They are subject to change and are for planning purposes only.
SCHOOL DISTRICT PLANNING COMMENTS:
Prospect Valley Elementary is currently using one temporary
classroom and Wheat Ridge Senior is using ten temporary classrooms.
The School District would request fees in-lieu-of land dedications
for this plat. In that regard, the School District also requests
that the computation of fees be calculated based on the full market
value of the land per acre as zoned and improved for residential
purposes as opposed to raw land or any value based upon prezoninq
approval.
The School District has offered the same comment for consideration
by the City Council and the Planning Commission for two years with
no response. The District would again request that a new method be
established for calculation of fees in-lieu-of land based on zoned
land values, thus representing a more reasonable fee compensation
to offset the impact of developments on school capacities.
Any fees in-lieu-of amounts would be held in escrow accounts for
future application by the School District in accordance with our
procedures and the Jefferson County Land Development Regulations.

Based upon projections from this development and subdivisions in
this area which have been approved or are pending approval, current
school. capacities at-Prospect Valley Elementary and Wheat Ridge
Senior are inadequate to serve the anticipated student population
from this proposal. .However, the recent passage of the Bond Issue
on October 6, 1992, will provide a four classroom addition at
Prospect Valley, a building addition/renovation/upgrade at Wheat
Ridge Senior and various improvement projects at all three schools
at a cost of $8,837,633 for this area..-

dated January 16, 1995 regarding the above referenced

Please be advised that the above referenced property
is in an area served by The Consolidated Mutual Water Company
by virtue of a Distributor's Contract with the Denver Water
Board.,.: Domestic water -service may be provided to .this
property subject. .to compliance- with the" Company's -rules,
regulations and requirements for such service as-well as the
water tap allocation policies as established by the Denver
Water Board.
The Company's.-rules, regulations .and .requirements
further. require that each. separate structure be served by a
separate -tap and meter, and in order to receive domestic
water service, the property must also front a Company main.
If-the future planned use of this property is within any of
the above categories, the ,owner, engineer or architect should
contact this. office as_soon as possible so that we may
determine what, water system improvements will. be needed .to

PURPOSE: Construction of five (5) patio homes.
Dear Meredith,
After a review of the afore mentioned plan, I am requesting
the following items be addressed:
1. Quail street is designed as a dead end with no turn around
ability, accessed from 38th Ave. Request a culdesac with a
radius of forty five (45) feet be created at the end of the
street, or an adequate alternative be proposed by the
developer as required by code. Quail Street currently exceeds
dead end requirements. Request this issue be resolved prior to
further actions by the city.
2. The triangular parcel that will remain undeveloped open space
with ground cover remaining uncut and native presents an
inherent potential fire danger to the proposed residence. This
area should be maintained to reduce the risk of fire to the
area.
There may be additional comments on items unforeseen at this
time. Additional items will be handled as the need arises.

The Public Works Department has reviewed the site plan submitted for the above referenced
project, and has the following comments:
1. The required drainage study and approvals for constructiot- within the 100 year flood plain
for this project have been reviewed and approved by Bob Goebel.
2. We will need construction drawing for those public improvements that will be needed on
the Quail Street frontage. These plans should include a detailed design of the access to the
Lena Gulch maintenance road from the end of the proposed street improvement.
3. We will need an erosion control plan.
4. We will need fill permits ('if so required) processed for any respective overlot grading.
5. Traffic has reviewed this submittal and has no comments at this time.
6. I have attached a copy of the continents for the first review of the plat submitted for this
project. These comments have.been forwazded to Futura Eng. for correction.

b. .after reviewing the final plat, the City Planning Commission shall
forward the plat to the City Council. The property underapplication shall be
posted fifteen (15) days prior to the public hearings both at the Planning
Commission and the City Council.
c. Upon receipt of the plat and the accompanying recommendations, the
City Council shall accept, disapprove, or refer the p]at to the City Planning
Commission for further study. If the plat is disapproved or referred, written
notice thereof shall be sent by the Planning Department to the subdivider.
d. Following z-,~eptance of a plat by the City Council, the plat shall, be
signed by the ?layor and attested by the City Clerk. The Planning Department
shall then record the plat in the office of the Jefferson County Clerk. and
Recorder within a reasonable time.
The subdivider shall furnish to the Office of the Treasurer the recording
fee required by the Jefferson County Clerk and Recorder prior to recording of

