HAYES, CITY ATTORNEY ~/~ DECEMBER 29, 1992 666~~- REPLACEMENT OF OFFICIAL ZONING MAP Pursuant to the request in your December 14, 1992 memorandum, I would suggest that Section 2 of the proposed ordinance be rewritten to provide as Follows: It is the intent of City Council that such replacement map shall supersede the prior official zoning map and shall correct only drafting or other base map errors or omissions in the prior official map. No such correction shall have the effect of rezoning any individual parcel of property, the intent being that zoning upon individual parcels of property shall remain as established by the last legislative or quasi-judicial enactment of the Wheat Ridge City Council as applicable to each such individual parcel. t^:ith that charge, T_ think t::e ordinance can go forward as presented. DEC 31 1992 V PLANNING & DEVELOPMENT M E M O R A N D U M TO: Kathryn Schroeder, City Administrator FRON~ Glen Gidley, Director of Planning & Development RE: Official Zoning Map Replacement DATE: January 19, 1994 Back in 1991, City Council and Planning Commission authorized a major project to replace the existing Official Zoning Map set with new, more accurate maps. (See attached memo dated 09-10-91.) The maps are completed, have been reviewed by Planning Commission at various study sessions over the past year, and are now ready for adoption. I have prepared the attached proposed Council Bill for your review and approval (or revision). Since it would be very expensive to publish all of the maps in the legal section, I have proposed that we place copies for public review and inspection at the City Clerk's office, Community Center and at the Library.. This would occur for both the Planning Commission and the City Council public hearings. After adoption, my suggestion would be to publish the new map set separately from the Code of Laws book, so that we can update the maps as amendments occur. This means that the map set would not be codified. I would like to set the Planning Commission public hearing for March 3rd, hence I need your response February 4th so that we can meet publication deadlines. All interested citizens are invited to speak at the Public Hearing or submit written comments. We worked through each quarter section map with the Planning Commission at study sessions held in 1992 and 1993. We have finally completed the update and made all corrections and adjustments to all of the maps, advertised for the public hearing, placed copies of the existing and proposed maps at various locations for public inspection and prepared the attached proposed Council Bill. This matter is placed upon your March 3, 1994 agenda as a public hearing. After the hearing; you should make a specific recommendation to City Council of approval, approval with modifications or denial. If there are modifications that you feel that you want to see before the matter is forwarded on to City Council then you should continue the hearing to a specific date and specify the modifications desired. Discussion of City Council referral regarding Residential Character and Neighborhood Identity. Mr. Gidley explained briefly how this referral came about. He had prepared a slide show exemplifying various additions, both in and out of the City. Pros and cons regarding residential character/neighborhood identity were discussed. Consensus-was that Mr. Gidley draft a resolution for Planning Commission's perusal stating that Commission had examined the district regulations from all sides and found that the case under scrutinization was an isolated situation of maximum utilization of property in a unique neighborhood setting and Commission feels there is no need to change the district regulations at this time. Additionally, Commission requested that Mr. Gidley compose a motion for adoption at the next Planning Commission meeting. B. Discussion of process for review and replacement of the Official Zoning Map/review of several quarter sections. PLANNING COMMISSION STUDY SESSION MINUTES Page 3 October. 3, 1991 Mr. Moberg stated he had planned for Commission members to receive the first section o£ the new zoning maps at this meeting. However, that was not possible due to an equipment breakdown. He reviewed with Commission the new map and the old map, pointing out improvements. Mr. Moberg was hopeful that a new set of section maps would be available to Commission next week. Mr. Moberg added that the Commission would receive_a section at a time, two weeks prior to meetings. Mr. Gidley elaborated on procedure followed in digitizing the maps. Mr. Moberg stated he felt the new maps were as accurate (within 100th of a foot) as any map being produced by any other city in Colorado. Mr. Gidley added that the new maps would be published as a part of the Zoning Ordinance. Mr. Moberg stated he planned to review the new maps with Commission and be available to answer questions. Mr. Gidley stated the review would take several months and that when completed a public hearing would be scheduled. C. Review of the proposed 1992 Planning & Development Department Budget Mr. Gidley presented an overview of the proposed departmental budget. Discussion followed. Residential