplain a floodplain permit must be obtained, Specifically, Sec 26-806 (D) states that any new construction
of any residential structure for human occupancy within the floodplain must obtain a class II floodplain permit,
and plans must be certified by an engineer to the floodplain administrator that the lowest floor is elevated at
least one foot above the base flood elevation, The applicant has submitted all required information, and the
floodplain administrator has not approved the I'equest
The applicant has also submitted the required final drainage report from a registered engineer, which indicates
that the lowest floor of the house will be at least one foot above the base flood elevation of 5428,57 feet

impact on the floodplain and adjacent property, Based on the plans submitted, there may still be an adverse
impact on the floodplain and there is grading proposed on adjacent property ~

approval has been received from adjacent property owners where necessary, The engineer for this project has
expressed that there may be a solution which would make the floodplain permit approvable, Information may
be presented which states this priol' to the public hearing, Howevel', based on the information that has been
presented to staff and reviewed by the floodplain administrator, this application cannot be approved at this time,
Thel'e are also currently two separate properties which encompass the building footprint proposed for the house,
The applicant must consolidate these two lots prior to approval for the building permit, if this floodplain permit
is approved, Consolidation plats can be approved administratively without a public hearing,
II. STAFF CONCLUSIONS AND RECOMMENDATIONS
Upon review of the above I'equest, staff concludes that the single family home as proposed may have a negative
impact on the 100 year floodplain, Therefore, staff recommends DENIAL for the following reasons:
I, The floodplain administrator has not approved the request based on the information submitted at this
time,
2, There may be a detrimental effect on the 100 year floodplain based on the information that has been
submitted and reviewed,

FLOOD STUDY MODELING AND RESULTS
Modeling of the flood plain was done using a 100-year flow of2450 cfs, which is the
flow used in previous studies to establish the 100-year floodplain elevations. A
comparison between the 100-year floodplain elevations from the HEC-2 runs in the
Wright-McLaughlin study and the HEC-RAS calibration run in this study are shown
below:

The runs agree to within 0.11' and are considered calibrated. Furthermore, the finished
floor elevation of proposed structures should be constructed at a minimum elevation of
5428.57. This is I' above the 100-year floodplain elevation at Section 8004 in the
Wright-McLaughlin study, which goes through the site of the proposed residence.

The floodway analysis indicates that the floodway at section 8004, which is the section
that includes the site of the proposed residence, is approximately 84 feet wide.
Furthermore, the proposed fill is outside the limits of the floodway. Therefore, all fill
proposed for this residence is located in the flood storage district and is not in the
floodway district. Thus, the proposed construction is permitted on this lot if a special
exception to build in the floodplain is approved by the Wheat Ridge Board of
Adjustment.
HEC-RAS computer output data are provided in the appendix. The run titled Koentges
Floodway shows the results of the calibration run (the first line of each section in the
output tables) and the encroachment analysis. The run titled Koentges Mitigation
Revised shows the results of the analysis with the proposed grading. Appropriate
portions of the Wright-McLaughlin HEC-2 output are also provided in the appendix. The
appendix also includes a copy of the drawing included in the Wright-McLaughlin study
with the proposed site construction and results of the floodway analysis contained in this
report added. HEC-RAS generated cross sections at river station 8004 for both the
existing and proposed condition are also contained in the appendix.
~ CONCLUSIONS
Tract A of the Valley Brook Subdivision and most of Lot 1 of the Knight Subdivision is
located in the Flood Storage District. Building is permitted in accordance with the City
QfW1i~t~dgeE19QdP~ajn Otdinanceif approved by the City of Wheat Ridge Board of
AdJuStmei1ts.A residence is proposed on this site with a minimum finished floor
elevation of 5430.5, which is well above the minimum elevation of 5428.57 required by
ordinance. Furthermore, excavation along the north property line is proposed to mitigate
the effect of filling in the floodplain required for the residence so that there will be no
increase in the 100-year floodplain elevation when the project is completed.

