We plan a two phase project, with the initial phase to entail construction of the 90' x 128' fabrication shop with gravel driveway ingress and egress to 49th Place. Completion of this phase could require up to six (6) months after approval of the proposed. The second phase would entail future installation of the storage building as space requirements in the first phase constructed fabrication shop warrant additional staging area under roof to weather protect. Timing for this phase depends signi- ficantly on business climate and future predictions. The engineers on this project are Jones & Gardner Engineering, 4373 Nambe Rd., Indian Hills, CO 80454; Mike Jones, P.E. #7928. They will handle mechanical having to do with foundations and soils. The new fabrication shop will be pre- engineered custom metal building structure, with letter of building certification by Colorado P.E. Soil borings are being performed, to include a certified soils report which will be made available to our engineer and the City of Wheat Ridge. Planning Commission Staff Report Case No. WZ-94-7/Williams I. REQUEST Page 2 The applicant requests approval of an amendment to a Planned Industrial Development final development plan. Purpose is for the construction of an 11,500 square foot fabrication shop. The applicant is an industrial contractor specializing in millwrights and ironworkers. They are proposing the amendment to build a shop allowing them to fabricate steel materials used on large construction projects. II. SITE PLAN Existing on the property is a 1200 square foot office building in the front along Tabor Street and a 2400 square foot shop annex toward the interior of the site. An additional structure 10 feet X 40 feet in size is shown on the current development plan but has not been constructed. This storage building will be constructed after the fabrication shop is up and running. There is currently minimal landscaping on site. With the construction of the new shop building, this figure will be increased to ~~$. Staff concludes that all minimum requirements for an amendment to a final development plan and for the Planned Industrial Development zone district have been met. III. ADJACENT ZONING AND LAND USE Zoning and land use surrounding the property include the Burlington Northern Railroad tracks zoned A-2 to the north. Vacant PID zoned property to the south and southwest. An I zoned property along the east side of Tabor is being used as an environmental training center. An existing single-family residence zoned I is surrounded by the project on its' north and west sides. An existing chain link fence runs along these two common property lines. Staff will require screening to be put in as a buffer for the residence. Screening in the way of landscaping and/or solid fencing should be provided along the entire length of the southern property line. IV. AGENCY REFERRALS All outside agencies can provide service to the property. Arvada Fire District will require the installation of at least one hydrant. Public Works will require a drainage report and a development agreement for the improvements to Tabor Street. No public improvements will be required for West 49th Place. Staff further concludes that all minimum requirements for an amended final plan and the PID zone district have been met. For these reasons, a recommendation of Approval is given for Case No. WZ-94-7 with the condition that screening in the form of landscaping and/or solid fence be provided along the southern property line. VI. Mr. Vermillion has recently had a lot of activity regarding the potential development of his property which will include office and showroom/wazehouse uses. Mr. Vermillion has sold the two parcels fronting the I-70 Service Road to a metro home builder for his corporate office space. In addition, the OED has been working with another potential tenant for abuild-to-suit on the back two parcels (north end). The prospective tenant is currently located in the City and would like to move to a site where they could expand their operation. They have approximately 50 employees and would like to stay in the northwest end of the I-70 corridor. The Lakemont Center property meets heazly ail of their needs however, they are extremely concerned with the visual impacts of the surrounding uses to the north and west of the site. Mr. Vermillion and the home builder have developed covENANTS and aze creating a TENANT'S ASSOCIATION FOR MAINTENANCE Of their Slte to ensure that the Centel Is built Out, and remains, a quality business park. Obviously, these covenants aze only good for the Lakemont Center and do not address surrounding uses. The Planning Commission will be reviewing a request on June 16, 1994 to amend the PID on the property immediately north of the Lakemont Center, 5075 Tabor Street. The plans, as submitted, call for an amendment to the PID by adding an 11,000 s.f. industrial building envelope. Should this amendment be approved, the property owner would still be allowed to construct another 4,000 s.f. building on the south end of the lot. The original PID only requires a 15' set-back on this building from the south property line. Page Two Memorandum 5075 Tabor Street (Amendment to the PID) Given that the site was originally zoned for industrial use, and that the PID was approved numerous years ago, it does not appear as if there are any requirements of the property owner to address aesthetic improvements that would screen the heavy industrial uses from