A 12" water main line extension and fire hydrants will be needed to serve the property and to meet Arvada Fire Protection District requirements. Water main lines and fire hydrants will be installed at property owners expense. 2. Water tap and service lines will need to be installed to service the property at property owners expense. 3. We will need construction drawings for the public improvements to be constructed on West 43rd Ave., as well as any storm sewer improvements to the site. Please note: construction plans £or this site were originally designed by KKBNA in April of 1988. It is my understanding through meetings with Richard Gash that the original storm sewer design to realign the existing ditch is to remain the same with this project. The scope of this work must include the modifications to the existing irrigation siphon and the diversion pipe to the storm sewer. 2. We will need a drainage study which reflects the lot or lots that are to be improved. 3. We will need an erosion control plan. 4. We will need an excavation permit submitted for approval prior to an grading of the site commencing. 5. We will need a signature block on the construction drawings for ditch company approvals of any modifications to the existing ditch. 6. The true point of beginning has changed because the exterior boundary of the subdivision has changed. On the plat "Tennis Center at Clear Creek," an extended portion of West 43rd Avenue was dedicated, and the true point of beginning was on a corner of this dedicated portion. The proposed "Onyx Park Subdivision" does not include the portion of what is now West 43rd Avenue, so we moved the true point of beginning to the boundary corner that falls on the south line of the northeast quarter of Section 21, as shown on the plat. 2. The plat was revised to show two sets of dimensions around the exterior of the subdivision, one set being the final dimensions as established by Gillan's Engineering (the bold numbers), the other set being the original dimensions from the plat "Tennis Center at Clear Creek" (in parenthesis, labeled with a "P"). 3. We have assumed that the three courses and distances are referring to the ties from the east quarter corner of the section to the true point of beginning. Due to the change in the true point of beginning, we have established this tie as one course and distance as measured on the south line of the northeast quarter of Section 21. This has been clarified on the map with the note "(From East Quarter Corner to P.O.B.)." 4. The right of way dedication references were added to the plat, and copies of these documents are enclosed. 5. The boundary dimensions on the proposed plat "Onyx Pazk Subdivision" do not agree (see Item #3) because: • The actual field measurements by Gillan's Engineering vary slightly with what the earlier plats represented. This notice is intended to inform you of the process involved in land use development applications. Prior to application for rezoning or special use permit, the developer is responsible for holding an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of a proposed development in their neighborhood and to allow the developer to respond to citizen concerns in the design of their project. All residents within 600 feet are required to be-notified of the meeting. A staff planner will attend the meeting to discuss City policy and regulations and the process involved, however, the planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of Planning Commission and City Council where decisions are rendered. If you want input 'in the decision- 'making process, it is imperative that you attend the public hearings. The public hearings you will be attending are quasi-judicial in nature. Please do not contact your Planning Commissioners or Council geople to discuss the merits of a case prior to the public hearing. It could jeopardize your representatives' ability to hear the case. I£ you are an adjacent property, you may have the right to file a "legal protest" against the application. The result of this filing is that it requires a 3/4 majority of City Council to approve a request. Planning Division Staff Report Page 2 Case No. WZ-94-11/Gash REQUEST _ , The applicant requests approval of a combined final development plan and plat for property located at 10150 West 43rd Avenue. The property was rezoned from C-1 to Planned Commercial Development pursuant to Case No. WZ-93-7. Uses allowed on Lot 1 (eastern) are those allowed in the G7 zone district. Uses allowed on Lots 2 and 3 are Gi and some semi-industrial in nature as listed below: (4) Auction houses, inside only. (6) A building contractor's service shop and storage yard incidental to an office/showroom principal use, with no exterior mechanical equipment other than air conditioning. (12) Government or quasi-government buildings and offices. (13) Homes for the aged, nursing homes and congregate care homes. (15) Manufacturing and/or light industrial operations where no single machine exceeds five horsepower. (17) Shops for custom work or for making articles, materials or commodities to be sold at retail on the premises, where no single machine exceeds five horsepower. (20) Wholesale businesses. (21) Woodworking or carpentry shows for the making of articles for sale upon the premises, with no exterior mechanical equipment other than exhaust equipment. i The applicant is now requesting approval of a three-lot subdivision and for approval of a final development plan on the westernmost lot. The purpose is for the construction of an electrical contractor's office/warehouse/yard. II. SITE PLAN The applicant has proposed a site plan showing an "L" shaped two-story structure with a maximum building coverage not exceeding 11,700 square feet. 64.03% of the site would have hard surfaces and 10% of the lot would be landscaped. The Parks and Recreation Commission has noted that landscaping across from the park land at the southwest corner should be upgraded. Staff recommends trees be added along the west fence line between the parking area and fence. Outdoor storage would occur in a fenced area behind of and in the "crook" of the building. This storage must be screened with ssix-foot-high solid fence. All minimums for parking and setbacks have been met. The building is proposed to be built of fluted concrete with wooden accents. Staff recommends use of brick as accent to the south, east and west faces, with a minimum of 25% brick. There is also some question as to fire access and turn radii through the parking lot. The applicant is working with the Arvada Fire District to resolve the problem. At this point in time, the applicant has no plans for development of the eastern two lots and the tract leading to West 44th Avenue. Final development plans would have to be approved prior to the issuance of any building permits. 