Section 1. Chapter 26 of the Code of Laws of the City of Wheat
Ridge is hereby---amended by repealing Article I, Section 26-30-(R) ffF~~~

(R) Trash Storage Area Screening: Trash storage fore lti"-unit
dwellings, institutional buildings, and all business .and
industrial buildings or uses shall be accommodated within the
structure, or if located outside, shall be located or screened so
as not to be-visible .from adjacent public streets or from
adjacent low-density residential dwellings within one hundred
(100) feet_of the-trash storage area. If screened BY A FENCE OR
WALL, A FENCE PERMIT SHALL BE REQUIRED, AND such screening shall
be b a decorative wall or-fence not to exceed six (6) feet in
height. The enclosure. or screen wall or fence SHOULD BE
CONSTRUCTED SO AS TO protect from damage by normal removal and
replacement of the dumpster by a trash truck by incorporation of
protective pipe bollards and concrete curbs outside and inside of
the enclosure. PROPER MAINTENANCE WILL BE REQUIRED IF ENCLOSURE
IS DAMAGED AND OR DILAPIDATED, OR IN NEED OF REPAIR.
In no instance shall trash enclosures he permitted to encroach
into sight distance triangles for driveways or street corners.
No such enclosure shall displace required parking spaces, OR
LANDSCAPING, UNLESS REVIEWED AND APPROVED BY THE DIRECTOR OF
PLANNING AND DEVELOPMENT AFTER CONSIDERING ALL REASONABLE
ALTERNATIVES.
One- and two-family dwellings and. accessory uses, except for
temporary construction purposes, shall not be permitted ta_
maintain large trash dumpsters one (1) cubic yard or larger, as
such dumpsters are of-a size and type normally associated with
commercial uses.

Section 2. _S.everability Sf any clause, sentence, paragraph, or
part of this Zoning Code or the application thereof to any person
or circumstances shall for any reason be adjusted by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons or circumstances.
Section 3. Safety Clause The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of .Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that .this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Secticn a. Supersession Clause If any provision, requirement
or standard established by this Ordinance is found to conflict
with similar provisions, requirements or standards found
elsewhere in the Code of Laws of the City of Wheat Ridge, which
are in existence as of the date of adoption of this Ordinance,
the provisions, requirements and standards herein shall supersede
and prevail.

Re: Case ZOA-95-4 /Amendment to the Trash Storage Area Screening
regulation
Lately, staff has been encountering problems with the verbiage in sect. 26-30(R), the trash
storage area screening regulation, which fails to establish permit requirements for erecting
the screening around the trash storage area. For this, the applicant should be required to
apply for a fence permit, thus establishing the opportunity for staff to monitor the progress
of the screening process.
Secondly, the ordinance fails to establish that the applicant must maintain the storage area
should damage or dilapidation occur. This should also be performed on a complaint basis
where the Code officer can notify the applicant should their storage area need to be
maintained.
Finally, staff believes that the line which states "no such enclosure shall displace required
parking spaces or landscaping" should be amended to state that displacement of required
parking spaces or landscaping may be granted "after all other reasonable alternatives are
considered."
Staff recommends that the attached proposal Council Bill be set for public hearing before
Planning Commission. Any additional revisions that you may have should be incorporated
prior to that hearing.

by Planning Commission as a study agenda item, and has now been scheduled for public
hearing.
In summary, the changes will result in the following:
A. Require a permit for enclosures
B. Require maintenance of the enclosures
C. Allow staff flexibility to work with the property owner in locating the enclosures
SUGGESTED MOTION: I move that Case No. ZOA-95-4 , an amendment to Trash Storage
and Screening Regulations (Zoning Ordinance Sec. 26-30(R), be forwarded to City Council
with Planning Commission's recommendation for approval.