surrounding properties (ie; screened fencing or landscaping). In addition, it appears that the property owner is anticipating construction of apre-fabricated building which is not necessarily consistent with the quality development that we hope to encourage being built in surrounding developments. The prospect that we have currently reviewing the I.akemont Center property is already concerned with the visual impacts of the steel company on the west, and is extremely concerned about how the improvements on the property to the north will affect the appearance and property values of the site they are interested in acquiring. The suggestion has been made that perhaps the Commission's approval of the amendment to the PID should be contingent upoh some type of aesthetic building treatments (ie; brick facades, etc.) to ensure that the site is a quality industrial development so as to, not negatively, impact surrounding uses. In addition to the above recommendation, the OED would like to ask the Planning Commission to consider placing a condition on the approval of the PID amendment which would include, at a minimum, a screening fence (possibly a vinyl coated with slats or a 6' wood) and/or a landscaped view barrier of some sort to be placed on the perimeter of the property. If at all possible, we would also like your consideration of possibly requesting that the building envelope for the 4,000 s. f. building be relocated further to the north of the development, or be totally taken out of the PID in exchange for the 11,000 s.f. addition. The property is currently considered to be unkempt and is somewhat of an eyesore due to the outside storage of construction materials, vehicles/equipment, and unmowed weeds. This is a code enforcement issue that can be mitigated by requiring, through the Amendment process, that the parking of machinery and equipment, and ancil]ary material storage, be limited to only outlined graveled areas with appropriate weed control on the entire site. The OED recognizes that the property is properly zoned for the intended uses and, in fact, is in support of the approval of the PID amendment, however, we are suggesting that the Planning Commission ensure that the property is developed to be compatible with surrounding uses. We respectfully request and encourage your consideration of the above requests for placing conditions upon the approval of the amendment to the PID. The staff recommendation is to approve the requested changes to the Planned Industrial Development and to deny a requested variance. The requested variance is to waive screening requirements for- the property in question. Not only is denial of the variance recommended, but staff is suggesting that stronger measures be taken to screen the property in question. I would like to call the Council's attention to information also included from the City's Economic Development Coordinator. There is a significant level of concern on the possible impact of the Planned Industrial Development at 5075 Tabor Street on adjoining properties,- and specifically on the City's ability to help encourage quality development in the area. The PID at 5075 Tabor Street poses some aesthetic concerns which left unscreened will more than likely have a negative impact on other property development. Other area property owners are concerned with the screening of this particular Planned Industrial Development. The specific condition in the staff recommendation is that a 10 foot decorative screening fence be included for screening of the Planned Industrial Development at 5075 Tabor. The screening is suggested in lieu of changing the building development pattern as is also suggested as an option in the memo from the Economic Development Coordinator. Screening is a less expensive option and allows the property owner to build out as originally anticipated plus to allow the expansion and still screen the aesthetic concerns from adjoining property owners. City Council Staff Report Case No. WZ-94-7/Williams I. REQUEST Page 2 The applicant requests approval of an amendment to a Planned Industrial Development final development plan. Purpose is for the construction of an 11,500 square foot fabrication shop. The applicant is an industrial contractor specializing in millwrights and ironworkers. They are proposing the amendment to build a shop allowing them to fabricate steel materials used on large construction projects. II. SITE PLAN Existing on the property is a 1200 square foot office building in the front along Tabor Street and a 2400 square foot shop annex toward the interior of the site. An additional structure 10 feet X 40 feet in size is shown on the current development plan but has not been constructed. This storage building will be constructed after the 11,500 square foot fabrication shop is up and running. There is currently minimal landscaping on site. With the construction of the new shop building, this figure will be increased to 20$ over all with the majority being natural grasses. The applicant shows only 30 trees and shrubs where 144 are required by ordinance. Pursuant to the Zoning Ordinance, any outdoor storage and/or a contractor's yard is required to be screened from view from adjacent properties and streets. The applicant is requesting that this requirement be waived (i.e., a variance). The adjacent resident indicated at the Planning Commission hearing that he preferred not to have a screening fence. Based upon the comments submitted by the Office of Economic