Dear Ms. Reckert:
This will acknowledge receipt of-your correspondence
dated April 15, 1994 regarding the above-referenced project.
Please-be advised that the above referenced property
is in an area served by The Consolidated Mutual Water Company
by virtue of a Distributor's Contract with the Denver Water
Board.
Our records-indicate that the property addressed as
4650 Kipling has received domestic water from the Company
through a 5/8-inch meter (CMWCo Tap Number 2977/Account
Number B-1002045). Presently this is an inactive tap and the
meter setting must be-brought up to current Company standards
before domestic water. service can be provided to this
property. Enclosed for your information -is a copy of the
letter sent to the owner, Mr. Chado, outlining the necessary
requirements.
The Company requires that a new application for water
service be completed by the owner and returned to the Company
at the time there is a change in use. The Company considers
a remodel or building addition as a "change of use".
The Company's rules, regulations and requirements
further require that each. separate structure be served by a
separate tap and meter, and in order to receive domestic
water service, the property must also front a Company main.
If the future planned use of this property is within any of
the above categories, the owner should contact this office as
soon as possible so that we may determine what water system
improvements will be needed to serve this property.

Dear Mr. Chado:
This will acknowledge receipt of your Water Tap
Application to activate the water tap account for the above
referenced property.
As a result of our inspection of the existing meter pit
facilities, the following upgrades will be required to bring
the meter pit setting up to current Company standards. The
upgrades will Head to be completed prior to activating the
actual water service.

The Public Works Department has reviewed the site plan for the
above referenced project, and has the following comments:
1. We will need a revised drainage report which reflects the
changes created by the proposed expansion.
2. We will need a plan for the proposed Kipling Street frontage
improvements including but not limited to the extension of the
acel-decel lane on the property frontage.
3. The developer will need to obtain an access permit from the
Colorado Department of Transportation for the proposed access
on Kipling Street. The process will have to be done through
the Wheat Ridge Public Works Department which it serves as the
issuing authority. Thus, the developer will need coordinate
with the City to obtain the permit prior building the site.
4. To be consistent with the right-of-way section to the south of
this property, we will need 15 feet of right-of-way dedication
on Kipling frontage. This dedication is to accommodate the
proposed accel-decel lane and other miscelaneous items related
to the improvements.

RE:- Rezoning for approval of a combine outline,preliminary and

Dear Meredith:
The Colorado Department of Transportation has reviewed this
proposal and finds that the Department has no objections to allow
the use of a joint use access between property owners, provided the
proposed ingress/egress as shown on the offical development plan,
to this site is designed and constructed in strict conformance with
the State Highway Access Code.
Roadway widening will be required for speed change lanes, and will
include curb, gutter, sidewalk, storm sewer and highway signing and
striping. Also, a twenty-five to thirty five feet of width for the
proposed access width on Kipling Street must be used, as per the
State Highway Access Code, unless the developer applies for a
variance from the Code. If the developer wishes to seek a variance
fro the standards of-the code, a request must be submitted as an
attachment to a permit application form. The request for variance
shall include specific and documented reasons. The request and
supporting documents should documents should be submitted at the
time of permit application.

This letter is in regard to the submittal for the Ketelsen
Campers rezoning at 4650 Kipling. I have reviewed the submittal
and have the following comments. A copy of this letter and
redmarks have been sent to Roger Venables and Ron Hoisington.
The following items must be added to the plat or addressed
otherwise:
1. Adjacent zoning
2. Case history box;
3. Cross access easements as indicated on the attached drawing;
4. Cross access easement language;
5. Ingress/egress easement across Lot 1 for Lot 2;
6. Mountain States signature block should be changed to