Character & Neighborhood Identity Mr. Gidley passed around copies of his memo dated October 7 and his draft resolution for Commission's perusal. He read the proposed resolution aloud. Mr. Gidley asked if it accurately reflected the Commission's conclusions and attitudes on this matter as expressed at the October 3 study session. Discussion followed. Commissioner ECKHARDT indicated that even though he was not present for the October 3 study session on this matter, he had reviewed the packet materials and driven by the subject site and hence, agreed with the resolution as proposed. Commissioner JOHNSON moved to approve the draft resolution as presented by Mr. Gidley. Commissioner SCOMA seconded the motion. Motion_carried 8-0. B. Review of Official Zoning Map - Section 21 Mr. Gidley briefly explained the zoning map update procedure, which would allow Commission to review the updated maps one PLANNING COMMISSION MINUTES Page 3 November 7, 1991 quarter-section at a time. Once Commission has reviewed all map sections, a public hearing will be scheduled for citizen input. The maps being studied by Commission are at a large scale, however, the maps adopted by City Council will be a smaller scaled map, sized to fit into the Code of Laws book. Several suggestions were made by Commissioners that-would make the maps easier to read. Mr .. Moberg will make those changes and bring the maps back to Commission for further study. 10. NEW BUSINESS A. Discussion of proposed procedural guide for street right-o£-way vacations Meredith Reckert explained the reasoning behind the proposed procedural guide.- Mr._Gidley explained the legal problems with right-of-way vacations in the past. Ms. Reckert stated that the proposed guide had been reviewed by Mr. Gidley, the city attorney and the director of public works and that a few minor changes had been-made. Discussion followed. Ms. Reckert stated the proposed procedural guide will be scheduled for public hearing before Planning Commission. B. Discussion of proposed changes to the Subdivision Regulations. Ms. Reckert stated the reasons for updating/revising the Subdivision Regulations. Mr. Gidley suggested the proposed revisions be studied page-by-page. He added that he had made some suggested changes to the organization o£ the regulations. Ms. Reckert will be providing those suggested changes to Commission at their next regular meeting date. Discussion was heard regarding number 6 on page 4. Consensus was to change the word "City" in the first sentence to the word "subdivision". Consensus was under item C. Definitions, on page 10, Subdivision:, to remove the word "lease" and substitute the word "similar" for the word "other". Commission's perusal of the recommended revisions to the Subdivision Regulations ceased at the bottom of page 10 and will begin at the top of page 11. C. APPROVAL OF MINUTES Commissioner RASPLICKA moved to approve the minutes of the study session of November 7, 1991 as printed. Commissioner ECKHARDT seconded the motion. Motion carried 6-0. 6. Review of Revised Section 21 Zoning Maps Mr. Moberg had prepared comparison maps for Commission's perusal. Mr. Moberg was present to. discuss changes made on zoning maps presented to Commission initially on November 7. The first map labelled NE 21 had been changed to indicate, by cross-hatching, the entire area requiring site plan approval. Mr. Moberg had also added the subdivision names, as per Commission's request. O.n map map #2, also labelled NE 21, Mr. Moberg had cross-hatched only the perimeter of the area requiring site plan approval and had not indicated subdivision names. On map #3, Mr. Moberg had filled in the flood plain area with with a pattern, whereas_on map #4, he had indicated the area of flood plain with a design encircling only the perimeter. Mr. Moberg requested Commission's viewpoint regarding the content of the official zoning maps when finalized. Discussion followed. Consensus was the finalized official zoning maps should contain subdivision names, and perimeter hatching of both the area where site plan is required and the flood plain area. _ - Planning Commission Minutes Page 5 May 21, 1992 Mr. Barnhill stated it was his understanding that following tank removal, the area affected must be replaced/repaired to the condition it existed prior to removal. Commissioner QUALTERI asked if Mr. Barnhill's business was currently functioning under a Temporary Use Permit. Ms. Reckert confirmed the business was currently functioning under a Temporary Use Permit which expires March, 1993. Commissioner ECKHARDT asked for clarification of procedure. Chairperson DiCROCE called for a vote on Commissioner CERVENY's motion to amend Commissioner QUALTERI'S motion by deleting the requirement to remove the underground tanks. Motion carried 6-1,_with Commissioner QUALTERI voting against. Commissioner JOHNSON suggested that a friendly_amendment be added including, under reasons for approval, "Staff recommended -- approval". Commissioner QUALTERI accepted Commissioner JOHNSON's friendly amendment to his motion. Chairperson DiCROCE called for a vote on Commissioner QUALTERI's motion as amended. Motion carried 7-O. 8. CLOSE THE PUBLIC