Please refer to the enclosed redlined document. Page 1 sec.2 I am unclear as to which model is being used and why the "previous model" did not reflect existing conditions, yet cross sections, hydraulic parameters and design discharges were taken from them. Please explain in more detail. Page 2 The aerial photo with pasted on site plan is not acceptable. Existing contours are not readable on my copy. There is no reference ,- to vertical datum, and the contours on the site do not match the contours on the aerial photo. Page 3 One of the conditions of development was the placement of a six foot solid privacy fence on the west and south boundary line of the subdivision. It appears this was not considered in your analysis, nor was backwater discussed. State the base flood elevation at this cross section. State what the minimum finished floor elevation must be to comply to the flood plain ordinance. ~, x,.,.,,;~~~.,,.,, Futura Engineering, Inc. August 25, 1994 Page 2 Use a taller vertical scale to show more elevation detail. I see no site grading between structures to allow for proper drainage of the site. Page 4 sec.4 The table shows both models as "existing." Page 4 sec.5 The enclosed plan/profile sheet does not show existing and proposed contours for on-off site conditions. Keep in mind that this review is for the flood plain exception only. Public improvement review will be done at the final plat stage. However, when we get to that, please show existing profile grade of the curb and gutter to the north, and how your new design will match the existing grade. Page 4 sec.6 Please state the required minimum finished floor elevation. In looking at the UDFCD flood plain study of 1975, the existing site appears to be much lower in elevation than it is presently. If this site has been illegally filled over an extended period of time, the conditions of the site prior to the fill placement must be considered as "existing conditions." This is because the original flood plain boundary and water surface elevation was based on those previous conditions. Any fill which was placed after 1975 should be considered as proposed and its affects included in the new cross-sectionr-If; in fact, it°is determined that this fill was illegally placed, and this exception to the flood plain is not approved by the board of adjustment, then the illegal fill shall be ordered removed or is effects to the flood plain considered separately. If the fill shows no effect, then a fill permit will be issued for the site so that a record of the fill exists which shows compliance with the floodplain regulations. Please let me know if you agree that the site has been filled based on your field information. On the 6308 cross section on page 3, the site would appear as an "island" within the flood plain. We appreciate the opportunity to review this request. We have the following comments to offer: The site is located within the 100-year floodplain of Lena Gulch as shown on the current Flood Insurance Rate Map for the City of Wheat Ridge. 2. The report "Hydraulic Analysis of the Lena Gulch Floodplain at Quail Street, Wheat Ridge, Colorado" is adequate as faz as it goes, but it does not contain sufficient information to justify the issuance of a Special Exception Permit. The requirements of the Wheat Ridge floodplain zoning provisions regazding special exception permits should be listed and the manner in which the proposal meets each of these requirements should be clearly stated. For example, a statement should be included that indicates that the proposed development is not located within the floodway district since structures aze prohibited in the floodway district. Once it is determined That the proposed structures are iocated in the flood storage district, structures for human occupancy can only be permitted "upon a certification by a registered professional engineer to the floodplain administrator that the lowest floor, including basement, is elevated to one (1) foot or more above the base flood elevation." No such statement is included in the hydraulic analysis. 3. A map showing the existing and proposed 100-year floodplains should be included. 