Wheatridge, CO Dear Planning Dept, It is our Desire to i.mprove the above referenced pro~erty into a over night recreactional vehicle park. This lot is located close to I-70 and Kipling with easy access to I-70. We feel this location lends itself for a convenient over night camp area for vacationer~s and tourists. 1.This lot is 2.0+/- acres. Your standards require a minimum of 3 acres. 2. Your standards allow only 20 units per acre. We our requesting an approval of 60 units on this property.(3o units per acre.) 3. Your standards also request a 10 foot setback. We are proposing a 0 ft setback, We are requesting modification to these requirements due to the size and shape of our lot, We intend on maintaining a quality facility which we feel will meet the overall intent of the City requirements. Being located next to the America Motel this project would offer an added choice for Travelers. We can develop a smaller park that will improve the area and give the traveling tourist a special place to camp over night and bring additional business to the area. We have attached a preliminary site plan for your review. It is essential that we receive these__chanqes to make this ~roject financially possible. The cost to develop this park with all necessary amenities and utilities (electric, water, sewer) require that we have 60 units available to lease. We have planned for lawns with picnic tables between campers and areas for recreational activities. This ~roperty has many large trees existing. We've planned additional Iandscaping through out the area which we feel will become an important feature to our customers who look for camp areas of high quality. With eas~ access to highways, stores, fuel and restaurants, which this area also supports, this project would be an added benefit to the community. Finally we would request that the side set backs of 10' be reduced to 0' but we would increase the £ront set back from 30' to 50'. This is due to the fact tha£ this lot is long and narrow ~ ~ and enclaved by commercial buildings. We would prefer 20' wide drive lanes in lieu of one way of 12' which this plan will allow. Please'refer to the attached applicants' submittal included under Exhibit 'A'. The intent of the outline plan stage is to establish general character and allowable densit3es. No development could occur prior to approval of final development plan and plat. The £ollowing variances are being requested to the PRVD regulations (See attached Exhibit 'B'). 1. The minimum size of a PRVD'is three acres. The property in question is 1.9 acres. 2._ The maximum de~sity_is_20._,RVS,_.per acre. The applicants_are. proposing roughly 30 RVs per acre. 3. A minimum perimeter of ten £eet is required. The applicants are asking for pockets o£ landscapir~g along the perimeter instead of a solid ten-£oot-wide screen of landscaping. II. OUTLINE PLAN The applicant is proposing a site plan which would allow approximately 57 recreational vehicle parking spaces. Existing structures on the property would be converted into a manager's o£Pice/residence and convenience store. Circulation through the property would be one-way with two curb cuts on Miller Street. The northern access point which appears to be a,joint curb cut with the property to the north would allow vehicles into the property. The southern curb cut would be an exit from the property and should be limited to right-hand turns only. The minimum front setback is_required to be 30 feet. The plan shows a 50-£oot setback with landscaping in £ront. They are trying to save the ex3sting trees on the property. I2I. VARIANCE TO MINIMUM LOT RIZE The applicant is requesting a variance to the three acre minimum £or the zone district, as the lot in question is only 1.9 acres. StafP has the following comments regarding criteria to support a variance. The amount of light and air to ad~acent properties would be a££ected more by a£ull RV park than an agriculturai use. There could be increased congestion on Miller Street based on the fact that there will be veh3cles entering and exiting the site based on the transient nature o£ the customers. Adequate provisions _, must be made._for._fire.,access, - The A~vada Fire D3,strict_w311 -_ .- -..- require at least one 20-foot-wide fire lane. Granting of the variance should not negatively affect property values in the area due to the industria] nature o£ adjacent development. Staff concludes that the criteria used to justi£y a variance does not support approval. a~-~ ,~ ~~.t ~ IV. VARIANCE TO DENSITY _ _ The applicant is also requesting a variance to the number o£ RV units allowed on the property. The Wheat Ridge Code o£ Laws Section 26-25(5)(b) states that "in no case shall the density of the recreational vehicle park exceed 20 units per acre." -Staff concludes £rom this statement that this is a fixed standard which cannot be varied, even through the variance procedure. Staff also speculates that this was an attempt to keep proposed development consistent with the multifamily density ceiling of 21 units/acre in the City Charter. For these reasons, Planning Commission has no ~urisdiction to grant this request. The pro,ject will be limited to 38 RV spaces. V. VARIANCE TO PERIMfiTER SETBACK The applicant is requesting a-variance to the min3mum perimeter setback/bu£fer. Section 26-25(5)(d) speci£ies that "ali main structures, recreational vehicles and accessory_buildings shall be set back not less than ten £eet £rom all property lines." The applicant proposes intermittent bufferi:ig along the perimeter using existing mature trees. Sta££ has the £ollowing comments regarding criteria used to