SUBJECT:
A revised flood study and a revised grading report for the proposed Koentges residence at
34th Avenue and Simms Street were submitted on May 24. The study and report indicates
that the proposed construction of a retaining wall and re-grading of the site will maintain the
flood flows along Lena Gulch without adversely impacting the flood elevation or flood width
on adjacent properties. The grading plan includes re-grading a portion of property north of
the subject property.
The 100 year flood elevation is approximately 5427.5 feet at the location of the proposed
home. The new structure must be protected to an elevation of 5428.5 feet. The first floor
elevation of the new house is reported to be designed at 5430.5 feet above sea level.
I find that the flood study, grading plan and structure elevation are acceptable. The current
design of the house with the retaining wall and grading are satisfactory to issue a Class II
Special Flood Exception Permit. The grading plan calls for re-grading an area north of the
Koentges property to Lena Gulch. A permit cannot be issued until Koentges provides
evidence of the right to enter on the adjacent property to perform the required grading.

Dear Mr. Hollender,
I have completed the second review of the above referenced documents received on May 24, 2006 and have the
following comments:
This letter is to inform you that the GradinglDrainage Plan for the above referenced development have been
reviewed and are hereby approved for construction with the following stipulation:
. Written Approval Required
It appears the proposed grading may encroach onto the adjacent property to the north. Any work to occur
outside of the boundaries of the subject property shall require written approval from the adjacent owner(s)
affected by this project prior to issuance of any Grading or Building permit. If no offsite activity is
anticipated, a letter from you stating that no offsite grading work is to occur will suffice.
Please be aware of the following items regarding the construction of the project:
1. Grading and Erosion Control
The erosion control for the project shall be in place prior to the commencement of any grading activities,
and maintained as needed during the course of construction. Please be advised that additional erosion
control measures may be required if deemed necessary by the City Inspector.
2. Application for GradingIFiIl Permit
Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with
the fees due will need to be submitted for review and approval.
3. NPDES Permit
Due to the area of disturbance exceeding one acre, an NPDES (CDPS) Permit for construction activities
will need to be obtained from the State of Colorado, Water Quality Division and be submitted to Public
Works prior to the issuance of the Minor Grading/Fill Permit.
4. Drainage Certification Reqnired Prior to c.o.
Upon completion of the drainage improvements, the Engineer-of-Record Mr. Henry Hollender, P .E., shall
provide to the City of Wheat Ridge a written, signed and sealed Drainage Certification Letter stating that
the site grading was completed per the approved Grading & Erosion Control and Drainage Plans, all
drainage facilities were constructed and shall function as defmed in the approved Final Drainage
Report/Plan, and that the site has been accurately surveyed to confirm that the grading and the
construction of all drainage facilities was completed in accordance with these documents. The Drainage
Certification Letter shall be submitted to the City for review and approval, and shall be accompanied with
As-Built Plans for all constructed drainage facilities prior to issuance of a Certificate of Occupancy.
5. Public Improvement Restoration, Engineer's Cost Estimate, & Escrowed Funds
Public improvements are required by the City Code of Laws to be constructed along the frontage of all
properties at the time of development. However, since the subject property lies along a portion of Simms
Street which is currently unimproved, escrowed funds are to be taken in lieu of construction of the public
improvements. Per Sec. 26-413 of the City of Wheat Ridge Municipal Code of Laws, prior to any
construction commencing for detention pond(s), stormwater facilities, and/or the required improvements
within the public Right-of-Way, an itemized cost estimate from the Engineer-of-Record or his designee
shall be submitted to the Public Works Department for review and approval. The cost estimate is to be
submitted at the time of Building Permit. Upon acceptance of the cost estimate by the City the funds shall
be placed in escrow. The escrowed funds will subsequently be used to complete the public improvements
along the frontage of the subject property at the time Simms Street is reconstructed by the City of Wheat
Ridge.
6. Construction within the Public Right-of-Way
It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable for the
scope of this project, for snb-grade compaction and other related material tests for any improvements to
be constructed within the public Right-of-Way.
(SEE ATTACHED MATERIAL SAMPLING & TESTING REQUIREMENTS)
7. Right-of-Way Construction Pennit(s)/Licensing
Prior to the construction of any improvements, utility service connections, etc. within the public Right-of-
Way, the required Right-of-Way Construction Permit(s) and respective licensing shall be submitted to the
Department of Public Works for processing. Right-of-Way Construction Permits are issued only after
approval of all required technical documents, including but not limited to, the Final Drainage Report &
Plan, Final Plat, Final Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction
Plans, Grading & Erosion Control Plan, and easement and/or ROW dedications.
8. 2- Year Warranty Period for Public Improvements
The Contractor shall warrant all work performed within the public right-of-way for a period of two (2)
years, commencing upon completion of all constructed public improvements and Final Acceptance by the
City Inspector. Prior to the expiration of said 2-year Warranty Period, if the City Inspector deems that the
constructed public improvements are in such condition as to require repairs or replacement, the
Contractor shall complete such repair work upon request per the City of Wheat Ridge Permit Testing and
Inspection Requirements.

