DEVELOPMENT PLAN _ Case No. WZ-93-8 was approved by City Council on January 10, 1994 which approved an amended '± outline developmen4 plan and final plan for property located directly south of the subject site. The purpose of the rezoning was for the construction of a recreational vehicle sales lot at 4120 Youngfield. ~~ The owner is now requesting an amended outline plan and final development plan for adjacent land to ~ allow the expansion of the RV lot to the north. As such, both sites are shown on the applicant's development plan. __ The applicant is proposing a 1500 square foot addition to the existing building. The lot will be ° surrounded by asix-foot-high chain link fence tapering down to four feet toward the front. A fence is proposed to be built on a berm along the common property line with City-owned park land to the north. _- '" The Parks and Recreation Commission reviewed the development plan their December 8 meeting and ~~ approved the applicant's design. See attached Exhibit 'A'. `'- Site data breakdown indicates that there would be 1.6/°° building coverage, 61.7% paved surfaces and " 32.1% in landscaping Including the lake). Access is by a single curb cut for the development. No additional signage is being requested. All minimum requirements of the C-1 zone district have been met. In order for the expanded sales lot to, be built, an amendment to the original outline development plan is required. When the first phase of the development was approved in 1981, there was no mention of allowing vehicle sales lots. The list of allowed uses went so far as indicating that outside storage and display are not allowed. If an amendment to the outline development plan is approved to allow recreational vehicle sales, it would be only for Lots 3 and 4 and not the other two lots within this phase of the development. III. CRffER1A TO SUPPORT A REZONING In accordance with Wheat Ridge Code of Laws, Sec. 26-6(C.), before a change of zone is approved, the applicant shall show and City Council shall find: 1. That the change of zone is in conformance, or will bring the property into conformance with the Cdy of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive Land Use plan and other related policies or plans for the area. The Comprehensive Plan designates this area as multiple use. The amendment to the original PCD zoning would be consistent with this designation. Based on testimony at the original zoning hearing, Staff would support only RV sales and no other type of vehicle sates and no RV storage on Lot 4. The proposed use is an expansion of the existing facility to the south. Staff has concern about the aesthetics of the property, particularly the view from the greenbelt. However, the applicant has tried to mitigate the negative visual impacts by providing additional landscaping behind the building and upgrading the fence materials to a colored fence. The Parks and Recreation Commission has approved of the design and the interface with the adjacent park land. 3. That there will be social, recreational, physical and/or economic benefits to the community derived by the change off zone. There will be economic benefits to the City by increased sales tax generated. 4. That adequate infrastructure/facilities are available to serve the type of uses albwed by the change of zone, or tlrat the applicanit will upgrade and provide such where they do not exist or are under capacity. There is infrastructure to serve the property. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, create drainage problems, or seriously reduce light and air to adjacent properties. The rezoning should not negatively affect public health, safety and welfare by creating excessive traffic congestion, creating drainage problems or reducing the light and air to adjacent properties. 6. That the property cannot reasonably be developed under the existing zoning conditions. The property could be developed under current zoning, however, a recreational vehicle sales lot would not be allowed. 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. Spot zoning is not an issue. 8. That there is a void in an area or community need that the change of zone will fill by providing for necessary cervices, products or facilities especially appropriate at the location, considering available aRematives. The industry related to recreational vehicles sales is expanding, therefore one could conclude that development is filling a need. N. AGENCY REFERRALS All agencies can provide service to the property. Wheat Ridge Fire District can serve. Planning Division Staff Report Page 4 Case No. WZ-94-i6/Casement Public Works required the installation of curb, gutter and sidewalk along the frontages of Lots 3 and 4. A drainage plan and report will be required prior to the issuance of a building permit. Parks and Recreation Commission reviewed the proposal on December 8. See attached. The Director of Parks has indicated that he would like to continue working with the applicant on design and construction along the common property line. V. CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the proposed use is inconsistent with those allowed originally on the outline development plan. An amendment to the,Youngfield Plaza outline development plan is required specifically for recreational vehicles sales on Lots 3 and 4 only. This would be a modification to the underlying PCD zone. Staff would support the amendment to allow recreational vehicle sales. We would not support any other type of vehicle sales lot or recreational vehicle storage on this or any of the other lots in the planned development. Staff concludes that all minimums within the Gi zone district have been met by the site plan and therefore gives a recommendation of Approval with the condition that the applicant work with the Parks Department on final design of the landscaping on the common property line.