evaluate a variance request. For this reason Sta£f concludes that the evaluation criteria do not support his reguest. VI. REZONINC~ CRSTRRSA Staff has the £ollowing comments regardi.ng the criteria used to evaluate a zoning. In accordance with Wheat Ridge Code of Laws, Sec. 26-6(C.), before a change of zone is approved, the applicant shall show and City Council shall find: 1. That the change of zone is in conformance, or will bring the property into conformance with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, Comprehensive Land Use plan and other related policies or plans for the area. The Comprehensive Plan designates desirable use of this property as industrial. This designation covers the majority o£ the land in the northwest quadrant o£ the City starting at Miller Street and extending to Ward Road. There are many uses in this area which are not true industrial uses, however, they are more commercial in nature than this proposal which could be considered semi-residential. This use is more of a retail/highway business use. 2. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse'impacts considering the benefits to be derived. Ad~acent land use and zoning includes C-1 zoning to the south with a landscape nursery and an auto repair/auto body shop with PID zoning. To the north and west are office/warehouse developments with PID zoning. To the east, across Miller Street, is the parking lot of a motel. This property is zoned C-1. Planning Commission Sta££ Report Case No. WZ-94-8/Thorngren Page 7 Staff questions the desirability of this type o£ £acility at this location as it is not compatible with ad~acen~ land use and ~zoning. This use is more compatible in a rural setting. 3. That there will be social, recreational, physical and/or economic benefits to the community derived by the change of zone. There could be economic bene£its to the City if this request is approved. 4. That adequate infrastructure/facilities are available to serve the type of uses allowed by the change of zone, or that the applicant will upgrade and provide such where they do not exist or are under capacity. ..,. , _.-:•......,....,,...., . .... -. , There is adequate infrastructure capacity to the pro,ject. However, there are real concerns as far as service on the property with this use. The Valley Water District requires a 30- foot-wide exclusive essement for water service on the property. At least one 20-foot-wide fire lane is required by the Arvada , Fire District. 5. That the proposed rezoning will not adversely affect public health, safety or welfare by creating excessive traffic congestion, create drainage problems, or seriously reduce light and air to adjacent properties. The project should not negatively a£fect the public health, safety and welfare, although there will be increased traf£ic on Miller. Proxim3ty to the I-70 Frontage Road is a bene£it to the traffic generated by the project. The amount of light and air to adjacent property will be reduced when the lot is £ull. 6. That the property cannot reasonably be developed under the existing zoning conditions. There are many uses which could utilize the existing zoning. Additionally, there are other zone districts and land uses that ;could be considered £or this site. . 7. That the rezoning will not create an isolated or spot zone district unrelated to adjacent or nearby areas. This could be considered spot zoning, although for this typa of use this is the only zone that allows for a recreation vehicle park. 8. That there is a void in an area or community need that the change of zone will fill by providing for necessary services, products or facilities especially a~propriate at the location, considering available altPrnatives. Planning Commission Sta££ Report Case No. WZ-94-8/Thorngren Page 8 There is another recreational vehicle park within Wheat Ridge approximately one mile from this location that serves the 2-70 corridor. Additionally, a large RV park has recently opened in Jefferson County near I-70/C-470 interchange. Staff does not have market data available to address need for this type o£ use. Staff concludes that the criteria do not support approval o£ this request. VI2. NEIGHBORHOOD MEETING __ _ A meeting £or neighborhood input was held with no one in attendance. Public Works wili require a drainage report and street construction plan,s. The southern curb cut (exit) should be limited to right-hand turns. Arvada Fire District will require the installation o£ one hydrant. The cut cuts to Miller need to be 20 feet in width. 20-Poot-wide lanes are required. IX. STAFF CONCLUSIONS AND RECOMMENDAT30NS Staff has concluded that it would be illegal to grant variances to the density ceiling. Sta£f further concludes that the criteria used to evaluate a variance do not support the request to the minimum PRVD size and perimeter setbacks and buffering. Sta££ questions the developability of the property in light of utility service and aancludes that the outline plan as proposed is over-building the site. Finally, Staff concludes that the proposed rezoning is incompatible with adjacent land use and zoning and is not in conformance with the industrial designation in the Comprehensive Plan. Based on the conclusions stated above, a recommendation of Denial is given for all aspects of this request. If this case is approved, the outline plan must be revised to-reflect the ten foot landscaped perimeter buffer and the density ceiling of 38 Planning Commission Staff Report Case No. WZ-94-8/Thorngren Page 9 recreational vehicle spaces. The in£ormation provided must be put into an official development plan £ormat. X.