4. The hydraulic analysis indicates in its conclusions that a Conditional Letter of Map Revision is not necessary. Assuming that the elevation requirements and other conditions contained in the zoning provisions are met, a CLOMR would not be necessary. However, absent a CLOMR, federally regulated lending institutions aze going to be required to enforce flood insurance purchase requirements. You gave me the best mapping available for this reach of Lena Gulch given the extremely wide flood plain and the knowledge detailed new mapping for the entire flood plain the is not reasonable for this small development. The horizontal extent of flooding in this area of Lena Gulch is extensive. Details of the project area would not be visible if the entire flood plain area was shown. The "pasted-on site plan" is the best method available to show the relationship between the proposed development, the Quail Street drop structure and Lena Gulch channel (remember, we are not showing the extent of flooding on this figure, as discussed in Section 6 of the report). The datum of the site plan is the City of Wheat Ridge bench mark of 5399.03 NGS at W. 36th and Oak. The background maPP~g ~ City ~PP~g which I assumed was based on City bench marks. The existing ground in Urban Drainage improvement drawings (not submitted) agreed very welt with the City aerial maPP~B• I disagree with your comment, "...the contours on the site do not match the contours on the aerial photo." By defmition, contours are accm~ate to one-half the contour interval. All contours at the edge of the site (to match with the aerie] photo) are within one-half of the contour interval of the aerial photo. page 3• The flood elevation at the west and south boundary lines of the subdivision vary. Using the energy elope to transfer elevations, the flood elevations are shown on the attached, re-printed Figure 3.1.1. The bottom of the fence can be elevated if necessary along the south boundary but it appears the existing ground line is slightly above those elevations noted on the reprinted Figure 3.1.1. This subdivision is in the area influenced by the Quail Street drop just downstream of the project which is the hydraulic control for the several•hundred foot reach upstream. Would a new' emsting" analysis include an old ground line at SEGNO 6308 but the Quail Street drop, a condition which never occurred? After 2 submittals and a personal meeting with the engineer, he has shown me evidence to support the construction of 5 single family dwellings to 1 foot above the base flood elevation with no change in the 100 year flood water surface. Primary concluding evidence was contained in flood plain mapping performed by David Love and Associates. This mapping was used in the 1988 FEMA map revision which was granted by the Federal Government for completed improvements along Lena Gulch. The map specifically states that this is an area of shallow flooding (less than 1 foot) and that the boundary of the flood plain is difficult to determine. Amore detailed analysis provided by the applicants engineer concludes that finished floor elevations shall be no lower than 5,414.68 feet above sea level. Further restricting design and construction requirements are placed on this development by the engineer and must be certified by the engineer prior to issuance of a certificate of occupancy. These restrictions are contained in the report and thereby become a part of the record. I, as Flood Plain Administrator, therefore recommend that the Class II Special Exception to the flood plain be granted for plans and report submitted.. Quotations are from your letter. 1. "The site is located within the 100-year floodplain of Lena Gulch as shown on the current Flood Insurance Rate Map for the City of Wheat Ridge." Agreed, a copy of the FIRM is attached. 2. "...a statement should be included that indicates that the proposed development is not located within the floodway district since structures are prohibited in the floodway district. " The subdivision is located in an area of shallow flooding, not in the floodway district (see City of Wheat Ridge mapping, Lena Gulch, 100-Year Floodplain, ExisBng and Improved Channel Conditions, David J. Love & Associates, Inc., sheets 3 and 4 of 11, no date). "Once it is determined that the proposed structures are located in the flood storage district, structures for human occupancy can only be permitted `upon a certificaton by a registered professional engineer to the floodplain administrator that the lowest floor, including basement, is elevated to one (1) foot or more above the base flood elevation."' Basements are not permitted. Finished floors will be elevated to a minimum of one foot above the one-hundred year water surface for the cross section through the houses Page 2 Mr. DeGroot October 18, 1994 (SECNO 6308, CWSEL=5413.68). The attached reprint and enhanced Figure 3.1.1 shows TF's (top of foundation) ranging from 5414.6 to 5815.3. Typically finished floor is 1.5 to 12 inches above TF depending in foundation type. This puts the finished floor a minimum of 5814.7. Final TF's will be designed and certified which meet the one-foot-above criterion when foundation engineering has been completed. 3. "A map showing the existing and proposed 100-year floodplains should be included." The mapping has not changed due to no change in the flood elevation at this cross section. Previously mapping by Wheat Ridge (Lena Gulch, 100-Year Floodplain, Existing and Improved Channel Conditions, David J. Love & Associates, Inc., sheets 3 and 4 of 11, no date) and FEMA still applies. 