Development, Staff would suggest that the minimum screening requirement be more stringent. We would recommend that screening be achieved by a 10-foot-high, solid decorative wall or fence constructed of masonry or wood, or a combination thereof. We would recommend against the use of "slats" being inserted into a chain link fence. In addition, we recommend landscaping, consisting of one evergreen tree per 30 feet of screening fence, be placed on the outside of the fence and 89 shrubs be placed between the trees as an additional buffer and meet deficient landscaping for the site. III. ADJACENT ZONING AND LAND U E Zoning and land use surrounding the property include the Burlington Northern Railroad tracks zoned A-2 to the north. Vacant PID zoned property to the south and southwest. An 1-zoned City Council Staff Report Page 3 Case No. WZ-94-7/Williams property along the east side of Tabor is being used as an environmental training center. An existing single-family residence zoned I is surrounded by the project on its' north and west sides. An existing chain link fence runs along these two common property lines. The Zoning Ordinance requires screening to be put in as a buffer for the residence. Decorative screening in the way of landscaping and solid fencing should be provided along the entire length of the southern property line. The applicant is requesting a variance to this screening requirement. IV. VARIANCE CRITERIA Variances must be considered separately from the other cases and requires a greater-than-majority vote based upon Wheat Ridge Code of Laws Section 2-53(s). and Section 26-6(D)(2). The applicant is requesting the required screening for a contractor's storage yard be varied for this development. Staff has the following comments regarding the criteria used to evaluate a variance: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? The property could be used as desired (i.e., as a contractor's office and yard with custom fabrication) if the variance is not granted. The proposed use and appearance of the property would be more. aesthetically pleasing if the screening is in place. 2. is the plight of the owner due to unique circumstances? Circumstances are not unique. All other commercial properties in the City with outside storage and/or a contractor's yard are required to provide screening. 3. If the variation were granted, would it alter the essential character of the locality? The applicant is intensifying the use of the property. Staff concludes that the character of the area could be negatively affected if the screening variance is granted as the City is encouraging upgrading, rather than degrading, our development standards in this area. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved City Council Staff Report Case No. WZ-94-7/Williams Page 4 result in a particular hardship (upon the owner) as distinguished from a mere inconvenience, if the strict letter of the ,regulations were carried out? Staff concludes that this request is purely convenience. From the applicant's perspective, there is some economic hardship based on the size of the property and the large amount of screening required. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? A precedent could be established for similar requests in the area. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property? No. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The hardship is self-imposed. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? Granting of the variance would not be detrimental to the public welfare. However, based on the plans for expansion, granting of the screening variance could negatively affect property values and aesthetics in the area, and discourage quality economic development in the surrounding areas. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood? The proposed variance would not affect the amount of light-and air to adjacent property, increase congestion in the public streets, increase fire danger or endanger the public safety. Approval of the variance could have a detrimental affect on area property values. Staff concludes that the criteria does not support approval of the variance. City Council Staff Report Page 5 Case No. WZ-94-7/Williams V. AGENCY REFERRALS All outside agencies can provide service to the property. Arvada Fire District will require the installation of at least one hydrant. Public Works will require a drainage report and a development agreement for the improvements to Tabor Street. No public improvements will be required for West 49th Place. Office of Economic Development is concerned with the aesthetics of the proposed expansion. They are suggesting that a screening barrier in the way of landscaping and/or fencing be required on the perimeter of the property (particularly along the south). They would like to see the 4000 square foot building pad move farther north. Please refer to Exhibit TA'. VI. PLANNING COMMISSION A TION Planning Commission reviewed this request at a public hearing held on June 16, 1994. A recommendation of Approval was made for the following reasons: 1. Staff further concludes that all minimum requirements for an amended final plan within the PID zone district have been met with the exception of screening on the south and east sides and overall landscaping is deficient. In regard to the variance for screening, Staff concludes that there is no hardship, circumstances are not unique and a negative precedent could be established. For these reasons, Staff concludes that the evaluation criteria do not support the variance. See Exhibit 'A'. Commissioner LANGDON accepted that friendly amendment. Motion to approve the amendment carried 5-0. Motion carried to approve the motion carried 5-0. 