MATERIALS AND TESTING REQUIREMENTS
FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
DESCRIPTION
Materials sampling and testing for public improvements shall be performed by an independent
materials testing company at the expense of the developer, and/or utility district. Unless
otherwise designated, all referenced specifications, standards or policies shall be the latest
edition as revised or updated by approved supplements published and issued prior to the date of
the building permit.
REQUIREMENTS
All materials sampling and testing shall be performed by certified, experienced and qualified
materials testing technicians who work under the supervision of a registered professional
engineer in the State of Colorado. All materials sampling and testing equipment shall be
serviceable and have current calibrated certifications.
Soil classifications and moisture-density curves shall be provided to the Department of Public
Works inspector prior to in-place density testing. Materials testing technicians shall furnish
copies of failed test results to the inspector as promptly as the results become available. On a
weekly basis when testing is being performed, the developer shall furnish the inspector with
copies of all test results taken during the prior week and a cover letter, signed by the supervising
registered professional engineer, which summarizes the results and discusses any failed tests or
inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing procedures of
verification and central lab requirements shall be as specified in the Frequency Guide Schedule
of the Colorado Department of Transportation Field Materials Manual. One test is required for
any fraction of the specified frequency. The reference to Section 203.07 in the table is from the
Colorado Department of Transportation Standard Specifications for Road and Bridge
Construction.

Dear Mr. Hollender,
I have completed the first review of the above referenced documents received on April 21, 2006 and have the
following comments:
Final Drainage Report (Discussion)
1. Please include the following information in the Proposed Project Description portion of the
Report:
a. The 1 OO-year floodplain elevation for this area as determined by the Flood Study.
b. The square footage and finished floor elevation of the proposed building.
c. State whether or not a basement is to be constructed for the proposed building, and if a
basement is to be constructed, describe all waterproofmg methods to be incorporated into
the design (please be specific).
2. To support the Final Drainage Report, the information presented in the Flood Study Conclusion
should also be included in the Final Drainage Report.
3. If a structural retaining wall is to be constructed (please see comment 2 under the Grading &
Erosion Control Plan below), please describe this in the discussion and include the wall
specifications and details in the Appendix.
4. Describe how the flows which may run to the southerly side of the structure will leave the
property per the proposed grading plan (i.e., by grading in a swale along the easterly side, etc.).
5. If there is an existing swale along the westerly side ofthe subject property that currently serves
upstream properties, the swale will need to be included in the discussion and shown on the Plan.
Final Drainage Report (Appendix)
I. Include any retaining wall specifications and details (if applicable).
Final Drainage Report (plan)
I. IdentifY the sub-basin design points on the Plan.
2. Some of the contours do not appear correct:
a. The 5426 contour along the northerly side of the parcel is shown as a straight line across
the subject property to the easterly border. It is unlikely the contour match at the easterly
side would look like this.
b. The 5427 contour is also a straight line on the north of the building to the westerly side of
the parcel, and the contours appear to go nowhere south of the building. These need to be
revised to reflect how the site is to actually be graded (see the redlined Plan).
2. The contours shown on the Plan will need to be revised per comment 2 under the Grading &
Erosion Control Plan below. If applicable, show any structural retaining walls.
3. Please show the elevation of the 100-year floodplain as determined by the Flood Study.
4. IdentifY the swale along the westerly side of the subject property. If the swale currently serves
upstream properties lying south of the subject property, the proposed pipe under the driveway
will need to be constructed within the public (Simms St.) ROW so it may be maintained by the
City, and also be made of concrete (RCP) with a minimal 18" diameter.
5. If there is no existing swale serving upstream properties, the 15" CMP shall be constructed
completely within the subject property.
6. Please include to-scale cross'sections for A-A through C-C with this Report.
Flood Study
I. Please provide the pre-construction and post-construction ("before & after") cross-sections for
Cross-Section #8004 per your discussion with Tim Paranto.
Grading & Erosion Control Plan
I. The area to be where native seeding is to be placed needs to be clearly identified on the Grading
& Erosion Control Plan. (You might consider using some AutoCAD hatching to identifY this
area).
2. The proposed grading along the northerly side of the structure is too steep given the proximity to
the building foundation. Both the Public Works and Building Departments recommend that the
"shelf' lying between the structure and the proposed sloped area be a minimum of 10 feet, and
the slope itself being no greater than a 4: I. The structure could be moved southerly to
accomplish this, or if the building is to remain in its current location, a structural retaining wall
will need to be utilized.
3. Correct the contours as mentioned in the comments for the Drainage Plan above.
4. IdentifY the elevation of the 100-year floodplain.
5. It appears some offsite grading is to occur with the proposed Plan. Prior to the commencement
of any offsite grading, written permission from the respective landowner(s) shall be provided to
the City.
The Public Works Department requires 2 signed and stamped copies ofthe revised Final Drainage
ReportlPlan, Flood Study, and Grading & Erosion Control Plan. Please provide the above with the next
submittal.
Public Improvements, Engineer's Cost Estimate, & Escrowed Funds
Public improvements are required by the City Code of Laws to be constructed along the frontage of all properties
at the time of development. However, since the subject property lies along a portion of Simms Street which is
currently unimproved, escrowed funds are to be taken in lieu of construction of the public improvements. Per Sec.
26-413 of the City of Wheat Ridge Municipal Code of Laws, prior to any construction commencing for detention
pond(s), stormwater facilities, and/or the required improvements within the public Right-of-Way, an itemized cost
estimate from the Engineer-of-Record or his designee shall be submitted to the Public Works Department for
review and approval. The cost estimate is to be submitted at the time of Building Permit. Upon acceptance of the
cost estimate by the City the funds shall be placed in escrow. The escrowed funds will subsequently be used to
complete the public improvements along the frontage of the subject property at the time Simms Street is
reconstructed by the City of Wheat Ridge.