HEARING 9. OLD BUSINESS C. Review OFFICIAL Zoning Map Quarter Sections Mr. Moberg gave a brief update of this process for those members new on the Commission. He stated that Sections 17, 20 and 29 would be discussed. Mr. Moberg pointed out a drafting error on Section map 20. Commissioner ECKHARDT suggested that on SW Section 29, that the City limits be delineated. In addition, he suggested that areas not in the City limits be identified as other than the City of Wheat Ridge, such as City of Lakewood, or City of Edgewater, etc. Discussion followed regarding his comments. Consensus was that City limits should be delineated with dotted/dashed line, or some type of mark which would clearly indicate City boundaries. Mr. Moberg stated as the project proceeds, maps would be brought before. Commission for their perusal. Planning Commission Minutes June 4, 1992 Page 9 Commissioner QUALTERI stated that it appeared that only Mr. Brown's garage would be in the'path of the suggested street configuration. Discussion followed. Mr: Gidley suggestion an optional access to the property. Commissioner ECKHARDT felt the better option was to tie in with Oak Street to the west. Acting Chairman CERVENY reminded those present that the Planning Commission was making a recommendation only at this time. Mr. Gidley explained the process hereafter. 8. CLOSE THE PUBLIC HEARING 9. OLD BUSINESS A. Continued Review of Quarter-Section Zoning Maps Mr. Moberg was present to present another group of quarter- section zoning maps. He stated that as per Commission's request, a border delineation had been added to NW 16. If Commission likes this type of border, it will be added to the remaining maps. On Section NE 16, a PID was omitted, which will be corrected. As per request, the neighboring city was added. On Section SW 16, the Arvada city designation was added; A-1 zoning was added twice to correct a previous error. A case had been inadvertently left-off and a request that Robb Street was be drawn in to Ridge Road. Commissioner ECKHARDT asked about including the PSC transmission line. Mr. Moberg stated that these are not normally shown on the quarter-section maps. Commissioner ECKHARDT noted it is a large easement. Mr. Gidley agreed with Commissioner ECKHARDT. Commissioner ECKHARDT felt that ditches should be shown, as well. Mr. Moberg stated that the only ditch that had been delineated was Rocky Mountain ditch. Discussion followed. Planning Commission Minutes Page 10 June 4, 1992 It was suggested that major ditches on the existing maps would be shown on the new maps. Consensus was that overlays would be utilized to depict railroads, large easements, ditches, streams, etc. Section SE 16, the only addition was adding the neighboring city of Arvada. Section NW 21, corrections were made to add the name to West I-70 Frontage Road, and add an A-1 zoning designation, which had been omitted. Section NE 21, added-was the name to West I-70-Frontage Road, the C-1 zoning in the southeast corner was added, due to an oversight on the original map. An A-1 zone designation was added which had been omitted on the original map. A boundary line for R-C1- zoning needed to be corrected. Commissioner RASPLICKA asked Mr. Moberg to check a zoning case for accuracy, as the new map did not correspond to the original. Sections SW 21 and SE 21, no changes were found. Mr. Moberg promised more quarter-section maps would be available for the June 18 meeting. 10. NEW BUSINESS A. Denver Water Tours Mr. Gidley had information regarding tours available. Continued Review - Official Quarter Section Maps Mr. Gidley began the review with Section NE27. Consensus was that items that would require further investigation were as follows: the width of R-2 zoning at the top of the map; the "L" at Cody Court; and Field Street where it runs along the shoreline of North Henry Lee Lake. The next section reviewed was NW27. Consensus was that items that would require further investigation were as follows: check West 35th Avenue between Holland Street and the east boundary of Garrison Street; and to add Wheat Ridge High School to this section map. The next section discussed was SE28. Consensus was that Paramount Park should be identified on the new map. Commission felt that all parks should be identified. The case number in the southeast corner of the map should be removed. "Rangeview" Circle is two words and should be changed. Mr. Gidley stated he would find out if this can be changed. The "Lakewood" should be moved into the center of the triangle, as it .is confusing as it is now. Mr. Gidley will check the substandard lot at West 31st Avenue and Morningside Drive.. NE28 was the next section to be discussed. Consensus was that the irregular-shaped lines in the southeast corner would be' investigated. Nothing further was noted. Planning Commission Minutes Page 3 July 2, 1992 - Study Session Section NW28 was discussed. Mr. Gidley will be checking the case number located in the Applewood Knolls 12th filing; Quail Street north of West 35th Avenue does not line up with Quail Street south of West 35th Avenue and appears to be offset 50 feet. Prospect Valley Elementary School should. be added. Add another R-1 