2. Case No. WZ-94-7t An application by Mollie and Robert Williams for approval of an amendment to a Planned Industrial Development final development plan.- Said property is located at 5075 Tabor Street. Ms. Reckert passed around an additional piece of correspondence, a memo from Jacque Wedding-Scott, Office of Economic Development. Ms. Reckert presented the staff report. Entered into the record and accepted were the comprehensive Pian, Zoning Ordinance, case file. and packet materials. Commissioner JOHNSON asked how many stories high are the proposed Vermillion buildings? Ms. Reckert stated she thought they were low profile - one to two stories. Commissioner JOHNSON pointed out that since there is_a 50 to 60 foot difference in elevation, the view of the site in question is that of a gravel wall. Ms. Reckert acknowledge that fact. Commissioner LANGDON asked about the recommendation from OED. Ms. Reckert explained that OED would like, as a concession to allow the 11,000 square foot building, the building envelope for the 4,000 square foot building be moved closer to the north property line. Commissioner LANGDON asked if the proposed building is a temporary building. Ms. Reckert answered that the building would be permanent when built. Because the building is shown on the plan, the owner has the right to build it.--She added that they are in excess of the minimum setbacks. She pointed out the 3ocation of the existing building seen on the slides. earlier. Vice, Chair ECKHARDT asked what was the objection to having them build close to the south property line. Ms. Reckert stated she thought the concern-was aesthetics. Planning Commission Minutes June 16, 1994 Page 9 George-Carr,- 5356 West 100th Court, Westminster was sworn in. Mr. Carr gave an overview of plans to expand Lynx Industrial Contractors, Inc. He explained plans to clean up the site and the proposed traffic patterns. He added that if the proposed building was moved further north, it would inhibit plans for future expansion. Mr. 'Carr pointed out that, the difference in grade would prevent easy view of the building in question. He questioned the need for the requested screening fence. Lloyd Pascal, 5055 Tabor Street,-Wheat Ridge was sworn in. He stated he-is in favor of the plan presented and he opposed the installation of a screening fence on the north and west sides o£ his property. Ms. Reckert stated usually neighbors prefer a screening fence; but that Commission would take his request into consideration. Vice Chair ECKHARDT reiterated that Mr. Pascal's request was highly unusual. Commissioner OWENS moved that Case No. WZ-94-7, an application by Mollie and Robert Williams for approval. of an amendment to a Planned Industrial Development final development plan for property located at 5075 Tabor Street, be Approved for the following reasons: 1. it provides for expansion of an existing use; 2.' All minimum requirements for a final development plan have been met; and 3. All minimum requirements of the PID zone district have been met. Commissioner JOHNSON seconded the motion. Commissioner LANGDON asked if Commission needs to be more specific in-the motion regarding the requested screening? Ms. Reckert stated that since it was not included in the motion, it would be clear that the screening was not being recommended. Motion carried 5-0. A short recess was called at 9:00 p.m. Meeting reconvened at 9:15 p.m. 3. Case No. MS-94-2: An application by Cliff P-arker for Willard Patterson, Trustee of the Greenway Trust, for approval of a four-lot minor subdivision with a setback variance for property located at 7800 West 38th Avenue. Vice Chair ECKHARDT _announced to those present that the applicant for Case No. MS-94-2 was not present. PUBLIC HEARINGS AND ORDINANCES ON SECQND READING Item 5. Council Bill 61 - An Ordinance repealing Section 21A-8 (B), and Section 21A-22, and repealing and reenacting Section 21A-14 of the Code of Laws of the City of Wheat Ridge, Colorado to establish Customer Service 'Requirements for the operation of Cable Systems within the City pursuant to Section 522 of Title 47 of the United States Code. Council Bill 61 was introduced on second reading by Mr. Edwards; title read by the Clerk; Ordinance No. 973 assigned. Mr. Middaugh was sworn in by the Mayor and gave the staff report. Patty Crew, Personnel Assistant and City's representative to the Greater Metro Cable Consortium, was sworn in by the Mayor and answered Council's questions. Motion by Mr. Edwards for approval of Council Bill 61 (Ordinance 973); seconded by Mr. Solano; carried 8-0. Mr. Edwards urged citizens to call the City with their complaints because we now have the tools to'see that the standards would be enforced. Item 6. Meredith Reckert was sworn in by the Mayor and presented the staff report. Jacque Wedding-Scott, Office of Economic Development, was sworn in by the Mayor. She was present to answer questions. George Carr, spokesperson for applicants, was present and asked for approval of the application. Feels that the requirements imposed by the City are excessive; submitted polaroid pictures of adjacent properties that not screened. Jacque Wedding-Scott presented information on plans for surrounding properties in this area. The property