NOTE: These are estimates from School District computations. They are subject to change and are for planning purposes only. SCHOOL DISTRICT PLANNING COMMENTS: Prospect Valley Elementary is currently using one temporary classroom and Wheat Ridge Senior is using ten temporary classrooms. The School District would request fees in-lieu-of land dedications for this plat. In that regard, the School District also requests that the computation of fees be calculated based on the full market value of the land per acre as zoned and improved for residential purposes as opposed to raw land or any value based upon prezoninq approval. The School District has offered the same comment for consideration by the City Council and the Planning Commission for two years with no response. The District would again request that a new method be established for calculation of fees in-lieu-of land based on zoned land values, thus representing a more reasonable fee compensation to offset the impact of developments on school capacities. Any fees in-lieu-of amounts would be held in escrow accounts for future application by the School District in accordance with our procedures and the Jefferson County Land Development Regulations. The triangular parcel that will remain undeveloped open space with ground cover remaining uncut and native presents an inherent potential fire danger to the proposed residence. The design is now to scale and it appears that a probable 90 degree turn can be accomplished using the east side of the designated street area, providing there is no obstruction, and crossing into lot # 3. Once again, while this design is not the most desirable, it is apparently the only design that wil_1 allow for the development of the project due to other constraints that are beyond control of the developer. It is requested that the Engineering Department provide a letter to the Eire District regarding the agreement to re-enforce the side walk portion of the drive way to Lot # 3 to a depth of 10 inches in order to gain an additional five (5) feet of drive area. The additional footage will be needed to negotiate and accommodate the ability to square up the vehicle in order to accomplish backing of the vehicle. This will allow for a 45 degree turn to the rear of the vehicle in order to make the turn back to the n~h. This design creates ~hree point maneuver by the fire .vehicle to accomplish a complete turn around and the additional footage of the side walk will be needed to create the least amount of backing movement by the fire vehicle. The density approved was for five single-family units. The applicant is now requesting final development plan and plat approval. Included under Exhibit 'A' is an agreement with adjacent property owners regarding specific design elements for the development. These elements have been included in the final design.. II. DEVELOPMENT PLAN The applicant is proposing a development showing five single-family homes. The homes will range in size-from 1400 square feed to 1780 square feet and will be in the .$130,000 - $150,000 price range. Each home will have two garage stalls plus two off--street parking spaces.. Development standards include the following: Minimum front setback: 30 feet Minimum side setback: 5 feet Minimum rear setback:.- 20 feet Maximum building coverage: 40 percent, **Maximum building height: 35 feet (**except Lot 5 wh ich is limited to one.-sto ry in height) There are_many mature trees on the property. The developers will try to save as many of these .trees as possible. As such, they have proposed an alternate street design which allows an emergency vehicle to make a three-point turn using a "bow" in Quail Street. Both the Public Works Department and Fire District have participated in the- final design of Quail Street. Language has been added to the document face restricting use of the conservation easement which is designated as. Tract 'A' o_n the final plat. All requirements for _a final development plan have been met. III. SUBDIVISION PLAN _ _ The plat shows five lots ranging in size from 60.15 square feet to 7160 square feet. _-- An additianal_dedication occurs for the."bow" turnaround in Quail Street. Tract 'A' has been created for a_conservation easement. This area will be maintained by the homeowners' association. An irrigation ditch running through this tract will also be a responsibility of the association. A signature block has been provided for the president of the ditch company. Westridge Sanitation District will require a short line extension. Brookside Ditch Company is concerned as to who is responsible. for maintenance and repair of the ditch running under Quail Street. Public Works has indicated that in this type of situation (ditch in right-of-way), the City is the responsible party. Wheat Ridge Fire District has concurred with the alternate street design. They have requested that the sidewalk and driveway to Lot #3 be reinforced. to a depth of ten inches. They are concerned that the conservation easement if left!native" and uncut could pose a fire hazard.- Public Works Department has approved the drainage report. They are currently reviewing street construction plans. V. STAFF CONCLIISIONS Staff concludes that the proposed final development plan is consistent with the approved outline plan and meets the requirements for a final development plan. Staff further concludes that all requirements of_the subdivision Regulations have been met. For these reasons, a recommendation of Approval is given for Case No: WZ-95-2. VI. Brookside Ditch runs through the southern portion of the land proposed for development in case WZ-94-6. It is shown on your drawing in its approximate location. A south fork is an overflow release which goes hack to Lena Gulch and the lateral itself goes east almost to Quail St, and North to a paint where it drops into a siphon which carries it under Quail and on to the properties it serves to the east of Quail. It appears that the ditch may hecame a part ^f someone's yard and if so it should be made clear that Brookside Ditch has keen in operation since-the 1800s and is an enforceahle right not to be inter erred with. The flaw ^f this ditch must he allowed tc continue unobstructed. The Planning Commission needs to address where the respon- sibility lies to insure this. Of equal concern is the area of the siphon. This was required when the ground elevation was changed and the street put in to serve the now existing apartments and townhouses. Apparently the pavement will double above this pipe. Whether or not the City had an agreement with the past developer is not known and he has been gone a long time. Re:,ponsibility for insuring the flow in this pipe beneath a city street needs also to he addressed now. The same people oppose it as did several years ago, and for a different reason Back then we never heard them mention an irrigation ditch. It was 3ust that they had bought their homes in a quiet peaceful area and they didn't need the extra population around. They were successful in blocking it but they didn't offer anything positive for the area. They didn't have to look at the eyesore from their Liv- ingrcom windows. They don't even border that area, nor do they faoe it. This property aotually ie in the 3600 w block and they are living at 11254 and 56 38th-over 2 blocks away. We care about our homes, Wa care about our block, We care about our street, We care about Wheatridge. The goad plan that Mr.