SUBJECT: REZONING OF PROPERTIES LOCATED AT 4976 AND 5000 ROBB STREET FROM A-1 TO PID_ DATE: JULY 23, 1992 TIME: 7:00 P.M_ LOCATION: 8600 RALSTON ROAD - RE/MAX WEST OFFICE BUILDING NEIGHBORS ATTENDING: SEE ATTACHED SHEET The neighborhood meeting was held to inform the residents of the intent of the developer to rezone the subject property from its existing A-1 zone to PID. The intent of the rezoning is to allow the construction of four (4) warehouse buildings (with small office spaces) which range in size from 3,000 square feet to 12,000 square feet. (See attached exhibits). We informed the neighbors present of the process the City requires a property to follow when requesting a zone change and that the neighborhood meeting is the first step in that process. We informed the neighbors that they also have the opportunity to express their concerns, if any, at the Planning Commission public hearing, and also at the City Council public hearing., There was an introduction of the proposed project_ A proposed site plan exhibit and architectural rendering elevations were presented to show the neighbors what the buildings would moat likely look like. There was a general discussion indicating the pros and cons of the project. The following is a listing of the concerns that were brought out during ,the meeting: 1. In general the project was received tentatively by the neighbors. The acknowledged the landscaping planned and were favorable with the amount of landscaping shown, but were concerned with continued maintenance. We informed them that a Owners Association will be formed to taker of items such as these. 3. They were concerned with the fact that Valley Water District will need to extend a 16-inch water main to the project site from the south. We assured them that a traffic plan will need to be approved by the City that will insure ample access to the neighborhood. 4_ Concerns about exterior upkeep of the structures. We informed them that the unite would be individually owned, but an overall Covenant Control would be placed on the property that will address these types of concerns_ 5. Mr. Hawn was concerned about the possible contamination or affect of the development to his water well. We informed him that all precautions would be taken during the construction of the site against any such contamination_ These were the major items of concern. I have included the sign up sheet and my hand written notes for your records. I have also included a copy of the Notice of Neighborhood Input Meeting £orm that was mailed out. The property is mainly covered by weedy vegetation and trees. The trees do offer significant wildlife habitat and should be protected if at all possible. The proposed spring detention area will benefit wildlife more if it is in a natural state: If the detention area is constructed in a artificial medium (ie. concrete), the use by wildlife will be minimal. Currently the area is used occasionally by many species including, foxes, raccoons, skunks, deer and many species of birds. Again, if the trees can be maintained, and the detention area constructed in a natural state, the impact of -this proposed development on wildlife should be minimal. REQUEST The applicant is requesting approval of a rezoning from Agricultural- One to Planned Commercial Development and for approval of a combined outline and final development plan and plat. The property is located at 5000 Robb Street and the purpose of-the rezoning is for construction of four office/warehouse buildings. There is a small, single-family residence on the front of the property which will eventually be demolished. II. DEVELOPMENT PLAN The applicant is proposing a combined outline and final development plan. The intent of the outline plan is for establishing land use allowances and general development parameters. Uses allowed within the development are C-1 and C-2 uses with outside storage. The development plan proposes four office/warehouse buildings with a total of 35,000 square feet o£ floor area. All minimum setbacks for commercial development have been met. Each building site shows a small amount of screened outside storage. Site data breakdown includes 23~ of building coverage, 45$ in paving and 29~ of landscaped coverage. Building height is limited to 50 feet. Notes have been added regarding signage, landscaping and outside lighting. Existing trees which will remain have been shown. A six-foot-high solid fence should be added along the southern property line to provide buffering for the.. residence to the south. Staff concludes that the requirements for a combined outline and final development plan have been met. III. PLAT The applicant proposes a four-iot subdivision consistent with the platting requirement for planned developments. A 30-foot right-of-way dedication occurs for Robb Street. No right- of-way is being shown for West 50th Avenue. A storm water detention .easement and cross-access/ingress-egress easement have been added to the plat face. All other requirements of the Subdivision Regulations have been met. IV. STREETS Pursuant to Case No. WPA-90-1, West 50th Avenue .was removed as a Major Regional Arterial from the Major Streets Plan. However, the minutes Planning Commission Staff Report Page 3 Case No. WZ-92-7/Todd from the April 23, 1990 City Council meeting indicated that the connection of local streets occur instead, including West 50th Avenue_ between Oak and Robb Streets. See Exhibit 'A'. Staff has requested a thirty-foot right-of-way dedication for West 50th Avenue along the northern property line. The development plan and plat do not reflect this dedication. In 1986, when the Craig Chevrolet development was approved, a