Purpose: Construction of five single-family homes
Dear Meredith,
On 02-07-95, I received a new drawing concerning the street
design for the turn around proposed for this development. The
design is now to scale and it appears that a probable 90 degree
turn can be accomplished using the east side of the designated
street area, providing there is no obstruction, and crossing into
lot # 3. Once again, while this design is not the most desirable,
it is apparently the only design that wil_1 allow for the
development of the project due to other constraints that are beyond
control of the developer. It is requested that the Engineering
Department provide a letter to the Eire District regarding the
agreement to re-enforce the side walk portion of the drive way to
Lot # 3 to a depth of 10 inches in order to gain an additional five
(5) feet of drive area. The additional footage will be needed to
negotiate and accommodate the ability to square up the vehicle in
order to accomplish backing of the vehicle. This will allow for a
45 degree turn to the rear of the vehicle in order to make the turn
back to the n~h. This design creates ~hree point maneuver by
the fire .vehicle to accomplish a complete turn around and the
additional footage of the side walk will be needed to create the
least amount of backing movement by the fire vehicle. Please advise
me of any further developments that may affect the fire service
concerning this project.

adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications,
Prior to application for rezoning or special use permit, the
developer is responsible for holding an informal neighborhood
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in the design of their project. All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front of Planning Commission and City Council
where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or
Council people to discuss the merits of a case prior to the
public hearing. It could jeopardize your representatives'
ability to hear the case.
If you are an adjacent property, you may have the right to file a
"legal protest" against the application. The result of this
filing is that it requires a 3/4 majority of City Council to

JURISDICTION:

I. REQUEST
The property in question .was rezoned from R-1 and R-3 to Planned
Residential Development pursuant to Case No. WZ-94-6. The density
approved was for five single-family units.
The applicant is now requesting final development plan and plat
approval. Included under Exhibit 'A' is an agreement with adjacent
property owners regarding specific design elements for the
development. These elements have been included in the final design..
II. DEVELOPMENT PLAN
The applicant is proposing a development showing five single-family
homes. The homes will range in size-from 1400 square feed to 1780
square feet and will be in the .$130,000 - $150,000 price range. Each
home will have two garage stalls plus two off--street parking spaces..
Development standards include the following:
Minimum front setback: 30 feet
Minimum side setback: 5 feet
Minimum rear setback:.- 20 feet
Maximum building coverage: 40 percent,
**Maximum building height: 35 feet
(**except Lot 5 wh ich is limited to one.-sto ry in height)
There are_many mature trees on the property. The developers will try
to save as many of these .trees as possible. As such, they have
proposed an alternate street design which allows an emergency vehicle
to make a three-point turn using a "bow" in Quail Street. Both the
Public Works Department and Fire District have participated in the-
final design of Quail Street.
Language has been added to the document face restricting use of the
conservation easement which is designated as. Tract 'A' o_n the final
plat.
All requirements for _a final development plan have been met.
III. SUBDIVISION PLAN _ _
The plat shows five lots ranging in size from 60.15 square feet to 7160
square feet. _--
An additianal_dedication occurs for the."bow" turnaround in Quail
Street.
Tract 'A' has been created for a_conservation easement. This area
will be maintained by the homeowners' association. An irrigation
ditch running through this tract will also be a responsibility of the
association. A signature block has been provided for the president of
the ditch company.

All requirements of the Subdivision Regulations have been met.
IV. AGENCY REFERRALS _
All agencies can provide service to the property.
Westridge Sanitation District will require a short line extension.
Brookside Ditch Company is concerned as to who is responsible. for
maintenance and repair of the ditch running under Quail Street.
Public Works has indicated that in this type of situation (ditch in
right-of-way), the City is the responsible party.
Wheat Ridge Fire District has concurred with the alternate street
design. They have requested that the sidewalk and driveway to Lot #3
be reinforced. to a depth of ten inches. They are concerned that the
conservation easement if left!native" and uncut could pose a fire
hazard.-
Public Works Department has approved the drainage report. They are
currently reviewing street construction plans.
V. STAFF CONCLIISIONS
Staff concludes that the proposed final development plan is consistent
with the approved outline plan and meets the requirements for a final
development plan.
Staff further concludes that all requirements of_the subdivision
Regulations have been met.
For these reasons, a recommendation of Approval is given for Case No:
WZ-95-2.
VI. RECOMMENDED MOTIONS
OPTION A: "I move that Case No. WZ-95-2, a request for approval of a
final development plan and plat for property located at 3701 Quail
Street,-be Approved for the following reasons:
1. It is consistent_with the approved outline development plan.

