The Wheat Ridge Community Development Department has received a request for approval of
a class I floodplain permit at the property located at 4198 Xenon Street. No response from you
will constitute having no objections or concerns regarding this proposal.

conditions for flood plain alterations were received and submitted to FEMA for a flood insurance
map reVISIOn.

RE: Comments on Fence Permit Submittal for Prospect Recreation District property at 4198
Xenon St, Wheat Ridge, CO.
Dear Mr. Crane:
The following is a response to the City of Wheat Ridge comments dated September 6, 2006,
and addressed to Mr. Dave Kuehn of Prospect Recreation & Park District. The comments are
shown in italics with our responses following.
Portions of the proposed fence appear to be located within the limits of the 100-year
floodplain. I have included an aerial which approximates the location of the proposed fence
in conjunction with the floodplain limits. Pursuant to Section 26-806 of the Wheat Ridge
Code of Laws, a class I flood plain permit is required for any fence located within the
floodplain.
You have a few options regarding the proposed fence permit. You may move the portion of
the fence that is located in the floodplain to an area which is not in the floodplain. You also
have the option of having your engineer delineated the location of the floodplain on the site
plan, showing the fence outside the floodplain limits. The third option is to apply for a class I
flood plain permit. A class I flood plain permit will require the submittal of engineering
documents produced by your engineer to show that the fence is of 'break-away' construction
and that the construction of the fence will not adversely affect properties up or down stream.
Response: Enclosed please find a Flood Plain Development Permit for the proposed fence. We
have revised the plan to show the floodplain in the approximate location as shown on the aerial
provided by the City. In addition, the fence alignment has been adjusted so that only a minor
length of fence is within the floodplain. This section is parallel to the floodplain delineation and
was established after discussions between Bill Willis of Martin/Martin Inc. and the City of Wheat
Ridge.
We have also included documents that we have used in our research regarding the location of
the floodplain. It is our opinion that the 1 OO-year floodplain as established by the Flood Hazard
Area Delineation-Clear Creek, (1979 Gingery Associates, Inc.) is at an elevation of
approximately 5,423 feet. These elevations are confirmed on the Flood Insurance Rate Map
(panel 08059C0194 E Effective June 17, 2003).

Since Martin/Martin's topographic survey of the site was conducted using the same datum as
the Flood Hazard Delineation Study, it is our opinion that the 100-year floodplain actually lies
below the edge of the bank of Clear Creek and that no part of the fence is within the 100-year
floodplain.
Thanks for your continued cooperation in relation to placement of the fence within the City's
delineation of the 1 OO-year floodplain. If you feel that our interpretation of the situation is a better
approximation, please let us know and we will amend the drawing accordingly.