~Nese proposed should enhance all, including an upgraded irrigation ditch. Furthermore we rn;.x y.. should"could use the 8ea1 Estate tax. We would hope the Council would appreciate the pride xe have in our homes and our oommunity. Legally, I wonder if this can be blocked. It does mean a difference in the valuation of our homes. He added that he found it hard to believe that any space on the subject site was more than 2,000 square feet. For that reason, he thought the furniture store, Bunkbeds by Bob, would probably be allowed under .the current zoning. Commissioner RASPLICKA could not locate the fence separating the development from the irrigation ditch. He stated this was a safety concern. The homeowner's association would be responsible for maintaining that area. He was uncertain who would have liability. Steven Ness, 11252 West 38th Avenue, was sworn in. Mr. Ness was representing the applicants and was prepared to answer questions. Louise Turner, 11256 West 38th Avenue was sworn in. Ms. Turner stated she was represented the Brookside Ditch Company in place of Lou Ficco, who was out of town. She spoke of her concern that the ditch would be maintained/repaired; that the flow of the ditch would not be interrupted; and that the piping design under Quail Street was adequate and proper. She elaborated. Chairperson ECKHARDT asked Mr. Gidley if Mr. Goebel had met with the ditch company? Mr. Gidley stated he did not .believe the final design had been approved by the ditch company. Commissioner JOHNSON asked if an easement for the ditch exists across the property. Ms. Turner stated the easement had been moved by the City. She elaborated. Discussion followed. Mr. Gidley reported that the specific requirements for the alignment of an easement associated with the ditch had not been placed on a plat yet. That needs to occur. There is an implied easement by virtue of the ditch's current location. When you relocate a ditch, it is appropriate to create an easement. Commissioner CERVENY asked if the configuration of the ditch would change. Ms. Turner stated the ditch would be moved. Mark raff, 12957 West Oregon Drive, Lakewood was sworn in. Mr. Graff stated he was president of the Brookside homeowner's association, on the east side of Quail Street across from the subject site. The board of directors of'the homeowners association voted to support the project. Planning Division Staff Report Case No. WZ-95-2/Batug 2. REQUEST Page 2 The property in question was rezoned from R-1 and R-3 to Planned Residential Development pursuant to Case No. WZ-94-6. The density approved was for five single-family units. The applicant is now requesting final development plan and plat approval. Included under Exhibit 'A' is an agreement with adjacent property owners regarding specific design elements for the development. These elements have been included in the final design. II. DEVELOPMENT PLAN The applicant is proposing a development showing-five single-family homes. The homes will range in size from 1400 square feet to 17.80 square feet and will be in the $130,000 - $150,000 price-range. Each home will have two garage stalls plus two off-street parking spaces. Development standards include the following: Minimum front setback: 30 feet Minimum side setback: 5 feet Minimum rear setback: 20 feet. Maximum building coverage: 40 percent **Maximum building height: 35 feet (**except Lot 5 wh ich is limited to one- sto ry in height) There are many mature trees on the property. The developers will try to save as many of these trees as possible. As such, they have proposed an alternate street design which allows an emergency vehicle to make a three-point turn using a "bow" in Quail Street. Both the Public Works Department and Fire District have participated in the final design of Quail Street. Language has been added to the document face restricting use of the conservation easement which is designated as Tract 'A' on the final plat. All requirements for a final development plan have been met. III. SUBDIVISION PLAN The plat shows five lots ranging in size from 6015 square feet to 7160 square feet. An additional dedication occurs for the "bow" turnaround in Quail Street. Tract 'A' has been created for a conservation easement. This area will be maintained by the homeowners' association..--An irrigation ditch running through this tract will also be a responsibility of the association. IV. AGENCY REFERRALS _ _ All agencies can provide service to the property. Westridge Sanitation District will require a short line extension. Brookside Ditch Company is concerned as to,who is responsible for maintenance-and repair of the ditch running under.Quail Street. _ Public Works has indicated that in this type of situation (ditch in right-of-way), the City is the responsible party. Wheat Ridge Fire District has concurred with the alternate street design. They have requested that the sidewalk and driveway to Lot #3 be reinforced to a depth of ten inches. They are concerned that the conservation easement if left "native" and uncut could pose a fire hazard. Public Works Department has approved the drainage report. They are currently reviewing street construction plans. V. PLANNING COMMISSION ACTION _ Planning Commission reviewed this request at a public hearing held on February 16, 1995.. A recommendation of approval was made for the following reasons: i. It is consistent with the approved Outline Development Plan. 2. All requirements for a final development plan have been met. 3. All requirements of the Subdivision Regulations have been met. With the following condition: 1. An easement for the Brookside Ditch be recorded by separate document. VI. 3TAFF CONCLUSIONS Staff concludes that the proposed final development plan is consistent with the approved outline plan and meets the requirements for a final development plan.