Tc The Planning Commission;
This is to inform the Planning Commission that the South
Lateral of the. Brookside Ditch runs through the southern
portion of the land proposed for development in case
WZ-94-6.
It is shown on your drawing in its approximate location.
A south fork is an overflow release which goes hack to
Lena Gulch and the lateral itself goes east almost to Quail
St, and North to a paint where it drops into a siphon which
carries it under Quail and on to the properties it serves
to the east of Quail.
It appears that the ditch may hecame a part ^f someone's
yard and if so it should be made clear that Brookside
Ditch has keen in operation since-the 1800s and is an
enforceahle right not to be inter erred with. The flaw ^f
this ditch must he allowed tc continue unobstructed.
The Planning Commission needs to address where the respon-
sibility lies to insure this.
Of equal concern is the area of the siphon. This was
required when the ground elevation was changed and the
street put in to serve the now existing apartments and
townhouses. Apparently the pavement will double above
this pipe. Whether or not the City had an agreement with
the past developer is not known and he has been gone a
long time.
Re:,ponsibility for insuring the flow in this pipe beneath
a city street needs also to he addressed now.
None ^f this is discussed in the staff's lenghty report
and we ask that it he made a part of the record and given
careful consideration.

To the Wheatridge City Council,
We attended your meeting lent night, August 8th. Wa
xere shooked, that again, we find opposition to case
# W Z-94-6, proposal forthe property at 3701 Quail.
This approval la sorely needed. The same people oppose
it as did several years ago, and for a different reason
Back then we never heard them mention an irrigation
ditch. It was 3ust that they had bought their homes in
a quiet peaceful area and they didn't need the extra
population around. They were successful in blocking it
but they didn't offer anything positive for the area.
They didn't have to look at the eyesore from their Liv-
ingrcom windows. They don't even border that area, nor
do they faoe it. This property aotually ie in the 3600
w
block and they are living at 11254 and 56 38th-over 2
blocks away.
We care about our homes, Wa care about our block, We
care about our street, We care about Wheatridge. The
goad plan that Mr.~Nese proposed should enhance all,
including an upgraded irrigation ditch. Furthermore we

should"could use the 8ea1 Estate tax. We would hope the
Council would appreciate the pride xe have in our homes
and our oommunity. Legally, I wonder if this can be
blocked. It does mean a difference in the valuation of
our homes. Please drive over there and look at this
situation.

I am writing regarding the property development
hearing held on August 8, 1994, on 3701 Quail
owned by John and Julie Batug.
I own the property at 3700 Quail and would welcome
the building of the five proposed patio homes in
what is currently a heavily weeded area_ I would
like to mention the following points:
•, There would be plenty of remaining open
space via the Lena Gulch
• The five patio homes would increase the
value of the property in the area
• I do not believe we should keep out a
developer who wants to enhance the city and
whose work would bring additional revenue
to the city.
+ These homes would be far superior to the
currently standing condominium/apartments
on the west side of Quail which detract and
devalue the area.
• Prohibiting this builder from producing
a quality project now map leave an opening
for a lesser project to occur in future
years.
• Please consider that people who do not
own property on the same street or adjacent
to the proposed project, are unlikely to
value the opportunity for a high quality
property development.

Mr. Flasco suggested that the concerned parties try to reach
agreement at that time, then even though the applicant might have
to return before Planning Commission, the other parties would
not.
He added that he found it hard to believe that any space on the
subject site was more than 2,000 square feet. For that reason,
he thought the furniture store, Bunkbeds by Bob, would probably
be allowed under .the current zoning.
Commissioner WILLIAMS asked what would happen if proper posting
had not occurred.
Chairperson ECKHARDT suggested that the case be continued to
March 2, 1995. However; the applicant and concerned neighbors
can-possibly come to an agreement yet this evening while Planning
Commission hears the second case on the agenda. He added that
continuance of this case would allow Staff to make certain proper
posting occurs.
Discussion followed.
Commissioner JOHNSON moved that Case No. WZ-94-17 be continued to
March 2, 1995. Commissioner-CRUMPTON seconded the motion.
Commissioner LANGDON asked if the applicant and neighbors could
arrive at an agreement, is it .necessary for Commission to hear
the case a second time?
Mr. Gidley stated yes. He added that any agreement made by the
applicant and concerned neighbors would not be binding to
Commission's decision.

