The zoning approval occurred on three separate properties: • 10241 W 38th Ave -owned by Raymond Michael • 3975 Miller Court -owned by J. Galen Easler, Helen Ann and Donna Lee Huitt • 10150 W 40th Ave -owned by P E & Anna N Weller An outline development plan was approved showing 140 patio homes on the combined 28.39 acres (28.7 acres minus .31 acres of future public right-of-way) for a density in the area of 4.93 units/acre. Now, the owners of the eastern-most property do not want to sell their property to the developer, although they participated in the original zoning. Since they will not sign the Mylar for the approved outline development plan, it cannot be recorded. Without the recorded document, the zoning can not be finalized. As such, the developer has applied for an amendment to the original PRD rezoning and plan approval to exclude the Weller property from the legal description in the ordinance and to remove it from the outline development plan. Final plan and plat approval for the remaining two parcels cannot be pursued until this has been done. Since there cannot be planned development zoning without any recorded document setting parameters for development, the City is asking that the PRD zoning approval on the Weller property be rescinded and the original R-1 zoning be reinstated. Section 26-25 of the Wheat Ridge Code of Laws requires that development plans be recorded within 30 days of the final action by City Council. If a recordable instrument has not been submitted for recordation within 60 days, the Staff shall schedule a public hearing to reconsider the zoning approval. The developer has submitted a revised outline development plan which is the same as that approved originally except the easterly parcel (Weller property) is not shown. See attached. Memo to Planning Commission September 29, 1994 Page 2 The number of units has been reduced to 115 for a density of roughly 5.5 units per acre which is still within the low density range. This is the same number of units on the Huitt and Easler properties which was reviewed and approved by City Council. All other parameters of the original outline plan are still valid. The proposal is for a gated community with a single access point from West 38th Avenue. A secondary access point at the northwest corner of the project is provided for emergency vehicles and pedestrians. Lot sizes will be a minimum 4500 square feet. The homes will generally be two stories with a maximum height of 35 feet. Each lot will have a small amount of yard area with some common space in the development. Common area will include a club house, swimming pool and walking paths. Two garage stalls plus two off- street parking spaces are also provided for each unit. A six-foot-high screening wall with perimeter landscaping will surround the development. No development plans have been submitted for the Weller property although a letter requesting continuance of the recision of the planned development zoning has been submitted. See Exhibit 'A'. The Comprehensive Plan designates future desirable land use as low density residential and multiple use. Multiple use allows any use other than industrial as long as it is compatible with adjacent zoning and land use. Staff concludes that the revised PRD zoning on the Huitt and Easler properties and R-1 zoning on the Weller property would be consistent with the Comprehensive Plan. STAFF CONCLUSIONS AND RECOMMENDATIONS In regard to Case Nos. WZ-94-14 and WZ-94-15, Staff has reached the following conclusions: • The PRD zoning approved by Ordinance #968 is invalid as there is no binding outline development plan recorded with Jefferson County. • The developer cannot proceed with getting final plan and plat approval until a revised ordinance and outline plan are approved for the western two parcels. • The revised outline plan submitted on the western two parcels allows far a density of 5.5 units per acre which is consistent with the low density designation on the Comprehensive Plan. • Since the Weller property is being removed from the overall zoning and plan approval, there will be no legitimate PRD zoning on it . Therefore, the previous zoning (R-1) zoning should be reinstated. For the reasons stated above, a recommendation of Approval is given for Case Nos. WZ- 94-14 and WZ-94-15. This was accepted. Motion by Mrs. Worth to amend under condition 4. "The overall density shall be reduced to 4.9 units per acre"; seconded by Mr. Edwards; failed 3-4 with Councilmembers Worth, Edwards, and Fields voting yes. Mr. Edwards will vote no oh the original motion because he is concerned about the density and how that pertains to the specific zoning criteria we are mandated by law; when this came up it was 4.9 units per acre and he is tired of the developers stating they are going to pull out if they don't get their way. Mrs. Worth agrees with Mr. Edwards; we do have criteria tc follow; there is a legal protest; people in the surrounding .area have asked for 4.9 units; she will also vote against this. Vote on original motion failed 4-3 with Councilmembers Worth, Edwards, and Fields voting no. (Needed a majority vote of 6 yes votes to pass). Mr. Edwards asked that as a member of the prevailing side, this be reconsidered at this time, Council Bill 70 with the conditions as provided, except in Condition 4. it say"4.9"; seconded by Mrs. Worth; failed 3-4 with Councilmembers Worth, Edwards, and Fields voting yes. Mr. Siler moved to reconsider the previous vote; he got confused and voted differently than he had thought; seconded by Mr. Edwards; carried 6-1 with Mr. Solano voting no. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained.