8. Signature blocks for City Engineers and the Parks and

I. REQUEST
The applicant requests approval of a rezoning from A-1 and R-2 to
Planned Commercial Development and for approval of a combined
outline and final development plan and plat.
The property is located at 4650 Kipling and is the northern two
lots of the property being subdivided in Case MS-94-3.
The applicant in this case owns the Ketelsen Campers recreational
vehicle sales lot located at 9870 West I-70 Service Road South.
In September of 1993 the Board of Adjustment granted a one-year
Temporary Use Permit to allow a recreation vehicle storage lot on
proposed Parcel 'B'. The TUP has allowed excess inventory
storage while the applicant pursues rezoning and subdivision
approval.
I2. OUTLINE & FINAL DEVELOPMENT PLAN
The applicant is proposing an outline development plan on both
parcels and a final development plan on Parcel 'B' (rear).
Proposed uses allowed on the property are a],1 C-1 uses but
excluding used auto sales unless ancillary to a new car
dealership.
The final development plan on Parcel 'B' shows a 137-space RV
inventory storage lot which is how the property is currently
being used in accordance with the approval granted per Case No.
TUP-93 7. The inventory lot is accessed from the sales lot to.
the north. A six-foot-high chain link fence with screening shim
encloses the property on the east and south property lines.
Although only 6$ of Parcel 'B' would be landscaped with the
storage lot this figure would have to be increased to 10~ if a
structure is ever built. An amendment to this final development
plan would be required if a building would be built on the
property in the future.
The applicant is requesting. outline plan approval on Parcel 'A'.
At this time, the proposed future build-out on this front parcel
is being shown as a building for the sales of recreational
vehicle accessory supplies and equipment with a maximum floor
area of 16,000 square feet. However, this concept could change
as long as the use is consistent with the approved outline plan
and development is consistent with the C-1 development standards.
Approval of a final development plan would be required prior to
the construction of any buildings on this front piece..
In accordance with the subdivision proposed in Case No. MS-94-3,
a joint curb cut with the parcel to the south is shown on Kipling
Street.. Cross access is reserved along the northern boundary of

Parcel 'B' and on the common property line between parcels 'A'
and 'B'. Cross access should also be shown along the southern
boundary of Parcel 'A'.
If the applicant needs a secondary access to Parcel 'B' across
Parcel 'A', a 20-foot-wide road-based driving surface .should be
provided. This secondary access would be only for deliveries and
emergency access.
With the exception of the amount of interim landscaping on Parcel
'B', al 1, minimum requirements of the C-1. zone have been met.
III. CRITERIA
In accordance with Wheat Ridge Code of Laws, Sec. 26-6(C.),
before a change of zone is approved, the applicant shall show and
City Council shall find:
1. That the change of zone is in conformance, or will bring the
property into conformance with the City of Wheat Ridge
Comprehensive Plan goals, ob3ectives and policies,
Comprehensive Land Use plan and other related policies or
plans for the area.
This property is designated as Commercial Activity Center and is
included in the Kipling Activity Center master plan area. On the
master plan future land use map, desirable land use for this
property is designated as retail/highway business. Staff
considers the storage area as an extension of the existing
successful business to the north. Rezoning of these two parcels
allowing C-1 uses would be consistent with the future land use
map designation.
2. That the proposed change of zone is compatible with the
surrounding area and there will be minimal adverse impacts
considering the benefits to be derived.
Zoning and adjacent land use surrounding the property includes
C-1 zoning to the north with a motel and the applicant's existing
sales facility. Pennington Elementary which is zoned R-2 abuts
the property to the east. Vacant, A-1 zoned land is located to
the south. Staff anticipates this property to be rezoned and
developed commercially sometime in the future.
3. That there will be social, recreational, physical and/or
economic benefits to the community derived by the change of
zone.
There could be economic benefits from the commercial zoning by
increased sales tax generated.

4. That adequate infrastructure/facilities are available to
serve the type of uses allowed by the change of zone, or that
the applicant will upgrade and provide such where they do not
exist or are under capacity.
Ail outside agencies can serve the property subject to
improvements required.
5. That the proposed rezoning will not adversely affect public
health, safety 'or welfare by creating excessive traffic
congestion, create drainage problems, or seriously reduce
light and air to adjacent properties.
The rezoning should not negatively affect public health, safety
and welfare by creating excessive traffic congestion, creating
drainage problems or reducing the light and air to adjacent
properties. At the time of final development plan approval on
Parcel 'A' and if the use of Parcel 'B' would change, these
criteria would have to be reevaluated.
6. That the property cannot reasonably be developed under the
existing zoning conditions.
The property could be used agriculturally.
7. That the rezoning will not create an isolated or spot zone
district unrelated to adjacent or nearby areas.
Approval of the rezoning would not cons+_i.tute spot zoning as
there is adjacent commercial zoning.
8. That there is a void in an area or community need that the
change of zone will fill by providing for necessary services,
products or facilities especially appropriate at the.
location, considering available alternatives.
The industry related to recreational vehicles sales is expanding,
therefore one could conclude that development is filling a need.
Staff concludes that the criteria used to evaluate a rezoning
supports approval of this request.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on February 8, 1994.
See Exhibit 'A'. Those in attendance were:

Ms. Gallagher lives adjacent _to a playing field on the Pennington
Elementary school property and was worried that this is where
development would occur.. She expressed concern regarding
drainage in the area but does not object to the RV storage and
screening used.
An additional written response was received and is included under
Exhibit 'B'.
V. AGENCY REFERRALS
All responding agencies can provide service to the development.
Colorado Department of Transportation has no objections to the
joint access on Kipling, however a 50-foot-wide curb cut would
require a variance. Roadway widening will be required.
Consolidated Mutual requires that each separate structure needing
a water tap have direct frontage to a district main line (i.e.,
Kipling Street). If and when a building permit is requested for
the development of Lot 2, all of the district requirements will
have to be met.
Public Works will require a 15-foot right-of-way dedication for
Kipling Street. improvements including an accel/decel lane and
curb, gutter and sidewalk will be required on the frontages of
Lots 1 (Parcel 'A') and 3 when Lot 1 (Parcel 'A') develops. A
drainage report will be required.
VI. RECOMMENDATION/CONCLUSION
Staff concludes that the proposed rezoning and combined outline
and final development plan are consistent with the Comprehensive
Plan and are compatible with adjacent zoning and land use. Since
the criteria used to evaluate a zone change supports this
request, a recommendation of Approval is given for Case No.' WZ-
94-2 with the condition that cross access be shown along the
southern boundary of Parcel 'A'.
VII. RECOMMENDED MOTIONS
OPTION A: "I move that Case No. WZ-94-2, a request for approval
of a rezoning from A-1 and R-2 to Planned Commercial Development
and for approval of a combined outline and final development plan
for property located at 4650 Kipling Street, be Approved for the
following reasons:
1. The proposal is consistent with the Comprehensive Plan;
2. The proposal is compatible with adjacent zoning and land use;
and

Ms. Reckert presented the staff report. Entered into the record
and accepted by the Chairperson were the Zoning Ordinance,
exhibit, case file and packet materials.
Chris Porter was previously sworn in. Mr. Porter explained that
only rainwater would be draining into the wells on the property.
Oil must be collected and handled according to EPA standards. He
added that the development would be connected to the sewer ---
system. He explained the proposed use-of the property and
discussed screening, noise, traffio, pollution and views.
R~.n Hoisington, planning consultant with CRH Development
Specialists, 3000 Youngfield was sworn in. Mr. Hoisington
summarized the site plan.
Ms. Buchanan stated she had no problem with the project as
described by Mr. Hoisington. She did not want her view of the
mountains obstructed and she wanted to be notified when the last
parcel is developed. She asked if the third parcel would remain
agricultural.
Mr. Gidley stated it would remain agricultural for the present
time, however sometime in the future it would probably develop
commercially.
Ms. Buchanan reiterated her views.
Chairperson RASPLICKA stated that every city has regulations. He
noted that Wheat Ridge doesn't have much open land to develop.
Commissioner ECKHARDT read the uses allowed in the outline
development plan, which were those allowed in a C-1 zone
district. He noted that no residential use was mentioned.
Ms. Buchanan asked again to be notified.
Chairperson RASPLICKA reiterated that Mr. Gidley had explained
the three types of notification. He recommended that neighbors
pay attention to all zoning signs placed in their neighborhood
and stated questions could be answered by city staff.
Commissioner LANGDON stated he could understand the concerns of
residents in the area, however property owners have the right to
develop their property. He elaborated. -

Commissioner ECKHARDT informed those present that while the
zoning is presently agricultural, the owner could legally build a
barn and obscure the current mountain view.
Commissioner LANGDON moved that Case No. WZ-94-2, an application

rezoning £rom Agricultural-One and Residential-Two to Planned
Commercial Development and for approval of a combined outline,
preliminary and final development plan for property located at

Mr. Gidley stated this proposed ordinance would take care of a
"loophole"- in the previous ordinance regarding recreation
vehicles. This ordinance allows an individual renting a__property
to store his/her recreation vehicle on the rented property.
Chairperson RASPLICKA asked if someone could park their RV
directly on the property line or if there was a setback
regulation:
Mr. Gidley stated there is no setback regulation for the sideyard
and the RV can be parked on the property line. He added that
they must be parked six feet from the street:,

