Dear Mr. Hollender,
I have reviewed the drainage and erosion control plan for 10400 W. 44ht Ave. and have no
comments regarding it. Listed below is the summary of comments from other departments
regarding the Erosion Control Plan and general comments regarding the project/Final
Development Plan Amendment.
. Attached are the comments from the Public Works Department regarding the
Grading and Erosion Control Plan for the Newgate Apartments at 10400 W. 44tl,
Ave. All required corrections must be made to the plans before any permits can be
obtained. The approval of the Grading and Erosion Control Plan does not
constitute approval ofthe amendment to the Final Development Plan.
. Before any construction of the carports or garages may begin, the Final
Development Plan must be approved and recorded at with Jefferson County Clerk
and Recorders Office. If site grading or fill is required as a part of this project, a
grading! fill permit must be obtained before doing any of this work. The erosion
control measures will be required to be in place before the grading or fill work
begins.
. A pre-construction site inspection was perfonned on February 27, 2008. The
report from the inspection is attached. All issues addressed in the pre-construction
site inspection report will need to be addressed.

Re: - Second Review Comments of the Grading, Drainage, & Erosion Control Plan for the
Newgate Apartments garage & carport project located at the at 10400 West 44th Avenue.
Dear Mr. Hollender,
I have completed the second review of the above referenced documents received on February 26,
2008. This letter is to inform you that the above-mentioned document for this site has been
reviewed and approved for construction by the Department of Public Works with the following
stipulation:
Stipulation of Approval:
. The straw bail shown along the westerly side of the property to be used for erosion
control purposes shall be replaced with a 12" (minimum) straw wattle per the current
City standards.
In addition, please be aware of the following items regarding the construction of the project:
I. Grading and Erosion Control
The erosion control for the project shall be in place prior to the commencement of any grading
activities, and maintained as needed during the course of construction. Please be advised that
additional erosion control measures may be required if deemed necessary by the City Inspector.
2. Application for GradingIFiII Permit
If applicable, prior to the commencement of any onsite grading, an Application for
GradinglLandfill Permit, along with the fees due may need to be submitted for review and
approval.
3. Drainage Certification Required Prior to C.O.
Upon completion of the drainage improvements, the Engineer-of-Record Mr. Henry Hollender,
P.E., shall provide to the City of Wheat Ridge a written, signed and sealed Drainage Certification
Letter stating that the site grading was completed per the approved Grading, Drainage, and
Erosion Control Plan, and that all drainage facilities (including roof drains) were constructed in
accordance with this document. The Drainage Certification Letter shall be submitted to the City
for review and approval prior to issuance of a Certificate of Occupancy (or Certificate of
Completion) and be accompanied by As-Built Plans. The As-Built Plans shall include spot shots
depicting the comers of all completed structures and adequate elevations for all items to ensure
proper construction.

Two (2) copies of the "As-Built" Plans shall be submitted as follows:
a. I copy is to be on full-size 24" X 36 " bond paper, signed and sealed, and
b. 1 copy is to be on electronic media (DVD or CD-ROM) and shall be in an AutoCAD
compatible (DWG) format.
4. Public Improvement RestorationlDebris Tracking
It will be the responsibility ofthe of the contractor for the project to repair any damage to the
existing public improvements along W. 44th Avenue or W. 42nd Avenue as a result ofrelated
construction traffic in the area. Also, the contractor will be responsible for maintaining W. 44th
Avenue and W. 42nd Avenue on a regular basis such that they remain free of construction debris
and tracking from construction traffic accessing the site.
5. Right-of-Way Construction Permit(s), Licensing, and Bonding
If applicable, prior to any construction within the public right-of-way, the necessary Right-of-
Way Construction Permit(s) and respective licensing will need to be submitted for processing by
the City. Right-of-Way Construction Permits are issued only after approval of all required
technical documents, including but not limited to, the Final Drainage Report & Plan, Final Plat,
Final Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction Plans,
Grading & Erosion Control Plan, Traffic Control Plan, and easement or ROW dedications. In
addition, if the cost of the proposed public improvements exceeds $10,000, additional warranty
bonding shall be required.

GENERAL COMMENTS: I did a preliminary site review and took pictures. I noticed erosion on the west side
of the property behind the headwall of the irrigation ditch culvert. An existing light pole may need relocated on
the south west parking lot since that area will now be a garage. The new ditch on the west properlY line behind
the llaralle may need to be rocked. The side walk connections to the new oarking llaral:!e at the tennis courts are

Dear Ms. Peppers,
The application for the Final Development Plan Amendment for the propeIty at 10400 W. 44th Ave in the City of Wheat Ridge has been
received and I have the foHowing comments.