forty- foot right-of-way dedication occurred for West 50th Avenue. This street was never built but abuts the subject property at the northeastern corner. Construction of the street on the subject property and adjacent property to the east would provide this link between Parfet and Robb Streets. Staff concludes that it is clear that Planning Commission and City Council intended to improve east-west traffic circulation opportunities in this area. It is also clear that intention was established for West 50th Avenue by the requirement of a dedication upon the Craig Chevrolet Subdivision immediately to the east. We therefore recommend that the development and plat be revised to show a thirty-foot dedication for West 50th Avenue along the northern property line. Please refer to Exhibit 'B'. V. AGENCY RE ERRALS All agencies can serve the property with certain improvements. Valley Water District will require extension of a 16-inch water main from Robb Street Park. Anew eight-inch water main is required on site. Arvada Fire District will require three hydrants. Colorado Division of Wildlife requests that existing mature trees remain on-site and that the detention area at the southeast corner be kept in a natural state. City of Arvada indicates that the proposal will be consistent with the land to the north which is zoned PUD-I (Planned Office/Industrial Parks). They did not comment regarding West 50th Avenue except that Ridge Road is classified as a collector to the north. Public Works is reviewing a drainage report and street construction plans for Robb Street. They are requesting a collector half-street dedication for West 50th Avenue. VI. A meeting for neighborhood input was held on July 23, 1992. Enclosed under Exhibit 'C' is a synopsis of that meeting. Planning Commission Staff Report Page 4 Case No. WZ-92-7/Todd VII. CRITERIP~ Staff-has the following comments regarding the criteria used to evaluate a rezoning request. 1. That the change of zone is in conformance, or will bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive --- Land Use plan and other related policies or plans for the area. The Comprehensive Plan designates this area as Industrial. Staff concludes that the proposed rezoning, uses allowed and development of the site would be compatible with this category. The Major Streets Plan amended per Case No. WPA-90-1 designates the West 50th Avenue corridor as a collector between Kipling Street and Ward Road. Staff concludes that because no dedication is shown for West 50th Avenue, the plan is contrary to the Major Streets Plan of the Comprehensive Plan. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. Although there is adjacent residential development to the south, the applicant is trying to mitigate impact by placing buildings on the northern portion of the property. An effort should be made to keep existing trees. A six-foot solid fence should be built along the southerly lot line. 3. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. There could be economic benefits derived from the rezoning. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. The owner will be responsible for extending utility main-lines to service the development. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, create drainage problems, or seriously reduce light and air to adjacent properties. That the property cannot reasonably be developed under the existing zoning conditions. The front of the property is currently being used as a single-family dwelling. 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Approval of the development will not constitute spot zoning. 8. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. Approval of the project will attract new business to the City of Wheat Ridge. Staff concludes that the criteria used. to evaluate a rezoning generally support approval of this request, except that no dedication occurs for West 50th Avenue. Staff recommends the development plan be amended to show this dedication. VIII. CONCLUSIONS & RECOMMENDATIONS Staff concludes that all requirements of the Subdivision Regulations have been met and that the submittal meets the requirements for a combined outline and final development plan. Although Staff concludes that rezoning to Planned Commercial Development is generally consistent with the Industrial designation on the Comprehensive Plan, no dedication is shown for West 50th Avenue and therefore, the proposal is contrary to the Major Streets Plan. Based upon noncompliance with the Major Streets Plan, Staff is obligated to recommend DENIAL. Should Planning Commission, however recommend approval, we would suggest the following stipulations: 1. A six-foot-high solid fence be shown along the southern property line; and 2. Staff initiate an amendment to the Major Streets. Plan to eliminate West 50th Avenue; and 3. Staff initiate a vacation of existing right-of-way dedicated for West 50th Avenue by the Craig Chevrolet Subdivision. IX. REQUEST Page 2 The applicant is requesting approval of a rezoning from Agricultural- One to Planned Commercial Development and for approval of a combined outline and fina`1 development plan and plat. The property is located at 5000 Robb Street and the purpose of the rezoning is for construction of three office/warehouse buildings. There is a small, single-family residence on the front of the property which will be demolished. II. CASE HISTORY At their October 18 public hearing, Planning Commission .reviewed a request for this property showing four office/warehouse buildings. A recommendation of Denial was given for the following reasons: 1. The property is located within the City of Wheat Ridge, and all