zone designation north of Prospect Valley Elementary School. B. Departmental Recommendations -._1993 Budget Mr. Gidley provided Commission members a packet of information regarding the planning and development department, which included an organization chart; a staff allocation summary sheet for-1992, plus a 1992 program summary. He explained this information to Commission. Mr. Gidley explained the various changes to the department since he started in 1978. _ Additionally, Mr. Gidley provided Commission members a copy of the 1992 division budget summary showing proposed changes for_ 1993. He explained the information and answered questions. Consensus was that Mr. Gidley should request funds so that two Planning Commissioners can attend the American Planning Association conference in 1993. The Planning Commission Chair will plan to attend the City Council budget session with Mr. Gidley. C. Discussion Re: Comprehensive Plan Update Mr. Gidley gave an overview of his memo dated May 26, 1992 regarding a possible Comprehensive Plan update. Lengthy discussion was heard. It was decided that some of the areas in need of updating were as follows: census figures are out of date; broad areas of zoning and land use should be reexamined for changing patterns; reexamine special districts; examine the transportation plan to see if the current street classification scheme can function as it is for another 20 years and housing should be reexamined to include neighborhood quality and how we might preserve the quality of neighborhoods.. Wheat Ridge currently has no housing code. A public facilities/capital improvements plan should be implemented. Consensus was to have Mr. Gidley add $75,000 to the 1993 budget. in order to update the Comprehensive Plan. Once the funds are encumbered, a decision can be made how then to proceed. 10. The item was postponed to August 20, 1992. Additionally, Mr. Gidiey requested the addition of several items under Committee and Department Reports.- Commissioner CERVENY moved to approve the agenda as amended. Commissioner LANGDON seconded the motion and motion carried 5-0. 5. APPROVAL OF MINUTES Commissioner CERVENY moved to approve the minutes of the July 2, 1992 study session as printed. Commissioner LANGDON seconded the motion. Motion carried 3-0 with Commissioners DiCROCE and OWENS abstaining. 6. Continue Review of OFFICIAL Quarter Section Maps SE15 was the first map discussed. Nothing of significance was noted. SW15 was next discussed. Consensus was the dash/double-dot designation could be used for water features but should be added to the legend. In addition, designate the City of Arvada in the NW corner of the map above West 51st Place. On the SE22 map "HUnta" Subdivision should be "Hunita". Mr. Moberg will check the addition of a bulb at W. 41st/Everett Drive; Greg is also checking the water feature denoting ponds on this map. Everett Jr._High is .missing on SW22 and-should be added. Jellison Street should be added in the NW corner of this map. Greg will check out the extension from the bulb at Independence Planning Commission Study Session Minutes July 16, 1992 Page 3 Street. Greg will add Jellison Street to the map to clear up confusion. On the quarter-section map NE22,.Mr. Moberg will check out various "glitches" on West 44th Avenue, plus an offset on Garrison Street. Quarter-section map NW22 was discussed and consensus was for Mr. Moberg to check out the following items: the cul-de-sac on Garland Street; the length of Hoyt Street; add Pennington -- Elementary; and check case numbers listed on Phillips and Happy Valley subdivisions. Mr. Moberg is also to check the jog at the SE corner of West 44th and Garrison Street. Mr. Moberg stated the maps would be .corrected-and a new set of maps prepared for Commission's perusal. B.. Administrative & Legislative Process Survey Results Mr. Gidley gave a brief overview. At this time, Mr. Gidley began feeling ill and thus Commission took a short break. This Council Bill, if approved, would replace the existing Official Zoning Map (46 quarter sections at a scale of 1 in. = 200 ft.) with a new Official Zoning Map (46 quarter sections at a scale of 1 in. = 400 ft.). A sample copy of the existing and proposed zoning map (one quarter section) is attached for reference. You will receive complete sets of the existing and proposed maps prior to the public hearing. The new maps are of a size that will fit as pages in your Code of Laws book. The Planning Commission approved these new maps at a public hearing held on March 3, 1994. I have attached a copy of my memo to City Council dated September 10, 1991 as reference. Shortly after that date is when we began this major project. I would draw your attention to Section 2. of the Council Bill. We have taken every effort ,possible to insure that zoning boundaries have not changed. Three staff members and eight Planning Commissioners, and now eight City Counselors will have looked at each quarter section in search of errors. We believe that they are error-free, however, please look at them yourselves and list any questions that you may have. The only revisions to zoning boundaries or zone classification are as follows: 1. If a zone district erroneously did not have a letter/number classification (i.e., C-1), then we added it as per the last zoning action on the property. Thera was only one of these and we .will point it out to you: at the public hearing. 