Staff has initiated this proposed amendment to the Zoning Ordinance Sec. 26-30(R) Trash
Storage & Screening Regulations in order to improve enforcement and compliance. In
summary, the changes will result in the following:
A. Require a permit for enclosures;
B. Require maintenance of the enclosures; and
C. Allow administrative flexibility to work with property owners in locating the
enclosures.
Planning Commission held a public hearing on this proposed amendment on January 11,
1996 and recommended approval. Staff recommends a First Reading on this Council Bill
be set for January 22, 1996 and a Second Reading/public hearing be set for February 12,
1996.

Screening Regulati~pns (Zoning Ordinance Sec. 26-30(R)
Date: February 14, 1996
Based upon concerns expressed by citizens and the prior City Council and concerns of our
enforcement staff, planning staff has initiated this proposed amendment to the Zoning
Ordinance Sec. 26-30(R) Trash Storage & Screening Regulations in order to improve
enforcement and compliance. In summary, the changes will result in the following:
A. Require a permit for enclosures;
B. Require maintenande of the enclosures; and
C. Allow administrative flexibility to work with property owners in locating the
enclosures.
Planning Commission held. a public hearing on this proposed amendment on January 11,
1996 and recommended approval. Staff recommends a First Reading on this Council Bill
be set for February 26, 1996 and a Second Reading/public hearing be set for March 11,
1996.

WHEAT RIDGE, COLORADO, CONCERNING PROVISIONS. FOR TRASH
STORAGE SCREENING..
BE IT ORDAINED BY THE CITY COUNCIL OF SHE CITY OF_WHEAT
RIDGE, COLORADO,-THAT: .
Section 1. Chapter. 26 of the. Code of Laws of the 'City of Wheat _
Ridge is hereby amended by repealing Article. I, Section 26-30(R)
inclusive,-and re-enact as follows: _
(R) Trash Storage Area Screening: Trash s,torage_for ALL.
EXISTING AND NEW multi-unit dwellings, institutional buildings,.
and all business- and industrial buildings or .uses shall be
accommodated within the structure, or if located outside, shall
be located or screened so as :not to be-visible from adjacent
public streets or from adjacent low-density residential dwellings
within one hundred (100-) feet of._the trash storage area. If
screened BY A FENCE OR WALL, A FENCE PERMIT SHALL BE REQUIRED,
AND such screening shall. be by a decorative wall or.fence wee

~ka8 The enclosure or screen wall or~fence SHOULD BE CONSTRUCTED
SO AS TO protect from damage by normal removal .and replacement of
the dumpster by a trash truck.

AND OR DILAPIDATED, OR IN NEED OF REPAIR, AND THE AREA AROUND THE
CLOSURE SHALL BE KEPT CLEAN.
In no instance shall trash enclosures be permitted to encroach.;;
into sight distance triangles for driveways or street corners:.
No such enclosure shall displace required parking spaces, OR
LANDSCAPING, UNLESS REVIEWED AND APPROVED BY THE DIRECTOR OF --
PLANNING AND DEVELOPMENT AS AN ADMINISTRATIVE VARIANCE AFTER
CONSIDERING ALL REASONABLE ALTERNATIVES. AN ADMINISTRATIVE
VARIANCE SHALL FOLLOW-THE PROCEDURES SET'FORTH IN SECTION 26-
6(D)(2)(a) MINOR VARIANCES, EXCEPT SHALL NOT BE LIMITED TO THE
TEN (10) PERCENT PROVISIONS THEREOF..
One- and two-family dwellings and accessory uses; except for°-
temporary construction purposes, shall not be permitted to _
maintain large trash dumpsters one. (1) cubic yard or larger, as
such dumpsters-are of a size_and type normally associated with
commercial uses.

Section 2. ~everability If any clause, sentence, paragraph, or
part of this Zoning Coda or_the application thereof to any person
or circumstances shall for any reason be adjusted by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons. or circumstances.
Section _3 -Safety Clause -The City Council hereby finds,
determines;- and declares that this ordinance is promulgated under -
the general police power of the City of Wheat Ridge, that it is --
promulgated for the health, safety, and welfare of-the public,
and that this ordinance is necessary for the preservation of
health and safety and for-the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 4. This ordinance shall take effect days after
final publication.