Right-of-Way Construction Permit(s)fLicensing
Prior to the construction of any improvements, utility service connections, etc. within the public Right-of-Way,
the required Right-of-Way Construction Permit(s) and respective licensing shall be submitted to the Department
of Public Works for processing. Right-of-Way Construction Permits are issued only after approval of all required
technical documents, including but not limited to, the Final Drainage Report & Plan, Final Plat, Final
Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction Plans, Grading & Erosion
Control Plan, and easement and/or ROW dedications.
2-Year Warranty Period for Public Improvements
The Contractor shall warrant all work performed within the public right-of-way for a period of two (2) years,
commencing upon completion of all constructed public improvements and Final Acceptance by the City
Inspector. Prior to the expiration of said 2-year Warranty Period, ifthe City Inspector deems that the constructed
public improvements are in such condition as to require repairs or replacement, the Contractor shall complete
such repair work upon request per the City of Wheat Ridge Permit Testing and Inspection Requirements.
Application for Minor GradinglFilI Permit
Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with the fees
due will need to be submitted for review and approval. This Permit is issued at the time of the Building Permit.
NPDES Permit
Due to the area of disturbance exceeding one acre, an NPDES (CDPS) Permit for construction activities will need
to be obtained from the State of Colorado, Water Quality Division and be submitted to Public Works prior to the
issuance of the Minor Grading/Fill Permit.
Drainage Certification Required Prior to c.o.
Upon completion of the drainage improvements, the Engineer-of-Record Mr. Henry Hollender, P.E., shall provide
to the City of Wheat Ridge a written, signed and sealed Drainage Certification Letter stating that the site grading
was completed per the approved Grading & Erosion Control and Drainage Plans, all drainage facilities were
constructed and shall function as defined in the approved Final Drainage Report/Plan, and that the site has been
accurately surveyed to confirm that the grading and the construction of all drainage facilities was completed in
accordance with these documents. The Drainage Certification Letter shall be submitted to the City for review and
approval, and shall be accompanied with As-Built Plans for all constructed drainage facilities prior to issuance of
any Certificates of Occupancy.