approval of a final development plan and plat. The property
is zoned Planned Residential Development, is located at 3701
Quail Street.
Mr. Gidley presented the staff report. Entered into the. record
.and accepted by the Chairperson were the Zoning Ordinance,
Subdivision Regulations, case file, packet materials and
exhibits.
Commissioner RASPLICKA could not locate the fence separating the
development from the irrigation ditch. He stated this was a
safety concern.

Mr. Gidley pointed 'out a short fence was indicated at the
southwest corner of Lot 5, however, it did not extend along the
south property line of Lot 5. The homeowner's association would
be responsible for maintaining that area. He was uncertain who
would have liability.
Steven Ness, 11252 West 38th Avenue, was sworn in. Mr. Ness was
representing the applicants and was prepared to answer questions.
Louise Turner, 11256 West 38th Avenue was sworn in. Ms. Turner
stated she was represented the Brookside Ditch Company in place
of Lou Ficco, who was out of town. She spoke of her concern that
the ditch would be maintained/repaired; that the flow of the
ditch would not be interrupted; and that the piping design under
Quail Street was adequate and proper. She elaborated.
Chairperson ECKHARDT asked Mr. Gidley if Mr. Goebel had met with
the ditch company?
Mr. Gidley stated he did not .believe the final design had been
approved by the ditch company.
Commissioner JOHNSON asked if an easement for the ditch exists
across the property.
Ms. Turner stated the easement had been moved by the City. She
elaborated.
Discussion followed.
Mr. Gidley reported that the specific requirements for the
alignment of an easement associated with the ditch had not been
placed on a plat yet. That needs to occur. There is an implied
easement by virtue of the ditch's current location. When you
relocate a ditch, it is appropriate to create an easement.
Commissioner CERVENY asked if the configuration of the ditch
would change.
Ms. Turner stated the ditch would be moved.
Mark raff, 12957 West Oregon Drive, Lakewood was sworn in. Mr.
Graff stated he was president of the Brookside homeowner's
association, on the east side of Quail Street across from the
subject site. The board of directors of'the homeowners
association voted to support the project.
Commissioner LANGDON moved that Case No. WZ-95-2, a request for
approval of a final development plan and plat for property

reasons:

Commissioner RASPLICKA asked Mr. Gidley if a provision should be
added regarding Brookside ditch.
Mr. Gidley stated it would do no harm to add it.

Mr. Ness requested to speak again.
Commissioner LANGDON withdrew his motion so that Mr. Ness could
speak.
Mr. Ness showed to Commission a map drawn by his engineer,
depicting the precise location of the intake valve on Tract A,
also showed the pipe going under Quail Street and connecting to
the existing pipe. He explained further. He added that the City
engineer had approved the plan.. He stated the changes would
improve the current system.

Dear Adjacent Property Owner:
If you have received this notice, you reside or own property
adjacent to a property involved in a land use case being
processed by the City of Wheat Ridge.
This notice is intended to inform you of the process involved in
land use development applications.
Prior to application for rezoning or special use permit, the
developer is responsible for holding an informal neighborhood
meeting. The purpose of the meeting is to provide the
opportunity for citizens to become aware of a proposed
development in their neighborhood and to allow the developer to
respond to citizen concerns in the design of their project. All
residents within 600 feet are required to be notified of the
meeting.
A staff planner will attend the meeting to discuss City policy
and regulations and the process involved, however, the planner
will remain impartial regarding viability of the project.
Keep in mind that this is not a public hearing. Although a
synopsis of the meeting will be entered as testimony, it is the
public hearings in front o£ Planning Commission and City Council
where decisions are rendered. If you want input in the decision-
making process, it is imperative that you attend the public
hearings.
The public hearings you will be attending are quasi-judicial in
nature. Please do not contact your Planning Commissioners or
Council people to discuss the merits of a case prior to the
public hearing. It could jeopardize your representatives`
ability to hear the case.
If you are an adjacent property, you may have the right to file a
"legal protest" against the application. The result of this
filing is that it requires a 3/4 majority of City Council to
approve a request.