4. "... However, absent a CLOMR, federally regulated lending institutions are going to be required to enforce flood insurance purchase requirements." This issue has been discussed with the client and he acknowledges the need for flood insurance purchase. REQUEST The applicant is requesting approval of a Class II Special Exception to allow the construction of five patio homes in the Lena Gulch 100-Year floodplain. The property in question is zoned Residential-Three and Residential-One, however, it is currently the subject of a rezoning application. The request, for approval of a rezoning from Residential-Three and Residential-One to Planned Residential Development and for approval of an outline development plan was passed by Planning Commission at a public hearing held on June 16, 1994. Please refer to Exhibit 'A' which is a copy of the proposed plan. The .case was scheduled for City Council review on August 8, but it was continued so that the Board could review an application for a Special Exception Permit. In accordance with the FEMA Flood Insurance Rate Map, the property is located within the Lena Gulch 100-Year flood plain. Referrals of .the flood plain analysis were sent to Bob Goebel, Director of Public Works and Bill DeGroot of the Urban Drainage and Flood Control District. It is the opinion of Mr. Goebel and Mr. DeGroot that the statements made by Larry Dezman of Futura Engineering are in accordance with the City's Flood Plain Ordinance. They have also concluded that construction of the five patio-homes will not negetively affect the flood plain. For these reasons a recommendation of approval is given to allow construction-in the 100.-Year flood plain with the condition that the finished first floor elevations be no lower than 5414.68' and that certification of these elevations be done by a registered engineer at the time foundation forms are put in place prior to the placement of concrete. - II. Conclusion and Recommendation It is staff's conclusion that construction of the five patio homes will have no negative effect on the Lena Gulch 100-Year flood plain. Therefore, a recommendation of APPROVAL is given for Case No. WF-94-3 with the following conditions: 1. Development be in accordance with the approved official development plan presented. Any drastic changes to the building locations shown may require a revised analysis BOARD OF ADJUSTMENT STAFF REPORT CASE NO. WF-94-3 Page 3 2. The finished first floor elevations be no lower than 5414.68' above sea level and that a certification of elevation be done by a registered engineer at the time foundation forms are set prior to placement of Concrete. 3. The variance is for the improvement of safety to the neighbors'-health and property along the west fence line. 4. The 14' height is driven by a generally accepted code -- standard and the experience of the. home owner along the west side. WITH THE FOLLOWING CONDITIONS: 1. The fence must be chainlink. 2. The 14' section is to extend only to the length so as to protect the property at 6675 W. 29th.Avenue. Motion was seconded-by Board Member ECHELMEYER. Motion carried 5-0. Resolution attached. C. Case No. WF-94-3: An application by Steven Ness for John and Julie Batug for approval of a-Class 'II Special Exception to the Flood Plain to allow construction within the Lena Gulch 100-year Flood Plain. Greg Moberg presented the staff report. All pertinent documents were entered into record which Chairman JUNKER accepted. Board Member ECHELMEYER questioned why this was passed by City Council to them, and Mr. Moberg replied City Council cannot approve floodplain variances. The Board has to approve the exception and then it is forwarded on to City Council for final approval. City Council wanted .the Board to hear this first so they would not be spinning their wheels in the event it was denied. Board Member ROSSILLON asked if this can be approved-because they are not raising the water level, and Mr. Moberg answered the applicants have to meet certain criteria and not inhibit-the flow of the floo3way. . Mr. Moberg presented a letter from Urban Drainage dated October 20, 1994, and said the letter arrived after the packets were .delivered. Board Member ABBOTT wanted to know -what the structures-are to the northeast and Mr. Moberg replied townhomes. Board Member ECHELMEYER asked if the area marked for the patio homes is higher than the ground level of the units to the north and will they maintain that ground level, and Mr. Moberg said he would have to ask the engineer. WHEAT RIDGE BOARD OF ADJIISTMENT MINUTES OF MEETING: October 27, 1994 Page $ Board Member ECHELMEYER said there-are also at least 5-6 -- homes that set to the west of this development on about the same plateau and wanted