WHEREAS, the City of Wheat Ridge Planning Division has submitted a list of
factors to be considered with the above request, and said list of factors
is attached hereto and incorporated herein by reference, and made a part
hereof; _and
WHEREAS, there was testimony received at a public hearing heard by the
Planning Commission and such testimony provided additional facts.
NOW, THEREFORE, based upon the facts presented and conclusions reached, it
was moved by Commissioner LANGDON, seconded by Commissioner JOHNSON, that

Section 2. Conditions. The Outline Development Plan, attached
hereto and incorporated herein, is hereby adopted and shall serve
as a general guideline for the future development and use of the
legally described property. Prior to development and use of the
property, preliminary and final development plans, and a
subdivision plat must be approved in accordance with Wheat Ridge
Code of Laws, Appendix A., Section 20. Right to develop shall
not accrue. until the Final Planned Commercial Development Plan
and Subdivision Plat have been legally approved by the Wheat
Ridge Planning Commission and City Council and recorded with the
Jefferson County Clerk and Recorder, and subject to meeting all
other requirements as provided by the Wheat Ridge City Charter
and the Wheat Ridge Code of Laws.
Section 3. Safet~Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power o£ the City of Wheat Ridge, that it is

adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications.
Prior to application for rezoning or special use permit,=the
developer is responsible for holding an informal neighborhood
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in .the design of their project. All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner _
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front of Planning Commission and City Council
where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or

I. REQUEST

The applicant requests approval of a rezoning from A-1 and R-2 to
Planned Commercial Development and for approval of a combined
outline and final development plan and plat.
The property is located at 4650 Kipling and is the northern two
lots of the property being subdivided in Case MS-94'-3.
The applicant in this case owns the Ketelsen Campers recreational
vehicle sales lot located at 9870 West I-70 Service Road South.
In September of 1993 the Board of Adjustment granted a one-year
Temporary Use Permit to allow a recreation vehicle, storage lot on
proposed Parcel 'B'. The TUP has allowed excess inventory
storage while the applicant pursues rezoning and subdivision
approval.
II. OUTLINE & FINAL DEVELOPMENT PLAN
The applicant is proposing an outline development plan on both
parcels and a final development plan on Parcel 'B' ,(rear).
Proposed uses allowed on the property are all C-1 uses but
excluding used auto sales unless ancillary to a new car
dealership.
The final development plan on Parcel 'B' shows a 137-space RV
inventory storage lot which is how the property is currently
being used in accordance with the approval granted per Case No.
TUP-93 7. The inventory lot is accessed from the sales lot to
the north. 'A six-foot-high chain link fence with screening
encloses the property on the east and south property lines.
Although only 6~ of Parcel 'B' would be landscaped with the
storage lot this figure would have to be increased to 10$ if a
structure is ever built. An amendment to this final development
plan would be required if a building would be built on the
property in the future.
The applicant is requesting outline plan approval on Parcel 'A'.
At this time, the proposed future build-out on this front parcel
is being shown as a building for the sales of recreational
vehicle accessory supplies and equipment with a maximum floor
area of 16,000 square feet. However, this concept could change
as long as the use is consistent with the approved outline plan
and development is consistent with the C-1 development standards.
Approval of a final development plan would be required prior to
the construction of any buildings on this front piece.
In accordance with the subdivision proposed in Case No. MS-94-3;
a joint curb cut with the parcel to the south is shown on Kipling
Street. Cross access is reserved along the northern boundary of

Parcel 'B' and on the common property line between parcels 'A'
and '~'. Cross access should also be shown along the southern
boundary of Parcel 'A'.
If the applicant needs a secondary access to Parcel 'B' across
Parcel 'A', a 20-foot-wide road-based driving surface should be
provided. This secondary access would be only for deliveries and
emergency access.
With the exception of the amount of interim landscaping on Parcel
'B', all minimum requirements of the C-1 zone have been met.
III. CRITERIA
In accordance with Wheat Ridge Code of Laws, Sec. 26-6(C.),
before a change of zone is approved, the applicant shall show and
City Council shall find:
1. .That the change of zone is in conformance, or will bring the
property into conformance with the City of Wheat Ridge
Comprehensive Plan goals, objectives and policies,
Comprehensive Land Use plan and other related policies or
plans for the area.
This property is designated as Commercial Activity Center and is
included in the Kipling Activity Center master plan area. On the
master plan future land use map, desirable land use for this
property is designated as retail/highway business. Staff
considers the storage area as an extension of the existing
successful business to the north. Rezoning of these two parcels
allowing C-1 uses would be consistent with the future land use
map designation.
2. That the proposed change of zone is compatible with the
surrounding area and there will be minimal adverse impacts
considering the benefits to be derived.
Zoning and adjacent land use surrounding the property includes
C-1 zoning to the north with a motel and the applicant's existing
sales facility. Pennington Elementary which is zoned R-2 abuts
the property to the east. Vacant, A-1 zoned land is located to
the south. Staff anticipates this property to be rezoned and
developed commercially sometime in the future.
3. That there will be social, recreational, physical and/or
economic benefits to the community derived by the change of
zone.
There could be economic benefits from the commercial zoning by
increased sales tax generated.