notification and posting requirements have been met, therefore there is jurisdiction to hear this case; 2. Without a dedication for West 50th Avenue, it is contrary to the Mayor Streets Plan; 3. Until such time as an alternate street plan is in place, Commission does not feel comfortable. in recommending approval; and 4. Staff recommends Denial. III. DEVELOPMENT PLAN The applicant is proposing a revised combined outline and final development plan. The intent of the outline plan is for establishing land use allowances and general development parameters. Uses allowed within the development are C-1 and C-2 uses with outside storage. The development plan proposes three office/warehouse buildings with a total of 34,000 square feet of floor area. All minimum setbacks for commercial development have been met. Buildings 2 and 3 show a small amount of screened outside storage.- The buildings have been re- oriented to the north with a secondary access to West 50th Avenue. Site date breakdown includes 22% of building coverage, 31o in paving and 25~ of landscaped coverage. Building height is limited to 50_ feet. -Notes have been added regarding signage, landscaping and outside lighting. Existing trees which will remain have been shown. A six-foot-high solid fence should be added along the entire length of the southern property line to provide buffering for_the residence to the south. Staff concludes that the requirements for a combined outline and final development plan have been met. Planning Commission Staff Report Case No. WZ-92-7/Todd IV. PLAT Page 3 The applicant proposes a three-lot subdivision consistent with the platting requirement for planned developments. A 30-foot right-of-way dedication occurs for Robb Street. A 30-foot right-of-way dedication is being shown for West 50th Avenue. A storm water detention easement and cross-access/ingress-egress easement have been added to the plat face. V. STREETS Pursuant to Case No. WPA-90-1, West 50th Avenue was removed as a Major Regional Arterial from the Major Streets Plan. However, the minutes from the April 23, 1990 City Council meeting indicated that the connection of local streets occur instead, including West 50th Avenue between Oak and Robb Streets. See Exhibit 'A'. Staff has requested a 30-foot right-of-way dedication for West 50th Avenue along the northern property line. The development plan and plat have been amended to reflect this dedication. In 1986, when the Craig Chevrolet development was approved, a 40-foot right-of-way dedication occurred for West 50th Avenue. This street was never built but abuts the subject property at the northeastern corner. Construction of the street on the subject property and adjacent property to the east would provide this link between Parfet and Robb Streets. Staff concludes that it is clear that Planning Commission and City Council intended to improve east-west traffic circulation opportunities in this area. It is also clear that intention was established for West 50th Avenue by the requirement of a dedication upon the Craig Chevrolet Subdivision immediately to the east. Staff concludes that the amended plan and plat are consistent with the Major Streets Plan. IV. AGENCY REFERRALS The revised submittal was re-referred to affected outside agencies. All agencies can serve the property with certain improvements. Valley Water District will require extension of a 16-inch water main from Robb Street Park. New eight-inch and 12-inch water mains are required on site. Arvada Fire District will require three hydrants. They have no objection to the revised plan. City of Arvada indicates that the proposal will be consistent with the land to the. north which is zoned PUD-I (Planned Office/Industrial Planning Commission Staff Report Page 4 Case No. WZ-92-7/Todd Parks). They have no objection regarding West 50th Avenue dedication: Public Works is reviewing a drainage report and street construction plans for Robb Street and West 50th Avenue. VII. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on July 23, 1992. Enclosed under Exhibit 'G' is a synopsis of that meeting. VIIY. CRITERIA 1. That the change of zone is in conformance, or will bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive Land Use plan and other related policies or plans for the area. The Comprehensive Plan designates this area as Industrial. Staff concludes that the proposed rezoning, uses allowed and development of the site would be compatible with this category. The Major Streets Plan amended per Case No. WPA-90-1 designates the West 50th Avenue corridor as- a collector between Kipling Street and Ward Road. Staff concludes that because a dedication is shown for West 50th Avenue, the plan is consistent with the Major Streets Plan of the Comprehensive Plan. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. Although there is adjacent residential development to the south, the applicant is trying to mitigate impact by placing buildings on the northern portion of the property as much as possible. An effort should be made to keep existing trees. A six-foot solid fence should be built along the southern lot line. 3. That there will be social, recreational, physical and/or . economic benefits to the community derived by the change of zone. There could be economic benefits derived from the rezoning. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. The owner will be responsible for extending utility main lines to service the development. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic , congestion, create drainage problems, or seriously reduce light and air to. adjacent properties. Planning Commission Staff Report Case No. WZ-92-7/Todd Page 5 The project should not adversely affect public health, safety and welfare. 