to know-if they requested a floodplain variance. Mr. Moberg answered those homes-were built prior to the Floodplain Ordinance which was established in the mid-70's. No further questions were asked of staff. Larry Dezman of Futura Engineering, 12741 E. Caley Avenue, #126, Englewood, CO, was sworn in. Mr. Dezman said they used the City's mapping and existing studies as a basis for their report and submitted these to Urban Drainage and the City. Comments from Bill DeGroot and Bob-Goebel were .in concurrence with the conclusion of the hydraulic report. There is no change in the 100-year flood level-due to the construction of this development as they are out of the floodway and according to an engineer's-iriterpretatiori of the floodplain ordinance, they meet the requirements of the exemption. Board Member ECHELMEYER asked what is 'out of the floodway' and Mr. Dezman answered there are two districts in the floodway administration. The floodway dis-trict is the high velocity core which carries most of the total water in a flood event, and the floodplain or storage is_the slower moving outer areas on either side of the floodway. The floodway will carry about 90-95% of the water and the floodplain or storage on the outside will carry the remainder. Board Member ECHELMEYER questioned the last home closest to the ditch being in somewhat of a precarious position, and Mr. Dezman answered the ground is relatively. higher through that area and keeps the .higher velocity flood waters away. The grading of these lots was the highest location to the west-and as a consequence the water is drawn from the bank to the 'drop structure'. The ground behind this development appears to be higher than the local floodplain elevation and tends to make any water separate. Board Member ROSSILLON asked if the water is deeper to-the, north of the site and Mr. Dezman said-it is slightly deeper but is slow moving water, and added an interesting note is that Quail Street slopes north at 3-8th Avenue. Board Member ABBOTT asked in reference to grading, is all of the provisions in Section 26-206(F) provided in condition- #3, and Mr. Moberg said the applicants would. not be allowed to do anything other than what is allowed by that section WHEAT RIDGE BOARD OF ADJIISTMENT MINIITES OF MEETING: October 27,.1994 Page 9 and if you cite that section as a condition, it will contain all.-that is needed. Board Member ABBOTT'S concerh is that ahy person buying a house will not end up with a drainage problem in their backyard, and Mr. Moberg said the grading matter.-is dealt with through the building department and the applicant will have to submit a drainage plan. Board Member ABBOTT said he is interested in protecting the future homeowners and Mr. Dezman said he has probably graded about 2000 houses in the last four years and added this is - very much in conformance with the .standards of.the industry. Board Member ECHELMEYER thought if these houses are built on the same level as the ground it looks like it will force- water into the development further up the street to the north because they are lower than the .ground level of the patio homes. Mr. Dezman said those units are on the same cross section so they are really not influenced by water backing up. At the back of the lots there is a small slope down so they are not Creating a situation-where the water can shunt around the houses. Board Member ECHELMEYER feels any fence from the horse property behind the development will also be responsible for shunting action,-but Mr. Dezman-said any shunting that will occur will be to the west. Board Member ABBOTT asked if the area is kind of-like an island with the water going around the high spot and Mr. Dezman said yes, and presented the FEMA map -for more clarification, labeled Exhibit 'A'. The net result of the study is that the existing mapping stays effective because - this construction does not change the water surface elevation. _- No further questions were asked of Mr._Dezman at this time. Steven Ness, representing the applicants, 11252 w. 38th Avenue, was sworn in. Mr. Ness said he is not the technical expert but does ask for approval of.this request. Board Member ECHELMEYER stated he does not understand why the water would not spread out evenly on both sides of the stream rather than channel itself off to the southeast and he is concerned with the houses that set to the north. Mark Graff, 12975 W. Oregon Drive, Lakewood, CO, was sworn in. Mr. Graff is the owner of a townhouse at 3712 Quail.