Planning staff is recommending a second continuance of case number WF -06-02, a request for approval
of a Class II Floodplain Exception Permit to allow construction of a single family home on property
zoned Residential Once (R-l) and located at approximately 3430 Simms Street to the May 25,2006
Board of Adjustment public hearing.
This case was continued indefinitely at the March 23, 2006 Board of Adjustment public hearing and
reset and renotified for the April 27, 2006 Board of Adjustment public hearing. Per the Board of
Adjustment Bylaws, Article V, no. 3, ifthe case is continued for an indefinite period oftime it must be
reset and renotified to be heard again. If the case is continued for a definite time, no additional notice
must be given. Staff is recommending continuance to a definite time, May 25, 2006.
All required information was submitted to hear this case; however it was concluded by planning and
public works staff that there are multiple issues remaining that must be addressed prior to hearing this
case.

The floodplain permit for approx 3400 Simms (Koentges) will be heard before the Board of
Adjustment on Thursday, April 27 at 7:30 pm and it will be the first case on the agenda.
The case was continued from the last hearing because of a lack of information submitted to
make a recommendation. Thus far, the information submitted for this case is -
_ Existing conditions survey - this survey shows the base flood elevation on the site
(5427 and 5428 feet) and is stamped by a PLS.
_ Grading and erosion control plan - this shows the footprint of the building and the
lowest floor elevation (5430 feet). This plan was prepared by an engineer but not stamped.
So my question for you is - is this sufficient information to proceed with the hearing and
make a recommendation? Or as the floodplain administrator do we need additional
information to consider the case? We don't need official sign off from you prior to the
hearing, only after the Board makes their decision and they want their building permit. I
will forward the information received to you.

Subdivision (3400 block of Simms St). The property is within the floodplain; therefore a
Class II floodplain permit will be required. . .

Planning comments:
The applicant is proposing to construct a single family residence on property which is
located in the floodplain. As a result, a floodplain permit will be required. Per Sec. 26-
806 (0), a Class II floodplain permit will be required.
Please be aware of setback requirements in the R-1 zone district. If applicable setbacks
and development standards are not being met with this request, a variance may be
required. If there are buildings proposed which encroach into existing lot lines, either a
consolidation plat or lot line adjustment will be required to alleviate this issue.
Public improvements will be required along the subject lot's frontage of Simms Street
where there are none existing.
The process for applying for a Class II floodplain permit entails submittal of the
application, $750 fee + $90 public notice fee. The request must be heard at a public
hearing before the City's Board of Adjustment. The Board of Adjustment meets on the
fourth Thursday of each month. The next hearing available is the March 23, 2006
hearing. Please be aware that after the application has been received, a referral process
will be necessary. . This will entail a 15 day period in which all of the necessary
departments and agencies (Urban Drainage, etc.) are notified of the request and given an
opportunity to respond. This must occur prior to the Board of Adjustment public hearing.

Public Works has reviewed this location and have the following comments:
1. Public improvements will be required on Simms Street.
2. The subject lot is currently situated in the flood plain. Thus, Class IT Flood Plain Permit will be
required. It is not clear if the proposed portion or the entire building structure will be located in
the floodway or flood storage area. PW recommends that applicant to retain an engineer to assist
in the permitting process and also to determine the structure location with respect to the flood

Per the requirements of the City of Wheat Ridge, we are
submitting the following outline for our request to construct a
single family home on the site known as Tract "A", Valley Brook
Subdivision and Lot 2 Tract "B" of the Knight Subdivision in the
3400 Block of Simms St.
A. Our request is to construct a single home on said lots with an
attached multi-car garage.
B. Place the home on the Eastern portion of Tract "A" and the
NE portion of Tract "B", Lot 2.
C. Construct a Basement only upon flood plain verification of
elevations.
D. Fully landscape the site.
As architects, builders and developers, we are well versed in the
construction methods required for potential flood plain issues and
hope that the City of Wheatridge would issue a construction permit
for our proposed residence.

1. THE CONTRACTOR SHALL NOTIFY THE CITY OF ' WHEAT RIDGE AT LEAST
THREE DAYS PRIOR TO STARTING CONSTRUCTION.
2. EROSION CONTROL MEASURES WILL BE INSTALLED PRIOR TO GRADING
ACTIVITIES.
3. AT ALL TIMES DURING CONSTRUCTION, ALL TEMPORARY AND PERMANENT
EROSION AND SEDIMENT CONTROL MEASURES SHALL BE MAINTAINED AND