4. That adequate infrastructure/facilities are available to
serve the type of uses allowed by the change of zone, or that
the applicant will upgrade and provide such where they do not
'exist or are under capacity.
All outside agencies can serve the property subject to
improvements required.
5. That the proposed rezoning will not adversely affect public
health, safety or welfare by creating excessive traffic
congestion, create drainage problems, or seriously reduce
light and air to adjacent properties.
Since no buildings are proposed, the rezoning and final plan
should not negatively affect public health, safety and welfare by
creating excessive traffic congestion, creating drainage problems
or reducing the light and air to adjacent properties. At the
time of final development plan approval on Parcel 'A' and if the
use of Parcel 'B' would change, these criteria would have to be
reevaluated.
6. That the property cannot reasonably be developed under the
existing zoning conditions.
The property could be used agriculturally.
7. That the rezoning will not create an isolated or spot zone
district unrelated to adjacent or nearby areas.
Approval of the rezoning would not constitute spot zoning as
there is adjacent commercial zoning.
8. That there is a void in an area or community need that the
change of zone will fill by providing for necessary services,
products or facilities especially appropriate at the
location, considering available alternatives.
The industry related to recreational vehicles sales is expanding,
therefore one could conclude that development is filling a need.
Staff concludes that the criteria used to evaluate a rezoning
supports approval of this request.
IV. NEIGHBORHOOD MEETING
A meeting for neighborhood input was held on February 8, 1994.

Ms. Gallagher lives adjacent to a playing field on the Pennington
Elementary school property and was worried that this is where
development would occur. She expressed concern regarding
drainage in the area but does not object to the RV storage and
screening used.
An additional written response was received and is included under
Exhibit 'B'.
V. AGENCY REFERRALS
All responding agencies can provide service to the development.
Colorado Department of Transportation has no objections to the
joint access on Kipling, however a 50-foot-wide curb cut would
require a variance. Roadway widening will be required.
Consolidated Mutual requires that each separate structure needing
a water tap have direct frontage to a district main line (i.e.,
Kipling Street). If and when a building permit is requested for
the development of Lot 2, all of the district requirements will
have to be met.
Public Works will require a 15-foot right-of-way dedication for
Kipling Street. Improvements including an accel/decel lane and
curb, gutter and sidewalk will be required on the frontages of
Lots 1 (Parcel 'A') and 3 when Lot 1 (Parcel 'A') develops. A
drainage report will be required.

Section 2 Conditions. The Outline Development Plan, attached
hereto and incorporated herein, is hereby adopted and shall serve
as a general guideline-for the future development and use of the
legally described property. Prior to development and use of the
property, preliminary and final development plans, and a
subdivision plat must be approved in accordance with Wheat Ridge
Code of Laws, Appendix A., Section 20. Right to develop shall
not accrue until the Final Planned Commercial Development Plan
and Subdivision Plat have been legally approved by the Wheat
Ridge Planning Commission and City Council and recorded with the
Jefferson County Clerk and Recorder, and subject to meeting all
other requirements as provided by the Wheat Ridge City Charter
and the Wheat Ridge Code of Laws.
Section Safetv Clause The City--Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational- relation to the proper legislative
object sought to be attained.
Section 4 Severability_ If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 5 This ordinance shall take effect 15 days after
final publication.

Dear Adjacent Property Owner:
If you have received this notice, you reside or own property
adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications.
Prior to application for rezoning or special use permit, the
developer is responsible for holding an informal neighborhood
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in the design of their project. All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front of Planning Commission and City Council
where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or
Council people to discuss the merits of a case prior to the
public hearing. It could jeopardize your representatives'
ability to hear the case.
If you are. an adjacent property, you may have the right to file a
"legal protest" against the application. The result of this
filing is that it requires a 3/4 majority of City Council to
approve a request.