1. The north elevations of the two proposed northern most garages are visible from W. 44th Avenue and will need to include
architectural elements that make these elevations more visually appealing. The Architectural and Site Design Manual
requires that at least 25% of a fayade visible from a public street shall contain ample amount of visual interest and avoid
monotony through the use of multiple materials, faux windows, or other architectural elements.
2. The northern 3 proposed garages on the west side of the property are proposed to be built with in a 10 foot drainage and
utility easement. The garages will need to be re-Iocated so they are shown not to be constructed in this easement.
3. Please change the number of detached garages to twelve (12) and the number of carports to six (6).
4. Please indicate the heights at mid-roof of all garages and carports on the elevations on subsequent pages.

1. The elevations which have doors to access tenant storage will be required to be adjacent to other garages. They will not
be pemtitted on ends which are open and within public view.
2. At least one security light mounted on an exterior wall of one of the garages for the areas between the garages is
recommended for security and public safety.
3. The brick wainscot on the front and side elevations of the garages will need to be extended onto the rear elevation of all
the garages as to incorporate a change in materials as required by the Architectural and Site Design Manual.

V The carports with a back wall will need to incorporate the use of another material on the rear elevation in order to break
~the large expanse of the "blank wall" as required by the Architectural and Site Design Manual.

2. According to the Public Works Department, there is public right-of way for the construction of Miller Ct. extending
from W. 44'" Ave. to W. 42nd Ave. across this property. Several buildings have been built over the right of way;
therefore the construction of Miller Ct. will not occur. The City of Wheat Ridge requests that the property owner file an
application for right-of way vacation by ordinance in order to convey this land to the property owner. I will be in
contact over the phone to further discuss this matter.
Please review the responses and redline of the other commenting agencies and make changes accordingly for the second. After
all concerns have been addressed and the corrections have been made please resubmit four full size copies of the plat to me for
further inspection. Upon the correction of all discrepancies, the final Development Plan Amendment will be sent to the
Community Development Director where the amendment will be approved, approved with conditions, or denied.

Dear Mr. Hollender,
I have completed the first review ofthe above referenced documents receiyed on November 8, 2007 and have the
following comments:
Grading & Drainage Plan
I. Please show the roof drain discharge direction as being parallel to the ditch for the structures
adjacent to the ditch, as opposed to perpendicular or flowing directly into the ditch due to long
term erosion concerns. (Or provide erosion control measures along the bank, which will require
approyal from the Ditch Co.).
2. Need to provide sediment control along the ditch during construction for all proposed structures
or any other areas of disturbance in the yicinity of the ditch.
3. Rename the sheet to "Grading, Drainage, and Erosion Control Plan".
4. The 3 garages lying on the northerly side of the ditch appear to encroach into the 10 Drainage &
Utility Easement. As no permanent t structures are allowed within the easement area, the
proposed structures will need to be relocated to lie outside of the easement.
Final Development Plan (Amendment)
I. No comments at this time.
The Public Works Department requires 2 signed and stamped copies and one electronic copy in pdf
format of the revised Grading, Drainage, & Erosion Control Plan. Please provide these with the next
snbmittal.
Application for Minor Grading/FiII Permit
Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with the fees
due will need to be submitted for review and approyal. This Permit is issued at the time of the Building Permit.
Drainage Certification Required Prior to C.O.
Upon completion ofthe drainage improvements, the Engineer-of-Record Mr. Henry Hollender, P.E., shall provide
to the City of Wheat Ridge a written, signed and sealed Drainage Certification Letter stating that the site grading

Dear Meredith,
We have reviewed this site plan for conformance with the 2003 International Fire Code
and have the following comments:
1. ~o Parking Fire Lane signs will need to be posted at the garage and carports to
prohibit the parking of vehicles that would block access to the structures.