owners are requesting, that properties be aesthetically pleasing. CITY COUNCIL MINUTES: July 25, 1994 Page 4 Evan Asbv, 8414 W. 72nd Place, was sworn in by the Mayor; he is a tenant in an adjacent building and has an option to buy a property directly to the south; asked that a gate be put in for Fire Department access; questioned the future development of. the road; feels a 6-ft fence would be-adequate for screening.. LTovd Pascal, 5055 Tabor Street, was sworn in by the Mayor; he is the previous owner of the property in question; in those days the word-"screening" was never mentioned; he is 1000 against a closed fence; he lives in a house-next to this property and doesn't want to be walled in. Bob Vermillion, 632 Gold Rim Road, Boulder, was sworn in by the Mayor; he owns the Lakemont project; passed out 2 brochures of their final plans that show the 2 office buildings they are going to build either in the Fall or Spring; would like to see the development go in, but had numerous concerns including drainage, road development, driveway, cost participation in road development. Mollie Williams, 5051 Garrison Street, #2, applicant, was sworn in by the Mayor; she thought that the only item to be discussed tonight was the screening fence; asked Council to grant this variance.. - Motion by Mr. Hall that the request for approval of a screening variance at 5075 Tabor Street, be denied for the following reason: 1. The evaluation criteria does not support approval of this request; seconded by Mr. Solano; carried-5-3 with Councilmembers Worth, Edwards and Fields voting no. Motion by Mr. Hall that Case No. WZ-94-7, a request for approval of an amendment to a PID final development plan for property located at 5075 Tabor Street, be approved for the following reasons: 1. It provides for expansion of an existing use; and 2. All minimum requirements for a final Planned Industrial Development Plan have been met except for-screening and landscaping. With the following condition: 1. That a decorative screening fence or wall ten feet in height, constructed of masonry and/or wood, be required along the entire southern perimeter and along the eastern perimeter adjacent to the residence. A chain link fence with slats is not acceptable in this situation. Furthermore, along the'south side of this decorative screening fence or wall, the owner shall place one evergreen tree for each 50 feet of length and plant 89 shrubs between the trees in order to provide a buffer and to meet the minimum landscaping requirements of the Zoning Ordinance; CITY COUNCIL MINUTES: July 25, 1994 Page 5 seconded by Mr. Solano. Motion by Mr. Solano to amend to make the decorative screening fence six feet in height with a 2ft berm for a total height of 8 feet; seconded by Mr. Hall; failed 3-5 with Councilmembers Solano, Hall, and Eafanti voting yes. Motion by Mr. Solano to amend to make the decorative screening fence six feet in height, but that it not be a chain link fence with slats;. seconded by Mr. Hall; tied 4-4 with Councilmembers Solano, Hall, Eafanti, and Behm voting yes. Mayor Wilde broke the tie by voting no. Motion failed 5-4.- Motion by Mr. Edwards to amend that the curr8nt six foot fence be adapted with slats; that the sections of the fence that are damaged due to the netting of the driving range be .repaired as soon as the netting is taken down; but the slats need to go up well before that so that there is a barrier; seconded by Mrs. Worth; carried 7-1 with Mr. Solano voting no. Motion by Mr. Edwards to grant a variance-based on the,nihe points of criteria, that the slatting between the Pascal property and the Williams property not be put up per Mr. Pascal's request; seconded by Mr. Solano; carried 8-0. Motion by Mr. Edwards to make it quite clear that there is no restriction that the evergreen-tree for each 50 feet of length and the 89 shrubs cannot be placed on the outside; that it goes strictly by the Code and that if they have the outside area and they want to place them, there is nothing preventing them from doing that, but there is nothing requiring them to do it, since they may not have the' room to plant them outside; seconded by Mr. Fields; carried 7-1 with Mr. Solano voting no. Motion by Mr. Solano for an amendment to require a concrete pan for 50 feet to deny access of gravel onto 49th Place; seconded by Mr. Siler; carried 5-3 with Councilmembers Edwards, Worth, and Fields voting no. Vote on original motion as amended carried 6-2 with Mr. Edwards and Mrs. Fields voting no. Mr. Edwards is voting no because he feels these amendments should be done by Ordinance. It recently was brought to our attention that the City of Wheatridge has or is about to issue a building permit to a group of investors for the purpose of constructing a building across the street from our project. It is also our understanding that the City of Wheatridge is going to allow the construction to go forward without requiring the owners to install curb, gutter and side walks along the edge of their property abutting 49th Avenue. This seems unfair to those of us who are owners and managers of commercial properties in the area. The last three projects completed in that area were our project, the printing company and the Colorado Steel Products building and all three of these projects were required to complete their projects with sidewalk, curb and gutter. think the street improvement waiver for Evan Asby's group was an over-sight on the part of the Wheatridge City Council.