2. If a zone district line was within five feet of a property line, then it was adjusted to the property line. 3. Several Planned Development Districts (PCD, PRD, PID) were shifted geographically due to old mapping errors. We will point these out to you at the public hearing using overhead transparencies. Additionally, you may notice streets that may not be drawn on the maps as you know them. The base map is drawn using the City's monumentation program.' Only "dedicated" streets are shown, as they are dedicated by legal description. They may not actually be constructed, only dedicated. This base map work provides a foundation upon which a wide variety of thematic maps can be developed. The (Official Zoning Map, which is actually a series of quarter-section maps, has been completely digitized utilizing AutoCad software. We are now able to produce very accurate, clean and clear and, easily- revised zoning maps at a variety of scales. The existing Official Zoning Map set, which consists of 46 quarter-sections, has been amended and revised so many times that they have become cluttered, messy and in many instances, difficult to interpret. Since they are reproductions of the reproduce well.myAdditionally,bthemiotllinesrandamany streets are very inaccurate as they are based upon maps that the City inherited from Jefferson County when we became a city in 1969. Dimensions of the quarter-sections are not accurate since they were based upon the incorrect assumption that all sections are one mile by one mile. The monumentation program provided accurate corner points and hence accurate boundary dimensions. As such, there is a small degree of skew, stretch and/or shrinkage of lines on the new maps, when compared to the old maps. Staff would recommend that the existing Official Zoning Map set be replaced by the newly developed zoning maps. The Zoning Code Section 26-3.(D) provides a "Procedure for Replacing [the? Official Zoning Map". It requires that such "map" be adopted by ordinance. It also provides that drafting errors or omissions may be corrected, provided that no such correction has the effect of amending the original official zoning map. The process that we would suggest is as follows: 1. Planning Commission would review each quarter-section map for accuracy and consistency at one or more study sessions. .~ ._. Planning Commission would schedule and hold a public hearing after which they would make a recommendation to City Council that the maps be approved, approved with modification, or denied. 3. If corrections are necessary, as a result of the Planning Commission hearing, staff will make those corrections. 4. The ordinance, together with a reduced composite of the zoning maps would then be published for public notice. 5. A public hearing would be scheduled and held by City Council, after which Council would approve the ordinance and maps as printed or modify, or they would deny such ordinance. INTRODUCED BY COUNCILMEMBER r WORTH ORDINANCE NO. 466 Council Bill No. 56 Series of 1994 TITLE: AN ORDINANCE ADOPTING BY REFERENCE A REPLACEMENT OFFICIAL ZONING MAP PURSUANT TO WHEAT RIDGE CODE OF LAWS, SECTION 26-3(D). WHEREAS, the existing Official Zoning Map of the City of Wheat Ridge consists of forty six (46) quarter section maps plus an index cover sheet, drawn at a scale o.£ one (1) inch equals two hundred (200) feet; and WHEREAS, such maps have been updated over the past thirteen (13) years by hand drafting; and WHEREAS, such maps have become difficult to interpret because of the nature and number of changes and additions; and WHEREAS, such maps were drawn upon base maps that were fundamentally flawed due to inaccurate section and quarter-section boundary dimensions and new base maps have subsequently been created which are based upon modern land surveying and accurate monumentation methods. NOW, THEREFORE, BE IT ORDAINED BY THE CSTY COUNCIL OF THE CITY OF WHEAT RIDGE, LOCATED WITHIN TOWNSHIP THREE (3), RANGE SIXTY NINE (69) WEST, COUNTY OF JEFFERSON, STATE OF COLORADO. Section 1. Pursuant to Wheat Ridge Code of Laws, Section 26- 3(D), the existing Official Zoning Map is hereby replaced by a new Official Zoning Map. Such new Official Zoning Map is hereby adopted by reference and is located within the office of the Wheat Ridge City Clerk. Such new Official Zoning Map consists of forty six (46) quarter section maps drawn at a scale o£ one (1) inch equals four hundred (400) feet. Section 2. It is the intent of City Council that such replacement map shall supersede the prior official zoning map and shall correct drafting or other base map errors or omissions in the prior official map. No such correction shall have the effect of rezoning any ;individual parcel of property, the intent being that zoning upon individual parcels of property sha1T remain as established by the last legislative or quasi-judicial enactment of the Wheat Ridge City Council as applicable to each such individual parcel.