6. That the property cannot reasonably be developed under the existing zoning conditions. The front of the property is currently being used as a single-family dwelling. 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Approval of the development will not constitute spot zoning. 8. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. Approval of the project will attract new business to the City of Wheat Ridge. Staff Concludes that the criteria used to evaluate a rezoning generally support approval of this request, and, therefore recommends approval of the development plan. IX. CONCLUSIONS AND RECOMMENDATIONS Staff concludes that all requirements of the Subdivision Regulations have been met.and that the submittal meets the requirements for a combined outline and final development plan. Staff concludes that rezoning to Planned Commercial Development 3s generally consistent with the Industrial designation on the Comprehensive Plan, and with a dedication shown for West 50th Avenue the proposal is consistent with the Major Streets Plan. For these reasons a recommendation of Approval is given for Case No. WZ-92-7 with the condition that a six-foot-high solid fence be shown along the entire length of the southern property line and that the entry design (i.e., brick veneer or other material)'be carried out on all sides of the buildings with street exposure. RECOMMENDED MOTION OPTION A: "I move that Case No. WZ-92-7, a request for rezoning from A-1 to PCD and for approval of a combined outline and final plan and plat for property located at 5000 Robb Street, be Approved for the following reasons: 1. The intent of the rezoning is to allow the construction of four (4) warehouse buildings (with small office spaces) which range in size from 3,000 square feet to 12,000 square feet. (See attached exhibits). We informed the neighbors present of the process the City requires a property to follow when requesting a zone change and that the neighborhood meeting is the first step in that process. We informed the neighbors that they also have the opportunity to express their concerns, if any, at the planning Commission public hearing, and also at the City Council public hearing. There was an introduction of the proposed project. A proposed site plan exhibit and architectural rendering elevations were presented to show the neighbors what the buildings would most likely look like. There was a general discussion indicating the pros and cons of the project. The acknowledged the landscaping planned and were favorable with the amount of landscaping shown, but were concerned with continued maintenance. They were concerned with the fact that Valley Water District will need to extend a 16-inch water main to the project site from the south. We assured them that a traffic plan will need to be approved by the City that will insure ample access to the neighborhood_ 4. Concerns about exterior upkeep of the structures. We informed them that the units would be individually owned, but an overall Covenant Control would be placed on the property that will address these types of concerns_ 5. Mr. Hawn was concerned about the possible contamination or affect a£ the development to his water well. We informed him that all precautions would be taken during the construction of the site against any such contamination. These were the major items of concern. I have included the sign up sheet and my hand written notes for your records. I have also included a copy of the Notice of Neighborhood Input Meeting form that was mailed out. This is a reconsideration of a Denial recommendation by Planning Commission at the October 15, 1992 public hearing. The applicant has submitted a revised development plan and plat for the property located at 5000 Robb Street. Mr. Gidley reminded Commission that Case No. WZ-92-7 had been previously reviewed October 18 at which time a recommendation of Denial was given. He presented the staff report, which included slides. Entered and accepted by the Chairperson were the Comprehensive Plan, Subdivision Regulations, case file and packet materials, slides and exhibits. Mr. Gidley read his memo dated November 19, 1992 a response to Plaza 5000 proposed development from the Board of Land Commissioners, who recommend denial based on the dedication for W. 50th Avenue. Commissioner QUALTERI had some concern about the mention, in the letter from the Board of State Land Commissioners, of SLB owning a portion of W. 50th Ave. Mr. Gidley explained that Robb Street is not a dedicated public street, but is a prescriptive right, which is a right earned by general public practice. He noted other areas of Robb Street not dedicated. Mr. Gidley doubted that SLB could close Robb Street at any time. Commissioner RASPLICKA questioned the need for a 16-inch water line going up Robb Street. Mr. Gidley stated a 16-inch water line is oversized for this particular development. He understood that Valley Water District requires the over-sizing based upon the assumption that there will be a need to service additional properties. He thought the Planning Commission Minutes Page 4 November 19, 1992 r developer of this project is financially responsible only for a 12-inch water line and then future owners would pay for the additional size. He further recommended that the northernmost one foot of W. 50th Avenue not be dedicated as a public street allowing the City of Wheat Ridge some control over access. Ivan Hawn, 4900 Robb Street was sworn in. Mr. Hawn stated he was the property owner to the south of the proposed development. 