2. The developer needs to provide a plan noting the existing hydrant locations in
reference to the new garage and carport structures. Existing fIre hydrants will need
to be located and accessible within 300 feet of the structures. Additional fIre hydrants

an administrative Final Development Plan Amendment at the property located at 10400 W. 44th
Ave. No response from you will constitute having no objections or concerns regarding this
proposal.
Case No.: MZ-07-04/Newgate
Request: Amend the recorded Final Development Plan to allow for the construction of
garages and carports for tenants. Approximately 48 single car garages will
replace 67 open parking spaces and 70 carport parking spaces will replace 56
open parking spaces. The existing parking lot will be utilized as well as areas

TITLE:
Approval of Right-of-Way Vacation for Miller Court, from the north line of
West 43rd Avenue northward to the south line of West 44th Avenue.
Executive Summary:
Miller Court was dedicated as a public roadway by the Travis Subdivision plat back in 1951.
Subsequent to this dedication, the Newgate in Wheat Ridge Subdivision was platted over a
portion of the Travis Subdivision. During the course ofthe Newgate development project,
apartment buildings were apparently allowed to be constructed over the previously dedicated
Miller Court Right-of-Way. Staff recommends that the Miller Court Right-of-Way be vacated
across the Newgate Apartments property to remove ROW which will never be used, and to clear
up the title for the Newgate Apartments.
Statement ofthe Issues:
The Newgate in Wheat Ridge Subdivision plat was filed at the Jeffco Clerk's office on September
15,1972. Several apartment buildings were constructed within the Newgate in Wheat Ridge
Subdivision, some of which lie directly over the dedicated Miller Court Right-of-Way. As these
buildings have been standing within the Miller Court Right-of-Way for more than 35 years, it
would appear that the Miller Court Right-of-Way in this area will never be utilized for public
roadway purposes. The Miller Court Right-of-Way should be vacated across the Newgate

This request is regarding the Newgate Apartments located at 10400 W. 44th Avenue. The
property in question is 15 acres in size and has 264 multi-family units on it. The property
is under new management and the new managers would like to provide tenants with
alternative parking options. Currently all parking is uncovered surface parking. The
management company would like to provide both carports and garages for their tenants in
addition to uncovered parking. Some of the existing surface parking and recreation areas
will have to be used to accommodate these structures.

Planning comments:
The property currently has Planned Residential Development (PRD) zoning, with a
recorded Final Development Plan (FDP) which was approved in the early 1970's.
Although the site plan is shown on the FDP, there are no established design parameters
for the development therefore; Staff will be applying the R-3 development standards for
new construction on the property.
Because the garages and carports are not shown on the existing FDP, the applicant
must amend the FDP show the proposed improvements on the property. The final
development plan amendment will be an administrative review without need for public
hearings pursuant to the criteria listed in section 26-311 (amendments to development
plans).
It appears that there will be a small reduction in the amount of parking provided as the
new structures may displace a few spaces. A total of six uncovered space will be
displaced with the new structures. The development still exceeds the current standard for
parking based on the breakdown of unit types.
Because the project is for an addition to a multi-family project, the standards of the
Architectural and Site Design Manual must be considered. The elevations of the garages
as proposed are shown as having stucco exteriors with no other change in materials.
Staff is requesting that the exteriors of the garages be upgraded to include a brick
wainscoting to match the apartment buildings. The carports would remain as proposed.
The garages shown on the very south side of site appear to be located in the W. 42nd
Avenue right-of-way. They must be relocated and would have to meet a minimum 30'
setback from the street. The applicant indicated that they could be relocated to a different
part of the site. The setback from internal property lines is required to be 5' for structures
8' or less in height (measured to roof midline) and 10' for structures over 8' in height.
There is an existing 10' wide drainage easement which crosses the property in a west-to
east configuration. There is an existing ditch located within the easement. The flows and
ditch configuration must be maintained.
No civil drainage design documents will be required with the FDP amendment and
building permit. However, required swale locations and downspouts locations with
directions of flow must be shown.
There is a 50' wide unused right-of-way for Miller Court which crosses the property from
the southern property line north to W. 44th Avenue. Staff is showing that this right-of-way
is still in place and has buildings and other site improvements located on it. As such,
Staff would like to see this vacated and would request that the applicant initiate the
vacation application. The city would prepare the legal description and waive fees for this
process. Right-of-way vacations require public hearings in front of both Planning
Commission and City Council.

The first step towards approval of an administrative amendment to a FDP began with the
pre-application meeting held on August 2. Staff anticipates the FDP amendment to be
two pages with a site plan and structure elevations included. A surveyor's seal is required
for the document. The FDP amendment and vacation procedure can be processed
concurrently.
Upon submittal of an application to amend the FDP the project will be reviewed by the
assigned staff member. During this time the request will also be sent to other city
departments and referral agencies for comment. When the review is complete the staff
planner will prepare comments regarding required modifications to the document and to
inform the applicant of other issues from other departments that need to be addressed. If
all requirements have been met, the administrative amendment can be approved. Once
approved, the FDP document will be recorded with the Jefferson County Clerk and
Recorder's office as an Official Development Plan.