- Street. He said when the townhouses were built the developer brought the ground up one inch to get the buildings out of the floodplain: Approval of this project is the best thing that could happen in this neighborhood and he does not foresee a problem with the floodplain and Mr. Graff would like to see approval of this request. No questions were asked of Mr. Graff.. Caroline Nobel, 11254 W. 38th Avenue, was sworn in. Ms. Noble and her husband live south of this proposed development and share 150 feet of border with the property. She said they thought this property was in the floodplain and could not be developed. Since they live right on Lena Gulch they are very concerned about the water backing up into their frontroom. The applicants have-alr-eady been approved-to cram a lot of houses into-less than an acre and any structure, to her-thinking, will dam water. Ms. Noble asked the Board to table this request if there is any doubt or if there is not much understanding of-the-drainage. She feels this development will make it way too dense and'the - - land should be left open. Ms.Nobel pointed out where-her house is located. Board Member ECHELMEYER asked how far up from the level of the top of Lena Gulch do you set on-the ground, and Ms. Nobel answered about 3-feet. Board Member ECHELMEYER wanted to know what Ms. Nobel meant when she said there had been. changes to the Flood Plain, and Ms. Nobel asked her husband to come up and help explain this. There has been some major improvements on the property. with the 'drop structure' but no one is absolutely sure as to what will happen in a 100-year flood and they do not the water to back up anymore than it has done. Howard Nobel, 11254 W. 38th Avenue, was sworn in. Mr. Nobel said the improvements to Lena Gulch have been from the downstream up but the improvements stop right at Quail Street. There is a drop structure as the engineer indicated.- Their house is directly upstream from this development and Mr. Noble would like to be convinced-with the changes that this development will not have a bad effect on the upstream houses. INTRODUCTION. ' Lena Gulch flood elevations are studied to assure the construction of the Batug Subdivision will not increase the 100 year water surface elevation. The proposed subdivision will be composed of five lots ' and houses built by the subdivider. Structure locations and fmished floor elevations are set by this study. Work previously completed by an Urban Drainage and Flood Control contractor was used as the base model. Improvements to Lena Gulch have been recommended for many years, several of which have been built. The furthest upstream existing improvement is a drop structure immediately downstream of the project. None of the HEtd-2 modeling obtained from the UDFCD contractor accurately modeled ' the existing condition. Wheat Ridge aerial photo mapping was used to model the area. Two hydraulic models are presented. The first is an existing condition model based on the applicable ' UDFCD model. The second is a model with proposed conditions at the subdivision. SECTION 2. PR.EVlOUS WORN. ' Previous work was completed by Sellards and Grigg and Love & Associates for Urban Drainage and Flood Control District. Models from both studies were obtained through Sellards and Grigg. The previous modeling did not accurately reflect conditions as they exist today. Cross sections, hydraulic ' parameters and design discharges were taken from the previous models. SECTION 3. I4YDRAULIC ANALYSIS. ' 3.I General. Futura's standard method of cross section modeling was used in which the center of the channel is assigned channel cross section station 1000. Values leas than 1000 are left of the channel when looking downstream. Stations greater than 1000 are right of the channel. "One of the UDFCD model cross sections (SECNO 9025) was "turned around" to conform. An existing condition model was generated from the previous work with cross sections added to reflect today's channel and improvement conditions. One of the new cross sections was through the middle of the new lots, which is perpendicular to left overbank flow. A proposed condition model was then created by superposing the proposed houses on the lots (see Figure 3.1.1). 3.2 Additional Gross Sections. Anew cross section was added at channel station 6308. The purpose of the cross section is to establish the existing condition water surface profile against which the proposed conditions will be compared. The cross section is oriented perpendicular to the flow direction on the left overbank. 3.3 Starting Elevation for Subcritical Flow. ' The starting elevation for the water surface profile is critical depth at the crest of the existing drop structure located at SECNO 6187. 3.4 Hydraulic Parameters. Hydraulic parameters were taken from the previous work. Both the e~sting and proposed hydraulic models are adequately commented enabling the reader to follow modeling rationale. 3.6 Upstream Hydraulics. In both models and the previous work, SECNO 6538 is a hydraulic control section. Modeling was not extended upstream of 6538 which is 230 feet upstream of the Batug development.