'He asked that Planning Commission use their best judgement when making a decision on this proposed development and that he and his neighbors would try to live with it. Richard Todd, 4570 Teller Street was sworn in. Mr. Todd stated he felt the staff had addressed the issue well and he was available to answer questions. In the pursuit of this mission, we seek development projects on our holdings, and development adjacent to our properties is typically beneficial to the SLB. However, we believe this instance to be different. By this letter, we are formally stating our opposition to this proposed project, and request that your Planning Commission deny approval based on the proposal's incomplete addressing of road and traffic requirements in this area. The proposal indicates a 30' easement for W. 50th Avenue, but the balance of the street easement would have to come from the SLB. In addition, the extension of Robb Street to the north to Ridge Road is not a dedicated easement. This access bisects the SLB property and may be inappropriate for any anticipated travel. The SLB has not been contacted by the developer to try to cooperatively resolve these issues. REQUEST The applicant is requesting approval of a rezoning from Agricultural- One to Planned Commercial Development and for approval of a combined outline and final development plan and plat. The property is located at 5000 Robb Street and the purpose of the rezoning is for construction of three office/warehouse buildings. There is a small, single-family residence on the front of the property which will be demolished. II. DEVELOPMENT PLAN The applicant is proposing a combined outline and final development plan. The intent of the outline plan is for establishing land use allowances and general development parameters. Uses allowed within the development are C-1 and C-2 uses with outside storage. The development plan proposes three office/warehouse buildings with a total of 34,000 square feet of floor area.- All minimum setbacks for commercial development have been met. Buildings 2 and 3 show a small amount of screened outside storage. The buildings are oriented to the north with a secondary access to West 50th Avenue. Site date breakdown includes 22~ of building coverage, 31$ in paving and 25~ of landscaped coverage. Building height is limited to 50 feet.- Notes have been added regarding signage, landscaping and outside lighting. Existing trees which will remain have been shown. A six-foot-high solid fence is planned along the entire length of the southern property line to provide buffering for the residence to the south. Staff concludes that the requirements for a combined outline and final development plan have been met. II2. PLAT The applicant proposes a three-lot subdivision consistent with the platting requirement for planned developments. A 30-foot right-of-way dedication occurs for Robb Street. A 29-.foot right-of-way dedication is being shown for West 50th Avenue. A one- foot strip is dedicated to the City to enable us to control access points from the land to the north, which is in the city of Arvada. A storm water detention easement and cross-access/ingress-egress easement have been added to the plat face. City Council Staff Report Case No. WZ-92-7/Todd IV. STREETS Page 3 Pursuant to Case No. WPA-90-1, West 50th Avenue was removed as a Major Regional Arterial from the Major Streets Plan. However, the minutes from the April 23, 1990 City Council meeting indicated that the connection of local streets occur instead, including West 50th Avenue between Oak and Robb Streets. See Exhibit 'A'. Staff has requested a 30-foot right-of-way dedication for West 50th Avenue along the northern property line. The development plan and plat reflect this dedication. - In 1986, when the Craig Chevrolet development was approved, a 40-foot right-of-way .dedication occurred for West 50th Avenue. This street was never built but abuts the subject property_at the northeastern corner. Construction of the street on the subject property and adjacent property to the east would provide this link between Parfet and Robb Streets. Staff concludes that it is-clear that Planning Commission and City Council intended to improve east-west traffic circulation opportunities in this area. It is also clear that intention was established for West 50th Avenue by the requirement of a dedication upon the Craig Chevrolet Subdivision immediately to the east. Staff concludes that the amended plan and plat are consistent with the Major Streets Plan. V. AGENCY REFERRALS -. _ All agencies can serve the property with certain improvements. Valley Water District will require extension of a 16-inch water main from Robb Street Park. New eight-inch and 12-inch water mains are required on site. Arvada Fire District will require three hydrants.- They have no objection to the plan. City of Arvada indicates that the proposal will be consistent with the land to the north which is zoned PUD-I (Planned Office/Industrial -- Parks). They have no objection regarding West 50th Avenue dedication. Public Works is reviewing a drainage report and street construction plans for Robb Street and west 50th Avenue. State Land Board concurs with the 50th Avenue dedication. See attached Exhibit 'B'. VI. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on July 23, 1992.,_Enciosed under Exhibit 'C' is a synopsis of that meeting. City Council Staff Report Case No.. WZ-92-7/Todd VII. CRITERIA Page 4 1. That the change of zone is in conformance, or will bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive Land Use plan and other related policies or-plans for the area. The Comprehensive Plan designates this area as Industrial. Staff concludes that the proposed rezoning, uses allowed and development of the site would be compatible with this category. The Major Streets Plan amended per Case No. WPA-90-1 designates the West 50th Avenue corridor as a collector between Kipling Street and Ward Road. Staff concludes that because a dedication is shown for West 50th Avenue, the plan is consistent with the Major Streets Plan of the Comprehensive Plan. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to be derived. Although there is adjacent residential development to the south, the applicant is trying to mitigate impact by placing buildings on the northern portion of the property as much as possible. An effort should be made to keep existing trees. A six-foot solid fence is shown along the southern lot line. 3. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. There could be economic benefits derived from the rezoning. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. The owner will be responsible for extending utility main lines to service the development. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, create drainage problems, or seriously reduce light and air to adjacent properties. The project should not adversely affect public health, safety and welfare. 6. That the property cannot reasonably be developed under the existing zoning conditions.. The front of the property is currently being used as a single-family dwelling. City Council Staff Report Case No. WZ-92-7/Todd Page 5 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Approval of the development will not constitute spot zoning. 8. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially appropriate at the location, considering available alternatives. Approval o£ the project will .attract new business to the City of Wheat _ Ridge. Staff concludes that the criteria used to evaluate a rezoning generally support approval of this request, and, therefore recommends approval of the development plan. VIII. PLANNING COMMISSION ACTION At their October 18 public hearing, Planning Commission reviewed a request for this property showing four office/warehouse buildings. A recommendation of Denial was given for the following reasons: 1. The property is located within the City of Wheat Ridge, and all notification and posting requirements have been met, therefore there is jurisdiction to hear this case; 2. Without a dedication for West 50th Avenue, it is contrary to the Major Streets Plan; 3. Until such time as an alternate street plan is in place, - Commission does not feel comfortable in recommending approval; and 4. Staff recommends Denial.. See Exhibit 'D' which is a reduced version of the original submittal. Subsequent to that hearing, a revised plan was submitted showing a street dedication for West 50th Avenue. The revised plan and plat was reviewed by Planning Commission at a public hearing held on November 19, 1992. A recommendation of Approval was made for the following reasons: 1. All requirements of the Subdivision Regulations have been met; and 2. The submittal meets the requirements for a combined outline and final plan and plat; and 3. The rezoning to Planned Commercial Development is generally compatible with the Industrial designation on the Comprehensive Plan. The entry design (i.e., brick veneer) be carried out on all sides of the buildings with public street exposure;. and 3. The City of Wheat Ridge retain a one-foot strip of the north easement of the property; and 4. The Planning Commission recommends Approval of this rezoning and development-plan and final plat, however, should City Council desire to approve the original plan submitted by the applicant instead of the plan herein recommended, the Planning Commission would accept that decision without requirement of a referral back to the Planning Commission for another public hearing. The items stated under. condition numbers 1. and 3. have been incorporated into the plan being reviewed by City Council. IX. CONCLUSIONS AND RECOMMENDATIONS Staff concludes that all requirements o£ the Subdivision Regulations have been met and that the submittal meets the requirements for a combined outline and final development plan. Staff concludes that rezoning to Planned Commercial Development is generally consistent with the Industrial designation on, the Comprehensive Plan, and with a dedication shown for West 50th Avenue the proposal is consistent with the Major Streets Plan. For these reasons a recommendation of Approval is given for Case No. WZ-92-7 with the condition that the entry design (i.e., brick veneer. or other material) be carried out on all sides of the buildings with street exposure. (Case No.=X2.;-77 (Richard Todd for Phillip Haas) Council Bill 35 was introduced on second reading by Phil Edwards; title read by the Clerk; Ordinance No. 917 assigned. Glen Gidley presented the case and entered exhibits into the record. Richard Todd, 4570 Teller Street, applicant, was sworn in by the Mayor and asked for approval of the rezoning. Motion by Phil Edwards that Council Bill 35 (Crdinance 917), a request for rezoning from A-1 to PCD and for approval of a combined outline and final plan and plat for property located at 5000 Robb Street, be approved for the following reasons: 1. All requirements of the Subdivision Regulations have been met. 2. The submittal meets the requirements for a combined outline and final plan ad plat; and 3. The rezoning t Planned Commercial Development is generally compatible with the Industrial designation on the Comprehensive Plan. With the following condition: The entry-design (i.e. brick veneer or other material) be carried out on all sides of the buildings with public street exposure; seconded by Mr. Shanley.