111. SUBDIVISION PLAT _ _ Planning Division Staff Report Page 3 Case No. WZ-94-11/Gash The applicant has proposed athree-lot subdivision to allow for the future sale of the eastern two lots. A right-of-way dedication for West 43rd Avenue occurred when the property was replatted in 1988. An easement table has been provided to vacate and dedicate easements on the property. A signature block needs to be provided for the Oulette Ditch Company president. All requirements of the Subdivision Regulations have been met. N. AGENCY REFERRALS Arvada Fire District will require the installation of water lines and fire hydrants on the property. There are some questions regarding fire access around the building, however, they are working with the applicant to resolve the problem. Valley Water will require a water line extension in West 43rd Avenue. The cost for this installation will be shared by the developer and the district. Public Works is requiring the full width construction of West 43rd Avenue from the eastern edge of the property to connect wRh West 43rd Avenue to the west. The applicant is in the process of having previously approved plans rectified. A preliminary report has been reviewed. The Parks and Recreation Commission has reviewed the proposal and feels that landscaping at the southwest corner (across from City-owned park land) needs to be increased. V. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff has concluded that the proposed final development plan is consistent with parameters established at rezoning stage. Staff further concludes that all minimum requirements have been met. For these reasons, a recommendation of Approval is given with the following conditions: 7. Lots be renumbered to be consistent with the plat. 2. The outdoor storage area be screened with asix-foot-high solid fence. 3. The applicant continue working with the Arvada Fire District regarding fire access around the building. 4. The applicant provide upgraded landscaping with input from the Parks Director for the southwest corner of the property, with trees along the west edge. 5. That brick be used as accent to the building walls. In regard to the subdivision plat, all requirements for the Subdivision Regulations have been met, therefore, a recommendation of Approval is given with the condition that a signature block be provided for the Oulette Ditch Company president. Ms. Reckert stated the building size was approximately 11,000 square feet. Commissioner CERVENY asked Ms. Reckert what percentage of brick was being requested by staff. Mr. Gash stated he was planning to use a "decor brick" which is a grooved cinderblock with wood accents. Chairperson ECKHARDT stated that Mr. Gash could probably work that out with staff.- Mr. Gash added that he had been working with the Arvada Fire Department regarding access for emergency vehicles. He had also met with the representatives from Oulette Ditch Company regarding ditch construction. Ms. Reckert added that if the Arvada Fire Protection District finds it necessary to enter the property from the west, an additional easement would be required. Mr. Gash stated that he had spoken with the owners of Newgate Apartments regarding possible entry from the west and reiterated they would be willing to sign an agreement to that effect. Commissioner RASPLICICA asked about numbering the lots. ~' Ms. Reckert stated that she did not care how the lots were numbered, but they must be consistent. Letter to Mr. Oualteri Bob Goebel .explained there was a drainage project done on 30th between Kendall and Ingalls in conjunction with the City of Edgewater. The plans were drawn up with roadside ditc tter and property owners on Ingalls street request curb, gu sidewalks. The City Council approved the curb, gutter and sidewalk for Ingalls St. rather than the roadside ditches. Prior to this council decision, Mr. Qualteri, a resident on Kendall Street, had requested curb, gutter and sidewalk and was told he would have to pay for it. He agreed to and did pay for the sidewalks. When the Council approved the Ingalls St. residents curb, gutter and sidewalk at no charge, he went to Council to protest and ask for reimbursement. That Council rejected the. request. The dollar amount being requested is $1535.10 + a bill for the engineering which was $360.00; total $1895.10. Motion by Mr. Solano to forward to City Council for approval Mr. Qualteri's request for reimbursement of $1895.10. If we paid for one resident then there is an equity situation here. It was tabled because it was possibly Quasi Judicial. It was subsequently determined that it is not Quasi Judicial in nature. The extension concerns Mr. Gash's property development at 43rd and Kipling. 43rd Avenue is constructed to the east property line of PUBLIC WORKS ADVISORY COMMITTEE ~ • ~ ~ ~ ~ PAGE 2 MINIITES - FEBRUARY 8, 1995 this site. Mr. Gash will be requesting a building permit and will be required to construct public improvements. The City will requiring him to build the full width extension of 43rd Avenue from the eastern edge of his property to connect with 43rd to the west (southeast of Newgate Apartments). A portion of the street will cross City parkland as the extension will be curved to save 3-4 very large, mature cottonwood trees. If the street design was not curved the improvements would fall entirely on Mr. Gash's property, however, the site plan has been based on the curved street design. There are benefits to the entire southwest quadrant of 44th Avenue/Kipling if the connection occurs. The Arvada Fire Department supports this connection for general fire access in the area. The additional connection to Kipling will also take pressure off the 44th Avenue/Kipling intersection. Typically, with a road development, the developer is only required to dedicate and build one half of the road. Mr. Gash is requesting the City pay for the improvements that are off site. The cost would be about $25,000.00. The cost could be absorbed by the unallocated capital fund. If approved, Mr. Goebel would suggest Mr. Gash go ahead and build the street and bill the City for the cost of its measured portion. AGENCY REFERRALS Arvada Fire District will require the installation of water lines and fire hydrants on the property. Secondary emergency access has been provided by an easement to the west. Valley Water will require a water line extension in West 43rd Avenue. The cost for this installation will be shared by the developer and the district. Public Works is requiring the full width construction of West 43rd Avenue from the eastern edge of the property to connect with West 43rd Avenue to the west. The applicant is in the process of having previously approved plans rectified. A preliminary drainage report has been reviewed. The parks and Recreation Commission has reviewed the proposal and feels that landscaping at the southwest corner (across from City-owned park land) needs to be increased. V. PLANNING COMMISSION ACTION Planning commission reviewed this case at a public hearing held on January 19, 1995.