The property in question was rezoned from R-1 and R-3 to Planned
Residential Development pursuant to Case No. WZ-94-6. The density
approved was for five single-family units.
The applicant is now requesting final development plan and plat
approval. Included under Exhibit 'A' is an agreement with adjacent
property owners regarding specific design elements for the
development. These elements have been included in the final design.
II. DEVELOPMENT PLAN
The applicant is proposing a development showing-five single-family
homes. The homes will range in size from 1400 square feet to 17.80
square feet and will be in the $130,000 - $150,000 price-range. Each
home will have two garage stalls plus two off-street parking spaces.
Development standards include the following:
Minimum front setback: 30 feet
Minimum side setback: 5 feet
Minimum rear setback: 20 feet.
Maximum building coverage: 40 percent
**Maximum building height: 35 feet
(**except Lot 5 wh ich is limited to one- sto ry in height)
There are many mature trees on the property. The developers will try
to save as many of these trees as possible. As such, they have
proposed an alternate street design which allows an emergency vehicle
to make a three-point turn using a "bow" in Quail Street. Both the
Public Works Department and Fire District have participated in the
final design of Quail Street.
Language has been added to the document face restricting use of the
conservation easement which is designated as Tract 'A' on the final
plat.
All requirements for a final development plan have been met.
III. SUBDIVISION PLAN
The plat shows five lots ranging in size from 6015 square feet to 7160
square feet.
An additional dedication occurs for the "bow" turnaround in Quail
Street.
Tract 'A' has been created for a conservation easement. This area
will be maintained by the homeowners' association..--An irrigation
ditch running through this tract will also be a responsibility of the
association. A signature block has been provided for the president of
the ditch company.

All requirements of the Subdivision Regulations have been met.
IV. AGENCY REFERRALS _ _
All agencies can provide service to the property.
Westridge Sanitation District will require a short line extension.
Brookside Ditch Company is concerned as to,who is responsible for
maintenance-and repair of the ditch running under.Quail Street. _
Public Works has indicated that in this type of situation (ditch in
right-of-way), the City is the responsible party.
Wheat Ridge Fire District has concurred with the alternate street
design. They have requested that the sidewalk and driveway to Lot #3
be reinforced to a depth of ten inches. They are concerned that the
conservation easement if left "native" and uncut could pose a fire
hazard.
Public Works Department has approved the drainage report. They are
currently reviewing street construction plans.
V. PLANNING COMMISSION ACTION _
Planning Commission reviewed this request at a public hearing held on
February 16, 1995.. A recommendation of approval was made for the
following reasons:
i. It is consistent with the approved Outline Development Plan.
2. All requirements for a final development plan have been met.
3. All requirements of the Subdivision Regulations have been met.
With the following condition:
1. An easement for the Brookside Ditch be recorded by separate
document.
VI. 3TAFF CONCLUSIONS
Staff concludes that the proposed final development plan is consistent
with the approved outline plan and meets the requirements for a final
development plan.
Staff further concludes that all requirements of the subdivision
Regulations have been met.
For these reasons, a recommendation of Approval-is given for Case No.
WZ-95-2 with the condition that an easement for the irrigation ditch
be recorded by separate document.

Greo Penkowskv, was sworn in by the Mayor; he is representing LaQuinta Inn. They want
this problem solved; it has been going on for too long; they are not against Mr. Richter
developing his property, they are all for it; but their concerns are the removal of these
conditions, they need to know exactly where the roads are going to go; this should be done
by Ordinance; also feels that this would need LaQuinta's approval.
Brad Brauer. 3238 Zinnia Court, was sworn in; objected to removal of condition because it
ignores safety and Traffic and once again it says to the community that big business, land
developers, are first, community concerns are last; gave suggestion as to where he thought
the road should go.

The property located at 3701-Quail Street was given approval of a
final development plan and plat by Wheat Ridge City Council on
March 29,-1995. Orie of the conditions of approval was for a $75
per unit payment in lieu of park land dedication..
Although the plan and plat have been recorded with Jefferson
County, the parks fee of $375 has never been paid. Please remit
this amount to the City of Wheat Ridge at your convenience.
